good afternoon trays. michael cohen right now if you seconds ago starting to go over the actual wiring of the $130,000 to adult film actress stormy daniels. you told the court prior to that he and former cfo of trump organization allen was a burg spoke with trump directly to alert him cohen was going different the payment cohen claims weisel park promised him he would be paid back and trump was vary appreciative. he said he was doing everything he could and more to protect my boss he told the court. later he said i would not hand out a 130,000-dollar nda for someone else. cohen eventually paid daniels using a home equity line of credit card something he said he did to conceal the payment from his wife. cohen claims trump wanted the story suppressed because he worried about his electability with women after the release of the access hollywood tape. corn claims trump told him quote its a total disaster. women are going to hate me.

this is going to be a disaster for the campaign. cohen admitted to delaying the payment to daniels, hoping he could push it past the election and not pay her at all. trump denies ever having an affair with her and lawyers for trump are expected to focus on cohen's criminal history. he is a convicted perjurer who admitted to lying under oath several times. prosecutors say he did that in the past to protect trump. now, cohen just told the court again that he alerted trump right before making the 130,000-dollar payment khakis says he wouldn't have done that without telling trump about it first. of course trump's lawyers will push back on that narrative when the cross-examination of cohen begins. traced. >> trace: nate foy live for as outside the courtroom will get back to you as news warns. let's bring in andy mccarthy fox news contributor concrete to see you. let's pick up where nate left off. michael cohen saying he spoke to

alan weisselberg about that payment and also notified the former president about the payment. what is the get here? what are they trying to get at with this kind of testimony and equally. >> it's very peculiar because what he is testifying about are things that are not in contention. trump as nate said might pushback about how much he knew about cohen fronting the money to stormy daniels but here's the thing. none of this is illegal, it's not a legal to purchase somebody's story with a nondisclosure agreement. the element that would make this illegal if they could establish it would be that the payment violated the campaign finance laws. what we aren't hearing is a single word of any kind of testimony that trump had the campaign-finance laws in his mind at all. i don't think these transactions

are federal campaign expenditures and i am not alone in that. break is trying to suggest to the jury that they are by having his lawyers or his prosecutors tell the jury that cohen has led guilty to campaign-finance crimes and having pecker testified he entered into a nonprosecution agreement with the government regarding campaign finance but neither 1 of those things is admissible thanks against donald trump. >> i wonder what the defence is -- strategy for the defence is going forward. as you said no 1 pointed out the crime. all of these things, the nda, they talked about these things going back years and years and years and it's kind of common practice when you're a celebrity but if there is no crime, if you're the defence, do you go after cohen? or do you just kind of let some of the stuff go? >> trace its a great question because my weakness in analysing

these thanks or my bias at least with respect to these things is i was a prosecutor for many, many years. i was not a defence lawyer, i wasn't someone who got hired to dismantle these stories. so as a prosecutor what you always think is if your story has any logical break point like if you do something and consistent, that in and of itself is doubt. you have to avoid that. you're story always has to be logically consistent. the defence doesn't need 12 jurors, they really only need 1. if they get 1 juror to vote to acquit and 1 vote to convict they can get a hung jury here which is essentially a victory. they don't have the same sort of incentive and obligation to keep everything logical so i think they are pushing on 2 different things that don't sit easily next to each other.

on the 1 hand area telling the jury everything is fine with non disclosure agreements which is completely true. on the other hand what they are basically saying is trump didn't know much about this and it was all cohen. if this was the prosecutor's case i'd be saying if the nondisclosure agreements are fine and i don't want to look like i'm trying to push trump away from them are create distance. but they are appealing to the jurors on 2 different grounds. they hope it will acquit because the nondisclosure agreements are illegal but they are also hoping they can reach 1 or 2 or more jurors who won't convict anyone on the basis of cohen. >> it is impressive because we are hearing these recordings, we now know michael cohen recorded on the trump and brought these thanks into his negotiations. this 1 is from september 6th 2016. it was played in court and here

