>> julie: we'll begin with big news. fox news alert. the team biden is still trying to clean up the mess from his disastrous debate performance. white house chief of staff will hold an all-staff meeting shortly. i'm julie banderas in for harris faulkner. this is "the faulkner focus." that one call is one example of biden world's panic over the president's re-election chances. a new axios report saying that biden officials are feeling everything from rage to sadness to frustration over the debate. one official putting it bluntly everyone is freaking the f out. another report detailing just how a planned house democrat meeting devolved into a full blown anti-biden grievance session. the wall is cracking with congressman calling for biden to drop out. golden predicting trump will win

and says he is okay with that. former speaker nancy pelosi softening her full throated support with this. >> he has a bad night. now, again, i think it is a legitimate question to say is this an episode or is this a condition? and so when people ask that question it is legitimate. of both candidates. >> julie: biden's inner circle is urging him to keep pushing forward . reporters were more than ready when press secretary karine jean-pierre gave her first briefing in two weeks. watch. >> what happened that night? what did we see? >> is anyone in the white house hiding information about the president's health? are you being straight with the american people? >> why can't you come down here and assure us and the american people that he is okay. does president biden at 81 years old have alzheimer's, any form of dementia or degenerative

illness that might cause these sorts of lapses? >> he knows how to do the job. and he knows how to do the job not because he says it. his record proves it. >> julie: "the new york times" reported told an ally he is weighing whether to continue in the race saying it is the first indication he is seriously considering whether he can recover after a devastating performance. senior white house correspondent jacque heinrich was there for all of that and joins us now. >> we're looking into that "new york times" report that says the president understands he will have a very hard time recovering as a candidate if he cannot convince the public that he is viable in the future. so that acknowledgement that this is in the back of his mind is the first report to that effect we've seen. the calls for the president to step aside are reaching a fever pitch. 25 house democrats are preparing to call for him to remove

himself from the race if he appears shaky over the next few days. you had one member calling outright for him to step aside. this morning progressive congresswoman summer lee says time is not on the party's side to come up with a replacement. the campaign responding to all of this says all the chatter is silly. listen. >> it's just getting a little silly here that we are talking about one night in this presidential campaign where yes, he had a bad night. why are we letting that continue to make the news about what is at stake in this race when really there is so much online for women, so much on the line for families across this country, our economic freedoms are at risk. >> yesterday the president spoke with ham em jeffries and meeting with governors today. kentucky governor andy beshear says they just want to make sure

that biden is okay. >> i think the governors just want a direct and candid conversation with the president. we want to make sure you is doing okay. we all know him. he has formed a personal relationship with us and he says he is and we take him at his word but it is always good to see somebody in person. >> officials faced brutal questions yesterday. the whole of washington's press now asking the very questions that were once shamed about the president's mental fitness. everyone saw the same debate which reflected the same shakiness that was seen in many videos of the president recently which the white house deemed cheap fakes. the press secretary said she had no regrets using the term. it was coined by the media. >> president biden was being targeted with misinformation and purposefully being done to this president. what we did is we echoed that. i don't regret it at all. >> the administration's response

to our questions often seems to be don't believe your lying eyes. the border is secure, afghanistan withdrawal was a success, inflation is transitory. >> i think we have a right to say something we don't think is true. >> just over an hour from now the white house chief of staff is going to try to quell staff concerns because they are reportedly melting down unable to get explanations to quell their own worries about the president's mental fitness and reasons why the president appeared as he did on the debate. the campaign said they'll start having these conversations on all staff emails more often to keep people in the loop. we'll see the president also later today at a briefing ceremony. the white house says his son, hunter, is in the building and been supporting him and here for the fourth of july and that is the reason why he was present yesterday at a meeting where senior advisors were, which was confusing reportedly to some of the staffers, julie.

