talking about texas going blue for some time it hasn't quite happened. so the campaign does note he will be hitting a lot of the swing counties farther out west, but, as those texas stops are concerned, probably a little money. brian. >> lawrence: not going to win texas. >> lawrence: ticked off texas about the border. >> brian: trump at 48%. bush 41, 39%. jimmy carter 43%. is he at 38%. >> steve: not good. >> brian: behind the scenes he has blown up since january. how can my ratings be so low. how come, you know, people don't understand the things i have done? he also told him to punch up the speech and talk more about his glishments in the state of the union address. so, we keep hearing about his temper behind the scenes lawmps lawrence a lot of people lying about the president about the reality of america. paul krugman released a piece in the "new york times" yesterday.

the bond. and this creates a sort of perverse incentive for judges like this one who comes up with this astronomical, in my view ridiculous level of. >> brian: in anybody's view. nobody thinks that number is good. >> right. but in order -- basically his position is in order to get any other judge to look at what i have done to you, you have got to come up with basically a half a billion dollars just to appeal. it's like a judge saying i'm going to take your house away but you can appeal my decision, you just have to sell your house in order to do it. it doesn't -- many people look at this as a type of almost mob justice. as, you know, the attorney general ran on bagging trump. she is now pledging to seize his property just because he can't come up with this bond. at some point the courts have got to step in and say, look. this is enough. you are requiring this astronomical bond just for this

guy to be able to get any other judge to look at this decision. >> steve: sure. jonathan, get in the way back machine because you just perfectly set it up. she ran on getting trump and here she is back when she was running before she tried to get trump. watch. >> no one is above the law! including the illegitimate president! [applause] >> and so i look forward -- i look forward to going into the office of attorney general every day suing him, defending your rights, and then going home. >> i say one name, trump. that should motivate you. [laughter] >> will you sue him for us? >> oh, we're definitely going to sue him we're going to be a real pain in the [bleep] he going to know my name personally. >> president trump cannot avoid justice in the great state of new york. >> steve: okay. so there she is. then you look at today's "wall street journal" and they are echoing something you have said and that is whatever is transgressions, jonathan, defendants are entitled to due

process, which includes the right to appeal. the appeal has not run its course. and it goes on. but, you have been talking about how he is not getting due process for months. >> right. look, you don't have to like donald trump to be appalled by what we're seeing. i can't imagine why any business in new york would want to continue to do business in new york, including these banks. could you imagine being the bank that gives this bond to trump whether you have got an attorney general who is just laying waste to the land. these banks don't want to get in the crosshairs as the next target of letitia james. keep in mind what you just played by james walls a campaign based on selective prosecution. selective prosecution anathema to the rule of law. she actually ran on that. she pledged that she would get trump without saying what she would get him on.

she just pledged i'll bag him for you. >> lawrence: jonathan, i hate to interrupt you. but you go to the crutch of the argument. what is the legal recourse for that? we just played the montage. said on the campaign trail made it very clear is there anything legally that can be done just on that? >> >> it's very hard to make out a case of selective prosecution. i filed a couple of motions like that against prosecutors. judges don't like it. they don't like getting into the motivations. but the threshold issue here is just a basic due process of requiring confiscatory bonds in order to just secure an appeal. and this could end up going beyond the new york system. they could appeal this all the way to the supreme court. on occasion the supreme court has intervened in state actions. for example, on punitive damages. and said at points damages could become so high they deny someone due process of law this is

falling into that extreme category in my view. i find it appalling. it shocks the conscience that you have to pony up this type of money just to get someone to look at what you believe and i believe is an excessive ruling by this judge. >> ainsley: um-huh. it's a lot of money. he has to come up with it by monday. that's in new york. let's go down to georgia where the lawyers for trump and 8 co-defendants. they filed an emergency appeal in the fani willis case. they are trying to disqualify her, again. and this is from trump's lead defense counsel. the notion notes that the court found that willis' actions created appearance of impropriety and odor of audacity that lingers in the case nonetheless refused to dismiss the case or disqualify her will they be able to disqualify her through this appeal or will this happen? >> >> well, usually the courts will prevail on this. but the question is whether the trial judge will give leave to

appeal to do an interlocutory appeal which is relatively rare that will further delay the case. you know, basically, willis has been playing game of chicken with these courts. she has refused to remove herself, as she should. and she succeeded. you know were the judge knew if he disqualified willis, he would likely have had to disqualify the entire office. and that's quite a cliff to go over. and so he blinked. and they are going to ask courts to look at this and say how is this coherent or consistent? you know, you indicated that wade, his answers were less than forthcoming. some people believe he committed perjury. but she adopted his answers. they testified largely in tandem. so, if he was saying something untrue. she was saying something untrue. but, more importantly. thattance of impropriety does not end with nathan wade. these two are joined on this appearance problem. so, we will see if he gives leave. if he gives leave, then this

thing is not going to see a courtroom for a trial before the election. >> brian: yeah, we will see. if i was going against somebody, i would like to maybe go against her already so damaged her credibility so destroyed and she does not seem as though she is great legal mind. >> that's the best situation for trump is that she is, indeed, carrying more luggage than amtrak and maybe that's what you want. >> steve: great line. >> brian: jimmy failla is going to use that a little bit later. thank you very much, jonathan turley. appreciate it. >> lawrence: also comedian. >> brian: when trump and the bond he is trying to get down to 100 million. filed a 5,000 page. they got five days to get back back to him. you don't think it's a huge hail merry to look at this and say is the goal to get him to appeal? we know he is not going anywhere. his things aren't depreach united states.

