including malice murder and aggravated assault. police also arrested ibarra's brother diego during riley's death investigation. they say he had a fake green card, and federal prosecutors say he has ties to a venezuelan gang. we're also learning this week about a third ibarra brother. feds say investigators arrested him after a he also entered the u.s. illegally. and the laken riley act passed the house this week. it would require i.c.e. to detain undocumented immigrants for low level crimes. it's -- its path in the senate is unclear. mike? if. mike: madison scarpino live in atlanta, thanks very much. ♪ ♪ mike: the helicopter crash that killed two national guard soldiers and one border patrol agent is now under investigation. the helicopter carrying four people went down over a borderty near the rio grande on friday. jeff paul is live in eagle pass, texas, with the latest on the investigation. hello, jeff. >> reporter: hey, mike. yeah, the u.s. military is still

trying to figure out exactly what went wrong that caused that helicopter to crash during its mission here along the u.s.-mexico border. and while that investigation is ongoing, we are starting to learn more about the people who were onboard. officials now confirming the names of the three who were killed. 30-year-old casey frankowski, 28-year-old john grassia, and u.s. border patrol agent a chris luna. a fourth person was onboard, a national guard soldier who was seriously injured. the team was conducting a federal border operation in the rio grande valley on friday. the border patrol union says they were on routine patrol tracking some people who had possibly crossed into the u.s. that's when the aircraft experienced some type of mechanical difficulty and went down hard. former a acting i.c.e. director tom homan says these types of air missions with both national forward and border patrol are fairly common and incredibly

important. >> because there's not a lot of resources this. boots on the ground, it's a big area. the best way to cover it is by air. the national guard, you know, they can operate the helicopter, but the borderer patrol agent knows the lay of the land. so they work together very closely. >> reporter: here in eagle pass, texas, migrants continue to arrive at the border. our cameras captured this group of roughly 40 people who crossed the rio grande, some carrying very small children. one national guard member with the state of texas told the us it looks like they're entering peak crossing season. right now the river levels are at some of the lowest they have been over the past few months, and the weather isn't too hot. so in the very near if future, we could start seeing some of those larger groups trying to cross into the u.s. mike? mike: we'll track it. jeff paul live at the borderer, thanks a lot. more for on the crisis, or chad wolf joins me now, former acting dhs secretary under president trump and the executive director of the america first policy institute.

chad, welcome. >> thank you for having me. mike: what's your reaction to the latest headlines coming from our southern border? >> well, obviously, the death of national guardsmen and a border patrol agent is tragic. i agree with tom homan, those flights and the type of capability that they give us is absolutely critical. so not only have they done those in the past, but i assume they'll continue those types of operations as that border is very difficult to patrol. but, look, the crisis is ongoing. and and as you anticipated, we're coming upon the spring season. those numbers and the illegal apprehensions start to surge. and they'll start to surge because there's not a policy in place down along that border that is deterring the illegal behavior. mike: president biden's taking some pushback for the way he refers to the alleged murder of nursing student laken riley. let's play it. [inaudible conversations] >> lincoln, lincoln riley. an innocent young woman who was killed. by an illegal. undocumented person. shouldn't have used all legal. you should -- it's undocumented.

mike: what do you make of that walkbacksome. >> well, what they should be more focused on is actually stopping the crisis along that border and less concerned about the terminology. look, the term alien is in title viii of the u.s. code. the term illegal alien has been used by the supreme court. it actually defines what an alien is when they cross into the country illegally. so this idea that it's somehow if derogatory, it's not, it's in law. it's how courts have been referred to, it's how the department, dhs still refers to them as illegal aliens in court proceedings. so the term is not derogatory, it's just an acceptable term. but what the left is try thing to do is obviously -- trying to do is obviously shift the focus to undocumented or they actually used newcomer here recently as well. mike: i want to play for you a clip of my colleague, griff jenkins, speaking with a migrant this week. let's play it. [laughter] >> well, again, i mean, you know, not only do the migrant, but the cartels and the smug iflers, they all a watch what's going if on here in the united states. they know that under this administration that their likelihood of getting across that a border or and released into american communities is as high as it's ever been. and so of course they're going to be proud of that. that's what hay they want to do. they know they're abusing the asylum system to get acrosses the border and be released. so it doesn't surprise me that a they are looking for president biden to give them more and more access to the united states. mike: there's been some shift in terms of the texas border was he he red hot for a while. now the california border seems to be very hot. let's take a look at the numbers from the sand yea i go sector in the week ending march 5th. 8168, ap rementions from 72 countries, 168 unaccompanied minors encountered, 22 human

