>> the republican national convention will kick off monday from milwaukee as former president trump will hold a rally in battle ground pennsylvania later today. meanwhile, president biden defiant presses on with his reelection bid as the list grows to nearly 20 congressional democrats calling for him to bow out of the presidential race. welcome to fox news live. i'm molly line. hello, griff. griff: hey, molly. great to be with you. i'm griff jenkins. the president is in delaware where he'll hold meetings with two groups today, this of he was told point blank to drop out by a house democrat in one of the meetings. and lucas tomlinson is in delaware kicking things off. >> good afternoon, that's right, president biden will be manning the phones today calling two different groups of house democrats, the

progressive caucus and the new democrats, which as the name suggests, contains 13 house democrats that have called on the president to step aside and not run in this race. this comes as a new washington post abc news poll shows a majority of democratic voters say somebody else should be the democrat's candidate. as you mentioned last night, president biden speaking in detroit says he will vow to stay in this race. >> there's a lot of speculation lately, what's joe biden going to do? is he going to stay in the race? is he going to drop out? i am running and we're going to win! i'm not going to change that. >> we owe you big, everybody knows i like kids better than people. look, folks, there's a lot going on. we're here to have a rally. >> as you just heard speaking before the rally at a

restaurant in michigan congresswoman debbie dingell's district, where he said, i promise you i'm okay. he'll spend the weekend before heading to texas to speak at the lbj library, and johnson shocked the nation in 1968 when he announced he'd be dropping out. and president biden was asked why he isn't the transition candidate. >> you referred to yourself a bridge candidate for a younger, fresher generation of democratic leaders and i wanted to know what changed? what. >> what changed was the gravity of the situation i inherited in terms of the economy, our foreign policy, and domestic div division. >> president biden is here at his beach house, his family will be very busy.

keeping his job, but keeping their jobs, too, this fall. >> what i'd like to hear from the president and his team, cold facts and objective data. if they have different polls they ought to show us the polls. this is about winning. there's no second place in campaigns. >> there have been mixed reactions to the president's attempts to shore up his support among different factions, during the call at the caucus, one told him to drop out. and the president's and senior aides was difficult and tearful. the majority of lawmakers felt just as, if not more concern about the path of the party with the president at the top of the ticket. one of his most outspoken advocates is pennsylvania senator john fetterman. >> when are you going to just decide, hey, deal with it, deal with it. joe biden is our guy.

will enjoy the media spotlight after weeks of president biden and democrats in turmoil. former governor scott walker says that trump has been smart to stay relatively quiet during that. >> you've seen incredible discipline for former president donald trump to do that and let them implode. who would have thought that please don't quit, joe, would be the cry at a presidential rally just months before the november election. right now, that's it. >> now, here in milwaukee, democrats have promised counter programming pretty much all week long and protesters with the group called march on the rnc were here downtown last night saying, they expect up to 10,000 people to protest against the rnc and republicans starting on monday. >> join us to fight against the republicans racist and reactiony agenda to stand with palestine, to defend women's,

lgbtq and reproductive rights, to defend and expand immigrant rights and to advocate for peace, justice and equity for all. >> now, we're still waiting on more details in the official rnc schedule, but here are some of the speakers that fox news has been able to confirm will be on stage next week. we've got a wide variety including florida governor ran desantis, amber rose, kanye west's ex-girlfriend, and trent conway, and dana white. and the republicans chose milwaukee for a reason and fox news power rankings show that wisconsin is a tossup state, a battle ground state, if you will. so republicans are obviously hoping to flip this state red as they did before in 2016. we'll send it back to you. griff: bill melugin live for us in milwaukee. bill, thank you. molly. >> for more on the rnc, we're

joined by trump deputy campaign, caroline sunshine. and bill melugin did a fabulous job how the rnc has a little bit of spotlight on republicans this week. we shall see. there's been a dark cloud and drama and suspense on the democratic side. what are the republicans going to do to take a little bit of that sunshine, if you will. >> absolutely. well, we couldn't be prouder to have president trump as our nominee. he's unified the republicans behind him and you saw the new platform that president trump was intricately crafting for the rnc. this platform is dedicated to the forgotten men and women of america and who the convention is dedicated to as well and who president trump has been fighting for since he came down the elevator in 2015. and for the people who suffered under joe biden the last years, and cleanup on aisle 46, if you

know what i mean. this convention, we're highlighting the american people themselves. we are going to hear from people who have been affected by joe biden's chaos and disorder. we're honored to have some of rachel morin's family with us. and amber rose, and looking forward to seeing the young men from the unc fraternity and your viewers may remember joe biden allowed protesters on the college campuses and these young men were brave enough for our flag and ideals. and not only is president trump and his winning message going to be on full display, but so are the american people that he loves so very much. >> yeah, a lot of the suspense on the democratic side, long drawnout well-being check from governors to house members

