presidents barack obama and bill clinton. >> bill: karl rove and mark penn have analysis. but we begin with bryan llenas on long island covering jonathan diller's wake. the police union telling city politicians they are not welcome there. bryan, let's begin with you. good morning. >> bill, the wake is being held at the funeral home behind me today and tomorrow. it is a difficult morning for the family of officer jonathan diller, his friends, colleagues and hometown here in long island. a ten mile long thin blue line has been painted on the streets. blue ribbons and american flags seen throughout the entire community. they hang in support of officer diller and the police. diller leaves behind his wife, stephanie and infant son. last night hundreds showed up for a vigil to honor them. many first responders live here.

officer diller was killed monday during a traffic stop when he was shot in the stomach below his bullet proof vest. 31 years old and joined the force three years ago. here is officer diller's brother-in-law at last night's vigil. >> he loved what he did. he was born to be a cop. he was born to be a hero. he died being a hero. he died doing what he loved. i will forever -- forever be a better person because of him. >> the two suspects arrested in diller's murder have dozens of prior arrests and were out free on the streets. the driver charged with criminal possession of a weapon and for possessing a ghost gun. former president trump is coming to the wake. he was moved by the invitation to join diller's family and colleagues. he offered his heart felt prayers and said the suspects should never have been let back on the streets.

"new york times." is on the phone to strategies. is tonight necessary, karl? >> well, you need money to run a campaign. they have a big financial advantage and we know everything about both joe biden and donald trump. so the question is how are they going to spend the money? if they spend it on ads utility to that. if they spend it on the ground game and organizing in the seven battleground states it could help the democratic campaign identify target voters and get them out to vote. >> dana: mark, what do you think about the money race and also about the fact that at this event today you could see some protestors at least outside very upset about israel and gaza? >> there is a real campaign

about the issues and the campaign about the campaign. who is more negative, who is raising more money. fundraising goes into the campaign about the campaign. who is raising more. you don't want to tout you are bringing in fat cats, that you are having a star studded event. there is a campaign day when you are kerb-when crime is one of your biggest issues, seems to me to be a much better campaign day rather than playing up an enormous fundraiser with star studded former presidents. i don't think it does anything for the campaign. maybe it does something for the coffers. there are a lot of low key ways to raise money to make more sense to me. >> bill: you have been looking at the data. fox polling out last night at 6:00 shows this. trump gains in a two-way match-up with joe biden, he is up five at 50%, a critical number that you both look at. third party spoiler as of now,

trump -- you see kennedy at 12%. trump at 43, biden 38. it is still a margin of five points. karl, what are you seeing inside these numbers today? >> two things. one isn't it interesting that robert kennedy junior takes an equal number, seven points, from both joe biden and donald trump. that's interesting to me. second the big question is how many states is robert kennedy going to be on the ballot? this is -- we won't know for a while. you had to pick a running mate to get on the ballot in 20 some odd states. we don't know how many states he will be able to affect the election. it was very interesting that right now he is taking from both. we'll see if that's the case three, four, five months from now and also see how many state ballots he actually gets on. >> dana: dnc has an official office to go after the third party candidate issue. there are others besides rfk.

president trump also came after rfk, junior. together can they get their wish and get r.f.k., jr. out or marginal in his impact? >> he seems to have a pretty marginal impact. he is a fairly liked alternative candidate breaking double digits. 15 gets you into the debates if there are debates. this is a pretty surprising development that he starts out in double digits like that. it is surprising but i've seen. if i were the dnc i would worry about the other four or five points that biden is behind. what is the campaign doing about the poor job performance, inflation and immigration? by the time you get to the effective third party candidates, who knows? he could shoot up like a firecracker and explode and shoot down. it is unpredictable. the one thing you know is that

the job ratings in the low 40s has issues to make up on. that's what they should be focusing on. they pissed r.f.k. off. if they hadn't done that before he wouldn't be in the race. >> bill: some of the language they used over his announcement is over the top stuff. these are our power rankings that include toss-ups and leaners, okay? note in the upper midwest there we have michigan and minnesota leaning democrat but there is something we're watching right now. karl, do you see something moving in minnesota today like some republicans say they do? >> well, unfortunately i've seen minnesota appear to move in previous races. we'll see. it does -- minnesota is more like wisconsin than it is michigan. a little surprising to put it in the same place as michigan but look, it will be a very close election and we're going to have some surprises. i think georgia is looking redder than it did four years ago and nevada is looking redder than it did four years ago.

