the weekend charged with the rape and murder of a mother of five. rachel morin was brutally killed on a hiking trail in maryland last year and they found their man. good morning, everybody. monday. dana has the week off. i'm bill hemmer live in new york city and special guest and colleague of ours from d.c. >> aishah: i'm aishah hosni and this is "america's newsroom." a big story that is breaking right now and people are saying this is like lakin riley 2.0. it happened in a blue state. investigators say the suspect was stalking her for months before he attacked her from el salvador and has a rap sheet in his own home country. the family says the border has to be more secure so this never happens to your family. >> this is not a democrat or republican problem. this is an american problem. you would think that the border patrol would be able to stop

people and say hey, are you wanted for murder back in your country? if so, you can't come in here. that certainly is a big problem. merchandise is a long way from the southern border. clearly it is not something just affecting southern states. >> bill: the man accused of the murder entered the country illegally last year. he has a criminal past including ties to violent gangs. he was arrested in oklahoma, which is hundreds of miles away from the crime scene in maryland. >> this is the second woman in our county to be killed by an illegal alien. american citizens are not safe because of failed immigration policies. >> aishah: a sheriff has been on top of this crime and how the arrest went down. we go live to david spunt with more from washington. hello to you, david. >> hi, tragic story. rachel, just 37 years old as you said mother of five. last august she was found dead along the popular outdoor

running trail in bel air, maryland on the ware to the delaware border. no word about her killer for about a year. the family knowing someone raped and murdered her and that person was walking the streets ready to attack again. no more. police now say they have their suspect. on friday authorities in tulsa, oklahoma arrested this man, victor hernandez, 23 years old charged with rachel morin's rape and murder from el salvador. he illegally crossed the southern border into the united states in february 2023. police say he killed a woman in el salvador before escaping. police obtained a dna from a home invasion where several people including a young child were assaulted. this is the suspect and here is rachel's mother. >> when things seemed really

bleak and hopeless, the lead detective said to me, he said, patience will win in the end. and that's what they've been doing. they've been diligently working very hard and they've been patiently working through all the leads and it is because of that that we have an arrest today. >> hernandez is expected to face extradition from oklahoma to maryland to take charges. it could take several weeks. if convicted he will likely spend the rest of his life behind bars. >> aishah: heartbreaking story. >> bill: age 23. came into the country in january of 2023 when he was wanted for homicide in his home country. a month later he illegally crossed the u.s. in february of 2023. the incident a month later that david spunt was talking about. the break-in at the home in los angeles. in august of 2023 is when this murder was carried out.

it was june now, tulsa, oklahoma, her alleged killer has been arrested. want to get to the sheriff who can join us now. how did you catch him in tulsa, oklahoma? >> good morning. as i said throughout the course of this investigation, ten months long, it was going to be science and technology that brought us there or a very good tip. it ended up being science and technology. working dna and electronic phones and computers and all the social media accounts we were able to work hand in hand with so many partners and i have to say what the great partner the f.b.i. was through this investigation, the state police here in maryland and so many others. tulsa, oklahoma, los angeles, dna hit out in los angeles was a big break in the investigation. working hand in hand we were able to on a planet of billions of people able to find the one

individual, identify him and find him on a bar stool sitting in tulsa, oklahoma and get him in custody. >> bill: it seems like he was afraid of nothing. crosses the border, goes to california, your state and oklahoma. he was traveling this country when and where he liked. >> that's the great thing about the unities. we live in a free nation and travel from one place across it. our fear was that somebody who would do something as what he did to rachel would do it to other people here in our country, other women would suffer the same end of their life. and indeed hopefully not additional. we haven't found any cases yet. he killed a woman in el salvador and why he fled there to come here through our open border. he tried to come in legally and was turned away and that didn't deter him. we have such a porous border and he came right through. this is the result. >> bill: here is the governor of maryland. a democrat.

