pushing hard on the special council saying president biden was innocent. he exonerated president biden. the special council held his ground. i lost track how many times he clarified the word exonerated was not in my report. that's the conclusion. >> harris: what is the difference of not charging a man because his memories are bad. there are audio tapes of the ghostrideer saying that biden had this information and shared it. with robert hur saying no evidence. what's the difference between that and exoneration? >> right. prosecutors don't exonerate people. what happened here is robert hur declined to bring charges or recommend charges. the difference is it's not a finding that president biden didn't break the law or did nothing wrong, to the contrary. the special council was clear, he did take classified documents

with him. instead what the special council said is despite the evidence you could use to prove he committed a crime the special council didn't think a prosecution was warranted. probably because he thought he never could obtain a conviction with president biden being older and coming across to a jury as forgetful. >> harris: he said that's precisely the reason he added the detail about the president's memory. an hour ago the election committee overseeing the president trump case dismissed six indictments including three against trump. it left many intact and said prosecutors could seek a new indictment. six charges have to do with soliciting officials to violate their oath of office. that includes trump's phone call to secretary of state to find eleven thousand votes.

what is your take on the dropped charges against trump and others in the case? >> my take is it's a win for former president trump and the other defendants. not a total win. there are charges that remain. he dismissed charges against trump and the other defendants. the reason the judge did, harris is interesting, the prosecutors did not allege the facts that a crime was commitpugh in connection with the charges. he said to defend yourself in court and exercise your constitutional rights you have to know the facts they're charging you with to defend yourself. in the judge's view the prosecutors did not provide the facts. >> harris: alright. we will watch for the other counts and see what happens in the case. as you say a win for trump and defendants. hunter biden has declined a public congressional hearing for next wednesday on influence pedaling. it's part of the impeachment

hearing into president biden. hunter biden says it's a scheduling conflict. we know they have repeatedly asked for a public hearing. his former business associates were also invited to attend. what do you make of all of this? he showed up on capitol hill unannunannounced wanting the puc attention and all of the things. now they back away. >> ya, harris the old scheduling conflict. one of the oldest tricks in the book. i think it's clear hunter biden's lawyers are playing games here. as you point out he has done shenanigans showing up at congress, waving, not testifying, insisting he wants a public hearing and then turns it down. it doesn't surprise me at. announcer: think his lawyers are trying to kick the can down the road and avoid their client before the american people to tell the truth. >> harris: one of the reasons i said this in the breaking news
