new criticism after the brutal murder of a georgia nursing students. feds confirming the suspect is an illegal im grant. more details today as we say hello. brand-new week starts now on monday. dana is out this week. hello to our friend. >> thank you for having me. i'm aishah hosni. the suspect is from virginia with a prior arrest in new york city fueling concerns over who exactly is coming into this country and bill, where are they going when they come in? that's suspect illegally crossed into the u.s. in september of 2022. at the same time, he was crossing over, the biden administration was insisting that the border is safe. >> we have a secure border in that is a priority for any nation, including ours and our administration. >> we're certainly doing a lot more to secure the border.
6:02 am
we have taken unprecedented action over the past year and a half to secure the border. >> president biden: we have a process in place to manage migrants. >> the border is not open. we're doing everything we can. >> bill: wow. mary kathryn hamm on the political stakes of a broken border. peter doocy for a president under siege on this from all sides. what we know today as we begin a new week on this and more. madison, good morning. >> bill, good morning. this is the first day that uga students are back to classes after laken riley was killed on campus on thursday. police say the suspected killer is an illegal immigrant jose ibarra. he remains in jail in agent lens without bond facing a long list of charges connected to riley's murder. her freshman year roommate tells us that riley was the type of person always there for everyone and says that riley's death

should have never happened in the first place. >> that's just honestly infuriating to me. we know it has been a problem and i just don't like the fact that it's so frustrating that this is what it takes for it to really be brought to light that somebody's life being taken, especially for no reason. it is not like they knew each other or had a grudge against her or anything like that. the fact that somebody had to die for this to be brought to light and we don't have any certainty of something being done about it. >> ice confirms the accused killer entered the u.s. illegally through el paso in 2022. they say new york law enforcement arrested him just five months ago for quote acting in a manner to injure a child. ice says nypd released him before they could issue a detainer on him. riley died from blunt force trauma. autopsy results could come as early as today.
6:04 am
there is an on-campus vigil set for 3:00 p.m. today. riley's funeral will be on friday in her hometown of woodstock, georgia. her family says that they promise to honor her life in a very big way. >> bill: thank you, madison. starting us off there in athens, georgia. thank you. aishah. >> aishah: republican lawmakers are taking aim at president biden's border policy after learning the suspect in riley's murder is an illegal im grant. peter doocy is live with the latest from the administration. >> elected republicans aren't talking about it like it with as a random act of violence but rather like it is the heartbreaking but predictable result of a broken system. >> this is what we've been asking for and this is what we've been talking about for over two years now. in a recent september letter that the republican governors wrote to the president and administration, who are these people? where are you sendsing them? we have yet to receive that

information. now something like this happens. >> the suspect with at least one arrest on his record since arriving illegally has border state lawmakers warning of violent visitors from venezuela. >> biden and the democrats open border policy have allowed this man to come into our country, give him parole, and kill an innocent young woman. and, you know, here in scottsdale, arizona, there are venezuelan gangs, organized crime breaking into people's houses using wifi and cell phone blockers to get around cameras. these are organized criminals. >> the plan president biden is considering to try to remedy some of this is gaining moderate support within his own party. the plan is to discourage border crossings by prohibiting anybody from claiming asylum except at a

port of entry. >> i would support that. we do have a crisis at the border. but i also think something donald trump tried. donald trump has backed away from this. >> officials here, though, continue to insist that president biden supported that bipartisan senate border deal and it was republicans who essentially killed it in the congress. so as they see it, republicans are the reason that there has not been meaningful progress made at the border lately. aishah. >> aishah: thank you. >> bill: mary kathryn hamm is here. you were a student at the university of georgia and you say you ran this trail every week that you were in college. tell us about that. let's begin there. >> it is a bit of an emotional connection. i can see myself in this person, right? she is a former university of georgia bulldog, running this trail that i ran every single week. i know exactly what it feels
6:07 am
like to be there. it felt safe for a reason. there hasn't been a homicide on campus in 30 years. now her family tragically is facing this. the community is facing this. the university of georgia also had another student die by suicide this week. hard on the bulldogs. my heart is with them and with their families. so the fact is the facts of her case and suspected arrested is more than a political football. we don't want to cheapen it by not talking about this wonderful student whose picks terse, she won't get to live past that. i want to honor her life. but the media needs to talk about the facts of the case. many sources are sort of just leaving out that this person was in the country illegally and did have arrests already on the books in his past inside the country. he controlsed illegally. wanted to a ply for asylum. in new york for endangering a child and released. in new york you're released

female agent lets. what in the hell is that all about? >> this story was wild. i read the whole thing. that is a real fear. i used to run that path. when i run alone i think about these things. no attempt to look at statistics that might be helpful to female runners. they take a sample size of two tragic murders of female runners and then they don't mention that either one of them. the thread that connects those two is that both suspects, one serving life sentence were illegal im granulitis. maybe we should deal with that fact and maybe you are missing the story trying to turn it into another story because you don't want to deal with the fact this reflects badly on the policies of this administration. if we don't deal with the bad policy, bad things continue to happen. >> bill: another point here. if you were to drive 100 miles to the east from athens, georgia, you would hit the south

6:24 am
is there is obviously and attorney-client relationship and the judge has not in any way ruled that the attorney/client relationship has been pierced or that it has been dismantled somehow. so what the judge has to sort of parse out. the reason it's being done behind closed doors rather than publicly on the record, is he has to decide what information this guy has that is in the nature of fact witness information that doesn't have anything to do with communications that are about legal advice between an attorney and a client versus what conversations wade had with his lawyer or former lawyer that actually are covered by the privilege. the judge needs to sort that out and decide what can be proved on the record and what can't. >> aishah: this is similar to what is happening with the cell phone records. these records appear to be very
6:25 am
damming and why fani willis is trying to dismiss them from being used here. her motion says the records do nothing more than demonstrate that special prosecutor wade's telephone was located somewhere within a densely populated multiple mile radius where various residences, bars, nightclubs and other businesses are located. she is trying to make it seem like this is not that important. this is not a valid part of the case. how do you see this? how do you think this is going to go? >> this is what happens in most cases, aishah. what the people who are trying to prove a proposition do is tell the fact finder here it's the judge, often a jury in a trial, you have to take all of the evidence as a mosaic and decide how it fits together. when people are under attack usually it's the defendants in a criminal case, they try to take the evidence piece by piece in
6:26 am
isolation, get the fact finder to consider it independent of everything else and not weave it into how it fits in with everything else a and try to get it dismissed that way. fani willis here is saying this evidence is inadmissible. it is not inadmissible but in the law of evidence we have a concept called weight. not admissibility. we call it common sense but basically the evidence can be taken for what it's worth with its limitations. cell sight information proves a person was in a rough vicinity and can tell you whether the person was moving for stationary. it can be considered with everything else they've heard in the way of testimony and it sounds like it is consistent with two people having a relationship. >> aishah: we'll find out. thank you for joining us this morning. good to see you. >> thank you. >> bill: thank you. stand by for news on that if it comes our way. in the meantime it is confirmed
