savvy person. i also, there's a lot of texts that i just wanted to things that i do not think those are thought would just embarrass people and will not relevant. so i screenshot of the texts that i thought were relevant. i tried to use those in courts, but the prosecutor said i was hiding things. so they just kept on and on for days saying i was hiding things and explain to them, let them look through my phone. asa colbert, all of my tax. it was adam abadie was the prosecutor. so he just kept saying, that i was -- where is the beginning of the text? where is the thing after that. these are not complete, you know, just kept objecting and i had just screenshot in the text that i thought were highly relevant but were not for interest, i guess, i don't even know the word. but there were some that, like, you know, that miss willis' daughter had found out. they were ugly. they did not need to be admitted. >> oh, yeah, i had read that.

>> ashleigh: so i had tried very hard to just screenshot the relevant ones but they kept saying that i was hiding things. so when they objected they said they wanted the whole text chain and the judge ordered me, if i was going to admit of the text, to go figure out a way to download all of those. so i bought a program for 20, 30 bucks and took three hours and it was -- i was very proud of myself for finally figuring out how to do it but i was able to make a copy of it and then react our phone numbers. so this actually showed, like, when they are red, when they are reviewed. >> so i jen fritz, you were asking -- read the question. >> ashleigh: so i'm asking him, do you think it started before she hired him? >> you are talking about the affair, and what is his response? >> ashleigh: his response was absolutely. and so these are things that he had told me but i was getting ready to file my filing deadline was the eighth and as we are

doing this, you know, i'm fact-checking line by line basically. >> and it did you send him a copy of your proposed motion? >> ashleigh: i did. so at the hearing that i had, i was able to admit the e-mail where i sent him that. i sent him a copy of the motion that weekend when i wanted him to review it and that he had a tax. he did not write me back by e-mail but i submitted my e-mail so that you, -- so that the court can see exactly when i said it, when he responded and then he responded that everything looked good because i said, i'm sending you this motion. i need you to look at it and then he responded that everything looked good. he actually told me at first he wanted me to make some changes because i had not included the information about how much money he had received. i had only included information about how much wade had received and i did not know that it was really highly relevant to my emotions. but he was like, okay that is going to tipped them off that i'm talking to you and i don't want -- he did not want anybody

to know that he was talking. he was very concerned about what -- >> i will let you just read this. we left off up there. absolutely it began before -- it began when she was a judge in south fulton. when was she a judge in south fulton? >> ashleigh: she became a judge in august of 2019. and i did not coach did an open records. i first did an open records. >> harris: that they are going back and forth. that was interesting. we got to see how the original text messages between the divorce attorney for nathan wade and also his former law business partner was texting with this attorney for trump codefendant, ashleigh merchant. and so now that we get to see when they were open, but they the league they were set, i mean, it is all out there and easy to understand. senior correspondent jonathan serrie is at the georgia state capitol in atlanta. he has been watching as we have been and monitoring since the

hearing began. jonathan, what can you tell us that specifically stands out at this point to you? >> reporter: yeah, overall, the senate committee hearing is learning more details about what defense attorney ashleigh merchant says. she was able to learn about the romantic relationship between district attorney fani willis and nathan wade. her special prosecutor in the georgia election interference case. let's listen to some highlights. >> he said that -- he was very specific that it was before she became the a because that was one of the things that he could not remember it went to the judicial conference was but he knew that it was before she became the it. he told me they met at hotels. he would go to her place and i remember him saying, you need to find her, her bestie, who they had a falling out. that is the person whose condo was that they would meet at.

>> reporter: ashleigh merchant is an attorney representing former trump campaign aide right moment. roman who was a codefendant had filed a motion with merchant to have d.a. willis removed from the case. a judge is expected to rule on that by mid march but now, the committee chairman today asked merchant whether she had reason to believe that willis or nathan wade were coordinating with the biden white house over the course of the trip investigation. listen. >> open records for the white house access and we have records that miss willis and the mayor of atlanta were at those meeting with the vice president. >> reporter: fani willis and nathan would have testified that they did not become romantically involved until after she hired him to help investigate the trump case in november of 2021. but as you heard from ashleigh merchant's testimony earlier

today, the defense is alleging that the romance started much earlier than that. >> harris: so jonathan, i just want to get this straight because i have a former u.s. attorney coming up next. what was the deal with the meeting at the white house? did you say to vice president, kamala harris? >> reporter: said that several people were meeting at the white house. of course, the nature of that meeting was not expressed. it could have been some democratic event or a social event. >> harris: but who was in . >> these quick. >> reporter: but the implication was allegedly there may have been some coordination with this case. but they don't have any hard evidence of that at this point because the receipts and this is something that ashleigh merchant pointed out that nathan wade submitted are very vague. they just mentioned that he met with white house counsel or met with white house. but it does not go into any detail as to what the meetings where. >> harris: okay. i got it.

thank you, thank you, jonathan serrie, great reporting. brett tolman, former u.s. attorney and former senate judiciary committee counsel. i do want to drill down just a second on the white house meeting and how that comes into play. is that purely politics, or as a former u.s. attorney, is it something that you look at as misinformation, or what? >> brett: bro, i would tell you i think you are right to be asking questions about it and here is what the public needs to understand. there's really no circumstance for the white house counsel or anyone in the white house to go anywhere near this if they are -- if their goal is to make sure that it is an objective review of potential criminal activity of an opponent, of a political opponent. if, however, you are coordinating and you are wanting to take down a political opponent, that is temptation that the white house, i think, probably gave into, was to have conversations and looked at the

four different criminal cases, all of them have access and we are learning that most of them at this point have had conversations with the white house, just prior to charges being brought. that is not coincidence. that is coordination. >> harris: yeah. alright, i wanted to hit that because that seems to be a bigger issue now that we are hearing about it in a different venue. the state, senate committee special committee hearing. and now you get into what you just pointed out, two men battling it out and it takes you back to what donald trump said days ago when his u.s. supreme court victory happened, 9-0, you can't keep his name off the balance, no state can do that. what he said was stop using your high-power, president biden, of the doj and let's fight this out between the two of us. it is very interesting to that in the context of, with mason willis, with fani willis, excuse me, nathan wade and fani willis, was anybody on that

prosecutorial team particularly those two lovers talking with anybody at the white house? so it is interesting. i will continue to ask the question. all right, were critical to your top line about what is coming out today and when they met and what matters. >> brett: well, i think there's folks that have been saying for some time now, what is the big deal? you know? so what? so they have an affair? does that really impact the underlying criminal investigation? here is why it does. you have a legitimate inquiry into the ethics of the sitting d.a. you have to know whether or not there's a compromise to those ethics because that brings into question her prosecutorial discretion, whether she was capable of exercising it appropriately. then when she lies about their affair, now you have a bigger issue. now you have potential obstruction of justice. right now, what should be