smuggling events prevented, 48 pounds of cocaine seized. how devastating are those numbers? >> well, the numbers are extremely devastating, and that's just perhaps if one sector. as you look across that border, the pacifickers -- traffickers and smugglers understand how the border patrol starts enforcement actions so that when they see the state of texas and governor abbott taking action in eagle pass and del rio and different other places along that border, heir going to shift to places like new mexico, arizona and california. which is what you see today. because there's no national guard there, there's no razor is wire there, there's no enforcement actions other than the border patrol who's being severely limited by this administration. there's no enforcement action going on there. so i suspect that you'll continue to see the surge in places like california and arizona continue. mike: are you surprise president biden doesn't announce executive action -- didn't announce executive action at the state of the union this week? if. >> i am. it was a missed opportunity to talk to the american people and say, look, we don't have any

movement in congress, so i'm going to take my if authority as the president, and i'm going to direct the dhs secretary to take the following actions. he has that ability today. he can take a dozen different actions told if he chose to. the state of the union was a prime example and a prime opportunity to talk to the measure people about what he is -- the american people about what he is going to do. instead it was shifting blame to republicans and congress. we know congress isn't quick to do much of anything, so he can take action and a missed opportunity, certainly. mike: chad wolf, thanks for your time and your analysis today. >> thank you. ♪ >> instead of celebrating the contribution of immigrants to our country, to our economy and our communities, donald trump calls them vermin, poisoning the blood of america. mike: that was president biden at his rally in atlanta last night calling out former president trump for his negative comments about migrants. for more on this, i'm joined by gop strategist chris johnson and fox news contributor richard

congress, right, is this: democrats and republicans came together to pass the most conservative, bipartisan immigration bill that we've seen since in 1980s, right? it got to the united states house where it fell on deaf ears. now, yes, it is true what the former homeland security secretary said that there's 12 possible executive actions that could be, that the president could sign today. but if you take -- if you are rewind the clock to the trump administration, many of the executive actions that president trump signed were blocked in the court which is why the biden administration doesn't want to do that. they want to codify immigration law in the law so that the it can cannot be blocked and be mired down with court proceeding. who's standing in the way of that? house republicans who say they want stronger immigration laws, but there is a stronger immigration law. the bill passed by the united states are senate which house members will not take up. mike: chris, your response? >> biden benefited in the 2020 election by being just normal, right in this is the kind of stuff people get upset about when you're doing language

policing, walking away from the rhetoric most americans see as pretty normal. so him being unable to say illegal and is worried about undocumented, all that kind of stuff, that a sends the vibe to the american people that he's not the craneton joe that ran as the voice of normalcy and the voice of regular anemia 2020. that's why he won the primary in the first place, because they were looking at left-wingers like bernie sanders and elizabeth warren, and they saw him as the guy who was going to make things normal, deal with the chaos, and right now it looks like he's embracing those folks and getting into their rhetoric to win them over heading into the '24 election. mike: the biden campaign is out with a $30 million ad buy targeting battleground voters. let's play a clip of it. >> look, i'm not a young guy. that's no secret. but here's the deal, i understand how to get things done for the american people. i'm to joe biden, and i approved this message. >> can we do one more take? >> look, ooh i'm very young, energetic and handsome, what the hell am i doing this for?

[laughter] >> is that effective, richard? >> it's a good one. he's clearly making fun of his age, a major is thing in this election. but i think it's it's very important to think about where we are in the country. i think folks could care less about the semantics, and especially after watching the state of the union. i spent it with a whole bunch of undecided voters, and they said they want solutions to the problems. if care less about how you taint, how you make the cookie, they want the cookie to be baked, and they want to eat the cookie. when it comes to the border and the economy, they want real solutions, and i think the voters are very keen on the fact that they see congress as a problem, right, and they see republicans in this moment as a problem. and the reason why i say that is because what you see in the united states senate is senators actually trying to get things done. democrats, republicans, working across the aisle to get a border bill done, a border bill that would increase the border patrol, send more funding to the border, finish trump's wall, buy more planes to deport more illegal immigrants, close the

