"the faulkner focus" is next. >> harris: breaking news, the judge has ruled in the fani willis case, with all of its courtroom drama and extramarital scandal. the judge says fulton county district attorney fani willis can remain on former president donald trump's election interference case. the catch. her lover and head prosecutor nathan wade has to go. i'm harris faulkner and you are in "the faulkner focus." we're standing by for any response that we might get from fani willis after this huge decision in the case against her that alleged conflict of interest and inappropriate movement of cash between fani willis and the man she hired and had an affair with, nathan wade. the judge wrote this. there is a significant appearance of impropriety that infects the current structure of the prosecution team. there is no choice but to change it. we carried it all live. remember these fierce moments

and the willis/wade courtroom case? >> you're confused and you think i'm on trial. these people are on trial for trying to steal an election in 2020. i'm not on trial no matter how hard you try to put me on trial. >> harris: they claim their relationship began after she hired him in 2021. to the tune of 3/four of a million dollars. however, testimony and text messages from former friends and colleagues shredded their timeline. >> you have no doubt their romantic relationship was in effect from 2019 until the last time you spoke with her? >> no doubt. >> the text messages go like just date and that's from miss merchant. she says do you think it started before she hired him? mr. bradley says absolutely. now, absolutely is not a

speculative word. >> harris: jonathan serrie, who has been on this case throughout, is outside the fulton county courthouse in atlanta, georgia. >> judge scott mcafee has given d.a. fani willis a difficult choice to make but most legal analysts assume she will choose to stay on with her office and instead take the option to ask special prosecutor nathan wade to step down. that would allow willis and the rest of her office to proceed. the judge was unconvinced by defense allegations that willis and wade improperly benefited financially from a previous romantic relationship that involved cruises and other travel but judge mcafee did express concern allowing the couple to continue prosecuting this case together would lead the public to question whether their relationship had resumed. put differently they could think the d.a. is not exercising her independent professional judgment free of any

compromising influences as long as wade remains on the case. this unnecessary perception will persist. former president trump's lead defense counsel in the georgia case had this reaction. while respecting the court's decision we believe the court did not afford appropriate significance to the prosecutorial misconduct of willis and wade including the financial benefits testifying untruthfully when their personal relationship begin, as well as willis mlk church speech where she played the race card and falsely accused the defendants and their counsel of racism. he is referring to d.a. willis's speech at big bethel ame church in january. in his ruling the judge writes it did not cross the line to the point where it denied the defendants of their right to a fair trial or require the d.a.'s disqualification. it was still legally improper, mcafee writes. it creates dangerous waters for

the district attorney to wade further into, end quote. back to you. >> harris: thank you very much. let's get legal analysis here. leo terrell and jonathan turley. how fortunate are we. both attorneys and fox news contributors to start off "the faulkner focus." leo, i will go to you first. i want to know what your thoughts are. you were just fierce in your own right in terms of saying what needed to happen here. is this what it was? >> you know, harris, remember at the beginning we had that initial motion and he said, you know, grounds for disqualification based on actual conflict or the appearance. he found appearance of conflict and harris, he punted his obligation as a judge to fani willis to determine the remedy. let her decide what she wants to do. he failed to do his job as a judge by handing out the appropriate remedy. i find it disingenuous for her to downplay the comments she

made in a house of worship playing a race card. she tainted the jury pool. the judge down played it. seemed to me he found every excuse to allow her to remain in this position. i find that wrong as a judge. >> harris: jonathan, before i come to you i want to share this. attorney paul mauro wrote this. that it is far from over and fani willis may not be safe. there are other avenues for her dismissal, the georgia senate has opened its own misconduct investigation. in fact, governor kemp or georgia attorney general christopher carr could appoint a special prosecutor to investigate and possibly disqualify willis depending on its findings. your take. >> that's certainly true. this is going to continue to undermine the prosecution. from the very beginning of this controversy, willis has put her interests and those of mr. wade ahead of her case, ahead of the interests of the people of fulton county, and ahead of her office. that's one of the things that is

