will be in a florida courtroom in his classified documents case. that's the matter with the documents after he left the white house taken from mar-a-lago, okay? the judge will consider the starting date for that trial coming up at 10:00 in the morning. we're watching that. timing is key in all of this considering trump's other court cases which there are several. not to mention his running forare the republican nomination. the calendar is full. what you watched yesterday was a blame game at the border. president biden former president trump pointing fingers as the illegal crossings as of today keep on coming and rolling in. good morning, dana is back on monday. i'm bill hemmer live on friday. she had a rocking day yesterday afternoon. you came back for more today. >> i'm martha maccallum. this is "america's newsroom." so president biden and former president trump were both at the border yesterday around 3:00 p.m. eastern time until four something yesterday afternoon.
6:02 am
trump was in eagle pass, a busy section of the border there with governor abbott. then you have president biden over in brownsville, which is a very quiet section of the border these days. there he is with the border patrol chief he owens. >> bill: we've seen in all these primary contests the border crisis is shaping up to be issue number one come november. both biden and trump say the other one is responsible for it. >> this is a joe biden invasion. this is a biden invasion over the past three years. we had the most secure border and people weren't coming because they knew they weren't going to get in and we weren't promising free education, free medical, free everything. >> here is what i would say to mr. trump. instead of telling members of congress to block this legislation, join me and i will join you and telling the congress to pass this bipartisan border security bill. >> bill: we'll speak with former border patrol chief ortiz in a
6:03 am
moment. first from san antonio today. different location for bill melugin. why are you there and good morning to you. >> good morning to you. we're a few hours away from eagle pass as we get ready to ship out for poll ickx the. former president trump in eagle pass yesterday very quickly brought up the murder of laken riley. her funeral is later today. he spoke with her parents and placed the blame for her violent death squarely on the shoulders of president biden after her alleged killer, an illegal alien from venezuela was released into the country. >> what he is doing is unbelievable. joe biden will never say laken riley's name but we'll say it and we will remember. we aren't going to forget her. it has been a horrible story we've lived with for a last few days. >> president trump was at the border getting a briefing from greg abbott, as well as texas
6:04 am
national guard representatives and members of texas dps. he went to the epicenter of the border crisis, shelby park, a high-profile area seeing record illegal crossings as of last year. texas came in there, locked it down, kicked out the federal government. during the visit you could see people on the mexican side of the river waving to president trump. trump waved back. it's the legions of adult military age men pouring across our border from around the world. >> it is allowing thousands and thousands of people to come in from china, iran, yemen, congo, syria and a lot of other nations, many nations are not friendly to us. he has transported the entire columns of fighting-age men. >> trump was also flanked by border patrol union president brandon judd. during his visit trump went off on blue states sanctuary states.
6:05 am
specifically called out governor newsom of california who he referred to as governor new scum saying these blue states provides all sorts of benefits for illegal aliens coming across the border and creates an incentive. judd went after biden for his visit to brownsville. >> i want you to know my agents are mad as hell, absolutely mad that president biden went to brownsville, texas, rather than going to arizona or san diego, california, rather than coming to eagle pass, texas. >> during biden's visit to brownsville our colleague shouted a question to him asking mr. president, do you bear any responsibility for the murder of laken riley? president biden kept his back turned and did not answer. send it back to you. >> bill: nice to see you in san antonio. bill melugin rick former patrol chief ortiz is with me.
