meeting when the democratic governors don't want to put their names and reputations on the line without verification? >> incredibly important. the base of support, newsom and others who are spinning in the debate room in atlanta. these governors have been some of the best supporters on television, media for the president. so i think it's critical for them to see the president up close and personal and to continue their support of the president in the media. the gospel of the day in the catholic tradition is that of the doubting thomas. blessed are those who believe without seeing, these guys want to see first and then continue on in their support of the president. >> shannon: the "new york post" has this editorial piece this morning. there is no way to restore the illusion that biden is fit for the presidency but these governors out there giving less than full throated endorsements are going to come here. will they be deputized to go out with him i met with him, he is

doing great, let's move on. >> that's what the white house is trying to do here. when you have nancy pelosi questioning the president's capability it's fair to say we're deep in dem disarray tear tort and difficult to put it back in the box. >> mike: what about vice president harris saying she polls better in some regards. are some people close to her measuring the drapes? >> every indication that's not the case. they have their regular monday staff call with the vice president's team. they are full throttle in support of the president. i don't think there is any kind of measuring the drapes. she is a strong advocate for this president. i think she is the one that actually enthusiastically engages the base. she was on the college tours talking about reproductive health and out there doing the work of the president in terms of engaging young people and people of color. a strong teammate to the president. allocations are that she is fully on board with supporting

the reelect. >> shannon: you see this poll within striking distance within the margin of error head-to-head with president trump. emily, we know over the last couple years she has polled behind president biden when it comes to favorability, job approval. in these new numbers we're seeing she does better with people of color and younger voters. she had better energy and also their point person on the issue that has been the best for them, which is abortion. >> absolutely. this shouldn't be surprising. we saw four in ten democrats saying president biden should be replaced on the ticket after the debate. we see people looking for other options and calling harris makes sense having access to democrats fundraising capabilities and president biden's network and some republicans saying perhaps she should be the nominee if biden steps aside. we are seeing testing of the waters from democrats and start to see more of that particularly as members of congress come back next week and here in person and

getting asked what they think about the president. >> mike: president biden is underwater on the economy, 32%, immigration 28%, foreign policy, 36%. role of commander-in-chief 35%. kevin, so far we haven't heard from a lot of swing district members of the house and/or swing state senate candidates. how are they down ballot? >> they are holding their fire a little bit. they want to see more additional polling. we saw to shannon's point the cnn poll only a slight drop for the president. he increased his vote share in the most recent reuters poll. but to that commander-in-chief question, in terms of that polling, i think the president has a great opportunity next week hosting the nato summit here and see commander-in-chief in full control of his abilities leading the world stage from here in washington, d.c. and it is a great opportunity to hopefully flip the script on a lot of conversations happening.

>> shannon: to the issue about foreign policy growing editorials and polling before the debate and now since post debate on foreign policy. voters give the edge to president trump. most of these polls it is by double digits. how important will the nato meeting be next week? >> it is critical and has to be front and center. clearly in control and serving in that role as commander-in-chief. i also think president biden has trouble cause he is losing the progressive left on foreign policy. youth voters who have been consistent democrat voters are out there saying they're concerned about gaza and israel and not necessarily going to show up to the polls for him. this is a huge area there is a weakness for the president without the problems of the debate. >> mike: great start, thank you so much. >> shannon: hurricane beryl churning across the caribbean leaving death and destruction in its wake. three people killed in venezuela. check out these images. the monster storm now a

category 4 barreling straight towards jamaica where we find robert wray. good morning, robert. >> good morning to you. look behind me at the north atlantic in jamaica on the west side and it is gorgeous. you wouldn't think a category 4 storm is making its way toward this island of nearly 3 million residents but it is. we'll start to see the impacts of these ferocious winds, rain and storm surge as the day goes on. look at some of the damage video from the island neighbors to the east, including grenada, unfortunately many structures in decembermation. we have at least six people killed, including people down in the country of venezuela. it shows you the swath of this storm of beryl. the problem is right now beryl, although it is less in intensity, it is not weakening as predicted.

court's decision on monday. >> shannon: that is certainly true. now the judge overseeing president trump's new york criminal trial is agreeing to delay the former president's sentencing following the supreme court's historic ruling on monday on immunity. still up in the air, how that decision affects trump's conviction in the new york case. let's bring in tom dupree, former assistant attorney general. always good to see you. i want to read president trump's characterization about the ruling monday. he said total exoneration all caps. it is clear the supreme court's brilliantly written and historic decision ends all of crooked joe biden's witch hunts against me including the white house and d.o.j. inspired civil hoaxes in new york. let's talk about the impact. man, it was a broad, good decision for the trump legal team but doesn't mean these cases are over just yet. >> that's right. there are still a few steps that have to happen before the cases come to an end.

