let's kick things off. fox news alert. today deadline today for former president donald trump to pay his $454 million bond in his new york civil case. >> carley: that's right. if he doesn't do it, the state could begin freezing his bank accounts and seizing his assets. >> brian: besides that, not much at stake. eric shawn at the courthouse where the president former president is expected to appear on unrelated case. >> today is d-day. former president trump supposed to come up with $454 million bond that his lawyers say they can't get because it is too much money. as you said, we do expect the president to be here at manhattan criminal court later on this morning. that for the stormy daniels election interference hush money case. his lawyers that case throwed out or at least delayed by 90 days. supposed to start today but the judge gave them a month delay because the feds did not turn over about 100,000 pages worth of material dealing with michael

cohen. as far as attorney general letitia james she could start attaching mr. trump's assets today because of that fraud being found liable for committing real estate fraud for years. here is what the former president says on truth social about all of that quote. letitia james has a terrible record on violent crime as new york state attorney general. she goes after trump for doing absolutely nothing wrong. well, judge arthur engoron found that president trump as well as trump organization did do something wrong, they falsely inflated the value of their real estate deal for years in order to get better terms on loans. that is why the judge socked him with a $454 million fine that the ill gotten gains, according to the judge. so what happens today in the attorney general can post deadline, do several things. one, freeze trumpens bank and brokerage accounts. collect rent from trump's tenants. seize trump's new york policies. the president still has some

things he can do. he can appeal to higher court. sell the properties to raise funds. also seek financial assistance from multi-supporters and he has got another ace in the hole. that has to do with his truth social site. truth social today will go public and that can net the former president up to $3 billion but he can't sell any of that stock for six months, unless he gets a waiver. meanwhile the attorney general has already filed a judgment beginning the process on the seven springs estate. that's in west chester county. so that could be the first property to go. ironically, trump tower may not net her that much because it is a condo. the condo owners own those apartments. the former president's company owns the commercial space and of course the former president has his three story apartment in that building. meanwhile we expect him to be here later on this morning. we will see how that hearing goes. as long as this continues, while he even has his appeals ongoing for, this still cost him about $100,000 a day in interest.

so the interest from the payments are racking up. see what happens here later at court when the former president arrives. >> brian: bring in elliott a former state prosecutor who worked in the manhattan d.a.'s off the. elliott, great to see you. first, let's talk about the 454 million. >> sure. >> brian: the president has until what time today to post that bond and what changes on tuesday if he doesn't? >> well, right now the ball is in the appellate division's court. i don't think anything is going to happen until we hear from them. they typically issue decisions on tuesday and thursday. >> brian: do you think letitia james cares about that. >> she may not have a choice. they have broad discretion and they could delay it. they could reduce the amount. they could waive the bond all together. although i think that's extremely unlikely. very foolish to take any action while we are waiting for the appellate decision. >> carley: what do you think the asupreme court decisions will ultimately. >> trump given good faith indication he is close to

getting the bond together they will give him more time. >> steve: so you said they for the most part work on tuesdays? >> right. >> steve: what a difference a day makes. tomorrow could be the day that the appeals court says something or it could be a week from now. >> right. >> but you but, for the most part, given the fact shoe she would get so much bad pr from trump and others if she did not wait for this to play out, you know, judicially, but there's a -- she probably not going to do anything. >> no. there is a process here. she can't unilaterally start grabbing stuff it. just begins the process. first send out speaks to the financial institutions and figure out where bank accounts are and brokerage accounts are. those subpoenas have to come back to you. then you go to court judge engoron to get a lien. it takes months even a years to make a dent in substantial amount. >> lawrence: congresswoman in new york a.o.c. had this to say about seizing trump's assets. watch. >> i think what we are dealing

with politically is the much larger and much more grave and serious pressure of having this judgment against donald trump and him being in this degree of debt and the financial pressures that he is under and what he is subject to do in order to obtain those assets, i actually think that whether -- i actually think that there is risk in not seizing these assets and the open window that exists in him trying to secure these funds through other means. >> lawrence: that was a word salad but the question is that a proper legal argument? >> sounds like she is trying to deny him the same basic right every litigant has. >> steve: due process. >> due process. we don't have preventative it in this country take away they might do something corrupt. >> brian: just real quick. you think it's unlikely for them to reduce the total, correct?

