ballot, having a chance to get elected. that has no precedent in american history. >> bill: follow the bouncing legal ball with us. steve harrigan is live in atlanta on a day of reckoning for fani willis. first let's start in fort pierce, florida on the trump legal saga. bring us up to speed. david. >> good morning to you both. we know that things start pretty much on time in federal court. this was supposed to kick off behind me at 10:00. no electronics in the courtroom. we can't be certain but we know the former president is in the courtroom right now and is inside the building right now. remember, the f.b.i. raided mar-a-lago in august of 2022. here we are march 1, 2024, waiting for a trial date. this is a complicated case with tens of thousands of pages of documents. we expect the former president donald trump to be in court most of the day with his attorneys. also potentially jack smith himself along with his legal

team. we have video of the former president arriving in his motorcade today here in fort pierce with some of his supporters outside. the big focus when will this go to trial? it is scheduled to begin here may 20th in florida. but it is likely this date will slide. one of two chief reasons, both sides want it to. special counsel jack smith as of yesterday proposed july 8th to be the new start date. trump's team they could settle on august 12th. another reason trump is claiming in both his federal prosecutions that he should be immune because he was president when the alleged crimes occurred. the supreme court has agreed to take up the presidential immunity issue in late april. meaning a start of a may 20th date nearly impossible. judge eileen cannon appointed by donald trump when he was president is proceeding over the case. she met two weeks ago to go over

concerns the government has about producing classified evidence to trump team. as of today, this is called a scheduled hearing. we should get some idea about what she is thinking when it comes to a trial, july 8th would mean a couple weeks later would be the republican national convention. so certainly we are tiktoking closer to the really height of election season and it's also possible that she could move this trial perhaps to west palm beach which is still in the southern district of florida. right now the former president is motorcading about 70 miles and he would have to do so every day that he wants to come up here. bill and martha. >> bill: keep us posted what's happening inside the courtroom. david spunt in fort pierce. >> martha: the every trial on everyone's minds in atlanta now. steve harrigan on what we could hear this afternoon during the closing arguments in fani willis's misconduct case. hi, steve. >> we're about three hours away

from those final arguments in this misconduct hearing. basically the judge will have to decide one main question. does he think that the d.a. fani willis and the prosecutor she hired nathan wade are lying about when their relationship began? did they lie under oath? so far defense attorneys have presented one eyewitness, colleague who said she saw them hugging and kissing long before they said they were in a relationship and also presented text messages from wade's former law partner, one exchange went as follows. do you think it started before she hired him? absolutely. the law partner responded. trying to present cell phone records from nathan wade. those records show in the one year before the two said they were an item that wade called willis an average of six times a day. messaged her 30 times a day before the two claimed under oath they were in a relationship. the judge is likely to decide

googled this morning what a private flight time is from the various locations in florida because if it runs up against what happens in july, yeah, how long would it take him to get to milwaukee and back? is it something he would do every night to show up on stage and be there? there are legal logistical issues that need to come together here. you are right. politically this stuff has been good for president trump. he told us a year ago if i'm indicted no way i'm dropping out. it will help me in the numbers. it helped him in polling and fundraising and again and again we see that. he is coming against real legal issues. criminal felony charges that have long jail terms connected to them. while he is trying to manage a presidential campaign he has to be aware of the personal risk to him and how that all plays out. he got a big win from the supreme court this win. not that he may ultimately win the case but the delay in the timeline is a big feather in the cap for lawyers as they try to schedule all these calendars.

need a little bit of time to work through all of this. remember how different this case is than it was just a couple of weeks ago when willis and wade took the stand with the same story, no the relationship did not start before she hired him. anything that happened during their relationship they split and she paid cash. they weren't giving the defense anything to work with at that point. since then we've heard from other witnesses, terrence bradley situation is a difficult one for them. the texts are there with ashley merchant, one of the attorneys for one of the trump co-defendants in the case when asked him if the relationship started before willis hired wade he said absolutely. now he is on the stand saying he doesn't recall these things and listen, that's the best advice as an attorney you will give your client when things don't look good. if they truly can't recall and don't know the states and times say you cannot recall. now that he is on the stand, these texts have been presented and the judge is seeing all of this, he has to take everything he is seeing openly and been