for the bragg case, the significance is embedded deep within the supreme court's immunity decision was an important point which is that prosecutors can't use evidence with a president's official act to support a prosecution even for something that's non-official. in other words, it's a rule that says this evidence can't be used in any way, shape or form. so what is going to happen over the next couple months is that the prosecutors, trump defense team and judge in new york are all going to have to look at what evidence came in in this trial and was there so much evidence of his official acts that it tainted an polluted and corrupted the entire proceeding. >> shannon: there are all kinds of conversations with white house advisors and texts and emails and all kinds of things as we sat through the six week trial there is a lot to unpack. who does that? does judge merchan ultimately make the decision what should be allowed in and out? if it doesn't go well for the

trump team and leaves the convictions intact they'll appeal merchan's decision that delays the new york trial and potentially sentencing, too. >> absolutely. look, yes, judge merchan will be the one who makes the first call whether this evidence requires a new trial or setting aside the conviction. he is not going to be the last word. i suspect that honestly whichever way he goes on this, i think you will see the losing side appeal that decision. and then even after the new york appellate courts have weighed in it wouldn't surprise me if the united states security gets called on to make these types of decisions. from the prosecutor's perspective the immunity decision has upset the apple cart. >> shannon: can you give us a look how it impacts the federal cases? the jack smith case in d.c. is sent back down and look through all those things.

the immunity case, also applies to the mar-a-lago case and may put dents in that one, too? >> i think it does. it puts major dents in the january 6th jack smith prosecution. as far as the mar-a-lago case goes, i think it will have an impact. not as direct an impact as the january 6th case. it will have an impact and jack smith has to go back and parse through the indictment and make sure he isn't basing any charges on the official acts of then president trump. the other significant aspect justice thomas had a significant concurrence in the immunity decision when he questioned the legitimacy of jack smith's appointment. there may be attentive judicial leaders including cannon in florida paying a lot of attention to what justice thomas had to say about that. >> shannon: it got a little attention but not much. justice thomas has stayed on

israel and hamas after israel orders mass evacuations for southern gaza. a quarter of a million people will have to flee. trey yengst is live from southern israel. >> israel expanded evacuation orders for palestinians living in parts of rafah. an israeli military spokesperson telling fox news the new orders are only temporary amid heavier israeli strikes in the area. the hospital is treating many of the wounded and sick palestinians from southern gaza but remains overwhelmed and at capacity. the u.n. calling the new orders an impossible choice for civilians. >> evacuation of such a massive scale will only heighten the suffering of civilians and drive humanitarian needs higher. people are left with the impossible choice of having to relocate. >> as israeli soldiers continue to operate against hamas inside gaza, israeli officials are facing new questions about what the day after the war looks like

options out there for democrats. >> shannon: democratic congressman from massachusetts joins us now. always good to see you, congressman. bill reports there are growing numbers of coalition of house democrats to come forward publicly and ask the president to step down from the ticket. where are you on this at this moment? >> well, i have no inside knowledge of those reports. but i think that public conjecture on table news is not the right way to have the conversations. talk to president biden directly and have candid and tough conversations about the best path forward to defeat donald trump in november. that is the unifying issue for not just democrats but a majority of americans. the takeaway from the debated the president delivered a strong performance would have been donald trump refuses to distance himself from project 2025, put aside the federal bureaucracies.

not just home land security but social security as well. voters need to understand social security checks may come with strings attached by president trump. >> austin, how alarming should be it be to the president's team and campaign that he was the first to call for him to go? >> well, i think it is bigger than one democratic lawmaker, 50 million americans saw the debate and have real concerns and regardless of what the president decides, it will need to be a team sport going forward. governing is a team sport. the president has a terrific cabinet around him and the campaign should be a team sport. upcoming stars like pete buttigieg, others talking about manufacturing and kamala harris putting on her prosecutors hat tearing apart donald trump that he lied an average of 90 seconds and lawlessness that repels law

and order. we have strong people not just at the top of the ticket but around the ticket who can be strong surrogates. >> shannon: let's talk through some of those names. polling head-to-head for the vice president versus president trump. she is down 45-47 within striking distance. gavin newsom is down five points, buttigieg down four points. there are names and a bench out there. how do you decide when it's time to call somebody in from the bench and say okay, this is it for you? you talk about a team sport. could the party get quickly organized behind someone else as they would need to do? >> ultimately whether it's the president or another democrat, the best person to defeat donald trump is donald trump himself. he is historically unpopular with a majority of americans. foundationally it is because his character is morally bankrupt and americans want a leader of

this country to be someone they can respect and trust to put country before self and donald trump has demonstrated over and over again he refuses to do that and his second term would be far more dangerous than his first term and just look at what project 2025 offers. he will refuse to listen to congress when it comes to spending decisions and refuse to listen to the courts and turn the d.o.j. into his personal law firm for retribution and take basic services that americans rely on like medicare and social security and stamp them with the trump branding and politicize them. this is the argument we need to make. i want joe biden to forcefully make it but whoever is at the top of the ticket are equipped to make it. >> mike: i'm struck by former speaker nancy pelosi's language who has been in politics a long time. she asked is it an episode or a condition? what do you make of that? >> i don't make diagnoses. i am a politician, not a doctor.

his mind would wander and need prompting in certain meetings. members of congress were there to talk to him about issues of national security and they were very concerned about his ability to focus and do these things. so who is to blame that we're in this position now? because this is a man on the ticket unless his party does something radical and he decides to step away. he is the one who has been for the last 3 1/2 years negotiating all those meetings you talk about. >> it's a combination. it stops first and foremost with the president because he is the guy that's making the decisions. the one that's on the ticket. but then just right below that is the democratic leadership. they've got to see that this is not something good either for the democratic party or for the united states. if you can't have somebody who is genuinely sharp and on top and can provide leadership in a world with so many potential wars that could suck us into one of them which would all be bad for us. you have to have somebody who is