ends. it pushes more migrants trying to illegally cross out this way. officials say it is taking a toll on their schools. just yesterday our cameras captured this small group located near a middle school. it went on lockdown as border patrol searched for the migrants and rounded them up. the fire chief here tells us it has become a regular occurrence with campuses going into secure mode as a precaution which worries many parents because officials say a different kind of migrant crosses in this spot. >> the migrants when they make their way over they'll hide in backyards, trash cans, against buildings and schools. the vast majority are good people looking for a better life but again, we've seen the statistics. we know that there are bad actors in those groups. >> officials say most of the people apprehended in this area are trying to go undetected.

dozens of others over that incident that proves you can find them, you can arrest them and they found them. music mogul sean combs laying low after two of his homes were raided. the "new york post" reported he was about to go on a caribbean vacation when his daughters -- with his daughters when the raids took place. investigators saying it was connected to a federal sex trafficking probe. diddy denies any wrongdoing. william la jeunesse is back on the story. it is all the talk in los angeles again apparently. >> those close to the case tells reporters this is not a witch hunt. the sexual abuse and trafficking allegations that prompted the investigation are already contained in five lawsuits. a judge, of course, signed off on the warrants to search combs' homes in miami and los angeles. that included his phone, which police reportedly seized when confronting him monday in miami at the airport. now investigators are likely combing through a mountain of

have president biden's approval at just 47% regarding the israel and hamas conflict from democrats. you've seen this evolution. it is also an election year and seen the protests happening. israel and america are allies but it's a strained relationship right now. where do you think biden is going with this? >> well, you know, you're right in some ways, dana, certainly it has been the slow evolution. i remember i was actually in the middle east headed to israel. i was in the middle east on october 7th so i saw the state department tweet and later deleted the tweets but tweeted that basically all sides should refrain from violence. this is hours after the attacks. you have seen people throughout the biden administration that have been pushing since day one of the attacks for president biden to change his policy on israel. you also have to remember that most of the people running biden foreign policy are former obama administration officials. these are people that basically

hate netanyahu. they got into it with him over the jcpoa the iran nuclear deal. that hatred is what we see playing out now. they think for some reason they are entitled to patronize the state of israel. the only real democracy in the middle east by calling for regime change there. essentially what i see is that the biden political team has decided to trade the relationship with our closest and strongest ally in the middle east for what they think and hope will be more votes in michigan and minnesota. this isn't a principled stance. standing by israel requires moral clarity. that's something the administration doesn't seem to have had in the last couple months. certainly in the early days i was supportive of admiral kirby and others and their statements. you have seen that trickle where now at the united nations we can't even have the fortitude, we can't even have the moral

clarity to veto a resolution that doesn't mention october 7th, that doesn't mention hamas and by the way doesn't mention our american hostages. i know i talk about this all the time. we're six months of americans, five americans being held hostage by a terrorist group and this administration has basically done nothing to bring them home and certainly don't want to talk about it publicly. >> dana: hamas said this, regarding the american administration no doubt there are clear changes in its policy towards israel and this is perhaps due to the stupid and foolish policy of the occupying state which commits genocide killing civilians and starvation. you have to wonder the early stories being written about the white house is working on plans, military plans for the israelis in order to deal with their final taking out of the hamas militants. but i think that everyone keeps forgetting to mention and remind everyone that hamas is holding

american hostages right now. more attention on that fact might change some of these numbers. let me give you a quick final word on that. >> i would just say that what is happening with israel and hamas right now from the biden administration is endemic how they have screwed up the entire middle east as they emboldened iran, punished israel and gulf arab states. you see chaos in the middle east because they spent three years chasing iran around the world begging them to get back in a deal they never were. now american soldiers are dying in jordan because of iranian attacks. ships shot at on a daily basis. if you look at the broader middle east in the context of how biden is treating israel they have screwed up the whole middle east, dana. >> dana: there is more to chew on that. they would disagree with everything we've said but there are some great points.