>> right. yeah. >> brian: even though they put 1,000 page proposal different examples much different times reduced from 38 million to 10,000. >> i think it would be a wiser course for the attorney general because searching for some of these real estate assets and untangling this webex extremely complicated and expensive. wiser courts would be to consent to a reduction if he is can put up a significant reduction. >> brian: without the court? >> the parties can agree to it without the court. >> brian: she is not into that. >> lawrence: possibility of this going to the high court, the supreme court, when you look at rgb's opinion back in the day, and civil assets forfeiture has been under scrutiny for a while. do you think the high court could overturn all of this? >> yeah. even though it's unusual for cases to make it to the supreme court, when you think of the eighth amendment prediction against excessive fines, what doesn't fit the gilbert than this as excessive fine? >> steve: yeah. >> carley: there is a chance that donald trump already has all of the money squared away.

he said that he has already almost $500 million but he just wants to use it on the campaign trail. if he does have the money, he might be withholding it for the time being until the appeals court makes the decision. also, because it benefits him politically because a lot of americans see this as a huge overreach on the part of letitia james. but is he ultimately, if the appeals court doesn't rule in his favor, going to have to pay this massive amount of money. what will that look like? is that one lump sum all going to la tissue a shah games' office? >> no. it's actually -- it's held by the court. equivalent of an escrow account. >> steve: right. so, elliott, last week, on friday, we read the truth social thing from trump that said i've got -- you know, i have worked hard my whole life. i've got the money. i have got the money. at the same time his attorneys are arguing in legal court documents he does not have the money. >> right. >> steve: okay, so what happens now? because, you know, going

forward, it's like have you guys talked? >> the attorney general's office is absolutely going to point to that statement lean on that statement to claim that actually he does have the money. so, i'm sure his lawyers were not happy when that came out on truth social. critical condition critical condition trump wasn't referring to cash on hand. >> right. >> >> carley: elliot, you mentioned something that is really important that i don't think a lot of americans have considered yet. by no fault of their own we're in real unchartered territory here. suspects that this is a complicated thing for la tichina shah james to do. it takes time. if takes resources, and this is taxpayer dollars. how much money are we talking about here? >> there is no doubt in my mind that they reached 8 figures on this. but chasing these assets will make it a lot more expensive. some of these real estate assets may be completely off limits. if he has put his equity interest in irrevocable trust you will spend years trying to untangle ll cs and it will be for not. >> steve: donald trump is going to appear in another courtroom

involving the stormy daniels hush money payment. >> right. >> steve: last week the judge said okay. new documents. we will give him 30 days. actually, that was the d.a. so, what's going to happen today. >> you know in your guarded variety criminal case if a defense lawyer walks into court and says judge i need this many weeks and months to go through the discovery material yeah, sure. that's the safer course for a judge. takes a way a potential appellate issue. nothing typical about this case. prosecutors are going to argue very little of that discovery material related this case. >> lawrence: how unusual is it for a prosecution's office to not get the discovery from the feds before they go with a case? don't you want all the ammo possible if you are going to bring a case? >> something broke down here between the d.a.'s office. the u.s. attorney's office and the fbi. we haven't really untangled whose fault it is. you should not be getting 170,000 pages of discovery once a trial date has been set.

the train is coming and she is not embarrassed at all. what do you make of that? >> that was a little surprising. i think i would be embarrassed if i had an affair with a married man and it was on national tv. that's okay. i understand the train is coming. we are ready we will be ready whenever the case goes to trial. hopeful that it doesn't interfere with everything else that's going on in the world. but we are ready when the case comes forward. >> she says that she has prosecutors essentially who are still working on the case. >> but, it just hangs in the balance because we don't know where it's going to go. can you bring us up to speed on where we are in this case because last we heard judge mcafee the guy who said it's either wade or willis. one of have you got to leave. it sounds like he is weighing a bunch of different stuff. you want this to go to an appeals court to say hey, she has got to get off the case, right? >> right, right. that's where we are really steve, judge mcafee said there is a lot here but i'm not going

to find that she is dqed so the case is now going to go up to the court of appeals. the court of appeals can decide they can either send it back and say you are disqualified. you need a new prosecutor. they can send it back and say judge mcafee you actually made some errors. we think the actual, you know, impropriety here is enough and tell him to go ahead and fix it or think could say we are not going to decide this and then go up to the supreme court. so, you know, it's not going to be decided quickly. it's going to take at least a couple months for its to work its way through the system to determine whether or not she actually is disqualified. >> steve: does this happen before the election? >> i don't see any way that this could happen before the election. i mean. >> the appellate process takes about six months once it's initiated and we are not even there yet. we are still early i on in the stages. i don't see how it could happen that quickly. plus, ms. willis has charged this case extremely overbroad. no trial is going to happen and be resolved before the election. so what they're looking at is actually having someone running