>> julie: definitely. all right. the "new york post" editorial board with this headline. enablers have been hiding the worst of biden's senility from americans. it may not be so hidden now, though. a post debate poll finding more than half of voters now think biden should drop out after the debate. that includes nearly a third of democrats who think biden should withdraw. david avella, gopac chairman and doug schoen former clinton advisor join me now. the breaking news "the new york times" came out with. the fact biden has allegedly told an ally he is weighing whether to continue in the race is a huge development because the biden campaign, the biden camp has maintained no matter what hiccup that they've had in the past they are pushing through and that there is no way that he would potentially weigh that sort of decision. what kind of pressure do you think the insiders are putting

on biden right now? >> huge pressure, julie, huge pressure. the fact of the matter is despite what the biden campaign says, if the democratic establishment, the congressional leadership, the grassroots of the party say he can't handle a campaign, he is not up to the job, he is too old and the leadership of the party, presidents obama, clinton, congressional leadership say the same thing publicly or privately, joe biden will have no choice but to drop out. he cannot sustain a campaign if the party turns against him. and everything i'm seeing now that is both happening and happening with great -- >> there is one person who doesn't believe joe biden is in mental decline which is joe

biden. not uncommon among those suffering from mental decline. the second person is jill biden. for all of this talk of all these members of congress and all these elected officials who want him to get out, it really isn't going to come down to what does jill biden and joe biden think? as you look at some of the recent polling and heck, we learned yesterday that rfk will be the libertarian nominee in colorado, if states like colorado become in play, then all of a sudden resources get taken from the true swing states and biden starts getting under water pretty fast. >> julie: jill biden is aiding and abedding elder abuse as far as i'm concerned. the fact she has seen her husband struggle and has not stepped in especially after this debate, you know, it is an urgent matter. white house spokesman andrew bates posted this on "the new york times" report. we have to get this out here. he quotes that claim is absolutely false. if "the new york times" had

provided us with more than seven minutes to comment, we would have told them so. that's very interesting. doug, it doesn't seem to me that it would be so farfetched for a private conversation to be held. would it indicate necessarily that biden is actually considering stepping aside, maybe not. i'm sure the conversation has been had. somebody had to have had this conversation with biden since debate. >> i would be startled, if the conversation did not happen. i would be startled if there were not multiple conversations with joe biden and with the key staffers around him. look, what david said about the swing state polling is now evident in what i've seen and most observers have seen. states that were in play -- not in play are now in play and the seven swing states all show comfortable leads. if that continues, it will be impossible in my judgment for

joe biden to stay in the race politically and if the cognitive issues appear as serious as they did during the debate i can tell you, he will be out of the race within a couple of weeks. >> julie: the list of things that team biden, you know, have been blaming for the dismal debate is growing. his family pointed the finger at aides accusing them of overpreparing him. inner circle reportedly said the make provided by cnn made him look pale and pallid while trump looked tan. he has gotten a spray tan. they took care of that problem. there is another reported culprit that no audience at the debate perhaps hurt him and exhaustion after an international travel to france and italy. biden telling supporters yesterday i decided to travel around the world a couple of times shortly before the debate. i didn't listen to my staff and i almost fell asleep on stage. oh my gosh. of course, that cold that we told -- we're told he had on

debate night is still an issue. watch. >> i would not see this as an episode. he had a cold. that is the reality of the situation. that is the reality of what happened that night. >> julie: biden's deputy campaign manager telling donors the media has spent a ton of time blowing it out of proportion. did you see him doing the cupid shuffle on debate not? probably not. the media is hyperventilating and manifesting drama. that is unfortunate they can't come out. kjp as come out and said he had a bad night. not because of the cold. i have two men on camera. the man -- one of you have gotten it. you can't even blame man flu on this. a scary situation that certainly unfolded before the american public. not the first time. the reason we don't see the news

conferences and ad libing and relying on a teleprompter, this has been building for a very long time, david. now the american public has been exposed to it. >> you showed the 33% of democrats think he should not run for re-election. that becomes one of the most important voter blocks now in this race. do they vote for robert kennedy? do they vote for donald trump? do they stay home? that is what the biden campaign -- let's go back a second about why would biden wait so long to get to atlanta to do the debate? if he is tired why did they make him travel on the day he has to do the debate. some criticism of the campaign and how they run is warranted. that said, voters are also going to make their decision is up for the job. that's what the summer will be about. >> julie: karine jean-pierre had two key words to explain biden's