6:06 am
the numbers -- you have four years of trump, three years of joe biden. trump 1.7 million. biden 7.3 million. who won the day yesterday? >> i will tell you that certainly what we saw in eagle pass and in brownsville was a disparity of ideas how the border should be managed and secure. i think the border patrol came out ahead. they were able to explain to the president what is really needed there. refreshing to see jason owens on the ground with president biden. i realize that brownsville is one of the slower areas along the southwest border but it has always seen some heavy traffic over the years. so no matter what the president was going to hear firsthand from the border patrol officials what is needed is a law enforcement solution to what is happening along the southwest border. >> bill: what is that answer
6:07 am
then? >> you need consequences and be able to deport people. they have diminished ice's capacity to deport people back to their home countries. we need the state department to get more engaged to open up pathways and send people back to their home countries who aren't deserving of asylum and look at the criminal aliens coming across. the riley case is what we shouldn't have to expect in these communities. this we've had 15,000 gang members already arrested this year. there are still 5,000 people coming across being apprehended by the border patrol every single day. it's tucson, san diego, california, el paso. we have to do more. >> bill: okay. look at this. border encounters you are almost at a million. it is not even five months and the current year and now you are talking about the current team in power and whether or not they will do what you just laid out,
6:08 am
okay? go back 2 1/2 years and mayorkas told america what they were doing by rescinding all of these executive orders when he said this in september of 2021. watch. >> we have rescinded so many trump immigration policies, it would take so much time to list them. >> bill: i know what you want but you won't get it with this team. where are we come november? where are we this time next year? >> i think what we're going to have to see is drastic changes. they will have to execute some executive orders to get some sort of resolve on the border environment. what we've seen and what we'll see this summer and springtime is more illegal aliens coming across that river. traffic will increase. the conditions in south america and cuba, across the globe aren't changing. so until we actually input some consequences against this illegal migration, we'll
6:09 am
continue to find ourselves in the same situation. 1,000 pounds of fentanyl the border patrol has seized this year. 10,000 pounds of hard narcotics already seized this fiscal year not to mention what you described over 900,000 apprehensions. not even talking about the folks who have gotten away from us. >> bill: president biden said that republicans and house should take up the senate measure. should they? would that be good enough? >> there are some positive things in that bill to include more resources for the border patrol but it didn't go all the way we needed. we needed more teeth in that bill to be able to solve what is happening along the border environment. >> bill: thank you for your time. we are waiting for yesterday, it came and went. good luck, sir. thanks. >> thank you. >> martha: in new york city the democrat controlled city council is pushing back on mayor adams' call to change the sanctuary
6:10 am
status in this city saying that it would be harmful says the council as the changes would allow the new york police department to cooperate with ice to deport migrant suspects in violent criminal cases. that might have had an impact on the man who is the suspect in the athens, georgia case. he did break the law in new york city. bryan llenas joins us now at the roosevelt hotel with more on this struggle happening in a lot of cities. hi, bryan. >> good morning. even though mayor adams says he believes new york city should work with ice to deport migrants who commit serious violent crimes, the new york city council speaker says that's not going to happen. she believes it puts innocent migrants at risk of deportation. >> we are not considering laws, changes to laws. these laws have been in effect for decades. we believe in them. it would be harmful to retract and go backwards instead of going forwards as far as the law is concerned.
6:11 am
>> we're not going back and forth. i stated my position. they stated their position. the legal team is looking at what are the options we have. >> republicans like congresswoman malliotakis are pressuring the mayor to use executive action to by pass the city council and change the city's sanctuary law. adams says he wants to provide services to migrants as a sanctuary city costing the city billions but changed the laws signed by deblasio which banned the city, including the nypd, from cooperating with ice. new york governor kathy hochul and adams say migrants who commit violent crimes should serve prison time and then be deported. the aclu is also pushing back against them writing governor hochul and mayor adams calls for law enforcement to conspire with ice would undermine public safety and push more of our new neighbors into the shadows and away from the basic support

services that are essential to help them get settled, get jobs, and contribute to the community. ice tells fox the suspect in the murder of the college student laken riley in georgia entered the country illegally in 2022 and was arrested here in new york city for endangering his 5-year-old son. ice says the nypd allowed him to go free. >> martha: thank you very much. bryan llenas from new york. >> do you understand it, that their relationship began in 2019 and continued until the last time you spoke with her? >> yes. >> bill: remember that day two weeks ago in fani's former friend spilling the beans. today we might learn whether or not that love affair will end the case against the former president. wow, wouldn't that be something? stand by on that and this. watch. >> president biden: my son has