>> bill: 15 minutes before the hour. student loan forgiveness. you might forget about that idea if states like kansas have their way. august of 2022, president biden announced the three-part plan to cancel $20,000 worth of federal student loans. the following june the u.s. supreme court came down and struck down that debt relief plan. the white house and president biden were not finished. two months later that came in august to have debt cancellation for millions of americans. now there is a new program launched called a save plan. income-driven repayment plan, idr for short based on the income of the family. in october of 23 the federal student loan payments resumed. this is a ping-pong back and forth up until last week. march 21st, president biden

canceled $143 billion in student loan debt for almost 4 million americans. kris kobach says the state will sue to block the plan. good morning to you. make your best case. how do you think you can win this time? >> good morning, bill. the case is very similar to the first time around. it was illegal when the biden administration attempted to cancel student debt in 2022. the supreme court held by a 6-three decision last summer. now they're doing it again and kind of keeping their cards close to their chest as how they are doing it. it has become evident it will be probably well in excess of $2 hundred billion cancellation of debt. the majority of college debt owners will have the entirety of their debt canceled. and they are doing it by twisting the words of federal law once again. the first time they said they were modifying the loans. the supreme court said no you're canceling them. now they say we're modifying the terms of debt repayment.

it's not modifying it when you take it to 0. that's canceling the loan. >> bill: if you are a taxpayer and you didn't go to college, are they paying for this? >> yeah. this is on the backs of every taxpayer who didn't go to college as well as everybody else. that's a really great point. think of the unfairness of this. you take money from people who decided not to go to college, couldn't afford college, worked that i way through college and giving away their money to people who largely are many of them are graduate schools, went to expensive colleges and have this student debt. it is so unfair to do that. it is on the backs of the american taxpayer and unfair on the backs of taxpayers who didn't go to college or worked their way through college. >> bill: a bit of history 50, 60 years ago congress created the student loan program, right known as the higher education act of 1965.

isn't congress the vehicle by which government can step in and force change on this payment or not? >> that's a very good point. maybe we should have you argue the case. that will be one of our arguments in court. it's called the major questions doctrine. the supreme court has made it very clear this is so important to our separation of powers. this is a major question. congress did so in 1965 when they created it. if congress wants to forgive that student debt to the tune of $2 hundred billion plus only congress can do it. unelected executive agency can't take that power to make the legislative decisions from congress and one of the main arguments we will make in court. >> bill: when do you think we'll have an answer? >> we ask the courts to accelerate it as quickly as possible. we'll file in a few hours in federal district court in kansas and 10th circuit and possibly the supreme court. >> bill: it's an election year. are you confident that you will

have a decision before november? >> we hope to have an injunction in place before november and you point out something that i think politically important as well. perhaps just coincidence, the first loan repayment plan happened as the 2022 elections were approaching and this one is happening as the 2024 elections are approaching. it may be coincidence or that the administration is trying to curry favor. >> bill: if you see an elephant on the sidewalk, it is really an elephant. we'll follow it and see which way it goes. >> dana: fox news alert. we want to get you down to georgia. there is a hearing underway about fani willis and nathan wade. we'll see what will happen here. that's getting underway right now. as you can see they are getting the cameras into focus to find out where does this case against president trump and many others go from here? and fox news goes inside the pennsylvania factory that makes one of the most important weapons in the ukraine war.

i said what are you talking about? that was the power of a.i. i will tell you like i gave in my speech with the governor that day i said listen, everything in darkness comes to light, it just does. and so not to say that all of the a.i. community is wrong. there are parts of it that are cool. parts that are beneficial. when it comes to stealing intellectual and personal property rights and things of that nature and stealing basically the livelihood of the music business. without songwriters you don't have songs. without songs you don't have singers, without singers you don't have shows. it all trickles down. musicians don't have work. i'm glad to be a loud and vocal state with our state and governor and luke bryan and so many others who joined in saying we have to put a stop to this. we have to measure it down to a point where it is safe for everybody and to where everybody is benefiting from it in a good way. listen, i told them that day on
