russo-elling "rust" movie. criminal defense attorney lexi rigdon joins us. let's start at the end. i mentioned 18 months behind bars. do you think alec baldwin could actually face time in jail if he's ultimately convicted? >> if convicted, yes. but hannah gutierrez-reed, the armorer, got maximum, 18 months in prison, and that was her job. she allegedly brought the live rounds to set. her culpability is different. my prediction, if convicted, i don't think he faces maximum amount of time. it is his role in what happened in this. he was the one who pulled the trigger, his job was not as the armorer or to guarantee safety of the gun. there is evidence that can't come in.

my prediction is he would not get that amount of time if convicted. >> todd: what does prosecution need to establish in order to prove involuntary manslaughter in light of yesterday's ruling that baldwin's role can no longer come in. >> they will have to establish he was reckless in pointing the gun and shooting the gun. now there is a big dispute over whether he shot the gun or not. he said the gull malfunctioned and he did not shoot it. p prosecution will have to prove he was reckless in doing so. it would have been easier to do so if they had theories of liability here which is not only was he reckless in shooting the gun and pulling the trigger. if you don't believe that, he was reckless in the fact it was a sloppy production and safety protocol was not followed.

the attention has to be on whether it was reckless as a person in his position who was told he was give a gun that was safe, whether it was reckless to shoot it. the armorer, that was her job. i'm not sure whether he's going to be convicted. there are some serious issues with the prosecution's case and if he were not a celebrity and this was not high profile. no dispute this was an accident and not done intentionally by him. reasonable minds can differ. >> todd: you are a criminal defense attorney, if you're on baldwin team, how would you poke holes in the prosecution case? >> i would say, the person who is responsible for this is in prison right now, her name is hannah gutierrez-reed. she had one job and did not do it correctly. she was careless and brought