6:13 am
done nothing wrong. i trust him. i have faith in him. >> martha: the tale of the transcript. does hunter biden's recollection of events help or hurt as republicans pursue impeachment efforts against president joe biden? >> bill: a lot to go through on that one. she is going pro. caitlin clark has a big message to her millions of fans, all right. ♪ t, determination and problem solving. we're taking that passion and channeling it through our farm to home bedding bath, and apparel at red land cotton. we grow cotton in the rich red earth of north alabama. and we want our products to be made here in the usa, from the seed in the ground to the final stitch. go to red land cotton dot com and receive 20% off your order with code fox 20

6:19 am
the time on the campus of the university of georgia. authorities have charged an illegal immigrant from venezuela with her murder. >> bill: the transcripts of hunter biden's closed door deposition seeing the light of day. you can read them for yourself. it reveals that several allegations against the president's son have been confirmed. he had a response for all of that and what did we learn? >> the 229 page transcript covers the seven hours he testified. he with as in new york for a business meeting. asked his father to swing by. republicans believe that is important. >> i can understand now why hunter's lawyer doesn't want him to testify in public or to answer any questions in public. he just confirmed the core of the house's case and told them joe biden was in the meetings. he told them joe biden was on the phone. these were the smoking guns
6:20 am
democrats earlier said are not true and made up. hunter confirmed it all. >> bill: republicans say the transcript reveals inconsistencies between some of the witnesses. testy exchanges between hunter and matt gaetz. he told house members the president was not involved with his business dealings but republicans don't buy that claim. >> his testimony conflicted the testimony of other people, three or four other people, other witnesses we've had. somebody is not telling the truth here. i've been in business -- i've never had my father call in hundreds of times to business phone calls and then say he was not part of any business deals. >> the attorney for hunter biden says there is nothing new to ask, say, or do. there are questions as to whether hunter now wants a public hearing. republicans want hunter to appear but they're exasperated at where this is going. >> i think he should.
6:21 am
we need to put this thing to rest. it's dragging on. >> our base is demanding a vote. >> it is unclear if this is the final time hunter will appear on the hill. the consequence of the deposition, prosecutors could use the transcript against hunter in his two criminal cases. >> bill: got it. thanks, chad pergram the follow up today. >> martha: let's bring in nole rothman and kerb-great to have you both with us. hundreds of pages of this transcript and in it, you know, you hear hunter biden saying what he has been saying all along. he is close to his dad. he calls and checks in with him all the time. never involved in his business dealings at all. what do you make of it? >> we see him acknowledging he was highly involved and you go back to 2020. hats off to our corporate cousins knee "new york post." the stories were true.
6:22 am
this is now another test, i think, of some -- of our colleagues in the media whether they will rise above partisanship. they all went with the joe biden con job in many cases that the this is so damning, so awful, so corrupt, it must be a russian disinformation campaign. that's how bad it was. well now it's all true. we know it wasn't a russian disinformation campaign and the smoking guns are there. >> bill: here might be one of them. i don't know what you make of this noah. would you call it -- the question, would you call it involvement if my dad was in new york city at the same time i was in new york city and i was having lunch with some business associates and i said hey dad, come by for lunch? are you saying you wouldn't do with in your father if he was in town at the same time? i don't know if that was a rhetorical on behalf of hunter biden or not. that's part of the way it went. >> the question of whether you call it business.
6:23 am
the product being sold is joe biden. so then we have a product demo, which i think reassures all the check writers around the table that yeah, this is really it. this is really the product. it's awful. and it is just as awful as when he brought hunter along on air force two representing the united states. hunter with his hand out doing business in china, for example, introducing his dad to his new chinese business associate. and what is the business? >> bill: he repeatedly said it had nothing to do with my father. nothing to do with my dad, 0. >> comer's committee is credited for a holding the closed door hearing and releasing the transcript as soon as possible. we get a lot of information from the witness and don't hear the grandstanding from the members questioning him which is desirable and perfect. they give hunter biden a lot of rope to hang himself with. he says in this transcript in
6:24 am
