"america's newsroom," bill hemmer is off today. i'm thrilled to have you with me, jacque. >> jacque: great to be her. jacque heinrich. nikki haley is making a final push days after a new york judge ordered donald trump to pay $355 million in a civil fraud trial. haley has been telling voters she would make a better president than trump. a better chance at beating biden and america needs a president who can serve for the next eight years. charlie hurt saying haley has a difficult choice when it comes to attacking trump and all his legal troubles. >> the game she is playing attacking for the chaos. he is a disrupter. what people love about him is that. maybe you don't love everything about the disrupter. with it comes chaos. so it is -- it's a tough needle she has to thread and she is not threading it. >> dana: alexandria hoff is on the campaign trail in columbia, south carolina, a beautiful day there. >> hi, it is indeed.

good morning to you. the former governor is adamant that south carolina is not her final battle. in fact, at a rally in rock hill last night she told a large crowd about calls to drop out she said she would quote never give up. haley maintains she will prove competitive this saturday during the open primary. major focus on the trail has been foreign policy with criticism lobbed at former president trump for comments he made about vladimir putin and nato. john roberts drove into that. the contender was asked bay crowd member would she pardon trump if she were president and he convicted of a crime? >> i would because i think it is important for the country to move on. we have to leave the negativity and baggage behind. i don't want this country divided any further. >> at a rally in michigan this weekend the dominant frontrunner spoke at length about legal

i wonder what his answer would be right now when you have an attorney general and d.a. who run for office not on prosecuting crime but on prosecuting an individual. so if that's where we're headed as a country, that is dangerous territory. was it a technical violation of the law? maybe it was. but if you look hard enough at anyone, you will find something, which is why you don't prosecute people, you prosecute crimes. >> jacque: to that point there is a lot of concern in the business community this could happen to anybody and apparently enough concern that kathy hochul reportedly told business leaders you have nothing to worry about. and that headline alone would indicate that this is a political prosecution. sub text is we believe most people do the right thing and do their business well. just saying that you have nothing to worry about. what do you take from that? >> well to quote barack obama,

there are 56 other states. i think there are 49, but most of those other 49 would welcome businesses out of new york. my home state of south carolina certainly would. so if you are going to use your d.a. and attorney general to target people based on political orthodoxy, maybe you ought to find another state with, i don't know, maybe lower taxes and a better crime rate and there are 49 of them. >> dana: i want to ask you about the state to yourself. i know you are in south carolina. in georgia all eyes there last week. fani willis and all that. i was doing the geography and hoping i was right. the atlantic. recusal is the right course for the fulton county district attorney even if the judge rules if her favor. it seems obvious that would be the conclusion to fair-minded

people. what will she do, though? >> probably fight. i don't know -- look, potential conflict is usually enough to get d.a.s either recused or recuse themselves. just a potential conflict. because it is -- what is the use in having a verdict if people don't have confidence in it? so look, she and nathan wade. i'm interested in the conversations they had with the white house. even lay that aside. they are flawed characters prosecuting this case. so even if they were successful, there would be an asterisk by it. go find two prosecutors who aren't dating one another in georgia. it shouldn't be that tough. go find two. sheer the down side to what president trump is trying to do. i would love it for these two folks to prosecute me. from what i saw neither one of them are very good. the danger is they get kicked off the case and you find two that are really good at what they do. sometimes you have to be careful

what you want. >> jacque: there has also been a discussion it would be too vast of a case to pass on to someone else. is it? you are an expert. >> no. you know, the only people who think cases are complicated are the ones actually prosecuting it. what case isn't complicated? you have to convince 12 people in an environment where 12 people don't agree on anything. look, it would take -- it would take a good lawyer, maybe two weeks to get up to speed on something like this. so nothing is too complicated to pass off to another set of prosecutors who know what they are doing. >> dana: with a brain like yours it would probably take an hour, thanks for starting our monday with us. >> i didn't even know where georgia was. i had to do the math in my head. thank you for saying that. >> dana: take care zblsh zblsh

hundreds of protestors are detained throughout russia and navalny's widow continues her husband's work. benjamin hall in london with more. >> yes, around the world people are coming out to mourn of death of navalny to stand up and try to remember the one person who people thought could lead russia to democracy. that dream for many people has now disappeared. inside russia support is being crushed. people laying flowers for navalny are being arrested shutting down any support for the man who fought for democracy, freedom and the end to the war. navalny's body itself is still missing. his mother was pushed out of the morgue in siberia when she tried to see it. his widow says he was poisoned with the same drug he was poisoned with back in 2021 and also reports of the fsb, the subsequent kgb at the prison two

everybody said clinton would win and that donald trump could win. i was right. what i think is that joe biden needs to be allowed to be joe biden. i was with him a couple of weeks ago for eight hours and he was the joe biden that i know. when he is talking to people, he is energized and cares about issues and he is joe biden. joe biden, there is nobody better than joe biden. i think the campaign needs to let him get out there and be who he is and i also am sick and tired of everybody talking about his age. when you look at the age of donald trump, which is only a couple of years younger, who has 91 felony counts against him and goes on rants that make no sense. the one he did a week ago saturday night. >> dana: would you knowledge that president trump presents as somebody fully with it, with the energy despite the age.