the question is about you, in fact. roll this from sunday. >> i know that sheriff is a republican governor but do you also hold the federal government partially responsible for the death of this maryland resident? >> the sheriff is right. we have an immigration policy that needed to have been dealt with and was not. we know that we have got to fix a broken immigration policy and we know that we need congress to act on this. >> bill: democrat or republican doesn't matter, does it, sheriff? >> i'm an elected official and i answer to the citizens in our county and i care about public safety. the governor was right but he went on to say that blame president trump. the border was never more secure than when president trump was in office. it has been an issue dating way back my 40 years in law enforcement. i wrote a letter in 2019 calling them to secure the border. that was trump in office and he did do a better job of securing the border. it needs to be a bipartisan effort on both parties' parts

and whoever is sitting in the white house to actually come up with a decent and workable solution, immigration policy for those people who want to come and contribute to our society and not people who want to murder. >> bill: the gotaways from the border with people we can't account for. bottom right-hand corner so far this year 184,000. that's of may 29 . that number goes higher and higher and what it was in previous years. migrants unaccounted for after release under the biden border patrol program. the parole program, unaccounted for it's almost 100%, sheriff. i mean, we're not batting 1,000, we're almost batting 0. >> right. and that to my citizens in my county and every citizens is a public service crisis and we can fix it by coming up with a workable immigration policy for our country. it is just insane that we would

allow things that rachel's murder to happen. we allowed it by letting him into the country unshall changed. >> could we have returned him to el salvador? would that government have taken him back? >> there is a red notice on file. interpol warrant. they want him back to stand for the death of the woman in el salvador. but i don't -- he is here now. i don't want him to leave maryland ever again. we don't have a death penalty but i hope he dies in one of our prisons for what he did in this case to our community and rachel and for her family, god love them. you saw that interview. you played that interview with her mom. that shouldn't happen to families in our country. this is preventable. >> bill: thank you, sir, we'll follow it. the sheriff from hartford county northeast of baltimore. aishah. >> aishah: a russian court is setting the date for the closed door trial of evan gershkovitch.

the "wall street journal" reporter is accused of esp espionage, charges called bogus. good morning to you. >> nine days evan gershkovitch goes on trial as vladimir putin dangles a possible prisoner swap. the "wall street journal" reporter accused by russia of spying for the c.i.a. u.s. government and the journal have heatedly denied that. he has been held since march of last year, arrested after the russians say he was collecting information about a tank factory. they haven't produced any evidence backing that up and the journal insists he was reporting. putin has said there has been contact with u.s. officials over a possible swap. that happens to be a standard part of putin's playbook to get russians imprisoned in the west returned. >> president vladimir putin has confirmed such contacts exist but they are kept and should be kept in information silence.

ohio valley moving in towards the east coast. as you see there is that map. the dome of high pressure is setting up across the northeast. record challenging ridge that will take hold through friday, maybe even into the weekend and next week. we have to watch that. you can see the heat risk as we go through thursday. the worst of it moving in towards the ohio valley, interior northeast and new england. some of your heat indices with the humidity. it feels like 98 in detroit. pittsburgh. 99 in new york city. the average in new york is 80. we'll get up to 94. with the heat index feeling more like 100 degrees. philadelphia, last 98 plus day in june was 2012. this is early on for this kind of heat. we'll have to see what happens in the next few months. will it hang on? record highs again today for some of these big cities into the 90s. the humidity, oppressive heat

that will make it dangerous for the young, pets, elderly, those who can't being outside for a great length of time and you have heat illness. that won't be good. a lot of officials will be coming out today. the mayor of new york will come out and say these are the precautions we'll make for all of the folks here in new york city. >> bill: they call it summer for the reason, right? >> not even summer yet, thursday. >> bill: thank you, janice, great to see you. >> aishah: crews in southern california working to extinguish flames from a wildfire covering over 14,000 acres. firefighters are dealing with strong winds that are pushing the fire further and further into the los angeles area. fox weather's max gordon is live at the incident command post in california. what are you seeing? >> this is where firefighters are gathering planning their attack on the post fire for the day burning 60 miles to the

north of the los angeles area burning in rugged, steep terrain and winds a big factor. the fire sitting at 14,600 acres with around 8% containment. this fire's cause is under investigation. high winds have been a big challenge for more than 100 firefighters battling blaze with gusts up to 55 miles-per-hour. the national weather service los angeles office warning the strong winds will continue throughout the day with hot and dry conditions creating dangerous fire weather. the fire has destroyed one commercial property and threatening dozens of homes. officials issued evacuation orders and several roads are closed in the area. 1200 people have also had to be evacuated from hungry valley state park and pyramid lake is currently closed. it's the largest fire burning now in california. fire season in the west is still early, just the start.

