we start with this fox news alert. we have major breaking news in the trump legal saga. the u.s. supreme court has agreed to hear his immunity claim. that would set arguments for the week of april 22. this is huge, a decision that is likely to come in late june. so will joe biden's weaponized department of justice insist on a trial? let's see. the month that the republican national convention is to take place? that close to a presidential election? now, also breaking tonight, an illinois judge has removed president trump from the state's primary ballot citing an insurrection ban joining maine and colorado. we have a lot to breakdown tonight. here to help us, jonathan turley is with us, fox news contributor. let's start with the immunity case. i always felt it was the right thing for the court to take up, but i never had the confidence

that they would. they're expediting this. arguments will be made in late april. probably won't get a decision until late june. that butts up until july, the month of the republican national convention. i would argue, how do you have a case that close to a presidential election? >> that is going to be the question facing likely the department of justice. assuming for the purposes of argument that smith prevails. trump's claim is quite sweeping. there are likely to be justices that won't sign on to that. but some of the justices clearly have reservations. while trump's argument might be sweeping, they may view the d.c. circuit opinion to be sweeping in itself. they're unsure of where the line is drawn. let's assume that they rule for smith and they send back what is

called the mandate to the district court for the trial to go forward. if that happens in june, the trial judge has to get through pretrial motions that could take a couple months. then the trial itself can take three months. now, if you do that, you're getting awfully close to the election. the department of justice is long had a rule not to have elections within -- trials within a couple months of elections. now, even though jack smith has been given a lot of discretion, that policy rests with main justice. i think the attorney general himself really should sign off on departing from that policy. so there's a lot of questions here. jack smith is seeing a loss of calendar space. for him, it's significant. every day he loses reduces the likelihood that he can get a trial through before the election. >> sean: one of his arguments

was this has brought implications in terms of the country. you talked about and i've heard attorneys say maybe the president's attorneys were very broad in their definition of immunity. can they modify those arguments? fine tune them, if you will? >> yeah, i expect some justs are as concerned with the lower court's decision and the lack of clarity as to when a president can rely on immunity. so even if they may agree with the result, they may not agree with the logic or rationale of the lower court. but the real danger here for jack smith is once they get into that high grass of presidential immunity, you don't know where they're going to come out. they have to try to create some clarity here. that's what is surprising. many people felt that the court would just want this cup to pass from their lips and say we're not going to review it.

now they're going to review it, they have to lay down some new law here. this could not be more important. how they define these immunities has a huge impact on our separation of powers and the three branches of our government. >> sean: if donald trump and his attorneys called you and said what arguments would you make in that immunity case, what would you arguments be? >> well, you know, a number of questions that were left unanswered by the lower court decision. for example, let's assume that trump was not running for election but objecting to another person being certified, an election he was not a candidate in. would that also be outside the scope of the protected speech or the immunity? i think what you'll have is a lot of hypotheticals like that to better understand. the d.c. circuit had their own sweeping views on this.

many people would say no. what he was doing on the elipsis of that speech is saying it was outside of their responsibilities. the supreme court doesn't have the luxury of generalities. they often retreat to it. now that they have accepted this case, they have to make some type of delineation for future presidents of when they can count on immunity. i have a filing four of these justices did not feel like the lower court decisions did that. how will they come out on that? it's anyone's guess. i still believe that the odds favor jack smith in the outcome. but this is going to be one interesting oral argument. >> sean: it's going to take a lot of time. it will be interesting. let's move on to the other issue. illinois joining the states of

colorado and maine. again, in this particular case, the word insurrection was used. last i checked, professor, donald trump was never charged with insurrection, not even in the jack smith case, the january 6th case in d.c. let alone convicted of insurrection or citing an insurrection. how is it possible that they could cite that as the reason for removal from a ballot? >> well, the advocates are arguing that insurrection when this amendment was written was meant to include something like a riot. many of it's disagree with that. what is odd about this, most judges arating to hear from the supreme court. the expectation is that the court will reject this claim, this theory. this judge decided to break from the other judges and say no, no, i want to go on record. it like paddling to get on the

titanic before it sinks to be on the lost of those lost at sea. you know, the supreme court is going to be ruling on this shortly. it doesn't look that good. and this judge basically just replicated the colorado decision and said me too. in some ways, i don't think that will play well with the justices and re-affirms the fear expressed by people like justice alito and others that said, look, if we allow this, it's going to allow this sort of tit for tat type of rulings from various states. the rush of this judge to get in her own opinion to disqualify trump in illinois will only magnify those concerns for the court. >> thanks, jonathan, for your expertise. we appreciate it. today was a huge day on capitol hill. zero experience hunter biden finally sat down for his long-awaited deposition as part of the ongoing impeachment inquiry in to his father after

previously defy ago subpoena from house republicans. according to a copy of his opening statement obtained by fox news, he told lawmakers, i did not involve my father in my business, not while i was a practicing attorney, not in my investments or transactions, domestic or international. not as a board member and not as an artist, never. re really? why did devin archer testify that joe biden was on the phone with hunter biden's business associates 20 times that he calls. why did barber and tony bobulinski say the brand that he was trying to sell is joe biden? why did joe allegedly meet with, for example, the russian oligarch, the first lady of russia? she contributed 3.5 million to the family syndicate. according to devin archer, invested another $100 million