most shocking about this. she should have recused herself weeks ago. there is this disconnect in the opinion. i get much of what the judge is saying. he has done a fine job. he has been fair, he has tried to get it right. and i get it when he says look, i can't say that this relationship is the reason that she brought this case. that's true. unfortunately, the case was not brought for personal reasons, it was brought for political reasons. this is a very politically-motivated case, at least extending it to donald trump with this rather thin racketeering theory. so i get all of that. what i don't understand is how the court can find that she did act improperly in her public statements. he shreds the testimony. he strongly indicates that he did not believe mr. wade. but then he ignores the fact that they testified largely in tandem. willis adopted his testimony.

she supported his testimony. so if he was false, she was false. and it's very hard to separate these conjoined twins. it takes quite a surgeon. >> harris: i want to get to this. leo, i come to you with this because you are a civil rights attorney. maybe this is somebody who is known to you. this caught my eye last thursday as we were finding out that this case was wrapping down and, you know, there is a lot going on in fulton county right now about this case. people are saying -- i'll quote this man -- robert, a talk show radio host and civil rights attorney, a giant reality show. this was embarrassing for atlanta. it made our city look like a giant reality show. he confirmed to "newsweek" last week that now he plans to qualify to run against judge mcafee and that will happen in may. he noted that he voted for

democrats and republicans in the past and going against mcafee because -- not because of the trump or willis disqualification matter. that hasn't been settled when he gave that interview. we should note he is the executive director of a rainbow coalition project in atlanta, georgia. has worked and advised reverend jesse jackson for 20 years. are politics getting mixed into all this? i think it's at least on the table to ask. >> harris, it is a fair question. you and i have discussed this numerous times. it would be naive for anyone to believe these cases are being handled from a perspective through the prism of the law. they're political in nature. mcafee is up for re-election. if anyone is to believe he is not aware or conscious of the political impact of his decision on his re-election, you have to be naive about it. i will tell you right now this whole case when you look at this case and the other cases against trump, i think the american

public honestly understands there is a dual system of justice being administered not only in atlanta but in west palm beach, florida, in washington, d.c., in new york related to this election 2024 campaign. >> harris: and in fact there are six cases prosecutors have brought against the former president. let's get into it and i'll come to you, jonathan turley. dan henninger's column in the "wall street journal" this week head lined the high price of democrats and anti-trump law fare. most believe the rule of law is better than the law of the jungle. i will leave it there and come to you, jonathan. >> well, i do think that the public is viewing this pile-on of the president for what it is. these are a series of daisy-chain cases to take him all the way up to the election. all of these prosecutors are unrelenting with these courts saying we have to try him before the election.

some of them are just raw and openly political. that's what i would say about bragg's prosecution in new york. i would also say it about this case. the thing about the georgia case is there are some legitimate crimes here. those are crimes like unlawful access to election areas. those are relatively minor crimes. where it's political is adopting this novel and unprecedented racketeering claim to encompass all these defendants, including trump. they have very little to do with each other, other than their politics. but in terms of their actual conduct, the indictment is quite weak in establishing any conspiracy. that is where it becomes raw and political. i think the public is seeing that. despite the drumbeat in the media it is not working with the public. they view these as politically

motivated. >> harris: you can't get away from the politicians. tiffany johnson is also running that race against judge scott mcafee. the man whose resume, the new challenger that jumped on the spectrum as of thursday, says that he intends to file and take mcafee on. he thinks he can do a better job, i suppose, than making the city look like a reality show. gentlemen, please sit by. i want to talk more with you coming up. we'll bring you more reaction to the judge's decision to conditionally let fani willis stay on trump's georgia election case. she has to kick off her ex if she wants to remain on the case. it is looking more and more like we may not see former president trump in a criminal court before november. i can't wait to hear jonathan and leo talk more about what that could mean for the campaign. what does that mean for voters? jason chaffetz is next.

