poisoning the blood of our country. what the hell is he talking about? >> polls have shown republicans have made real inroads with latino voters. biden says he desperately needs the voters because states like this, arizona, is going to come down to a handful of states the entire election so he needs arizona. biden has been criticizing congressional republican force blocking the bipartisan immigration bill. the trump campaign and republicans have ripped this white house for reversing the trump administration's border policies. as there is continued criticism of this administration's border enforcement. >> texas, s.b. 4, operation lone star, they are doing more to help protect that border than everybody except maybe the frontline of dhs and they wouldn't need s.b. 4 if the federal government was stepping up to its responsibilities to protect that border. >> while in arizona today, biden is going to talk economy. announce $20 billion in grants and loans for the intel company to build manufacturing and

semiconductors here in the united states. steve, ainsley and brian back to you. >> steve: it's about the chips. hey, rich, so he is in arizona. and he is going to texas. the number one issue is the border. he is not going anywhere near the border. they are blowing it again. >> no border trip on this trip. >> brian: part of the reason is it's more of a negative than a positive. he wants to lean on legislation that never even got a vote in the senate. rich, thank you. what he just basically said from what i could see his message to hispanic voters were come on, you voted for me last time, do it again. he talked about housing, affordable housing. house something really not a good story right now in america. whether it's the interest rates, whether it's the lack of inventory. i'm finding it hard to believe that he is going out again trying to yell people into thinking the economy is better. his numbers say it is. people aren't feeling it. >> ainsley: biden, if -- he flip-flops on this. because he looked at -- he has been for open borders. and then he looked at how

americans reacted to that. especially as we got closer and closer to these primaries. >> steve: right. >> ainsley: he just started talking about immigration more. but then, overnight, it was his administration that filed this emergency application, saying, okay, the supreme court said if governor abbott, if the texas police, if they find an illegal immigrant, they can be arrested and then a judge can decide if they are going to be deported back to mexico. they said we don't like this, so they -- so they appeal it, the three judge panel from new orleans says that s.b. 4 should be blocked. a vote of two to 1. one of the guys who said the vote needed to be blocked was appointed by joe biden, one of these judges. >> steve: well, ainsley, you know, you set it up perfectly. here's the thing, last night, when we went to bed, and this is why we need a flow chart it, looked like a win for governor abbott. and people who want a strong border because the supreme court said, essentially, you know what? we're going to let the texas law be in effect until they exhaust their legal challenges. but then in the ruling, two of the conservative justices in the

majority on the supreme court said, you know what? we might actually intervene -- we ultimately want to decide what is going to go on after the fifth circuit in new orleans does something. and then the fifth circuit read that, and a couple hours later they said, you know what? we are going to do something about it right now. we will have oral arguments this morning. and so, once again, there is, you know, even though texas is doing everything they can to stop the flow of migrants, the federal government is doing everything they can to stop the state of texas. >> brian: crime is an issue with people coming across the border. that's when the president speaks and comes out and says originally mexico is not sending us their best. oh my goodness he hates hispanics no. he doesn't like people that try to break into the border and some of which are criminals. then he says the illegal immigrants, the migrants that poison the blood of the country. not all, everybody understands trump at this point, is he talking about people here like

ms-13 or some of the -- he said people aren't human, like the man and his brothers that have murdered laken riley. that is what is he referring to. so, joe biden's best play is look at the rhetoric that president trump is using. and the people say i'm not taking it personal. is he not talking about me. they see the difference. and that's why in the latest poll, from siena, "new york times," the president not only is close on the hispanic vote, is he winning by 6. beyond the margin of error. >> steve: there you go. >> president trump is. that's one of the reasons why joe biden went to a mexican restaurant in phoenix, arizona to press the flesh and try to say hey, i'm doing a good job. >> brian: aren't the best tacos at trump tower hasn't that been decided? >> steve: taco salad. >> brian: i stand corrected. >> ainsley: might be closed down. >> brian: what if she keeps the same menu. >> steve: that picture was on cinco de mayo which is coming

administration won't do, and is he trying -- you know, cutting the wires that they are putting up. fighting them in the courts. making this difficult to stop the flow. he clearly wants this. it's intentional. and he is not just losing hispanics by the way in arizona and in texas who are feeling the firsthand effects of the border. as you know, the impact of the border is happening now, you know, if you live in new jersey, if you live in new york. if you live in chicago. you are feeling it there. those are border states now because so many of the migrants are being fe flown tax dollars o those states. in addition to that, another interesting thing, virginia is an important state. with a lot of hispanics. a lot of el salvadorians. you just did that story on el salvador and the way they have kept crime at bay there they have made it the most safe country from the most dangerous to the safest country in the western hemisphere. if you don't think that the people in el salvador are telling the diaz pra community

in virginia who is dealing with high time in d.c. and virginia area what's happening in el salvador, they know what it takes lower crime. it means you neeeed cops. you need consequences. so that is also impacting -- they don't like the president. when he came to d.c. for the cpac. the biden administration was not happy with him or mele also using many of these tough on crime policies. they got the cold shoulder from the biden administration because they know they are tough on crime and it makes them look bad. >> ainsley: locking up all the gangs. so joe biden has this three-day swing through nevada, arizona, and texas. is he launching this new latinos con biden and harris. and is he running these campaign ads in english anding spanish and spanglish. campaign organizers many of them in place in arizona. his campaign hired more than 40 staffers for nevada and arizona. this is what his message to the latino community. listen to this and we will get your reaction. >> you're the reason why in large part i beat donald trump.

