being selectively prosecuted by counsel making prosecutorial decisions for political reasons and the special counsel making those decisions is not independent from the attorney general appointed by his father or the executive branch headed by his father this will not affect the outcome of the general election this fall. >> is much as hunter biden and says they are innocent he is one of the most disliked people in america. posting a three / one negative rating. i don't think this trial have a big impact on politics affecting the president personally more than anything else. >> and again the trial for the president son gets underway monday in wilmington. >> thank you lucas. let's go to mercedes : who can play out the next steps the one that everyone is paying attention to is that july 11 sentencing event. play that out. >> a lot can happen.
8:06 am
is always wonderful to start my day with you the big issue everyone is questioning whether or not donald trump will be sentenced to some prison time. 34 felonies it is at the discretion of the judge whether or not there will be incarceration. as the defense attorney you can never guarantee to your client once they are convicted they won't have jail time. let's unpack that. donald trump is the first time offender. no criminal history. there has to be a probation report he has to undergo just like all other defendants convicted. he will speak to a probation officer that will set forth and then a big unknown is ultimately will decide what his recommendation will be. he was asked by reporters last week whether he will recommend incarceration we have to see what the recommendation will be.
8:07 am
but talking about the judge who has expressed a lot of frustration against president trump there were 10 warnings and 10 sanctions for his conduct and also president trump was angry with the conviction not showing any remorse he believes he is innocent and targeted all of that will come into play generally speaking when defendants are convicted of a crime if they fall on the sword and beg for forgiveness and express just express remorse the judge may show leniency but none of that has taken place. so what to do if there will be incarceration cracks and frankly under the circumstances, think what it would be like if incarceration is imposed which may be very unlikely but if it is how you put a former president and the confines in prison? t6 to that point i know you don't like the politics of this but democrats have said whatever you do don't thrown in prison
8:08 am
because that will only help his odds of winning the election on november 5th. the judge is supposed to be behind that and critics say it isn't but i am curious whether a judge would consider the implications as a front runner for the white house plex why risk doing something like that? >> i am an insider i've a lot of belief in the judicial system. i believe judges will take politics out the window. this is me as a true believer having done this for so many years. neil: when did you wake up? kidding. [laughter] hope rings eternal. >> you have to. but at the end of the day i don't think politics will play into it. there could be some logistical issues the judge may consider and if he will impose
8:09 am
incarceration it will be house arrest. as a former president he has security detail how can you put a former president in prison? imagine the logistics everything that can certainly be an implication for the judge. something for him to consider it could be the logistical nightmare putting the former president in jail. that doesn't mean that will stop him from doing so but a creative way to do a house arrest. t15 keep that confidence as well. thank you very much. >> always a pleasure. >> and so the daniel, political reporter play out the possibility of the former president spending some time in jail. it seems unfathomable even from the political side that it would only help the president.
8:10 am
what do you think? >> i definitely agree. he now calls himself a political prisoner. he hasn't been sentenced to any jail time or spent any real time in prison, but he can use that as rocket fuel to his supporters to raise more money from it. so democrats are really hoping that the judge may be sentences them to community service and maybe in a few years the media would be watching him clean up garbage on the street from new york. neil: each one places through their politics and there's money coming into the trump campaign. and they are looking at raising 150 million off of this since the guilty verdict is coming down. is that a reflection of more support within the party or coming from outside the party? sat is crucial because a lot of people feel that once you are
8:11 am
stuck with the stigma of conviction that things change. it's not such an easy walk back to the white house. >> if you look at the last few states we have talked about, 20 percent of some voters in pennsylvania, republican voters were voting for nikki haley during this time of the trial. they will not be happy with a felony conviction. everyone has to look at them in the mere do we want a felon in the oval office? they may say i don't think this was the strongest case. maybe political persecution. but that's why we have a jury system for 12 regular people to decide and look at the evidence fairly. so in terms of negotiation with foreign leaders people may not want a convicted felon on one side and vladimir putin on the
8:12 am
other. neil: it's interesting the way you framed that. a lot of people look at this and say they don't get into these details or draw a distinction between someone being indicted or very different court cases that are likely to be adjudicated. they know this is a president who has the goal run-ins with the other party and they may see this as the other party piling on and not draw a distinction if convicted on anything? >> if he was acquitted i'm sure he would be saying this totally proved i was innocent. neil: good point. >> 10 percent of republicans are in and a poll saying he would not vote for trump because of this. lot of the support has been younger voters, voters of color who is not been on the trump trains and stay number one. they say -- -- they see a

conviction like this and say this gives me second thoughts. some young voters were not paying attention to the news during the trump administration so this gives them a fresh taste of chaos they may see if trump was reelected in november. neil: how does this sort out? does it? >> i think the debate is important. was interesting to me is some democrats think the biden campaign is making a mistake by not playing up the conviction as much as they could be. whether that features campaign ads, convicted felon donald trump in every add. if they don't, and they still lose democrats will say this may have made a difference. neil: thank you so much. from "politico" brilliant. in the meantime we are looking at the launch of the rocket not

blowing off a brand-new 737 max nine shortly after takeoff. the ntsb says the four bolts to keep the door on were missing. whistleblowers were testifying on capitol hill saying boeing has a number of safety problems and a culture that punishes people for speaking up about them. boeing has denied that. nonetheless the company acknowledges and needs to do a better job to clean up problems to regain the public was confidence. with one or two weeks of training for new hires to give a mentor when they hit the production floor. current workers given proficiency assessment also cutting back on traveled work which is work left undone by a supplier then done out of sequence during final assembly. that's what happened with the door plug fiasco. the head of the faa says it's

>> that was a close call and averted at just the last second. it does raise questions when the flying public hears about this. what is going on? we hear more of these type of events and remind us they are still a rarity? the former faa safety team member and a good pilot. should people worry? >> good morning. the faa does a phenomenal job at oversight we had the safest year in aviation history the past year. the simple answer is don't worry about it. when you get on an airplane he will be safe. a lot of this is over magnified by a social media and digital media all around the world. when i log onto my laptop every morning but we are blowing everything out of proportion.
8:29 am
neil: when you say out of proportion in the past to be not just hear about it? but we know it's still happening. >> that's right. i'm not talking about the big events like doors blowing out and super close calls but the go around, near misses happen. they are not as dramatic as the media makes them out to be. they happen quite frequently. but these controllers are under stress and overworked. they are still trying to catch up from covid. as far as boeing goes, it is a complicated task. and one of boeing's manufacturing places in seattle they have 30000 employees and that is just one facility.
8:30 am
and it is a difficult task for the current ceo in the future ceo to make boeing the way it used to be. neil: we get incidents involving boeing jetliners there are not many other choices for folks. so we don't have nearly as many aerospace giants as we use to. >> there are emerging players. >> but in fairness to airbus or others they stepped up not only during the pandemic but right now we are not seen the problems with other manufacturers. what i would like to say and obviously not to divulge any trade secrets, i would like to
8:31 am
see a consortium around multiple aircraft manufacturers, possibly possibly the faa could take this under their wing where they could share practices of what they are doing right in the manufacturing and assembly process and pull that information together to make the industry safer. that would be complex to do and hard to get everybody on board but all the manufacturers don't want airplanes to crash. airbus is not happy what is happening with boeing. everybody once a safe industry. neil: thank you very much. just a step back but then you have to put into perspective. so that so they go back to. >> some sad news to pass along we have learned michelle obama's
