night witnessed what, a week, frail, mentally impaired man with a very poor memory. they saw the thousand yard stare , open mouth to, glossy eyes. they heard confusion, muttering, trouble with numbers and names and concepts. in other words, joe. in postdebate, we saw biden struggled to get down three or four stairs, getting off the debate stage with his wife, helping him every single step of the way. a few minutes later, the first lady let a cringe worthy postdebate rally while her husband, the president, stared off into space. like he did during the debate. take a look. >> joe, you did such a great job, you answered every question, you knew all the facts [ cheering and applause ] and let me ask the crowd, what did trump do? lied! yes! >> sean: joe, you did it, you

disinformation. none of them ever saw a laptop. none of them knew a thing about the laptop. the only thing they knew is that they hated donald trump and wanted biden to win and they wanted to give biden a talking point in that debate after the laptop story broke. so now, what? and 2024, what can you expect now? what is the scheme that they will come up with this time? because you need to know how deep, how profound and how dangerous democrats, the media and the deep state have become in this country. and again, nobody is ever held accountable, unless of course her last name is trump and then they make it up. and after last night, we all now know why your attorney general has weaponize doj, will not release the robert heard tapes and why they are using law fair against donald trump and protecting joe biden from the extremely damn and -- damning

information on hunters very real laptop where hunter implicates his own father. 10 percent for the big guy, pops gets half my salary, which account should we pay for pops home repairs? remember those things? are democrats really now planning to topple joe biden? of course if they want to make a change, that is not going to be easy. joe and jill biden have been at the white house for decades and you think they'll just give up, packet up and leave for good and the greater good? the biden's only care about themselves. they are most certainly not weighing the impact to their party where their country. now today, after dozens of calls to bow out from high level democrats, president biden appeared to double down on his caffeine or whatever. i don't know what it is. and they sauntered out at a campaign rally in north carolina on the stage where he appeared just as confused as normal. that look, that blank stare.

but then today, the return of jacked up, hyper caffeinated joe. and all of the rage and insanity that comes with it. that is right, angry, screaming, jacked up joe is back. take a look. >> america bows to no one! no one! ever! you are freedom! you are democracy! america itself is at stake! i told them how i called the veteran that had given lives in the country and world war i. he called them suckers and losers. my son was one of those people! folks, don't trump is the first president i have heard of that stood up there and ran for president heading one term saying america is a failing nation. where the hell does he think he is? america is winning! as i stated, i can honestly say i've never been more optimistic about america's future in my whole career.

step or freezing or saying the wrong thing, is a cheap fake. but the solution would be for anybody curious about him, who wants to form an opinion about the president, just to watch an unedited biden event. well a lot of people don't tune in until there is something like a presidential debate and they got to see a full, unedited event. it is completely unclear that their opinions were changed the way the white house wanted them to be. and when you look today, the day after the debate where there were a lot of awkward silences while the president was speaking haltingly at times, he and his campaign are the ones who asked for no studio audience. today, it looked like he was feeding off the crowd or at the very least, if there is a pause, the crowd is filling in the silence with cheers or with a four more years chant or something. they are the ones who set the ground rules for last night.

and you look everywhere, i have spent the whole day in the white house booth, looking for democrats to say or explain why they think maybe he had a good night last night. and you cannot find it. i spent all day and then once barack obama describes it as a bad debate night, it is kind of over. no one is going to go over barack obama's head and say oh, no,, he's wrong. barack obama is wrong, the leader of the party. here is why he's wrong. it will not happen. >> sean: the thing is, when they brought up the whole cheap fake video thing, it was amazing because we went back and we were very careful. i often reach out to the white house and we tried to get comment. i don't know, is it something that maybe i said or maybe i did, peter? because they never get back to us. ever. >> that i don't know. but what i can tell you is that

there is no plan -- we talked to campaign people, there is no plan for president biden to drop out. i know that last night democrats in particular were hysterical about their election chances tanking. no plan for him to drop out. and they say that despite how things went last night, no one that helped with the seven days of debate prep is going to get fired. and they say that president biden will show up in september 2 debate trump again. >> sean: thank you peter. the contrast between biden and trump has never been more clear. for yet another example, here was trumped today in virginia. remember, polls show that state is dead even, take a look. >> did anybody last night watch a thing called the debate? that was a big one. but as you saw on television last night, we had a big victory