>> harris: we're still waiting for reaction from the district attorney in former president trump's georgia election interference case. about two hours ago judge scott mcafee ruled the d.a., fani willis, could stay on the case. however, if she chooses to stay on the case she has to kick off her lover and lead prosecutor, nathan wade. back with me now attorneys leo terrell and jonathan turley and jason chaffetz coming into the mix. former republican congressman of utah and former oversight chairman. jason, i'll start with you on this. more legal peril forare the district attorney. the house jude chairman, jim

jordan, has threat en fani willis with contempt of congress and comply with congressional subpoena in her office's use of federal funds. how does this work? >> there is nearly half a million dollars that was allocated from the federal government to that district attorney's office and they are questioning the receipts on that. where did the money go and how did they spend it? she has been unwilling to respond to that. guess what? if you take the federal money you will have to answer the federal questions. chairman jordan is on it. i'm glad he is doing that and it is the appropriate thing to do. >> harris: "politico" is asking this question. will there be any trump trials? argues we could see 0 trials before the election.

manhattan district attorney bragg yesterday said he is open to a 30-day delay to that trial. the request surrounds a massive trove of federal documents that alvin bragg had requested more than a year ago. he got them earlier this month. 73,000 pages in total. a judge will likely grant his 30-today delay. jonathan, your thoughts on it. >> as a criminal defense attorney i have to say 30 days is not a lot of time to deal with this type of -- burden of documents. the real question, obviously, is whether this judge will bring a modicum of fairness into this. many of these cases are moving at a pace that is unusual. i just did a column about the d.c. courts where i practiced in the past. in that case you have a judge who has insisted she won't consider the fact that this is someone running for president. and yet she has adopted a schedule that seems expedited at

every single stage. this is faster certainly than most cases in d.c., which could take years to move forward. so it is clearly being influenced, this gravitational pull of the defendant is having an effect on all of these judges. and that itself is concerning. this mad rush to try him before the election only magnifies the view that these are politically motivated cases. >> harris: politics again and forgive me, leo, i will go back to jason. real quickly, if these cases don't happen until just before november or around about that time, what does that mean for donald trump? >> well, donald trump has defied every bit of conventional wisdom. conventional wisdom was you get an indictment you are done, your political career is over. what they've seen in totality. this is a witch hunt.

they saw it when they went after donald trump on everything going on, russia, russia, russia. how many tiles did adam schiff say i have seen the evidence and get the mueller report and it is a nothing burger. he is the biggest impediment to the washington, d.c. bureaucrats and that is what makes him that much more appealing. so keep going after him hard, he gets politically stronger. >> harris: a witch hunt is a word we haven't heard in a while, leo terrell. evidence that only he could see. we couldn't see it. >> you know, harris, amazing thing about this donald trump has said on the campaign trail if they can go after me they can go after any one of us. that's true. you have to go that new york case. all these documents just delivered in the new york case, there is something called the brady rule which requires exculpatory evidence and documents to be given to the defense team. you are giving this information

at this last moment? this is a -- donald trump would not be facing these charges, harris faulkner, if he wasn't running for president. everyone in this country knows that. but they want to keep him off the ballot. that has failed. now they want to try to give him a scarlet f felony conviction before the november election. that will not work because these cases will not take place in my opinion before november of 2024. >> harris: quickly everybody can see the live bug on air now awaiting decision in a florida courtroom on trump and dismissing -- a motion to dismiss the florida case. your thoughts very fast. we don't have a lot of time, leo, i come back to you. >> the florida case if you are talking about the florida case, that case in my opinion won't take place until after the election. it will be continued throughout this year. >> harris: jonathan, quick thoughts. >> i think there is a good

today across texas and the southeast. president biden is on the road again in key swing states this week. some of those are where his polling shows he better spend some quality time on the ground. eft he was in michigan for the first time since more than 100,000 democrats voted in the uncommitted column last week. rather than vote for him they said i am uncommitted. the day before in wisconsin he said this about former president trump. >> i know it sounds like hyperbole and it is in your hands. this is how i run the first time i ran and how i will win again. you helped me in 2020 and made sure he was loser. and -- [laughter] we'll make sure that happens again. >> harris: i think what he meant the first time he ran against trump. i guess -- a new michigan poll shows trump is up by three

