[ ♪♪ ] cedar you thank you guys, good afternoon, i'm martha maccallum and this is the story and what a story it is. dramatic new video shot by fox cameras earlier today -- look at this! federal agents taking arrests out of the city hall where it suspected migrant squatters were living in this neighbourhood, they were discovered last day, your member of the origins of the story. six of them were free to initially under the nobel laws. could not hold them, right? can do that in new york. they face charges after guns and bags of drugs were found in the basement. you see the images of water they confiscated on the right side of the screen, the also found a 70 no child inside of that home. not clear whose child it is. one of the suspect that was frayed with no bail, no bail reminder, is this man, hector, of one as well. he had previously been charged

first, corresponded a briny yannis who has been on the ground covering breaking news in the story that the week. hello brian. >> hello martha, just taught what hours ago we were alive one about a thousand eyes in force and removal officers showed up in unmarked vehicles at this home -- ice -- three a would be presumed to be three of the six migrant squatters who were released yesterday by a judge here in new york city without bail. a man and woman were taken into custody in front of our cameras, another man was arrested live on our air. officers told these three from the home were eight migrant squatters were arrested on multiple gun and drug charges. the nypd says they did not cooperate with ice in these arrests because they are not allowed to by law. this is a sanctuary city.

two hours before ice removal officers shell never made the arrest, we spoke to 25-year-old hector, he is one of the six migrant squatters released without bail despite the fine that he had previous he faced an attempted murder charge. i asked him in spanish and he was leaving, if he was still living in the basement apartment, he said he was moving out and said he was tricked into living there. listen. >> at her now, you tell me. steel that was our producer jan johnson, he whipped out his ipad and began, what was just about to record when i stepped in and started speaking to him in spanish. this all started last week when the nypd added ten migrant away from police with a loaded gun. they chased him into a bronx basement apartment were several other migrants and a 7-year-old were living inside the apartment, police found four guns, a ghost gun, extended ammo and taught what bags of drugs,

ketamine and cocaine. over like to show you where we are in relation to an elementary school, right across the street from elementary school is where these squatters were living. this is her neighbours say they were just months and months of noise, scooters. in fact,, one neighbour told new york post she saw one migrants got the -- squatter beating up a man with a pipe. another neighbour tells me what makes the most angry is that these are offenders who are released once again and the fact that children were so close by. the landlord by the way martha filed eviction papers in november. they were saying they've being living here for about a year and a half. >> martha: just a couple quick questions as you continue to cover this. my heart breaks for these neighbours first of all. they reported a lot of what you just mentioned and they were told by the police officers is nothing we can do. we cannot pull them out of this home even though they are probably not there legally. so the same people that were arrested and released, were they the same people that went back

to this place and got arrested again a couple of hours ago? >> yes, we are saying presumably because we believe that they were. the offices went right to the back of this home and that is where the basement engines is and they pulled out three people. two man and a woman. 's outlook, ice is not saying specifically these where the folks that were arrested but we are presuming that because this is a home, that's the location of the basement, and they came two hours after we aired that a video of our confrontation with hector desousa-villalta. i would not say confrontation, we just happen to see him here, he ran out of here couple of hours before ice came an arm over the other folks speak to you said somebody in the car was shouting to him to get in the car and leave. you have not seen him on the property, he is gone now? soon he is gonna. >> martha: you do not know where he is, correct? soon know that is right. he is the one with a loaded gun, he is the whole reason this even

the people who have to have voted for who put in these terrible policies on mail reform and sanctuary cities. and think part of the confusion here is that that is two different cases going on. when we cite new york as a sanctuary city, that does not mean the feds cannot go in and enforce federal law. what it means as new york state authorities in the city police cannot, even though the cops would like to help them, they cannot help them because new york since 2014 has had this legal status as a sanctuary city -- city. i take that what happened here is that after the state released these guys under their ridiculous pale different bail provisions, the feds have come in and started to make a federal case which probably involves both immigration violations and drug and gun violations. >> martha: as he pointed out and in your peace, new york is the only state in the united states that does not permit judges to detain defendant's

