they are upside down and backwards on every single issue there's a reason trump was kicking there but before the debate destroys them at the debate and they got joe biden over there that can't make an argument for any of his policies i'm hoping republicans focus on policy because that's where the differences lie. >> absolutely in the democratic party has proven in the last week is the party of chaos. this country has seen a lot of chaos from biden's terrible policies over the last 4 years whether it's chaos at the south border, invasion of illegal criminals and terrorists from the country around the world increased crime in communities, chaos in the economy where hyo- hard-working families cannot afford things because their wages don't keep up with the pace abide in inflation with chaos abroad were in ukraine and the middle east none of this happened under donald trump a few years ago so it doesn't

edition of hannity. amid speculation joe biden could drop out of the race. a prominent conservative think tank is showing just how difficult it would be for the dnc to replace biden on the ballot. the heritage foundation which i'm associated to compiled a report on laws in key swing states for replacing nominees. the think tank oversight project sent out a memo stating there is a potential for pre-election litigation in some states to make the process difficult and perhaps unsuccessful. here with more as the heritage foundation oversight executive director mike howell thank you for joining us a lot of democrats think they could just simply swap them out to go to the convention swap amount new nominee in there on all the ballots. >> not so not so fast other things in the united states called states -- states and they

have their own procedures and basically there's different sets of ways to go about actually doing the substitution or withdrawal they have to contend with and with that differing timelines and qualifications that need to be met and there's a question of the dnc itself at the formal nominating process that informs a lot of the state laws have a difference how the law treats candidates compared to how they treat a nominee. the short of it is president biden dick clarity today he is the nominee of course the convention isn't until august i believe they are acting defensively now to try and protect themselves from such challenges to basically argue you can't replace me it's too complicated these guys will sue us some they don't want to happen. >> part of the issue is in order to get off the ballot 1 would have to have a note from a

doctor claiming you are incapacitated and unable to perform the duties and that is 1 of the conditions to be taken off the ballot. how could the president do that if that was the excuse but then also continue to be president of the united states if he wanted to be? >> it's a great question for the administration we had a federal finding of incompetence from the special counsel when in his report he referred to biden is unable to stand trial. to have such a finding and relitigate it. what counts as incapacitated is it a doctor's note is it something else. that's something i think we could sue on because it's really important the election integrity laws in the country are followed that's the lesson from 2020 but the rules were changed in the middle of the game to convenience 1 side of the aisle people of doubts of the outcome of the election we want to make