border if there's a border surge. who's standing in the way of that once again? republicans wanting strong border policy but nothing stronger than the things i just listed out. mike: does a humorous ad work, chris. >> i gotta give him credit, it was funny. i'm glad that he's acknowledging the age a issue. but i think democrats believe if they deal with it, they take it head on, that they're going to deal with the problem, their only real problem. but what happens, speaking of solutions, right, is you start talking about his record, the things that he has done as president or hasn't done as a president and speaking of the state of the union as a well. the kind of rhetoric he was using was very partisan, divisive and angry. younger folks are looking at that, can they're wanting real solutions. if they're less concerned about the age thing because biden's making jokes about it, they're going to be talking about those kind of solutions. and if you're going out there with with the divisive rhetoric that limits the abilities to do big, bipartisan reform whether it's permitting reform on the climate issue is, all these issues that republicans, when i talk with republicans on the

hill, they want biden to be conciliatory. he's not doing that, and getting rid of the age issue night just make that worse. mike: gentlemen, thanks very much. >> thank you, mike. ♪ ♪ mike: well, national guard troops continue patrolling new york city's subway system. new york governor kathy hochul has reportedly ordered the troops to not carry military grade assault rifles during their bag checks in high traffic stations, meanwhile, the nypd making progress with its own crackdown. c.b. cotton is live in new york city with a behind the scenes look. hello, c.b. >> reporter: nice to see you. new york governor kathy hochul won't say exactly how long troops will patrol the subway with system, but we do know transit officers are not going anywhere, and they've ramped up their enforcements too. the nypd transit chief gave us that behind the scenes look. these are the officers patrolling the platforms in position to speak with any riders or conductors in danger.

as for bag checks, the nypd has been at that for a while, but the officers doing them at the busiest subway stations are not only con fig if candidating weapons can be confiscating weapons, they're tracking down on new emerging crime in the city like pickpocketing. >> we've arrested migrants multiple times, professional migrant crews who are pickpockets. this shows the tremendous ability of our transit cops, nypd cops, the ability to recognize people. >> reporter: these men were wanted by the police suspected of pickpocketing. transit officers took them into custody this weekend after spotting them in the subway station. we were there as the men were taken into custody. officers found several iphones on them. one of the phones pinging. the transit chief says it was likely the phone's owner trying to locate it. as the investigation gets underway, he also say says it'll be up to the rest of the justice

mike: the department of justice launching a criminal investigation into boeing in the wake of the alaska airlines jetline arer blowout and fueling new fierce over air travel. transportation secretary pete buttigieg gave a stark warning to boeing on "fox news sunday" today. christina coleman is live here with details. hello, christina. >> reporter: hi, mike. yes, the department of justice

has opened a criminal investigation regarding the door panel that ripped off a boeing 737 max in midair in january. "the wall street journal" is reporting the doj investigation into this incident, also in a letter to congress boeing notes that it can't find records for work done on the door that blew out on the alaska a airlines flight. they're, quote -- their, quote, working high post if sis is that records regarding are muscle and reinstallation were never created even though boeing required it. the federal probe could also provide the doj with details on whether boeing complied with a settlement following the two deadly 737 max crashes in 2018 and 2019. on "fox news sunday," transportation secretary pete buttigieg weighed in on the ongoing efforts to improve safety. >> first of all, boeing needs to cooperate in every respect, and the faa as given them 90 days to show a comprehensive man on how they're going to turn their quality issues around. >> reporter: or boeing and united say they are cooperating

with federal investigators. again, it was a rough week for boeing. last monday an engine on a united airlines boeing 737 burst into flames on a flight from houston to fort myers, florida. a spokesperson for united told reporters a piece of bubble wrap somehow got sucked into the engine, causing the flames. no injuries were reported. the boeing 737 if 900 made a safe emergency landing in houston. also a tire fell off a united airlines boeing 777 shortly after it took off from san francisco this past week. the tire fell on some cars and a fence in a parking lot. one witness reportedly said the tire completely crushed a tesla. now, that flight was initially heading to japan, but it got diverted to lax. fortunately, that plane was able the make a safe landing here in los angeles. mike? mike: christina coleman reporting live. thanks a lot. president biden now saying israeli e prime minister

holy month of ramadan x officials are concerned this could spark further escalation. mike? mike: trey yingst live in tel aviv, thanks so much. for more, i'm joined by the deputy mayor of jerusalem. welcome. >> thank you so much for having me. mike: so five months after the terror attack by hamas, how are your people doing? >> well, it's been quite a roller coaster because imagine the shock and the trauma of the first few weeks. just to accept that something that horrible, that brutal had happened in the our country. we've never seen these things in our country. we've had many wars, as you kno- mike: sure. >> but not that level of brutality on civilians. it's something we never, ever thought we'd see. and, of course, as you know, worst, worst massacre since the holocaust for the jewish people. and so we've gone from this kind of depression, disbelief, trauma, shock to resill yens, to trying to find that hope that lieses at the end of the tunnel to action.