client even if it's okay to do the recording hack your not supposed to use it in any way to undermine the client or go against the clients interest. i guess his rationalization here is he was helping trump because he wanted to have this recording to put pecker's mind at ease that he would actually be repaid. i don't think there's been any testimony that he actually played the recording for a pecker. but at least that's why he said he wanted to have it. i think it's vary strange to be recording your client this way. >> trace: it really is interesting. quickly tackle he about to go here cast but you're take. this case could be over very soon. you have this idea where the defence is going to say let's dismiss this thing, is there a possibility the judge says, yeah, he just have been shown enough for this to actually go to the jury. >> legally that is what should happen. there is no proof of fraud here

right now the prosecution's star witness michael cohen is on the stand and has been testifying about setting up an llc you to pay stormy daniels. we are waiting to hear from him. he remains at risk of being thrown out of jail when he violates the gag order of this case but let's bring our editor craig great to see. we talk about this llc michael cohen set up he didn't put donald trump name on this. you think this is fascinating carrie and i want to know why. >> reporter: yes cohen testified he set up this llc to pay stormy daniels out of and set it up as a consultant. it was for real estate project, so to speak. you testified it was false and it was to pay the compensation for this nda. he was asked by the prosecution -- by the prosecution why he didn't put donald trump's name on it and he said it was to

protect him. you seem to make a face a couple thanks to note about this there is no evidence donald trump new there is an llc being set up to pay stormy daniels. it's important if they are testified was her fraudulent account. number 2 it's also clear even the bank new if he set up the account to pay stormy daniels that they would have said no you can't do that. it could have been a reputational concern they may have thought we aren't sure we want someone setting up an account to pay off a porn star but it's not necessarily illegal. certainly as we've discussed many times compensation for an nda in general is not a legal. again we don't at this point if trump knew anything about the ins and outs about how cohen set up the account. >> trace: and several times,

it's a bit bizarre to go to those kinds of lengths to protect you're boss. so that is 1 aspect we artie predicted he was going to say. and another thing he said earlier today was trump only cared about the campaign as far as the impact of the stormy daniels story eric of course other witnesses said that was not the case. these are the kinds of statements and testimony we've been expecting from michael cohen all along and i suspect the defence tomorrow will come full throttle with how that does not match up with what he is said in the past. >> trace: it's interesting because today on cnn anthony was talking about how he thinks michael cohen learned his lesson about lying and therefore only speaks the god's honest truth and watch him and i will get your response. >> i see him as a reformed person. i see him that has artie paid a price for lying in court and i see it as a near impossibility that he would be lying about

case may be today and that he testified that when the karen mcdougall scheme fell through that he was happy because trump would be happy that he didn't have the pay that money anymore. that's strictly in opposition to eye david packer testify to a couple weeks ago. he said michael cohen went ballistic, he was angry and cursing saying my boss we'll be vary unhappy. so that's a big hole right there and that's from colin's own mouth. so interested to see if the defence we'll raise that tomorrow among other things. >> yes they've got all these contradictions to deal with. lastly carrie have you noticed something that's jumped out at you that you aren't expecting? you know the story backwards and forwards. is there something you weren't expecting here today that they kind of played up. >> i would say nothing other than cohen directly saying i told trump i was going to front the money, i told him after i wired the money to keep davidson

should spend every day between now and then in a courtroom it seems to be doing him a world of good. what's most interesting about the poll is the details when you look at the demographics here. in those 6 key states they aggregate the numbers and trump is doing incredibly well among ethnic minority -- ethnic minorities. it's really striking he's getting 40% plus in a straight head-to-head amongst hispanics and 20% plus among african-americans. what's particularly interesting is he is weigh ahead in those 3 sunbelt states that are there. and much closer in the 3 rust belt states. what's interesting is those 3 rust belt states with the most white voters are, in this kind of vary strange irony, you know, the democrats like to accused donald trump of being racist and all the things, joe biden is really only competitive in