pretrial based on a finding of dangerousness to the community. clearly there is a community danger, this guns and drugs in the right across the street from a school. god help this child, the 70 old, we know nothing about who this child is -- 7-year-old. pete, when you watch this play out here on the streets of new york and we have seen the and a lot of cities, but goes through your mind? >> it does not feel real. it does not feel like this could be the united states of america. nothing about crossing the border they did was legal, nothing in the house was legal, nothing what having the guns and drugs was legal. yet our legal system, so called a new york, just releases them? and then is not willing to cooperate with the federal government? the judge in the da corrupts our -- tried to set up bail, from what i understand they could have but they try not to because

it is almost never honoured because even though if anybody had their name it written down to be a flight risk it's these guys! they will want to be gone! and with the gunny you have the danger aspect. we're on a fundamentally -- we are a fundamentally unserious country because we do not enforce our laws, we do not stand by our taxpayer members whether it's a house they own, just across the street from an elementary school? he let that happen? that should be another charge! guns near schools! you have a charge on a charge! >> martha: this is gone -- under present all the people seem to have absolute no rights rights are the people who live on the block. and the kids would go to the school. they have no right to a safe education, no right to a safe place to live in it new york and these people until this apprehension which we hope sticks, these people had all the rights to come into country to live in a place for free, you

heard. as a defendant's, six of them got out which means it was possible to hold people on these charges, they just chose not to do it. it's not just a case of there's no dangerousness finding, if he were an illegal alien, by definition you do not have enough ties to the country, so you should be a bail risk for flights. yet they release six of these eight guys, it's just ridiculous. >> martha: it's unbelievable. at the very least if you cross the border illegally and you steal a pack of gum, you break the social contract, you are already on tenuous ground or you should be if you're here without a right to be here and we're gonna talking a minute about another story that will blow people's minds of how many people are being flown in or even flying in on their own d dime, but they don't have any papers to be here in some cases. and d., mccarthy, thank you. great to have you both here

authorities. that is just the fact. >> martha: queasy. tommy learn standing by to give you their analysis on the situation. some more of the reporting here from national correspondent live in el paso, hello matthew. >> hello martha, over the past few days here in el paso we have talked to migrants sitting on the ground inside of the international airport here which tells a flying to other destinations are trying to fly to other destinations across the united states. the same time we know there are migrants that flying into the united states and florida governor desantis that he is trying to fight that program. it is all under this biden program that stands for cuba, hayti, nicaragua and venezuela. official numbers show that fiscal year 2023, 184,000 migrants in those countries flew into miami alone. that is a dramatic increase from just 1500 migrants in fiscal

year 2022. thousands why reportedly flew into other states like texas and california. desantis as the biden administration is quietly bringing in these migrants without informing the states making it nearly impossible to track them. in a statement to foxnews the white house denies desantis' claim of secrecy writing "this is a lawful process that cuts of smugglers seeking to take advantage of vulnerable individuals considering migrating and has successfully decreased irregular migration from these countries". saying to the program is secret is laughably false, pretty strong statement. florida says it has a one lawsuit that is pending active against a biden administration and there is a large group of republicans in the house who have demanded the president terminate this program. >> martha: match,'s we think so much. with that, tommy lauren, on out, and fox news contributor, senior pluto analyst, great to have both of you with us.

going to read a piece from here as all who covers the border and -- now commands away. he says these flights are not chartered, they're not paid for by taxpayers, they paid by the people who were on the flights but what's unusual is it was designed to reduce the number of people coming across of the southern border, designed by the biden administration and it is a highly questionable legal use of mass parole which is generally done on a case by case basis, not at hundreds of thousands of flights as we saw. included in those groups is believed to be the haitian man charged with raping a disabled girl in massachusetts, it is not clear if they have checked on his sponsor when he -- once he got here peak up -- because he was supposed to going semi. this is an example of somebody where there was not a lot of follow-up, he was supposed to be a new jersey with his sponsor but ended up in massachusetts and tragically for this teen girl, allegedly assaulted her. how, one, going back to the

previous point, does that sound like america to you? this squatters story and then flying people in by the thousands who don't wonder nearly have a way to get in here except for this program? >> well, as a country, we are a country of immigrants that we have made special considerations especially historically for cubans fleeing political oppression and in this case it sounds like this is an open program trying to give people a way to avoid some of these cartels and human traffickers. but the bigger point here is we are discussing immigration which is a hot political issue according to the polls is that if former president trump really cares about this issue, why did he block legislation that would provided more border agents, more asylum judges, allowed the president the power to shut down the border when there was chaos