so civil society in israel is very, very strong. people have gone into action from the young to the elderly, everybody's doing something for the war effort. we've had to volunteer in the south and with cultural workers because many of the agricultural workers ran in fear, many of the thai workers that we had. so the south had a real human resources problem, and so we had to go and volunteer. and we've had people doing things for soldiers, and we've had 250,000 evacuees, internal evacuees in israel. 50,000 of them were in jerusalem. now we have about a 35 thoax of them, all from the north of the country for a war that might happen in the next few months over there. mike: president biden's calling for an emergency mission to build a a pier to bring aid there to get into gaza. a key republican senator in the u.s. raised this concern today. let's play it. >> my concern is not getting aid to them, absolutely is, but i also a want to make sure that shipment, when it comes in, there is real inspection that's

actually happening to make sure that a we're not giving additional war making supplies to make a bad situation worse. mike: do you worry about more weapons getting in that way? >> he's hit the nail on the head, a accuseing israel of blockading with its ports, but why did israel have to have a blockade? they were bringing in supplies from iran. so they built tunnels from egypt. this is what hamas has done with all the a aid money that they received instead of building hospitals and schools for their people, a future for their people, an economy for their people. they were building 700 kilometers worth of tunnels. and so i think your senator raises a valuable point, who's going to do the inspections? and also, let's be honest, how can you build a port in a a matter of weeks? it doesn't seem very realistic to me. mike: okay. obviously, israeli people want to get their relatives who are being held hostage home. it feels like temporary ceasefire talks have stalled.

do you think they get a deal at some point and maybe some of those hostages can come home? >> i'm praying for a friend whose son, american also as well as israeli, is a hostage. and so we're all praying that those hostages come home. but at the moment, the people being intransigent are hamas. we also want a ceasefire to get our hostages back, but it's hamas that don't want it. they're saying no. and why are they saying no? because they want the whole world to pressurize israel, and that keeps them up the tree in order to not compromise. and this is a real problem that we're dealing with somebody who even, apparently by hamas standards, is going rogue on this. meanwhile, it's our innocent civilians include aring a 1-year-old baby and 19 women, god knows what's happening with them, that are there in those dungeons. mike: there are reports that israel's relations with the arab countries have been strained during this ongoing conflict.

you've done some business with the united arab emirates. what's the relationship right now with the uae? >> well, that's a great question, and the question that everybody's asking is can the abraham accords survive this. i'm optimistic on that front, and i'll tell you why. the u uae as well as bahrain, the saudis that want peace with israel, they all have had their version of hamas, the muslim brotherhood, the wahhabis in saudi arabia with, etc., they got are rid of them ten years ago. they know exactly who hamas is, and they know what poison hamas to the middle east. they also know something else, that iran is the big puppet master behind all of their pox says including hezbollah in the north and hamas in the south and the houthis who are attacking the americans. and so they understand something which i think the west is having trouble understanding, that the middle east and indeed the world is breaking up into two pieces. one is the countries that want

and i know there are folks on the other side of the aisle, unfortunately, who are trying to lean in here and put their finger on the scale. i'm not going to pile on. i'm going to allow the judicial process to proceed. >> reporter: there are other issues judge scott mcafee may have to consider, the defense is pushing him to reopen evidence and include the testimonies of two more witnesses. they say these witnesses dispute willis' and nathan wade's statements that their relationship began in 2022. willis also maintains she kid not financially benefit from the money wade earned in as lead prosecutor in the racketeering investigation. while all of this is playing out, two attorneys are running to unseat willis as fulton county district attorney. christian wise smith is challenging her in the democratic primary saying in part this decision was made with fulton county residents at heart. willis is facing courtney if kramer or on the republican side is, kramer saying willis should be held permanently liable if she lied on her financial

disclosures. let's hope georgia ethics shows her that she is not above the law. that statement is in reference to a state senate investigation into whether willis engaged in misconduct. willis called that republican-led probe politically motivated. still, mike, it's another item on her risk of growing headaches. mike: we will follow it. madeleine rivera, thank you so much. >> reporter: you got it, thank you. mike: i'm joining joined by attorney lexie rigden joining me now. >> thank you. mike: i want to play a clip from ashley merchant, the attorney in this case, and i'll e get you to react to it. >> so it's pinging from his house all the way down to the condo at midnight, one a.m. and then -- and he he calls her when he gets there. and then it goes silent for four or five hours, and then, you know, early in the morning hour he starts pinging again driving back with, and then he texts her when he gets home -- >> and this is before he gets hired in november of '21. >> yes. mike: what are your expectations as we look ahead to this willis