for office, running for the office of president being on trial. that's unheard of. >> steve: right. ash lee, right now it looks like. the case of the four cases facing donald trump right now. it looks like the strongest case to happen before the election actually has a court appearance today. donald trump is going to be in a courtroom here in manhattan, lower manhattan later today as they try to figure out exactly what the schedule will be for this -- the hush money stormy daniels case. i know it's hard to keep track of all the different cases, but, and i know you don't think this is a strong case, but it probably is going to happen before the election, right? >> this is the most likely case. if something is going to happen before the election this is the case. this is by far the weakest case in my opinion out of all of the cases. it's ironic that this is the one they are pushing forward and

this is the one that's going to be heard. the issue is not delay caused by the defense. that's what a lot of people are saying the defense is asking for a continuance. no, it's actually the state is just now handing over additional evidence. so, if they wanted this case to push forward quickly, they could have gotten all that evidence together. >> steve: right. >> the state can coordinate with the government and get all of this information. have it ready to go forward early on and then you north having all of these delays. they are creating opportunities for the defense to say we are not ready and that's reasonable. >> steve: as we were talking to a former state prosecutor a little while ago. ultimately, the trump side of is going to say, look, there is over 100,000 documents and then alvin bragg is going to say there is only like 300 that really are germane to this. let's see what happens. but ultimately it, comes down to the case where it sounds like alvin bragg asked the people who looked into michael cohen, they said hey, give us all the stuff you have got on it. apparently they didn't until the

11th hour. and it sounds like the feds, when they were doing the prosecuting of this guy, it sounded like they were reluctant to go forward and charge mr. trump because in that particular hush money case, the star witness would be michael cohen who has some credibility problems they say. >> right. and there's two things there. so, michael cohen is the star witness. that's the evidence that you need more than anything. i need that evidence. and that's what they have been withholding. plus, even if they are saying there is only 300 relevant documents that doesn't mean there is not a document relevant to the defense. the prosecutors aren't in the defense's head. if they give thousands of documents. the defense lawyers have an ohave a dutyto look at those 30. government we are going to trust you on that and ignore the rest of them. that's ridiculous. they have-to-a job to do. they have to look at every page of that document. >> steve: busy day in the courtroom. ash lee, thank you for joining

cancer. when should women begin and what sort of tests should they be asking for? here to answer those questions on this medical monday is fox news medical contributor dr. marc siegel. dr. siegel, good morning to you. usually when something big like this happens awareness is raised and that's a good thing. when should women start screening for cancers and what sort of tests should they be asking for. >> as you said this is very important that she came forward. very big public service. consciousness and awareness raising for young women. women should start with cervical cancer screening at the age of 30 or earlier. i mean, pap tests over two or three years. make sure you don't have hpv which is a human papilloma virus. you want to get vaccinated against that when you are in your teens. that's hugely important. the number one cancer of women is breast cancer. 240,000 cases per year. people might say kate middleton is 42 years old. we are starting to see cancers in younger and younger women.

you our own nicole saphier one of the top radiologists? the country insists on screening breast cancer 40 and above. use mammograms. ultrasound in the 40 to 50 decade. >> carley: are these things patients should be asking for or typical when you go to the doctor they say now is the time do it? >> doctors should know it. >> carley: they look at your chart and age and say let's do it nownkts patients should be their own advocate. other things. personalized medicine means i have got to know your genetic background did. your father or mother have something very young. i may send you for genetic testing. bowel squeeze, colon cancer. start 45 but earlier if they have genetic thing. ovarian cancer if had you brca gene i might screen you or ovarian cancer younger. hard to screen for that there is

a blood test can i do and do ultrasound. >> carley: the way that she phrase her cancer diagnosis in the video that she released she said she found it had been present and did a round of preventative chemotherapy. that sounds like a pretty positive diagnosis or should i be reading this a different way. >> that's how i'm reading it. preventative means it's not there now. >> carley: doesn't have cancer now. >> what she is saying i suspect she does not have it now. they got rid of it. they found it after that operation. probably on pathology. they got rid of it. now you get chemo to make sure it doesn't come back. we do that all the timed a gentleman mavunga chemo if you do it early and that kind of chemo chances extremely high yoe cases right know surpassed the 2023 level entirely first of