checking in and seeing how he's doing. on the republican side the big suspense is around former president trump's potential vice-presidential pick. can you give us any insight? do you have any scoop or hint that you could give us? >> well, molly, since it's just you and me -- just kidding. [laughter] >> of course, i'm kidding. i would say of course the only person who knows who president trump will select as well as when he will announce is of course, president donald j. trump. you made an excellent point. this couldn't be another point of contrast between the decline and disarray of the democratic party. and endless speculation who who he's going to select as vice-president, and and the democrats discuss if their vp is going to replace the nominee. and he understands the stakes, and he's going to select someone who will be an

excellent partner for him in making the country great. >> i had to a try, i had to try. the cop tcontrast. and democrats looking at frozen money, and shifting to houses and congressional races, we'll see. there's a headline that elon musk is tapping to swing the 2024 race. and fox business says there's indisclosed amount given to a pro trump group, essentially, how the money is going. what does that mean when you see big donations and unified party right now. where does that feel like it leaves your stance? >> as you mentioned for the democrats, the message from the likes of george clooney has been i would like my money back and also the message that the american people have for joe biden and the democratic party, they would like some of their money back, too, and it's rough four years in joe biden's economy, and somehow managed to

make an economy that made jimmy carter's light weight. and soaring prices on household items and the american people would like their money back. another point of contrast, president trump continues to raise millions of dollars and not just about the amount of money that's raised, but who it's coming from, small dollar donations from voters in all 50 states, from demographic groups, like i said, inside the republican party, but outside of our traditional voter base because president trump's message to make america great again is resonating with everybody and might add that president trump continues to make inroads with voters in different demographics, and if you're black, white or brown in the country, money is green and you can't get enough of it. we're grateful for the support we're receiving and looking forward to more. as president trump says, the best is yet to come. >> the final thing, a wall street journal headline as president biden faces calls to

withdraw, the focus for the republicans is beginning to shift more to vice-president kamala harris sometimes in racist and sexists way as they make this the wall street journal article talks about. what do you make of that? do you think it's time to look at the vice-president and is it in a racist and sexist way? >> and it's more of the media, and with joe biden's decline, cleanup aisle 46, it's the way that the liberal mainstream media lied and concealed joe biden's house with the american people. they don't have credibility with the american people. and more excuses from the liberal and mainstream media. the democrats are able to put up whoever they would like, maybe stick with joe biden or maybe somebody more active outside of the aisles of 10 a.m. and 4 p.m. and kamala harris has been the border czar of biden's blood

president biden last night saying he's not getting out. first, let's start with how you see the race and the president's condition as you watch him. certainly it's not good for the democratic party that internal turmoil is the main phrase used to describe where we are right now. the republican party, as you were just showing on your program, is filled with energy, excitement, we are going to win. and the democratic party is going through this awful family drama that should have been handled within a week at the most. so the failure here was not just the president's failure. griff: after the debate. not just the debate, but the failure at crisis management. this thing needs to be handled and handled now. but i also think we need to take a good look at how we got here. we got here because a vital, robust democratic process was suppressed over the last year and a half. there's an elite, an elite within the democratic party, not that the republicans don't have it, but the democratic elite joined with their media

partners, felt that they were entitled to choose joe. this was the bro joe protection program. if we had allowed-- if we had allowed a real conversation, the creative messiness, yes, chaotic messiness that's democracy itself over the last year and a half whether when it was bobby kennedy was there, dean phillips, myself. we would have been discussing the last year and a half what makes the democrats the right people to take it from here. instead, that was suppressed. and that elite listen today who they should have laughed at and laughed at who they should have listened to. griff: were they not being honest, about the condition of president biden? >> it know the about whether they were being honest. what was problematic, the american people never got to see it. if the president had had to actually campaign in in primary. you know, thomas jefferson said the only safe repository for power is in the hands of the people. now, i'm not mentioning this because i'm going back.

it's because right now, these people that felt that they had the right to choose, that it was joe, need to get off their high horses. it's their arrogance and sense of entitlement that put us where we are. they need to not believe they're entitled now to decide we're going to kamala or with gavin. the mistake made before must be corrected now and must be opened up. we need to have a blitz primary, an open convention, which we had for 200 years and worked fine. griff: i want to that point. and this is senator clyburn. >> i was there and i know it. griff: here he is talking about it. >> the conversation should focus on the record of this administration, on the alternative to his election, and let joe biden continue to make his own decisions about

