expedited appeal? i mean, look, the nextal. stepgn is the sentencing on june 11, july 11th. and our goaljune 11th i. 11t is, and that's to keep the the leading candidate fortate president of the united states out of prison. and that's what we're goinrisong to try to do. and he shouldn't go to prison. putting aside the fact the law suggestso putting fact that somebody likem should never go to prison for this crime. he waso to priso the president e united states and he he under no circumstances a should spend a day in prison. and that's what we're going to be asking the judge to doegoo is not sentence him to prison. but no matter the sentence, whatever it is, we're going to immediately appeal. and you're right, sean, we have all kinds of stuff to appeal. immediatkind of stufthis was a e the district attorney said yesterday. and he thisdist said it a year ago. this is the bread and butter. this is what they always do. ththat is not true. that is just not a true statement. there is not a single case that anybody has showed me in oa year that is anything like the case that this district attorney brought. that'sthing you're talkingat too about communications that took place in the year of our lord 2015 2016 records from 2017

11:17 pm
legal team, what would you advise and what would the next steps be as we head into this july 11 sentencing? well, i think you have look to an appeal and higher court judges in new york, sean, or just like merchan. >> i mean, there are many me this is a liberal, politically driven club. >> they protect their own. >> so i'm not optimistic that the former president'sprotc chances to overturn the conviction, which means i'm that trump's only real relif is in the federal court. >> but that's the proper venue anyway, because as jonathan pointed out, most of thed egregious violations by thoue judge, these were constitutional due process judg. >> for example, refusing to tell the defendant what this conspiratorefusingr c crime wase >> we still don't know. that's a clear violation of thee sixth amendment. >> and then, of course, tellinse the jury, they can forget all about a unanimitjury ty thaa

attorney? >> i would do something quite radical. o something foroccutely the sentencing to occur next week, not july 11th, so that you can get the appeal going. you can'so yout appeal until ths a sentence. if the court to expedite the sentencing. i would try to take the case now immediatel wouldy to the new york court of appeal, skipping the intermediate court of appealsrk which is a political court, manhattan basea pod democrats, largely. i would try to go right totr coe court appeals and ask them for a decision within 30 days in order get to the supreme court before the election. there's no reason have the sentencing delayed until july 11th. the judge knows what he's going to do. >> professor, why would you have any confidencete that judge merchan would expedite the sentencing? because i have you know, to me, i think the obvious thing to do, if it was him, would be to say, all right, you were releasedo if on your ownr ow recognizance pending appeal.
11:20 pm
i don't have faith he'll do. that. >> no, that's not the point. the point is to impose t. the sentenceimpose now so that e can be an appeal if the judge refuses, as he wouldof the refue to take the case to the court cu of appeals and say honors, we t want the sentencing to be done now. so we can appeal. if the judge refuses to allow the sentencing to, impose u your honors, let us appeal. now, we're not going to appeals. the sentencing now. we're going to appeal the conviction. wilhe conviso i would do everyg to expedite this. >> timing is everything. >> very dangerous times forr our constitutional republic. c. very dangerous. thank you both. greg, thank you both . fun being on fox nation with you yesterday. and professor, thank you. when we come back, lara trump is here. she'll react to the biden campaign reportedlycampai celebrating trump's guilty verdict. and judggny celebratine jeanineo all coming up straight ahead. >> oh, carney assault. it's carney. i saw that. that's what i said.
