& levin." trey: good evening thank you for joining us i am trey gowdy it is "sunday night in america" who would guess taking a class would help you follow a presidential election such as the state of american politics special counsel was appointed to look into donald trump and then to look into those investigated donald trump. and then hunter bided. and no job i didn't. presidents cannot be prosecuted under current d.o.j. policy but that does not mean they cannot be investigated. house republicans planned to do just that committees of jurisdiction are calling for the release of transcripts from special counsel investigation at issue is president biden's fitness to understunfitness to e nature of the charges and the intent and by extension his fitness to run the country. republicans want to testify before congress.

ipush robert mueller to testify and that wound up backfiring in a spectacular way. joining u is now fox news legal editor welcome. we are so happy to have you on the show. i remember democrats wanted robert mueller to testify and he did, twice before two different committees. both were unmitigated disasters for the democrats. so, is there risk in testifying publicly? >> there is always a risk. this airs, i think one of the main problems with special councils as they currently are. they can find someone not guilty of a particular crime but then write a report many times is far more devastating than illegal conviction. then when they go before congress can go either way it can help hur's case but to your point it could backfire as well and i do think there needs to be some thinking through about what

special counsel and the rags require courts should consider the ways been done for how many years because i think these reports are typically used and often abused by the other side to achieve their gains. trey: i hope when you are the attorney general i hope you will change the rags you are exactly right. prosecutors used to speak through indictments we did not have press conferences and we did not do special reports or memos. one part that caught my attention is special counsel hur suggested the facts involving bided were very different the facts involving donald trump heard you and i both know there is very good democrats wh were lawyers on these committees they are going to harp on trump and not biden when hur testifies i don't member of congress they all think they are quick great questioners but the truth is they could lose this hearing

where is right now they are winning the public in narrative as it relates to this report. >> completely. this report was politically devastating for joe biden. or he may have made a mistake as well as his attorney is calling up aspects of the report false we do not know which parts are false but then that opens up the question about releasing transcripts. while i would not necessarily have an issue with joe biden himself warning those transcripts released, which we have not seen it yet if it will vindicate him if in fact the department of justice did behave as he seems to suggest in a properly towards him or to do exactly what they said they did i do have concerns about the republicans calling for the release of these transcripts i think you could set a bad precedent for the future which is consistent with what you're saying generally. and you would know this better than anyone as a prosecutor -- i would think it would set a precedent transcripts should be released for all kinds of investigations and prosecutions which could impact the integrity

of those very things because it would discourage candor from the target, from the witness. you want to get the best information you can get but if people are worried about everything they say being extracted for soundbites from pendant or congress i'm not sure you're going to get the best information you need when you're trying to get to the bottom of something. orcs are going to get a mess which is why grand jury transcripts are held sacrosanct or they used to be another potable water before let you go but it seems like democrats have a real dilemma. how can i didn could i didn't le fitness to stand trial and reckless intent yet be fit enough to leave the country? if you could not impede or in front of the judge how can you pick justices as a real political gem dilemma for them i think. >> very much so. sadly we do not need a report to tells that anyone watching joe biden right now can see the decline.

was paid about six or $50000 of taxpayer money. the judge is going to sort that out. but what about the appearance? you are the chief elected prosecutor in your great state. i have never heard of the chief prosecutor being put on the stand much less being questioned about their personal life. i read an op-ed in the "new york times" a couple of weeks ago written by not a critic of this prosecutor but a law professor suggested let's think of the case let's think of the public's respect for the system. why doesn't fani willis to stepp aside? appoint her deputy, let him terminate mr. wade and let them get on with it. but if none of that can happen on if the office is recused -- if she is recused the whole office is recused them there's a special agency in georgia that in the whole state of georgia they can get another prosecutor

who can proceed with the case and dismissed the case they can change the theories they could do it or they think is in the interest of justice and will restore the public confidence in the system and in the prosecutor's office. >> i would think of the whole state of georgia you can find a couple prosecutors were not benefiting financially and are not sleeping together but let's move to new york that has been universally panned as a political stunt but is still out there that looks like it's going to trial next month. what do you think is going to happen there? exit is historic, not in a good way. the first time ever the former president of the united states is going to trial. that was the first case indicted when that was indicted you will recall it was reported jim comey tweeted this is a great day for america it was not a great day for america and no matter who the former president as it is a sad and solemn thing that is happening. that case was first when off

america." did not seemed like democrats are all that enthusiastic about joe biden before special counsel's report was made public. that report paints the picture of a man who should not be prosecuted because of dimensions from mental capacity as it relates to form the terminal intent. to be fair distinguish the biden facts from the chump effects this belief he was biden is an elderly man with trouble remembering important things. biden has been in politics are about half a century. he'd run for president before did not win the nomination. 2016 despite being at your vice president he stood down and blew up hilary clinton. in 2020 he was underperforming for jim clyburn rescued him from south carolina. biden does not, at least to me have a natural base within the democrat party. his approval numbers are down young people disagree with his handling of the war in the