part that jim biden, joe biden's brother, when they were talking about involving joe biden is entirely aspirational. wouldn't it be nice to have the president involved? it will never happen. that conflicts rather significantly with previous testimony that he had been given and other information we have about joe biden's where he received 10% of this remuneration for loans and he was the big guy. that information came out talking about these strong arming texts which hunter biden said he sent to the wrong person and that mistake was made because he was under the influence of either drugs or alcohol. these are said in defense of his own conduct incriminating himself and demonstrating he is not a reliable witness which makes it almost inevitable he will have to testify in public and expose himself to these very political showy hearings. >> martha: abbe lowell says it
6:25 am
makes it obvious there is nothing next to ask, answer, say or do. they were pushing for public testimony now it appears they're saying we're done, james. >> in a way i would agree that the 2020 stories that they worked so hard to suppress we've now seen are all true. joe biden obviously thought he wouldn't have gotten elected. in some ways there is no more to stay. i would still like to hear from members of the obama administration, obama white house counsel's office how did you allow this garbage? we know there were people during the ukraine episodes in the state department who did not like this hunter doing business trailing along with his father. i would like to know how that got past the white house counsel's office. >> martha: we also know the obama team was concerned about
6:26 am
this. hunter going on planes with him doesn't look good. they fell back well he just lost his son, a great tragedy. every time in this transcript when anything starts to be somewhat exposed they fall back on the tragedies that family has suffered and why we call each other constantly even in the middle of business meetings and the drugs or alcohol excuse. noah. >> that's a really good emotional blackmail effort to get you to back off your own conclusions. i can see why hunter's counsel wants to say we're done and not going to testify anymore. the politics of the impeachment inquiry have been moving in the wrong direction from republicans. votes aren't there. barely there for the inquiry to begin with and sure if they held the vote tomorrow for impeachment it would fail with republican votes in the opposition. in the event you have hunter biden on the stage trying to demonstrate that he is some consistentsy in his answers getting probed as answered as the representative said the base
6:27 am
demands it. a lot of votes previously a little leery of engaging in impeachment inquiry could begin to change. >> bill: a public hearing is in doubt. i think they'll fight it and see how far they go. comer wants it. doesn't look like lowell is willing to go. james and noah, have a great weekend. we watched this a short time ago in russia the funeral service for navalny has been held. his widow even today is vowing not to give up the fight against vladimir putin and take you there coming up. new evidence emerging in the relationship between fani willis and nathan wade. what was going on there? will it be enough to disqualify her from the case against donald trump? >> a man is not a plan, a man is a companion and so there was tension always in our relationship, which is why i would give him his money back. i don't need anybody to foot my bills.

>> bill: we're seeing something in florida. this is fort pierce now. donald trump just showed up screen right and look what's going on screen left. wow. it is trump territory on the southeast coast of florida and all those people have showed up for him to come in and listen to. the case is whether or not it could be bumped. a document matter that pertains to mar-a-lago after the president left the white house. we'll see whether or not the trial date stands up or what they decide to do. that's some turnout there. >> martha: quite the escort as well as you see on the full screen of the police in fort pierce, florida, escorting the former president to this court date. you know, this is why this works with the campaign. it doesn't work against the campaign. it doesn't -- it takes him off the campaign trail but puts him right on it. a huge outpouring of support
6:34 am
outside of this courthouse and very strong cooperation from the police department in that town as well. so this is quite the scene that we will keep an eye on and be watching it throughout this morning as president trump moves into the courtroom. also going on, another outpouring of support, funeral services today for russian opposition leader alexei navalny. the prominent putin critic died two weeks ago in a remote russian penal colony. huge outpouring of support for him today under very severe restrictions by the police in that area. they're chanting all sorts of things against putin in this crowd. alex hogan covering this for us from london. hi, alex. >> despite the risks thousands of people came out to the streets filling the area today to honor and remember the famous russian opposition leader navalny. a brief 45 minute ceremony at a

moscow church before he was then laid into the ground and we know that there was some back and forth between russian officials who had refused to release his body but about a week later they finally caved. you can see in some of these shots from earlier today despite the threat of potential arrest, massive crowds gathered chanting you were not afraid. we are not. at the cemetery navalny spokesperson said his body was lowered into the ground to the sound of frank sinatra's i did it my way. russian officials said he collapsed. his family calls it murders. supporters are grappling with the fact they won't get more answers after today about what really did happen and his wife has been a fierce critic of the kremlin ever since the death of whener husband. she spoke out today despite not being there at the funeral saying that she will try to make him proud. she doesn't know if she can do it but she will try, martha. >> martha: extraordinary story and quite the out pouring.