points. here is what i'm digging down on for you, political analysts are saying neither candidate with win this election without michigan. 100,000 plus people voted against biden for a column named uncommitted in michigan during this primary season. the latest fox news polling finds biden is also down two points in another key swing state, pennsylvania. both went for biden last time. this would be a flip. in arizona trump has an even stronger four point lead. biden won all three of those states in 2020. moderate democrat senator joe manchin has a warning for biden. >> he has been pushed so far left it is unbelievable and i've been raising hell from day one. i just -- this is not how you will get reelected. you won't get reelected over here. >> harris: cassie smutly and mat rick murphy former democratic

congressman from pennsylvania and former undersecretary of the army. what is the strategy right now for hitting some of these places, patrick? and can he actually say it's only just arab muslims in michigan? what about the electric vehicle press that you put on the auto industry there? he is in trouble. >> it is neck-and-neck and will be for the next eight months in these battleground states. you looked at he beat donald trump four years ago by 154,000 votes. 100 folks uncommitted. also on the other side 30% of michigan republicans voted for nikki haley. he also has to try, meaning donald trump, has to try to get those folks not to go astray from that side. it will be neck-and-neck. the fact that he is in four swing states oohth week and two other states next week shows he is playing to win. >> harris: i want to concentrate a little bit on michigan with

why are african-americans, hispanics and men and women looking at donald trump with new eyes? simple. we were better off under trump. >> harris: one democrat who is not happy about this is congressman gonzalez of the state of texas. critics tore into him for this quote. the rhetoric you hear from the republican party is shameful and disgraceful for latinos. you know when you see latinos for trump to me is like seeing jews for hitler, almost, you know? that's so offensive. former texas republican congresswoman flores is looking to unseat gonzalez in november and she says his racist comments are incredibly hurtful to our entire latino community in the rio grande valley. patrick, i'll come to you for reaction. >> i have no reaction except it is appalling what he said. i won't defend the congressman

for his comments. i will say the premise what you are saying is there is no doubt that people of color are in play. that latino vote specifically is 15% of the electorate. the highest it's ever been. i do think -- joe biden has delivered for people of color. when you look at latinos, senior specifically. insulin was capped at $35. >> harris: you always mention that. >> it saves $8 hundred to latinos. >> harris: one of the greatest things to treat your diabetes with bright will diabetes is watch what you put in your mouth. with the price of food under the president it has been difficult to do in lower income families especially. not that the drugs don't help. they're necessary. so is the food intake. cassie. >> what you touched on right there, that is the top issue of concern. the pocketbook issues, the cost of groceries, the cost of gas.

that's what affects all americans. i think latinos, african-americans, asian-americans are tired of being treated like a mono lit i can voting block and taken for granted. donald trump pays attention to us and actually delivered lower food prices, lower gas prices for sure. we remember the glory days of having less than $2 a gallon because donald trump put america first and all americans first. that's been the relish yu. i will note while joe biden won the majority of latinos in 2020 donald trump had an eight point swing in his favor. that's a winning margin. he has to make inroads, which he has shown he is more than capable of building. >> harris: your state is pennsylvania. why is it so close and flipped now trump over biden? >> because we have philadelphia, pittsburgh and the state of

for maybe that blind-sidedness that they had. >> absolutely. the economy and how people feel when shopping at the grocery store is the number one issue on the ballot when we get to november and they realize they made big mistakes to further their agenda along the way. having said that she said that and president biden says my number one priority is to bring prices down for the consumer. they are up 20% over three years. real wages just started outpacing inflation a couple of months ago. people are suffering. when you have a nation that isn't saving, tapping into 401ks, retirement money they are supposed to save for later, you have big problems on your hands and they aren't addressing any of that. >> harris: let's drill down on inflation and how it started. january 2021, milk was $3.47 a gallon. january 2024, $3.96. 4.1 increase. this is really where you get into it.