focuses on. michigan has an early primary. we need to be talking about issues and primaries that will be the issues in november. i know the president has heard it and has to deal with this issue. i have a lot of constituents, a lot of people that are neighbors and friends who are hurting, have lost family, scared for their family who have no food, no healthcare, no water. this is an issue that he has got to talk about with people. donald trump doesn't offer any solutions, either. >> dana: my last question axios is reporting people within the biden administration, democrats think his state of the union in two weeks is his public reset moment. do you think he will be able to clear that bar on march 7th? >> i think i agree that it is a very important speech. of course i agree he can clear that bar. this is a man that cares deeply, that is engaged and knows he whats to show the american people he is hearing them and

compliance. how does that work? the perp feels the authority. the entire system embodied in that person. you control the situation. the perps feel that and how you gain compliance. not necessarily a physical thing where you have to use pepper spray. it happens. the authority that you represent and embody is what gains you compliance. that fourth wall has been broken. it has been normalized to attack police and not respect that authority and you see the results not only in the injuries to the cops but in the conditions of the city. >> jacque: what you hear from so many officers they are afraid to use deadly force if it's necessary because of everything that happens to them after ward. obviously the defund the police movement, everything in the wake of that has had a terrible effect on retention. a lot of people retiring, difficult to recruit. is it in your mind getting any better? >> no. jacque, you are right on the salient point. aside from the fact they're very

receipt sent to deploy deadly force or serious physical force, there is a law on the books here courtesy of the new york city counsel, probably the most anti-police body in the country and that's saying something. if you depress the diagram of the perpetrator attempting to make an arrest you are guilty of a misdemeanor. alvin bragg won't drop that. they see not only injuries to themselves but their entire lives going down the drain everything they worked for. >> dana: the manhattan district attorney's office. the number of felony charges downgraded, right? in 2021, 658, 2022, 738. 2023, 938. it sends a signal to the criminals it's okay.

>> another metric embedded that is telling the. in addition to the fact that these are all being downgraded. which means they are getting right out. you arrested for a felony, downgraded to misdemeanor. they go right out the door. it's a summons and out you go. most of which they don't even answer. the arrests in manhattan are up 1/three. what does it tell you? they have a cops working. these guys are out there trying to do the job. everything they do is instantly in front of their eyes. whatever work you do. you come to work, on the air. before the shift is over they erase everything you did when you go home. at what point do you stop showing up? >> jacque: how many of those people being arrested have been arrested before. lenient bail laws and downgrading charges and you have a real issue. >> dana: california. >> it doesn't happen that they are hard on repeaters.

in south carolina, her home state is vast. he is 30 points ahead. in the real clear politics average when you get into california and texas, he is upwards of 60% ahead. she has a giant hill to climb. as far as were minds changed yesterday? much of what she said we have heard on the campaign trail. particularly when she says she has beaten all these other candidates. she has hung in longer than anybody else. a lot of people like ron desantis and tim scott saw the writing on the wall. i think she gave good answers yesterday to the audience questions. it was a very spirited back and forth that she was having with the crowd. crowds in south carolina, voters are always great and i think everybody enjoyed themselves yesterday. >> dana: what was the mood in the room? do they realize that the polls are what they are and this is an unlikely scenario that nikki haley would best trump on saturday? >> i think everybody had a read of what her chances are but still out there supporting her.

they believe -- i don't think they think she can win but i think they want to make a statement that they believe there is maybe somebody else that should be in the race that donald trump shouldn't just cruise through the nomination. a lot of pressure in coming down on her from his campaign and his supporters for her to drop out of the race and clear the path so trump doesn't have to spend time campaigning in any of these big states coming up. particularly super tuesday where you have 16 states all voting for more than a third of all the delegates. that takes a lot of time. she made the point trump will spend much of his time in a courtroom. he said he will campaign at night if he has to do that. she is presenting herself as an alternative. i don't know how much buy-in there is for that. >> jacque: she has made the case there is no incentive for her to drop out. last man standing against trump so to speak. did you get any time with her behind the scenes at all to answer the question we all have covering her, which is are her

donors getting anxious that she is burning money for a futile cause? >> i didn't talk to her about that yesterday at the town hall or in the meeting that we had prior to the town hall. i had asked her on that on america reports earlier. one of the big things and one of the things i can't fully understand, if she goes into this coming saturday and loses and loses badly she will have the cloud as a popular governor who couldn't win her state. if she wants to try it four years from now it will hang over her head. her donors want to see her carry through until the early contests in march. the 16 states and see how she performs. talked to karl rove about the endgame. the idea she will give it her best shot come hell or high water she will do whatever she does and have a good life regardless. >> dana: she does have a point to make about the fact there
