>> ainsley: if not we will take his assets. >> griff: here is a little of what james said. >> if he does not have funds to pay off the judgment, we will seek, you know, judgment enforcement mechanisms in court and we will ask the judge to seize his assets. financial frauds are not victimless crimes. he engaged in this massive amount of fraud. and it wasn't just a simple mistake, a slight oversight. the variations were wildly exaggerated and the extent of the fraud was staggering. last i checked, tourism is up and wall street is doing just fine. >> steve: okay. that's her point of view. it's scary to work here in new york city because, you know, the crime and all that other stuff we talk about on a regular basis, one of thing this things that donald trump did last night at one point during the town hall, he pulled out a copy of the 8th amendment and read a section that says and this is applicable to what he was talking about right there. he said excessive bail shall not

be required nor excessive fines imposed nor cruel or unusual punishments inflicted. if that is -- if a judge finds that applicable, he obviously stands to win on appeal. >> ainsley: that is a lot of money. >> steve: what he said was telling and could be why letitia james is talking about we will have to seize his assets. at one point laura asked if he has made a decision about paying the money, and he says we'll have a lot of cash but that doesn't mean he can take it. so, it sounds like, you know, if he pays it, it will be kicking and screaming and it sounds like they are going to appeal and do all sorts of stuff before he has to liquidate anything. >> lawrence: i just find it interesting that the attorney general says in that exchange that this was not a victimless crime. and then doesn't tell us who the victim was. and there was no pushback from the reporter to say can you outline hot victim is? i mean, one of the legal challenges that donald trump and his attorney plans on using in

court is that there was no victim. so, it would be interesting to get some type of answer from the attorney general. >> ainsley: donald trump would say imthe victim. i'm the one that has to fork over all this money. the judge doesn't make sense. saying that my property mar-a-lago is worth $18 million. for all of us who have been down in palm beach we know that is far from the truth. >> steve: right. >> ainsley: to buy a piece of property right on the water is going to be about $150 million just the land alone. his property though has beach front and then on the back side where the tennis courts are, they have the intercoastal waterways so you can put a boat back there. you have the advantage of the ocean in the front and intercoastal -- it is worth far more than 18 million. >> steve: the problem and this goes back to what was said in the court proceedings, was the t that with the valuation of palm beach county, real estate appraiser or agent said yep, that's the amount. it was a very low amount.

and that speaks to just all the stuff that has been involved in this particular case about property valuation. he signed off on the lower valuation. >> lawrence: so t did the bank's appraiser as well. >> steve: that's where the value valuation comes from. same guy. >> lawrence: they don't just take donald trump's word for it. there is back and forth between the banks. >> steve: experts. >> lawrence: that's how you come to valuation. it's clear when that exchange happened the judge cut him off and wouldn't allow him to explain the process of this. >> griff: it was interesting as steve pointed out he took out that constitution, 8th amendment out of his pocket and read it and had vociferous defense as you point out against. this actually likening this to communism. just step back for a second and look at the contrast he painted between joe biden, who didn't choose to do a super bowl interview, w who who has really remained out of earshot of the president -- of the press except

11-year-old girl with a rap a mile long? >> ainsley: in your experience, why is that? he was arrested for an unrelated charge, aggravated assault on friday. he has an extensive criminal history, including enticing a minor back in 2008. he lived in that trailer behind this young lady's father's house. apparently he had taken to the child to the bus stop before and dropped her off. he was supposed to do that this morning and she never got on the bus. that is our question. why would a parent allow her to go? do you think in your experience these individuals just don't confess, the parents don't know? >> it's unclear at this point. the mother says she didn't know of this individual's past, although the mother did not have custody of the child. she wasn't living at that location. the little 11-ye 11-year-old uds in the custody of the father. this individual was a friend of the father's. i'm sure he was aware of this person's past. and the fact he allowed this

person to be one of her primary care take takers. baby sitting her, taking her to school is beyond me. i have no idea why this individual was ever allowed around this little girl. and we are seeing the results. it's the nightmare that every parent fears. and that nightmare came true when her body was discovered. my heart goes out to the family. but why she was ever allowed around that individual, i think we will be asking that question for a long time. aid aid be around older man who is not part of the family especially one with a long rap sheet. could the father get in trouble? could he be charged? >> we'll see. we'll see. at this point it doesn't look like the d.a. is going to be charging the father doesn't look like he was involved in any way. however, throughout their investigation they will be diving a lot deeper into this relationship and into macdougall's past. if anything comes up that the father knew anything about this, if there is any inappropriate behavior prior to this, he absolutely could be charged. >> ainsley: right. okay. the district attorney says that he will be charged this person