and we can list them. however,, i think the worst moments in the debate or what is airing right now on the screen. that blank stare. it was like no one was home. and he is just looking out and looking in other directions. that was frightening to me. as we look at this, what was your reaction to that part of it? >> it is very frightening. and i thought just the way the two men handled each other was so desperate. president trump never even really looked over at joe biden. he looked up because your audience is not your opponent, it's not even the debate moderators, your audience is always the people. and then you had president biden looking oddly at trump. i think what we saw on display is that donald trump is a very complicated man with very simple ideas. build a wall, cut your taxes, replace obama care, all of it. and then you have joe biden who is the opposite, a very simple man. some very calm for gated ideas no one could follow, including

him. i love the combination of the one-two punch of trump last night as does biden, to your point. there were many times when president trump just sat back and let joe biden speak. he knows numbers numb him, all that rehearsal was not going to pay off, in fact it was going to make joe biden seem a bit robotic if not out of touch and out of sync. and then when appropriate, president trump went in there and won the debate. for all the talk today about who should replace biden, it was a disaster for biden. i want to talk about the other side of the ledger. donald trump won the debate. he neutralized the republican position on abortion, all the while defending unborn life. you talked with the regulation, talked about the economy in 2019 and the way that he handled covid. he talked about joe biden not telling the truth about no troops dying. he pushed back on the lies that they let fly about this and that and the other. and i think that president trump won the debate is much as joe biden lost it. i have this to say.

we pulled a lot of archives of the moderators. i call him fake jake and dana. and what we found were two people masquerading as journalists that were giving very strong anti- trump opinions on a regular basis. americas long, horrible nightmares now officially over for millions and millions of americans, et cetera. that would be opinion. that is not journalism. and i think by exposing that, and it kind of went viral. and everyone kind of expected -- they knew that they had a bias against donald trump. i think the fact that so many people were going to be looking for, putting a lot of pressure on them to be more fair than they otherwise would have been, i may be wrong. because i think that pressure, they definitely felt it. and number 2, i think that there was a lot of pressure on the biden campaign after the state

of the union and it was all jacked up and hyper caffeinated. if that joe would have shown up again last night, that's problematic. it showed up today but that even makes the narrative that much more bizarre to me. do you agree that the amount of attention given -- because donald trump did not have a say what network it was on, he didn't have a say who the moderators were. he did not have a say with the format was, he did not have a say about meeting microphones. it was either our way or the highway and he chose to take the unfair conditions and with her presidential candidate had to take and he went in there anyway. your reaction? >> yes sean, i think you're partially right about the cnn anchors, i will start there. they didn't play opinion journalist last night, they did ask questions and i think the questions were for the most part solid. they were your usual democratic litany of questions about abortion and global warming because that is the only thing that democrats think the election is about but they did

get to inflation. pointed out about eight tenths of the way through the debate that they had yet to ask a question about joe biden's age and his health. the number 1 issue in the race. and then shortly afterwards, dana asked the question and i was glad she did r but they never took advantage of the first live interview with joe biden to ask him about why he lied when he said he never talked business with his son hunter and all of the photos that he did. it came out he was on phone calls with his son's clients. why did they not press him on that? that is probably a bridge too far for anyone from cnn so they would not ask that question. >> sean: i think they are so locked into trumped arrangement that the ends justify the means. they knew damn well he had cognitive issues and they hit it and they could not hide it after last night. that is my take. anyway, good to see you both, i appreciate you being with us. eliane, thank you. when we come back, the mob, the media, they are rightly in panic

and what is their appetite to go against the voters that nominated joe biden? >> isn't it funny how the party that is preaching okay we have to save democracy act wants to bypass democracy, bypassed the primaries, bypass the caucuses and just make a decision by the party elites. but setting that aside, i worked with the oversight project there at the heritage foundation for the last four months. elections are not run by the party. elections are not run by the federal government. collections are run by the states. each state has a set of laws. and many of these states, about 16 of them in particular, do not allow you to replace your candidate unilaterally. you don't get to go to the convention and say joe had a bad debate, now we will put in gavin or gretchen or someone else. you cannot do that! look at rob f. kennedy junior khaki can't even get on the