question is, is there something they're not telling us? >> well, they certainly haven't answered, julie. and as far as i can tell, i've never seen -- i've been in politics close to 50 years. i've never seen a debate performance that bad. certainly not by an incumbent president. so this is unprecedented. i think my party will be benefited by an open nominating process, an open convention with transparency. i think that's where we are heading and i think that's the only way my party can win this election, an election that is rapidly slipping away from us. >> julie: doug schoen, thank you very much and david avella. the judge in former president trump's new york criminal case has postponed the sentencing date. that comes as a result of the supreme court's decision on immunity, which could affect all the cases against trump. his supporters cheering the ruling as a victory against the

>> julie: the victory for former president donald trump. the judge in the new york trial delayed sentencing until september 18th if it even happens at all. it comes as judge juan merchan can weigh the possible impact of the supreme court ruling on presidential immunity. trump's lawyers are arguing that it also merits tossing out his

entire conviction all together on felony charges of falsifying business records. jonathan turley says not so likely. >> whether judge merchan will be persuaded. the expectation he will rule against the president and this will delay it but sentencing will still come in september. >> julie: the supreme court granted broad immunity to presidents and restricts prosecutors from using any evidence or testimony concerning official acts to -- a former d.o.j. official says it could impact some of the evidence by the d.a.'s office. >> they said evidence of official acts cannot be used to help support prosecutor someone for unofficial acts. case in point. the new york trial. it is personal conduct, private behavior, sleeping with porn stars, cooking the books of your corporation, whatever else,

right? however, it relied on the testimony of hope hicks, former white house aide and other evidence that is tied to his time in the white house. now, trump's team can plausibly claim some of these were official acts that can't even be used as evidence. >> julie: katie cherkasky is a former federal prosecutor and joins me now. a feather in trump's cap. the question is will judge merchan basically throw the entire case out at this point? the likelihood of him being sentenced at all, what would you say that would be on september 18th? >> we're such a novel position at this point. it was a great week for former president trump legally speaking. as far as judge merchan reviewing this case before the sentencing, he essentially has to look at whether this evidence would have potentially changed the outcome. as you just showed, any evidence of any official acts is not to be used in a prosecution whatsoever. i think the bigger question, though, is what standard of

review the appellate courts might use and whether they will actually require that prejudice be shown or whether just because the evidence was used there is something called structural error to make the case go away all together. judge merchan is the first of many reviewing officials that will look at this. even if he denies the dismissal of the case the appellate courts will review the issue as well. >> julie: if it made it to the appellate court we know how long it takes. it won't be decided before the election. >> absolutely. appellate processes can take a very long time. if there is a sentence it will go through the typical appellate process. >> julie: chuck schumer ripping the supreme court's decision saying this. this disgraceful decision by the maga supreme court he called it comprised of three justices appointed by mr. trump himself enables the former president to weaken our democracy by breaking the law. you are nodding your head. >> i think it's a very myopic

position because of hatred toward donald trump. this deals with the american presidency. when you start going down hypothetical ideas what might happen. >> julie: the wall street editorial board so-called maga supreme court doesn't exist. unanimous decisions in the following cases, colorado trump ballot case, ruling against pro-life doctors suing the fda over the abortion pill and decision allowing the nra to sue a new york regulator for coerceing insurers to stop doing business with gun rights group. out of the 49 decisions by the court in this term, only 11 were decided along straight ideological lines. to call this supreme court maga is a cheap shot. >> i would say so. you could pick and choose and say something favors one side or the other. court is in my opinion following the constitution and making decisions not for the ages, not the particular controversies at

