candidates. just one candidate. and we all know it. the day before she was angry on cnn. now she is wondering if joe is all there. joining us now karoline leavitt former, now current trump 2024 national press secretary. caroline, do you think that president biden will be former president trump's opponent? >> well, i think the democrats have gotten themselves into a serious mess, brian. they ultimately are going to be stuck with joe biden. he has already sworn to more than 3700 delegates on the first ballot in the dnc convention next month. tens of millions of dollars and it's not that easy to transfer to another candidate. let's be very clear. no matter what the democrats do. and as you just played, nancy pelosi herself is throwing joe biden to the wolves. they know that they are in trouble with him. but it doesn't matter to us because president trump will beat any democrat that is on that ballot on november 5th.

across this country. the after donation to our campaign is just over $70. which tells you that president trump is building the greatest political movement that this campaign has ever seen. i don't know who would give a penny to the failing desperate biden campaign especially after his disastrous performance last thursday night. rest assured we are going to continue to raise money. we're going to continue to use these resources to bring president trump's winning message to every corner of this country including deep blue states like new jersey, new hampshire, virginia, and minnesota. where the polling has him either tied or leading joe biden right now. >> brian: i thought you were going to say new york. some people think he has got a shot in new york. now in single digits. no one thought that was possible and hasn't happened since 1980. >> caroline, thanks so much. have a great weekend. >> everyone just needs to breathe through the nose for a minute and take a deep breath. >> the media has spent a ton of time blowing this out of proportion. >> is he probably in better health than most of us. >> brian: really? nothing to see here.

♪ >> brian: sentencing in trump's new york trial is now postponed. postponed from its original day july 11th to september 18th. this is huge. that's after manhattan d.a. alvin bragg did not oppose the trump request to delay the sentencing after the supreme court ruled on immunity yesterday. joining us now for his reaction. will scharf attorney for former president trump. will, judge merchan wrote in his ruling the matter is adjourned until september 18th for the imposition of the sentence. if such still -- if it's still

necessary, or other proceedings. what do you make of that those additional sentences. is he looking at the immunity from the supreme court and saying i have to make heads or tails of this? is he actually confused? >> look, i think we won a massive victory at the u.s. supreme court yesterday on this immunity case now you are starting to see the dominoes topple in all of these other cases against president trump. judge merchan has a very serious problem on his hands. there were items introduced in evidence in the trial that he supervised that i believe are clearly covered by the supreme court's immunity decision. that effectively corrupts that entire trial. it could easily be grounds for a retrial. i think that's why the new york d.a.'s office was so quick to agree to a continuance of the sentencing, and it's why judge merchan seems to be deeply worried about the jury verdict that he supervised. >> brian: so this means for one the rnc is going to go off without a hitch. can you actually script it because you will not have the center of attention in jail. i want you to hear what norm

is he angry the supreme court stood up for the constitution, for the separation of powers and for the rule of law and that they weren't willing to just rubber stamp these insane jack smith prosecutions that i believe are just not well-founded in the law. so, frankly, norm eisen can pound sand. i understand that he is disappointed that we won yesterday. but the supreme court's decision is deeply rooted in the constitution and the separation of powers in core american legal principles and i, for one. am glad that the supreme court was willing to look past all of the politics and just focus on the law and on the constitution. >> brian: we will see where we go from here. at the very least we know what we are doing this summer. and that's watching politics and now we're going to be talking about going to court. think i that's good for the country. will scharf, thank you so much. congratulations. >> today's decision almost certainly means that there are virtually no limits on what a president can do. this is a fundamentally new principle. and it's a dangerous precedent. because the power of the office will no longer be constrained by

it's addictive and also contagious. you see that the contagion just spread after this opinion hit and it reached all the way into the white house. what the president said was untrue. and these are people that have worked for years to censor others for disinformation which i also talk about in the book. and, yet, they are the spreaders of disinformation. anyone reading the opinion knows that this is nonsense. but it's also dangerous because if you tell people, according to one person there will be death squads in the street, some people will believe it. and if they believe it, they will believe that they should be able to take any means to stop it. that's how you end up with people outside of justice kavanaugh's house. trying to kill him. and, yet, we don't have any mature voices it seems on the left who are saying hold it. the court here adopted the middle path. they rejected the extreme arguments on both sides. they said they are basically

three categories here. have you core constitutional functions where there is absolute immunity. by the way the opposing counsel recognized there would be protection for some of those areas. then they said for those areas that are beyond that, there is presumption of immunity but it could be overcome in a trial. and then, there is all of that conduct and speech that may be private or unofficial that has no protection. that's what the opinion actually says. >> brian: if you listen to the arguments, even i made up. i'm not one of your students nor do i have a law degree. i love the argument. you could tell it wasn't going to be absolute immunity. you could threl was a concern about the president being sued when he leaves office over policy. and that's the 6-3 decision. so i want you to hear what elizabeth warren says to be totally irresponsible. she says elizabeth warren is back on her packing the court push. saying donald trump and mitch mcconnell stole two seats on the supreme court and we are living with the consequences. i have said it before and i will say it again: it's time to