plus in real estate convenient chuns. according to the deposition, hunter said i'm sitting here with my father whatsapp message saying his father was not sitting next to him and the message was sent to the wrong recipient. while he was either high or drunk. seemingly contradicting his attorney's claim back in june that the message was fake. after his testimony, one reporter shouted this question at hunter. listen. >> will you do a public hearing? >> was there cocaine at the white house yours? >> sean: the left was in meltdown mode over hunter testifying today. take a look at the latest temper tantrum by the left. >> what we saw is a rather embarrassing spectacle where the republicans continued to belabor completely trivial points. they seemed to be focused on speaker phones. i did not know that that was the

devil's technology. apparently it is. >> what we just witnessed over the last hour was i think a deep sea fishing expedition. the republican case has completely fallen apart over the last several weeks. what we're seeing is just a complete and inappropriate expedition in to the president's son. >> they have nothing. that's what we just witnessed for the last hour. >> that first hour of this much anticipated testimony was the nail in the coffin to what is a complete bogus and sham impeachment inquiry. >> sean: mr. swalwell, then you have jamie raskin, you have aoc. the last guy you saw, the congressman -- wasn't he the guy that said when joe called in to hunter's business meetings, what do they talk about? probably the weather. here with more on today's

deposition, chairman james comer, jim jordan and jason smith. james comer, let's start with you. get your general impressions of the day. >> i thought it was a very good deposition for us. we were able to confirm a lot of the wrongdoings through hunter biden's testimony. there are many financial crimes that we believe that were committed by the biden family. hunter was asked about specific transactions with specific llcs that many of whom i have referred to as shell companies. regot his answer on the record. we're going to go back and verify many of those things. what we also learned today, sean, is that a lot of what hunter said was contradictory to at least three of his former associates said. now the next phase is to bring hunter in and hear from the

other biden associates and determine who the american people think are telling the truth. we have the bank records. the back records don't lie. we know the bidens have taken in tens of millions from our adversaries from around the world and we still don't know after all of these depositions, after all the hours of testimony exactly what the biden family did to earn the $30 million from our enemies around the world. >> sean: i think jim jordan, that's a key part of the question here. hunter on his own laptop implicates his father, half his income goes to pops. 10% for the big guy. we have devin archer. 20 phone calls that he testified to that joe called in on with foreign business partners. then meeting others at the cafe milano, the russian oligarch. that implicates the father in a major way, a big part of the testimony from what i read and

heard in my sources had to do with the fact that he just wanted to protect his dad under all circumstances in spite of what would be a lot of evidence to the contrary. >> yeah, sean, the house rules prohibit us in a deposition format from talking about specifics of that deposition until the transcript is released. as chairman comer said, there were lots of things said today that evidence we have already got and witnesses we have already talked to contradict what hunter biden said. so i do think maybe the best take-away is we got a lot of good information. it would be a good road map for when we do have a public hearing. but you're right. we already knew that it was phone calls, it was lunches, it was dinners, it was rounds of golf from the same white house that said he had no involvement whatsoever with his business and any of his business associates. but he engaged in those activities. we knew that from previous witnesses that we've had a chance to depose. >> sean: and jason smith, he's

saying that all of his business partners lied and he's the one telling the truth. then i go back to what congressman comer just said. when you look at the bank records, when you look at what you've identified what you said on this program and james comer said, identifying ten biden family members that got paid, okay. well, what did they actually do? what services were rendered for this massive amount of money of millions and millions of dollars? did you ascertain that? did you ascertain what hunter did, how he was capable of doing it, considering he mention his addiction? can you tell us the grandchildren that got paid, what they did for the money that they got? >> sean, hunter came up with numerous excuses. he first started out his opening statement that his father was not involved in his business dealings. guess what? his business associates have testified differently. the two irs whistle-blowers that came before the ways and means

committee, their evidence proves differently. in fact, 327 different e-mails prove differently. that was between joe biden, hunter biden and his business associates. joe biden was not just involved. he was a participant in these activities. >> sean: i beg your indulgence, james comer. bear with me. as hunter talked about a maga motivated conspiracy theories and how he's been hunted in a partisan political pursuit of his dad. you've been dealing in distortion, sensationalism. let's ask about the case that the americans know the most art, burisma, the oil and gas giant out of ukraine. was john solomon's reporting correct that in october of 2015, interagency decision came down in the obama administration that they would -- that enough progress had been made regarding corruption in ukraine that

warranted a billion dollars in loan guarantees? is that true? in october of 2015. >> i believe that was from an e-mail from the john kerry state department, yes. >> sean: okay. next question. in december of that same year, 2015, have you confirmed and corroborated that a phone call took place with joe biden and hunter when he was in dubai with burisma executives five days before joe went to ukraine? >> i believe devin archer testified to that, yes. >> sean: let me ask the next question. i think this is the key question. okay. when joe went there, did he brag before the council on foreign relations that in fact he said you're not getting the billion unless you fire the prosecutor? that burisma was so concerned about when they wanted d.c. help and that's when he leveraged the billion and they gave him six hours and son of a b that guy got fired. as a result of that firing, did hunter continue to get paid by burisma holdings for work that