issue. political or not. >> julie: i want to bring up the evidence in the new york criminal case. it does reflect on witnesses that were in the white house. hope hicks was one of the witnesses that would then, you know, grant the president immunity. so that witness would no longer be applicable as far as a conviction. how do you fairly sentence someone when they were convicted without the idea of immunity, right? if you use white house aides and using witnesses that would fall under immunity. i don't know how do you differentiate between what evidence can be used and not and would the evidence, been thrown out, have been convicted. >> when a judge or appeals court reviews a case and inadmissible evidence they have to review without the evidence the outcome would have been the same unless there was structural error, it is still a bad case. then if the case is thrown out, the case can be brought again

but you cannot use any of that evidence. i don't know whether they can get a conviction with that. hope hicks testified, there are statements that donald trump gave while in office. the charges themselves are actually acts committed while he was in the white house, the actual payments and bookkeeping. so there is a lot of question what is official and unofficial and that has to be determined first. and then the question whether the case can still stand without that evidence. >> julie: right. your guess, will it get thrown out? >> based on the merchan's i doubt it. this is the first of many issues on appeal. >> julie: we'll see if the sentencing happens on the 18th. my bet is no. thank you. the democratic freak-out over president biden's dismal debate performance is only getting worse. more house democrats reportedly looking to pressure biden into dropping out of the race. the white house just denying a "new york times" report that literally just broke before this show that biden is talking to an ally about his options.

plus some white house shadow campaigns are already generating buzz. vice president kamala harris is one of the names being floated around along with six other high-profile democrats. >> i think it is going to be an open convention. i think you will see folks like andy beshear of kentucky, josh shapiro and gretchen whitmer contending. the majority of voters were concerned about joe before the debate. now it's a clear majority.

"politico" opinion piece says it is not too late to replace biden and defeat trump. it references seven shadow campaigns, vice president kamala harris, governor newsom, gretsch inwhitmer, pete buttigieg, josh shapiro, illinois governor j.b. pritzker and andy beshear. >> i will support her. i want the ticket to continue to be biden/harris and we'll see what happens after the next election. no, this should not in any way do anything to work around ms. harris, we should do everything we can to bolster her whether it's in second place or at the top of the ticket.

>> julie: a new poll shows harris is running closer to former president trump than biden is. 45% say they would support harris in a hypothetical match-up. two percentage points behind trump at 47%. biden trails the former president by six points. cnn senior data reporter says anyone but biden may do better against trump. listen. >> harris is not as well-known as joe biden. she is not as well-known as donald trump, either. but if you look at this point right at this time, what you see is that 22% of voters have no opinion of kamala harris. compare it to 8% for joe biden. 7% for donald trump. so at this point in my mind she is a generic democrat looking at this data i am not really quite sure that democrats can do any worse than they are doing with joe biden at the top of the ticket. >> julie: another poll 50% would support michelle obama compared

to trump's 39%. biden and trump are tied at 40%. jason rantz is joining us now. i cannot believe when i read all of these stories that this is actually happening. we're in july. the election is in november and the democrats at this point aren't sure who is going to be the nominee or even be running for president, if the president indeed were to step aside. >> so much drama. >> julie: it is unbelievable and crazy. >> here is some important dates. not even about november and this is why i have a hard time believing this is actually going to happen and biden will step away. you have august 7th as the deadline to get on the ballot in ohio. in washington state you have the deadline to have a candidate that is certified by august 20th. you just have to have a provisional certification. if it goes to an open convention, are you going to skip out on ohio and skip out on

washington as a democrat? because certainly washington you will get the electoral votes no matter who you put up. you'll throw that away? ohio right now trump is in the lead. could that change if you throw someone else in there? maybe, maybe they give up on ohio. the time of this is not on the side of the democrats. if biden is going to step aside, he will have to make that decision within the next few days and there can't be a bunch of shadow campaigns. they can't go into an open convention. they have to be able to say one person, kamala harris, whoever will be the nominee otherwise they are making this even more difficult to win if they kept joe biden on the ticket. >> julie: you are right. "the new york times" came out with the big news that broke right before our program. the headline biden told ally that he is weighing whether to continue in the race. the white house senior deputy press secretary, andrew bates, countered that almost immediately tweeting that claim is absolutely false.

