constitution. the way this particular new york statute is written, this is a difficult question. if you take fraud out of fraud then you have something different and if it is something looser than fraud, how do you justify dra cokian penalties on any american, not just donald trump. >> todd: everything you said, i agree with, there are a lot of big issues that can be appealed are. are you worried he will push his council to relitigate the trial that was litigated, which you cannot do, instead of focusing on issues that can be appealed which r are ripe to be overturned.