he had no background or expertise in at a time where he focused a lot today on at a time that he admits he was addicted to hard drugs? is that all true? >> that's all true. >> sean: how many shell corporations have you identified and have you noticed any other legitimate business activity in any of those accounts? >> sean, i haven't found an l.l.c. yet other than his professional account that he charged all of the other llcs legal fees for. he was a lawyer. i don't know what legal fees he performed. at least 20 of those llcs don't appear to have any assets, they don't have any website, they don't have an office, they didn't produce a good. they didn't produce a service. they weren't licensed to be any type of lobbyist or consultant.

so it appears that 20 of those llcs were in fact shell companies. shell company by definition is a company with no assets or no known purpose. some of the companies he tries to claim throughout this investigation were investment companies. we released an e-mail from a bank examiner that looked in to one of these so-called investment companies and said in an e-mail from one bank examiner to another, this appears to be an investment company with no investments. that e-mail sums up everything that i have been able to learn from all of these different llcs that the bidens had. >> sean: jim jordan, let's go the other oil and gas giant. this one out of china. hunter claims the whatsapp message when he was high or drunk, he claims now that in spite of what he wrote, he's father was not there. first of all, for somebody that was high or drunk, i'd say that was a pretty articulate message

that was sent. pretty sophisticated on some levels. but he sent it, is it true or not true that days after that exchange that millions of dollars was sent to one of the biden family bank accounts? is that true, jim jordan? >> yes, that's true. that's exactly accurate, sean. >> sean: okay. >> before that -- in the spring of that year, you had eight chinese executives show up at the four seasons with hunter biden and his business partners, this is according to testimony from rob walker. while they're at this lunch to close the deal, in comes joe biden for a drop-in and he does a short speech to the group and leaves. and then the deal gets sealed. then the agreement gets finalized. a few weeks later hunter biden gets $3 million from this chinese energy company. and then later that summer, the very thing you just talked about with the whatsapp message is when the $5 million comes in to

hunter biden. >> sean: jason smith, in any of these business dealings where we're talking about tens of millions of dollars, can you -- hunter claims his background on a u.n. board, an amtrak board. his background as an attorney. when convenient, he seems to claim that he was addicted at the time. is there any services that you have identify that he offered any of these companies for the massive amounts of money that they're talking about here? >> the only services that he offered to all of these companies was access to the brand. the brand is joe biden. his father. they sold access all over the world, the chinese, ukraine, romania. you can name the countries. millions of dollars knowing that this is how you get to his father, through him. >> sean: last question. i'll ask congressman comer and congressman jim jordan. a lot of people felt that hunter

got special consideration when you sent a second subpoena. i understand this deposition was not videotaped today. you agreed to only three hours of the deposition on the republican side. what would you say? was that consideration given to peter navarro or steve bannon both facing jail terms for contempt of congress? james comer. >> i think we got a lot of questions in. i think the deposition lasted longer than that. john what the final count was. the democrats didn't use their full hour. the way the depositions work, we get an hour and then they get an hour. we took the full first hour, they took about 20 minutes the second hour. we took another full hour. they department take but maybe 15 minutes the second hour. then we went way past the third hour. so i feel like we got a lot of questions in. i'll yield to jim jordan and let him answer that. >> sean: jim? >> no, sean, i think we had a good deposition today as we said

before. we got a road map for if in fact we have a public hearing at some later point. we got these contradictory statements from hunter biden to all of the witnesses in evidence we have gathered thus far. we're going to continue. next week we have sally painter, who was with this democrat public relations firm that did work for burisma. the week after that, a public hearing with robert hur on the classified document issue relative to joe biden mishandling all of those classified documents over is several decades that he did according to the special counsel's report. >> sean: last exit question. scale of 1-10, how damaging was today's testimony or deposition to hunter biden? jason smith, you go first. 1-10, 10 being the worst. >> i'd say they're good at not recalling many things. so i'd say an 8. >> sean: james comer? >> i'd say an 8. >> sean: okay. jim jordan? >> sean, i think it was very good for us. as i said, i think we got a lot

packages because as you noted, the calendars run out. we have to break the cycle and the way washington works. we have to reformed budgeting and spending. we have this hard fight right now. >> jesse: two big issues on the minds of conservatives and many republicans. that is the issue of joe biden's white open borders. nearly 10 million illegal immigrants. former top fbi officials have described this as an invasion of military age men. we have described the countries that they're coming from, iran, number 1 state sponsor of terror. syria, egypt, host of the muslim brotherhood, afghanistan, home of al-quaida. china, tens and tens of thousands from there and 10,000 plus from russia, the number 2 geo political foe. is anything going to be done, any part of this deal going to deal with the issue of joe biden's wide open borders? >> we never stop working on it.