if "the new york times" had provided us with more than seven minutes to comment, we would have told them so. these conversations were certainly had in the white house. there is no question that the conversation hasn't been had. anyone who wouldn't have this conversation would be reckless. the question is, is president biden simply just having a conversation because people are approaching him or is he really weighing stepping aside? if he does that for the good of the party it should have happened by now. >> frankly, can we count on him to remember the conversation he might have had with any ally? i do know the reporting suggests the people closest to him, his inner circle, family telling him to stay in the race and something tells me he will listen to them over some of the noise that's happening. again, he is aware of the timeline. i'm sure there is a lot of conversations by even his big public supporters to rethink things. but i think when you have power, you are very unwilling to give it up. if you are the sitting president, even if it's joe biden and even if he understands the path to victory is going to

be very narrow at this point, you don't want to just willingly give it up. it will take a lot more pressure and what we're seeing publicly, this is so important, because it is really being framed in a way by left wing media outlets, i think, to try to cover up for the fact that they lied about his condition for the last three years. every single time they went on tv and anyone on the right questioned the mental cognitive issues of joe biden, oh, it's lying, conspiracy, they are doing that because they're scared. they have changed their tune. everyone saw the debate. >> julie: when karine jean-pierre is asked about video aired and called them cheap fakes, what do you call the debate? if that was not a fake. that was real. this did not happen overnight. cognitive decline does not happen over a short period of

time. this has been going on for years which boggles the mind of the cover-up process that is currently happening in in white house. we know there is a cover-up. no question, that is not speculation, that's fact. what else are they covering up? a delegate for president biden's re-election effort warns democrats about replacing the presumptive nominee and the impact on black voters. >> there is a long list of democrats, kamala harris, gavin newsom, gretchen whitmer. the list goes on and on. where is there consensus? you have to build consensus. there is not consensus right now. if you pick a white man over kamala harris black women will blow up the party and walk away. >> julie: i don't know if that does the democrats any justice by saying something like that. i quite frankly do not believe that black voters will vote for kamala harris simply because she is a minority. i do not believe that will help her. i think her record is what's

going to hurt her. nothing to do with her ethnicity. >> you mean the border czar might not have a great record? >> julie: one job and she screwed it up. >> the reality. i agree with you. i don't think there will be a mass movement of black female voters to go against the democrat whoever it happens to be. however, here is a vim i had question. when you have races as tight as they are now or we presume to be tight in the swing states, does 1% of the vote that says yeah, i'm upset here in arizona, i'm upset in pennsylvania and in michigan, does that 1% not vote, do they not vote for the democrat? do they vote for a third party? it does matter when it comes to those swing states. that 1% in any of those states can swing this entire election. right now democrats can't afford to lose a pennsylvania or a michigan. those are clearly in play with the exception of wisconsin, where it is neck-and-neck, all

the other polls suggest that trump is up by receive -- a few points and i expect that won't change. if anything it will get worse. there was some concern over a poll that will come out potentially later today or tomorrow showing the post-debate swing and the biden camp is suggesting it is going to be pretty painful. >> julie: black and hispanic and minority voters are in trump's camp. they see what kamala harris didn't do for the country. abc news announcing that president biden will give his interview since the debate to george stephanopolous, a former obama white house official. brian stelter says it is not enough. watch this. >> this reminds me of the old phrase about putting a band-aid on a bullet wound. an interview at this point would be a band-aid on a giant gaping bullet hole. this body, president biden, is

bleeding out and a single interview will not change that. i think instead of just an interview, think about another debate. think about a rematch between trump and biden. think about a series of press conferences. think about a series of town halls. that would be a little bit more, i think, in the realm of what might help at this point. >> julie: another debate, series of town halls. put the band-aid on a bullet hole. he said if he could, he would. and that is such an important point to make. if he could, he would. they have damage control, they have had plenty of time to plan damage control and he hasn't done anything. if he could, he would. the reason why is because he cannot. >> 100% cannot. i don't know anyone who will unsee that debate. it doesn't matter if he has a good two-hour press conference with the press or reasonably well in the next debate. everyone will make an excuse for