disqualification hearing this week? >> well, fani willis has so many more problems than just this disqualification. i think that the judge has said he's going to be ruling in the next two weeks, we're already a week in, and so potentially by the end of the week. but as maaed runs rivera just said, they wanted to open up to other witnesses to come and reopen the record so they can testify. depending on whether the judge is going to do that, that might delay the decision, although my supposition is that he's not going to do that because i don't think anything like that has been calendared. fani willis has a challenger for her seat, she's got the georgia senate looking into potential misconduct, and they can't do anything to her, they can't remover in office, but they do control the purse spring arings. -- pursestringings. so they can enact and amend laws for the future to try to avoid this type of thing and ethics investigations being opened into her. she's got a world of trouble whether she stays on this case or not. mike: okay.

fani willis for her part says, quote, i think people are angry because i'm going if to do the right thing and stand up for justice no matter who is the person that may have done wrong in fulton county. so they can continue on with their games, and i'm going to continue to do the work of the people. lexie, is her credibility shot? >> oh, i think her credibility is shot. and a statement like that makes it seem like this is all made up out of whole cloth. there are witnesses, i mean, her friend who was actually had to be subpoenaed who was not really a willing witness, you could tell she didn't want to be there who still had to admit, yes, the affair began in 2019. and then you had terrance bradley who told everybody who would listen, apparently, about the affair and then walked it back, apparently from pressure from wade's team. and so her credibility is totally shot. and now there are the other people coming out of the woodwork saying that this predated, and you also have all that cell phone evidence. so to make it seem like she's just being a target because she's prosecuting trump is intellectually dishonest.

mike: special counsel robert hur expected to testify publicly this week on pride president biden's handling or mishandling of classified documents. do you expect that hearing to move the needle in terms of public opinion? >> i think public opinion on bind in terms of his age -- biden in terms of his age, which is maybe next to the border his biggest achilles heel, his age. so i don't know if it's going to move the public opinion, but i think that anything that they continue to put out that puts this report back into the news especially after what was a better performance than expected in the state of the union is going to be good for trump and his team. what they want to highlight is that his cognitive issues are still there. despite the fact that he can string together a few words for a speech, his cognitive issues are still there. what i'm most interested in hearing is how hur responds to some of the things biden said after the report was issued such as he shouldn't have asked me about when my son died because there have been contrary reports that it was biden who brought it up.

this is going to give hur a chance to rebut the narrative that the president has put out there about how the questioning came about. mike: the jus is disdepartment missed the deadline to turn over president biden's transcript to lawmakers on capitol hill. a spokesman for house judiciary chairman jim jordan expressing some frustration. do you expect there will be fireworks at this hearing this week? >> potentially but not with him and not with hur. i mean, he issued a report that -- and he did it impartially. i mow there have been allegations that the he was partial, but there have been compliments by democrats about his professionalism in the past. i think that the focus is not necessarily going to be on the transcripts. it's not his fault what occurred, but it's going to be on giving some context to some of what went up, what came up in the report about biden's son's death and how he couldn't remember when he was vice president. so i think hur's testimony is going to be really, really important and put it back out there in the public to let us not forget how bad this report

mike: the northeast is feeling the impact from another storm system with a mix of heavy rain, strong winds and snow. say it isn't so. meteorologist adam klotz has your fox weather forecast. hello are, adam. adam: yeah, this is the largest system across the country, mostly clear. there is one up in the pacific north best and the system in the northeast if currently bringing

down overnight what was a lot of rain, now a little bit of cooler air. you're talking about snow, interior portions of new england, stretching back across the great can lakes. all areas where they're seeing snow so far from this system at least in new york state a couple of isolated hours getting over a foot of snow. a lot of these higher elevation, you're talking about upstate new york, but a decent amount of snow across this region. over towards vermont is, even more robust totals as your seeing several more communities getting at or over a foot of snow. and this one is not over just yet. it's probably winding town at this point, but we've still got winter weather advisories across the region particularly down wind from some of the great lakes. the ski resorts across vermont is, these are areas where where you're going to continue to see it and, of course, down in the ap latch. cha mountains you're seeing snow coming down. still winter-like weather. don't think that's going to stick. i'm taking you outst west because that is the other system i pointed out in the pacific noter west. that's going to be moving over