will she win? >> listen the powerful of incumbency a powerful thing. i think if there was a really strong candidate, she would be in trouble. at least especially in this neighborhood. now, she doesn't have a congressional office in this neighborhood. i have to tell you, it was shocking. i arrived around 9:10 a.m. in the morning. the prostitutes as you just saw some footage of it, the prostitutes are already out. people complain that they can't walk and feel safe after 7:00 p.m. at night, which means many of the businesses have to close. you see some of those vendors out there on the sidewalks. i talked to restaurant owners, business owners, they said, listen, they are selling even liquor. they said to me think about how much i have to pay for liquor license and they are selling liquor on the streets with no license, no health inspectors for the food being sold there as well. so, you know, they basically feel like it's turning into a third world street. this used to be a very nice, family-friendly district.

a huge problem, guys. for so long we have told you the problem on the southern border. obviously, it's an easier journey to travel across the rio grande. now you have another crisis in haiti, every time there's a crisis that breaks out in the country, you see those folks come across the border but they are coming by sea. and it is a dangerous journey. i talked to the florida fish and wildlife yesterday as we did a ride along, patrolling the area. and they said the time to come across on those boats, they pack hundreds of people in these boats, and it takes five to six days. they try to stop some of these boats, the coast guard does. but, if they can't stop the boats, then florida fish and wildlife steps in and allot of times it turns into a rescue operation because these folks then stop -- not even docks but places where they see some sort of land. and then there is a five to six mile swim. of course a lot of them almost

subway train. despite witnesses describing penny as a hero. alvin bragg is pushing forward with this case. happening today on capitol hill, several of hunter biden's former business associates, including tony bobulinski set to testify before the house oversight committee it. is the latest phase of the biden impeachment inquiry. the president's son was invited to testify as well at hunter's request. but his lawyer has rejected the invitation. the committee says the hearing will go on with or without the first son. lawyers for former president trump and eight co-defendants have filed an emergency appeal to remove d.a. fani willis from the georgia election case. the lawyer who initiated the effort to remove ill will his joined us earlier a "fox & friends" exclusive interview. >> i definitely think she could be disqualified. this commission in georgia hopefully looking into this and they could disqualify her. there is a lot of over avenues that the judge even outlined in his order. lots of over people are looking at this. she is facing re-election. she has two opponents right now.

leader of the free world, still a very powerful and wealthy man who has unlimited resources at his disposal, what hope does the average person have? i was talking to someone over the weekend a woman who owns elder care agency. shoe is not in washington and in politics. she told me she likes trump. i asked her what do you think about all these cases against him her immediate reaction was they are not doing that to him. they are doing that to us. i think that's a very real concern of americans. it should be. whether you are a republican or an american, if you don't have a free and fair justice system, which in new york right now we do not, you don't have a free country. >> brian: a couple of options. they say he could declare chapter 11 bankruptcy. he doesn't want to do that insiders are also saying that trump is thinking about doing nothing and letting things just see and see what's going on about what you just said. see the attorney general walk over and say trump tower is mine and think about it. we're not saying -- there was one verdict. but he has great shot at an appeal. if he wins the appeal and they

have his assets and they sell it, is he just out of luck. even though he wins. >> totally. evidence loses his building. let's talk about this bond for a second. you know, this crazy half a billion dollars bond? it's not like donald trump is a flight risk. right? so it would be perfectly reasonable and by the way consistent with how courts operate to work out something with him where they can reduce this bond or honestly waive it all together. and the fact that new york is so unwilling to do that it's just -- it displays a blatant partisanship that is frankly very disturbing to me as a lawyer, to someone who worked at the department of justice, to see the fact, to see these judges and lawyers abuse the law in the way that they are. against this -- against the former president. >> brian: we will see if he does nothing and looks like a bully, chapter 11, giving him some protection, or this judge will step up and say, listen, it's

excessive, knock it down to 100 million and do the bond at 100 million. but no bank will do it and guess what they are afraid of retribution being the bank that helped out donald trump and being in new york. i thought that was really significant. so, that's one thing. politically, i think the president benefits from this. look at his enemies, no one is comfortable with this. i look at kevin o'leary, kevin o'leary says the word is out, you don't do business in new york. it's just not worth it. let's say you have some views that are conservative. and that gets word to this mayor, or the attorney general. or the governor, then you are in trouble. and it's just not worth it where you could do business in 49 other states or maybe another country. how about this? a judge, an obama judge has ruled that illegal immigrants have second amendment rights? so they can go get a gun. tell me about the different wrinkles to this judgment. >> brian, you can't make this stuff up. okay, so there is a federal law on the books that says that people who are non-citizens can't possess firearms.

very straightforward, makes sense, right? common sense. we all understand. this well, this judge in illinois took a look at this law and she declared it unconstitutional as applied to a particular illegal immigrant because here's why. she said well the law itself is fine. it's constitutional. but, you know, given some recent court rulings that by the way have nothing to do with illegal immigration just have to do with firearms. looking at those, i think we need to take a look back at american history and make sure as applied to this gentleman it's okay. so do you know what she did? she went back and looked at the american revolution and apparently then, some british loyalists were assessed and they were determined to be nonthreatening and they were not dangerous so they were allowed to have firearms to defend themselves at that point. so she said because of that, this individual, he's not a criminal, he has a job, so, you know what? he can have a gun. and it's fine. >> brian: nuts.