government's platforms and censorship fears. >> that the government actually has a duty to take steps to protect the citizens of this country. >> you can't just sort of pick and choose which part of the government you are concerned about. >> encouragement would sweep in an awful lot. >> what do you with the fact that the platforms say no all the time to the government? >> brian: here to react louisiana governor jeff landry who helped file initial suit as attorney general and was there for all the arguments. governor, your thoughts about your chances of having this go through? >> you know, i sat in the court yesterday with congressman jim jordan and congressman dan bishop and we left there almost needing one of the cry rooms y'all talked about earlier today. the fact that some of these justices i just felt like they were going through an academic exercise rather than understanding the real life implication for tens of thousands of american citizens who were being censored on the internet and on these platforms. >> the things that this case uncovered, you know, a couple years ago when we filed this

case, then u.s. senate -- then attorney general eric schmitt and i, people laughed at us, said they thought we were going to be laughed out of the courtroom. yet, here we are at the supreme court and the things that we have uncovered. i mean, this was a case under which we found the fbi knew they had hunter biden laptop but yet let the social media platforms censor the "new york post" story, remember that they censored many americans who thought that the covid-19 virus came out of a lab leak and they censored that. and, yet, we find out today that that is most likely the case. they censored all kind. >> brian: you have all these people that were posting things on down then they end up getting shadow banned or banned or censored from tomi lahren, we know that so their argument is. this the government is like hey, i'm here to protect you. if someone starts posting things that hitler is great and we need a new hitler -- we need a new

hitler like leader to take us to the next level as a country, do you think the government should call up and say hey, facebook, take that down? >> what the justices seemed to not grip is that the federal government, all the agencies and the white house, they have an x account. they have a facebook account. they have got public service advisories that they could go out and talk to the american people. in fact, they could also talk to the social platforms and say, look, why don't you amplify this message because we believe that there is content on your platted forms that americans are getting wrong. but, yet, the justices seem to not grip the fact that the government doesn't have the ability to balance that message. and they forget that many americans distrust the government because of exactly that. >> brian: so, governor, here's an example. the president over the weekend said if when it comes to these car companies if you let china have free access to our markets, it's going to be a bloodbath. and everyone -- some people are misinterpreting and think that the president is calling for

violence on the streets. they might post that on facebook. they might post that on instagram. and then will this government, who happens to be running against donald trump who said it, will they decide we got take that down, it's not safe for america to read that? >> brian, you're exactly right. that's the problem here. the platform should be con dent neutral. and the justices seem to not be able to grip the difference between publishers, newspapers, and the media and social plat forms, which basically operate like virtual public squares. and they seem to want to allow the government to suppress citizens' rights to express their concerns about things that the government is saying or doing. >> brian: right. >> if the government disagrees they take them out in the public swear. >> brian: add this the media research company came up and did a study. they found that google has interfered with elections 41 times over the last 16 years. amplifying certain searches and decreasing. helping barack obama and hillary clinton, and hurting republicans. and that's what the media research found out.

>> ainsley: yeah. >> kurt: where it really goes wrong is how it's deciding who gets the voice inside of this. what i love is what we could learn from europe. they always seem to be a step ahead of us as washington continues to fail us. whether it's the white house, congress, executive branch, doesn't matter. we're just really not being looked after. what they do in europe is quite simple. if you have an algorithm, they have a body of people separately that look at that algorithm. they have full access to it. they are independent, if they see something wrong, they raise their hand and say hey, that's not right, ainsley is able to get her voice out there but kurt can't. or the other way around. they have an opportunity to correct this it. and they can't -- >> ainsley: i love that model. we should definitely do that here's some examples of what they found in 2008 if you googled obama, there were articles that favored obama over john mccain. in 2012, favoring obama over mitt romney. in 2016, algorithm excluded

potentially damaging auto results, auto fill results for hillary clinton but not for donald trump or bernie sanders. and in 2016, working with partners to help likely pro-clinton latino voters go to the polls. does this mean if you google hillary clinton positive articles are going to come up if you google donald trump any article including the negative ones would come up? >> kurt: it does mean that and it also means this is that auto fill thing is very important. you and i go, we start searching, and do you know how it completes it for us? well, mine completed in a way that steers our mind in a completely different direction than the truth. >> ainsley: yeah. okay. let's talk about apple. because during the antitrust trial, we learned that google was paying apple 26-point # billion dollars to make google our default search engine on our iphones. now google is in talks with apple to use their a.i. which is google gemini for iphone ai tools. does this violate or raise