it is in making the hill an interesting stomping ground for people. you have tim scott who donald trump has also spoken highly of. that is someone who would possibly follow a more traditional path of having run against donald trump and maybe he could be tempted there. you also have centers like jd vance who seemed to be auditioning and that's probably why you are also hearing comments about why they would have not done the same thing as mike pence in terms of certifying the election. you are really seeing people try to separate themselves or appeal to trump in terms of their loyalty test. trey: republicans at last of the special election to replace george santos which makes a pretty narrow minority, like a minuscule. it looks like republicans have responded by continuing to throw rocks at one another over who is to blame. what is the reality are folks getting along fabulously well

and we are just missing it? >> that is a really good thing there aren't buckets of rocks of people it would probably be picking up those rocks and throwing them at each other at this rate especially republicans who seem to be blasting one another. in terms of the race i think there was sort of a belief there's a good chance they did not hold onto the seat this was a very tough seek to hold onto after george santos was expelled. it is a big reason white members of leadership did not want the rest of the rank and file to vote him out in tom swazi had a huge name recognition democrats also spent -- make o -- outspent republicans i think 14 -- 15 millions republicans 8 million. they lost a seat and now the reality is when tough votes, then one less person after later this month, february 28 i think to get the vote done we saw with secretary mayorkas three votes make a difference in terms of at

something he was weighing in talking to consultants about. he has not pulled the trigger on that. but nancy mace is facing a challenge challenger from someoe knows down the state named templeton and templeton is trying to run against her record and might be getting help from kevin mccarthy allies so there is that. as for matt gaetz we do know the ethics investigation is continuing i do not think we'll be seeing the results of that anytime soon those investigations tend to take a lot longer than usually the committee wants. some of it relies on them volunteering offering information. >> i am sure there is a harder job in the world, olivia than the one you have but i don't know what it is. i think to deal with this all of the time. maybe you should have done better in college or maybe she do it i'd tell you to do which is go to law school so you can get rid of all of that. but nonetheless thank you for joining us on a sunday night. i'm sure we will be talking and again very soon.

russia and space and nuclear capabilities and satellites? >> i am just hoping the republics did not get played on this by the white house. the 1967 outer space treaty clearly says you cannot have weapons of mass destruction, and outerspace if it's the technology they're looking at and cite satellite technology that has been the books for years. the russians have a capability we have one. the chinese have won the indians have one. that is not new that is old stuff. but if they are talking about improving or putting a nuclear weapons base that is a game changer and i will tell you it is not necessarily because it becomes the capability what you are creating for but put a nukn space besides violating a treaty the russians and soviet union signed onto, that becomes an emp weapon if you explode a nuke in space you'v you got a major pron the ground over a considerable area that will be the worry i have got.

i think where i would come from as if it is this series is really easy for the president to declassify. he could do it overnight and say this is what i want to have happen. i have seen it done in the oval office. just do it, tell the american people but you hear two different thoughts you hear one where everybody's clutching their pearls, grabbing their go bags and heading down to the beach and the others don't worry about it it's no big thing. i would like to know what they're really talking about let the american people know let them make the call. trey: wanted to play a clip from the president and ask a question on the other side, the former president. >> nato is a busted until i came along as it everybody's got to pay one of the presidents of the big country stood up and said sir if we don't pay we are attacked by russia will you protect us? no i would not protect you in fact i would encourage them to do whatever they want to got to pay. asex aren' eric general here isy question why not have that talk

constitutional. if you were and i say this with all due respect, a constitutional foreign in both sides if you believe the document is been pushed aside. so i am assuming something in this -- i meant that as a complement actually. i am assuming what led you to believe something led you to believe malfeasance is office alone is not sufficient grounds for impeachment. >> the constitution is what protects our liberty. the only way we will lose it as if we abandon it and that is a job at each generation. with respect to the grounds for impeachment we know what are not grounds for impeachment maladministration, malfeasance, corruption, neglect of duties because the american founders at the constitutional convention rejected all of those terms. in madison's words they would make the president a servant of the senate.

that would completely destroy the separation of powers which is the heart of the constitutional mechanisms that keep us free. and they said on instead on high crimes and misdemeanors. those are actual crimes using the office. they did not want the policy and political disputes to be turned into impeachments. trey: i think that is what we have elections for or the policy and political disputes i'm going to ask you a question i would like to sme republican colleagues i assume alejandro mayorkas is doing exactly what biden would want him to do or else biden would get rid of him. so why the push to get rid of the puppet and not the puppet master? >> i do not understand that either. again all executive authority shall be vested in the president of the united states of america. all of it not some of it. any power a cabinet secretary exercises comes directly from the president through the constitution. he cannot serve two masters.