week's meeting with donald trump. aishah. >> aishah: it will be a big one. >> bill: plenty to discuss. marc thiessen and matt bennett. good morning to you. the white house blamed rupert murdoch and "new york post." all pretty weak. everyone was reporting on this. marc, it was the video on x all day on sunday. what did you think of it? should president obama have led him off the way he did? go ahead and give us your take. >> first of all, if this is an isolated incident it would be no problem. this is happening all the time. americans can see it. it is not just he is getting lost on stage. he is messing up his remarks. he welcoming a hamas hostage to the rose garden still being held by hamas and starting to read the instructions his speech writers put in his speech and in the clip you showed he said donald trump nominated two supreme court justices.

he nominated three justices. he even got that wrong. this is a president it is not surprising eight in ten americans are concerned about his mental fitness for the job. >> aishah: i will have you respond. i want to make a point. this is the president of the united states. if he really wants to take the crowd in, wants to take the applause, he is certainly okay to do that for 30 minutes if he wanted to. you know what president trump would do in a crowd that size. why is the former president then jumping in swooping in to sort of grab him and escort him out? either way it is bad. either he is trying to -- what do you think happened here? >> i've been at thousands of these events and let me tell you, when there are tons of celebrities in the audience, presidents are normal people and like to be around celebrities. what joe biden was looking out at was a crowd of hollywood big

shots and awesome for him to be looking at it. i don't know why president obama do what he did. i used to work for al gore. he was on stage a lot of times with clinton. they would put his arm around him and walk off together. i don't think it's a big deal. >> aishah: do you think obama was wrong to jump in? >> well, i don't know. maybe not in the moment. the way it has been interpreted certainly hasn't been great for the white house. i will say this. there is another clip circulating that was allegedly him wandering off when he was in europe. he was going over to congratulate a skydiver. a lot of this is malarkey as joe biden will say. this followed a 45-minute interview he did and what he said was the trump nominees he would have two more, not nominated two.

>> that's not true, matt. he said that he had two and he would have two more. he got it wrong. >> bill: we'll look at that transcript. one thing just on the whole obama thing, he knew there were cameras in that room. marc, he knew there were a lot of cameras in that room. and maybe there is not great blood between these two, but he kind of knew the moment that he was going to create. am i wrong about that observation? >> it's possible. it's also possible that just everybody around him knows how fragile he is and so they sort of guide him. this is not -- jill biden does this all the time with her husband guiding him off the stage or he will be lost on the stage and send her out to sort of walk him off the stage. you know, you can -- matt can

explain every one of these incidents but there is a body of evidence that has led eight to ten americans to say he is too old to be president. look, if everything was going great in the country and he was doing a great job, nobody would care about this. if the economy was humming, the border was secure, the world was as peace no one would care about his age. ronald reagan made jokes about his age because it was morning in america. 61% of americans think that joe biden's presidency is a failure. he has double digit disapproval on every issue. so then you layer on top the fact he stands and gets lost on the stage and people think this guy isn't fit to be president of the united states both in substance and in style. >> bill: in a way you are both right. he said the next president is likely to have two supreme court nominees, two more, two more. he has already appointed two that have been very negative in the rights of individuals. you are right, marc, he did say too. >> maybe he was endorsing one of

the supreme court nominees. maybe he likes one. >> aishah: let me ask you, matt, about the next big stage that both of nominees are going to be on. the big detate stage in a matter of days here. it will favor president biden. no notes, muted mics. will it be down to the response time for the mental acuity of each men? >> i don't know why they favor joe biden. cutting off the mics is to -- trump talked over biden the entire time and talked over the moderator and he talked over the president -- the then former vice president. so i think it just to keep