ballot in many states because he did not meet the threshold in the timeline. so even if they wanted to, short of death, you cannot simply change him out. >> sean: yes. joe, what's really spectacular to me is that there is no way anybody can convince me that the media and you're the best media analyst by far on fox and frankly, in the media in general , and you are the only one that does not always go along with the crowd and you stand back and you give real criticism that is justified 99.9% of the time. and i'm watching them and they are acting like well, we have never seen this joe biden before. and i'm thinking, yes, you have. they have all been covering for joe, they have open lying for joe, just like they peddle lies and conspiracies about russia. just like they push the whole

>> sean: after last night's disastrous debate, two questions are dominating the headlines today. is it time for biden to step aside? would he ever consider it? and who could replace him at the top of that an epic -- democratic ticket? one name raising a lot of speculation, california governor gavin newsom as well as the michigan governor. but when asked about the calls for biden to step down last night, gavin had this to say, take a look. >> i was very proud of the president today. so for my humble perspective, this is not about style. this is about delivering results for the american people. i would never turn my back on president biden. never turn my back on president biden. i don't know democrat in my party that would do so. especially after tonight. we have his back, we run back that -- we are all in and will double down in the next few months and when selection.

>> sean: a major setback today for biden's weaponize department of justice. the supreme court today ruled in favour of a january 6th defendant, holding that prosecutors overstepped when they charged the man with federal obstruction crime, a charge that donald trump also faces in one of special prosecutor jack smith cases, that is the dc case. it was a 6-3 decision. the court scent the case back to lower courts for further proceedings.

but it will likely lead to the dismissal of charges against many defendants. and also today, chief justice roberts announced the court will issue the final opinions of its term on monday with one of those obviously being donald trump's immunity case. here to weigh in, harvard law professor, allen along with our legal analyst. grade, i will start with you tonight. let's start with this. that basically the prosecutors overstepped using this obstruction, quote, law to charge january 6th writers. tell us what it means and more importantly, how does it impact the charges against donald trump? >> well the supreme court is constantly having to fix the manoeuvre or's, the sophomore mistakes of rogue prosecutors at the doj under biden. they misused and contort the law for political purposes. and then they get spanked as they did today by the supreme

court for bringing in proper charges. they try to force feed on obstruction statute that involves the tempering of evidence. my that's not what happened on and it means, as you point out, 330 people were falsely prosecuted and will probably have their convictions either tossed or modified. but for donald trump, it may mean that jack smith now has to rewrite his indictment or somehow find a way to circumvent today's supreme court ruling. i think you will try the latter because two of the four charges in the dc case are based on this misapplied obstruction law. i guarantee you that smith is furiously, right this minute, digesting today's decision because it could potentially got the special counsel case. so smith is a desperate man with the immunity decision which i think will be against them coming on monday. >> sean: professor, i would

love your take on this. >> first this has great implications for the new york conviction. biden is calling trump a convicted felon. no, he is not. he was convicted of a noncrime in new york. the prosecutors in new york is exactly what the supreme court condemned today. it took a statute that was designed for other purposes, stretched it, added another statute, resurrected dead statutes under the statute of limitations and invented a new crime. and the supreme court said today, no, you cannot do that. you cannot do that weather you are a new york prosecutor or a dc prosecutor. so this case not only helps donald trump and the district of columbia, it virtually assures its ultimate reversal in it's conviction in new york as well. and it tells prosecutors like brad, don't be creative. don't invent new crimes in order to get at people and you don't like weather they are protesters

or the candidates for the future of the united states. this is a good day for for america, a good day for civil libertarians and i was very pleasantly surprised to see one of the liberal justices join this opinion and shake her finger at prosecutors as well. and this is a very important case for all americans and all civil libertarians. >> you both predict, as i do, that the supreme court will weigh in on the immunity case with limited immunity that will likely help trump. i predict that is the outcome, do you agree? >> i think so. i think they will extend the existing civil protection for presidents to criminal immunity, shielding them as long as their actions are within the outer perimeter of official duties. and trump has a valid argument. >> and most of or in -- go ahead. if you had immunity while you were president, that immunity continues after you were president. that is an argument that jack