expand the court. professor, what's going on here? if they get the senate which they could maybe the next cycle or find a way to hold it this cycle, who knows. all hell is not going to break loose. you don't have manchin or sinema stopping anything. >> this is a former law professor who is saying we should instantly pack the court to get a liberal majority to vote the way we want. now, in what world does that sound like the rule of law? by the way, when joe biden was vice president, he and president obama vaporized a u.s. citizen in another country. does the administration, these pundits who are silent by the way when that happened, do they believe that he could be charged with murder? the point that the court was trying to get at is that they had to find a happy middle somewhere here. now, people say happy, but they were trying to find a way to create some breathing room for the presidency without giving absolute immunity on everything a president does or says.

american voters say someone else, not joe biden should -- would give democrats their best chance if they were at the top of the ticket. only 25% of voters say joe biden gives democrats their best chance. joe biden's approval rating is down to 36% in this poll. that is his lowest approval rating of his entire presidency in cnn polling. his lowest number nearly four months out from the election. >> brian: i wonder why? we're starting to get the first look into the impact of biden's debate disaster and what's happened since. several new polls showing the one from cnn there. trump is breaking away from biden. the harvard harris poll taken the days following the debate shows. trump with a 6 point lead nationally. and when it comes to voter enthusiasm, the "u.s.a. today" came out with a poll shows 82% of trump voters are excited to vote for him in november. 60% of joe biden's voters excited to vote for him in november. most of which are probably his family. what's more interesting is the democrats are starting to speak honestly about the real

>> exactly. voters have been expressing concern about biden's mental acuity for years. that's actually why he has been struggling in these polls against donald trump. the thing that's changing right now is merely that the media and other democrats are worried about their ability to pull, drag joe biden across the finish line in november. that's why they are panicking. and then boy are they panicking. >> brian: yeah. in fact, the "new york times" now reporting that democrat tammy baldwin, won't appear with president biden when he visits her state of wisconsin friday. she is locked in a tight senate race. and that's key for both parties. what kind of sign is that, kayleigh? >> you know, it is a sign in the right direction that democrats are clearly thinking about whether they could boot joe biden from the ballot. but, the thing is there really hasn't been much of a reaction on their part. a lot of pundits are saying. this but elected democrats are sort of hedging this field and they are refusing to actually go towards it. and i think that's because there's a deep disconnect right

now between the elected democratic leaders, the donor class, the establishment, the people who are responsible for joe biden running for re-election in the first place. and the democratic voters who, as mollie pointed out. have been raising these concerns for years. i think about my own demographic here, gen z voters. i'm not one of them. but the vast majority of my piers turned out to vote for biden in 2020 but only after he promised young voters that he would serve as a single term president. well, it turns out that biden in his decensorship pant party didn't really care much about those voters or the promise they made to them. they don't care about the people they represent. now they are surprised that young voters are leaving the democratic party in droves my answer is you shouldn't be you drove them out. you drove them right into the arms of donald trump today we found out that the president will sit for a taped interview on friday to air on sunday with

george stephanopoulos. what do you expect this to do? because, remember, stephanopoulos was pretty tough on him last time he did a sitdown. he said no general told me afghanistan army would clasp and this would be that type of disaster. >> yeah. george stephanopoulos who most people know him because he was president clintonens press secretary is a long-time ally of the clintons and a democrat operative is doing a taped interview with joe biden. this is not going to assuage people's concerns because the problem isn't whether in a taped interview that can be edited by allied media to make him look good whether he can look good. whether he can answer tough questions from people who aren't his political allies. until he is able to do that, that's going to be a problem. it's not just a problem -- right now the media and other democrats are freaking out about whether joe biden can be the 2024 nominee. if he can't be the nominee. 0 also can't be the president. if he is unable to fulfill the

observed after she got put on the ticket that we got a reverse bounce. it turned out that more americans, particularly democrats gave a lower approval to the biden-harris ticket than they had been giving to the biden ticket alone. the second is that she has had almost four years to demonstrate any kind of competency. any kind. >> brian: i know. >> pick a leadership issue. take some time. study a little bit. if the test for president is can you cackle? if the test can you laugh in the middle of your statement? you cannot be ever serious? she passed with flying colors. her own party knows that she's incompetent. she may, in fact, be one of the most incompetent people in the biden administration setting aside the president's difficulties.