the details. >> good morning, ainsley. james biden is expected to appear before the house oversight committee as they try to connect the dots between the president and his family's business dealings. today's testimony will focus on this payment so it is a $200,000 check given to joe biden from james on march 1st, 2018. the check was labeled loan repayment and it was sent to joe biden the same day that james received a $200,000 payment from americorps. it was given to him for his consulting work for the company, despite having no healthcare industry experience. hunter biden will also testify before the house oversight committee next week, meanwhile his lawrence are looking to dismiss his tax case in california. they're pointing to the newly indicted fbi informant who was accused of making up a burisma bribery scheme involving the bidens. prosecutors now say that informant has extensive ties to russian intelligence officials and hunter wants lawyers are saying, quote: it is more remarkable that beginning in july 2023, the special counsel's team would follow mr. smirnov

real estate investor grant cardone told his employees, quote: immediately discontinue all underwriting on new york city real estate. the risk outweighs the opportunities at this time. focus on texas and florida. and grant joins us right now from down in florida. hey, grant, how are you? >> hey, thank you, steve. i'm good this morning. >> steve: okay. listen, i think that's kind of a no-brainer. i mean, i'm sitting in new york city. if i had my druthers, i would think that florida or texas would be a better bet, just given the fact there is so much crime and the fact that, as we have been detailing, you know, the migrant crisis is zapping all of our resources here. this is not a good real estate right now, right? >> it was an opportunity we thought this year was the opportunity to come into chicago, california and new york city. everybody waiting for 40 years now to invest in that market place. i was completely confident, steve, this was the year to come. when that ruling happened, it

was like pencils down. don't touch it. don't go there. we invest for 14,000 investors at cardone capital that depend on cash flow. if i can't predict the cash flow because of some ruling or because of the migrants or because i can't evict people. new york city just keeps doing every single thing they can to sell real estate in florida and not sell real estate in new york. >> steve: right. and just look at the grant cardone story. you left the great state of california, what, over 10 years ago and moved to florida because that makes sense. now, grant, what is it about this particular judge's ruling that has you worried as a real estate investor going forward, the peril you could wind up in. >> yeah, so on every loan application or every transaction, i'm going to a bank and say i want to put a loan on this. you know, what are the loan proceeds going to be? those loan proceeds are based on the value of the property. they are going to require me to

actually underwrite my property on the cash flow, the income of the property, and what valuation i believe that property is worth. the broker will also put a valuation on it. probably a third party, one of my third parties to check my own underwriting for me, internally for my investors. and then the bank is also, steve, going to use at least one of the appraisal, maybe two, independent of me. they are are going to go out and hire those people and pay those people. they will charge me back for it later. there could be as many as five appraisals on that. the value that i'm going to put on the property, keep in mind when i'm buying something, i'm not thinking about selling it the next day, in the case of trump, is he not selling any of this stuff. in the case of cardone capital. we are long-term holders, 10, 15, 20 years, we want the property for the cash flow. i'm going to put a value on it in the future. and, look, i remember doing a deal once where i put a value on my property that i was getting rid of.

i inflated the value. a guy at the bank at merrill lynch heard about it and bought it for the price i had stated to the bank. so every seller is always going to push the price value up based on the future, not based on fraud. >> steve: so you are just worried that you might -- if you were big in new york real estate, this could come back to haunt somebody like you? >> until this thing is overruled, and i believe it will be, nobody, nobody in commercial real estate investing big money, we were going to put a billion dollars in new york city this year. we were going to put a billion dollars in chicago. maybe another billion in los angeles. and we won't touch any of them now. >> steve: all right. >> texas, florida, arizona go. hard and go big and go long. >> steve: all right. ladies and gentlemen. you heard it here first from grant cardone. grant, thank you for getting up early with us today. >> thank you, steve. >> steve: all right. thank you, sir. still ahead on this wednesday. look at that an illegal migrant