6:36 am
people in the crowd yelling putin is a killer. they didn't want a funeral and to have it under a radar and you see why today. >> bill: want to get back to this image in fort pierce, florida. a live look at the amount of support that's turned out for donald trump showing up in court. huge. so the court case -- the court matter will begin at 10:00 in the morning. recall a lath bit over the past couple of elections. fort pierce is not far from mar-a-lago. not far from jupiter, florida, where the inlet that holds every weekend a trump rally with boat after boat after boat and flag after flag after flag. this is deep red america right now and it is only moved that way since donald trump won in 2016. it hasn't gone the other direction. if you think about the general campaign against ron desantis during the primary season, this
6:37 am
is the reason why desantis could not get any traction against the former president. then you have this matter about seating a jury and we have seen what happened in new york and a lot of trump detractors have said you are stacking the deck against him. if you seat a jury in florida, this is the pool. >> martha: extraordinary with these cases that's the dichotomy at play. a trump-appointed judge here and she will make decisions about the timing on all of this and when they will see the jury. there was an expectation it would happen in may. whether or not this will be pushed off. it comes as, you know, people are digging into the robert hur report and the details that surrounded why president biden thought it was okay for him to bring documents home and to talk to his ghost writer about them. mark levin was on earlier talking about this with brian
6:38 am
kilmeade and they were saying at points in the hur report it says biden told his ghost writer i am not supposed to have these classified people. people don't know i have these. why is he not being prosecuted? because he is an elderly gentleman with a poor memory. these things are incredibly dynamic and they are like mirror images of each other and both of these presidents former and current deal with these document issues. >> bill: you are 22 minutes away from court beginning there. cannon is the judge there. bryan robinson on another legal matter. we'll make sure we keep everything straight. fulton county, georgia. at 1:00 this afternoon you get closing arguments in the case that involves fani willis and nathan wade. there will be a question as to whether or not they should still be on the case. this week we learned this. remember they testified that the relationship started in 2020.
6:39 am
under oath. brian, join the conversation here. the new evidence this week shows between january and november of 2021, you had nathan wade's phone ping near willis's home 35 times. 2 thousand voice calls, 12 thousand total interactions. so i'm looking at this thinking what does the judge have to decide in i guess he has to figure out did they lie? when did the relationship begin? and if they lied, does that disqualify them, brian? >> well fani willis took the stand and said i'm not on trial here. but i would say, bill, she is on trial here because she has had to give testimony to the court where she asserts certain facts about when their relationship started. there is a lot of circumstantial evidence suggesting when she held up those papers and said
6:40 am
these are lies, these are lies, there was a lot of truth in those document. certainly the cell phone pings don't prove that they were together at her condo, but this is not someone who lives there. he is from cobb county. it is not somewhere he would have gone to business or some place to go for a business lunch and not something you do at 3:00 in the morning when his phone was pinging in that area. if he wasn't at her house, what was he doing in that area? not the normal place for somebody in cobb county to be at that time of night. if you look at the testimony from mr. bradley, nathan wade's former law partner you see a guy who has done an about face. he spoke with certainty in the fall with the defense attorneys about when the relationship started prior to 2022 but he also knew there were consequences. he said witnesses wouldn't want to burn that bridge.
6:41 am
he is one of those witnesses and he doesn't want to burn that bridge. he is worried about the consequences of being a truth teller here. >> bill: one more question here. everybody knows everybody in this case and it's the legal circle of fulton county, georgia. ashley merchant is the attorney. terrence bradley is the former lawyer that represented wade. here her question on a text message. do you think the relationship started before she hired him? he said it started when she left the d.a.'s office and was judge. if that's true isn't the judge's decision here obvious? >> well, if you listen to fani's defenders here, bill, what they say is it's irrelevant whether or not they had an relationship and that the defense hasn't proven that there was a
6:42 am
relationship before 2022. i would say that in many ways they have proven it so does the judge think that one, that they lied, and two, does that count as perjury and give ham reason to remove them from the base. does he keep fani willis on the case and are he move the special prosecutor, nathan wade? or does he just do nothing? of course, all of these characters are having to qualify for re-election next week adding another layer of politics to all of this. judge mcafee will be on the ballot as will fani willis. >> bill: thank you for your time and see what happens. starts at 1:00 this afternoon. imagine it will bleed into "the story" with martha at 3:00. >> in is not sustainable. the cities, the country, the whole place is going bad. every state is really a border state.