it. he's earned that right and i'm going to give him that much respect. if he decides to change his mind later on then we will respond to that. we have until the 19th 6 august to open our convention. griff: so you want an open convention. what does that look like? >> first of all, what are we doing here? are we protecting joe biden's feelings or are we protecting american democracy? this is -- the conversation that you just showed with representative clyburn, why is this group -- and they purport to be the real grown-ups in the room. we need to allow the grown-ups come in. the real grownups in democracy is whoever the voters decide. and i'm on the ballot, kamala, dean, whom ever, let's get out there and talk to the american people and do over the next two months we were really not allowed to do the last near and a half. griff: you talk about the voters and op-ed, the editorial

page of "the washington post" writes this, and citing a washington post poll, 85% of americans now say that biden is too old to serve four more years as president, according to a post abc news ipso poll. 57% of democrats say he should end his candidacy. so, i ask you this, and it continues, but i want to give you the question before we run out of time. is president biden fit to continue to serve four more months? >> yes, i believe he is, actually. i believe he is fit to serve another four months. i do believe that, but that's very different than can he do that and mount the kind of successful campaign that we need, particularly with this scuttlebutt. we have to put this drama to rest. if we want to win in november, we must put this drama to rest and the only way to do that is for, and i hope it's happening this weekend, enough people whose voices would matter to the president would be sitting down with him and saying this must stop and it must stop now.

griff: the last question. 10 seconds. could you support harris at the top of the ticket? >> if the people choose her, if the voters choose her. if a small group of elite manipulate and engineer and do their shenanigans with the delegates, would i speak my mind. i believe in the tenets of the democratic party and believe it's so important that the man who says that climate change is a hoax not return to the white house, that the man who told mark esper, couldn't we shoot the protesters in the feet not be returned to the white house, the man who made sure roe v. wade was overturned not return to the white house, we've got to get going. griff: we shall see where it goes. mary anne williams, thank you for joining me. >> and israel says that the sh

events, the judge in actor alec baldwin's trial dismissed the case last night. baldwin was charged with involuntary manslaughter for the death of cinematographer halyna hutchins on the set of his movie "rust." chief correspondent jonathan hunt is in santa fe, new mexico with the latest. >> griff, it was an extraordinary end to what had been an extraordinary day in court, which culminated, of course, with alec baldwin walking out of the santa fe court to his waiting s.u.v. knowing he was a free man. what it all came down to was some evidence, specifically a package of bullets, that had been handed to the prosecution a few months ago, but were not revealed to the defense lawyers. now, the defense lawyers argued that that should lead to a mistrial. the judge asked to examine the

bullets in question herself and in this extraordinary moment she put on latex gloves and all of them looking at the bullets up close and the judge decided they were similar enough to the live round on the set of "rust" that they should have been disclosed to the defense lawyers and then she said this, listen. the state's discovery violation has inserted a needless delay, and dismiss for the efficient administration of justice. your motion to dismiss with prejudice is granted. dismissed with prejudice is gran granted. >> as the judge said those words, alec baldwin began sobbing quite obviously in court, hugging his lawyers, and then his wife hilaria who will

been with him every day of this trial. carrie, the lead prosecutor testified saying that they never gave the evidence to the defense because they didn't believe it was relevant to the ammunition that was on set. i talked to carrie morrissey after she left the court. listen here. >> did you let the hutchens family down? >> no, we didn't. we did everything humanly possible to bring justice to halyna and her family and we're proud of the work we did. we disagree with the court's decision, but we have to respect it. >> and griff, the judge dismissed this case with prejudice, meaning there can be no retrial. alec baldwin could face civil suits from the family of halyna hutchins and that looks, in fact, inevitable, but in terms of a criminal trial, he is now off the hook. he is a free man, griff. griff: jonathan hunt live for

us in santa fe. jonathan, thank you. molly: all right, for more on this remarkable turn of events, let's bring in the criminal attorney brian claypool. thank you for joining us and we appreciate your time on this saturday. want to get into this. we've covered trial and common for the defense to say it's time to dismiss this and they haven't proven their case, battles over evidence allowed and traded back and forth and frustration between teams what is turned over and not turned over. what happened here and how shocking do you find it to be? >> great to be with you, this is like winning the lottery. think about your chances of winning the lottery and that's what alec baldwin had happen here. and it stems from a bad news bears, santa fe county sheriff's department. i mean, this was pathetic. let's call it as it is, right? when you have live ammunition delivered on your doorstep to your office and said, here, we think this was the ammunition

that led to the death of halyna hutchins? what does the sheriff's department do? they don't inventory the bullets, don't have an internal report, they don't turn over crucial evidence to the defense. i mean, this is unprecedented and i will go as far as saying that alec baldwin, if i was representing him, he might be want to thinking about a civil rights lawsuit against this county sheriff's department. molly: he's got a fairly talented legal team, looking at what we're seeing here in these developments. the defense argued that the bullets delivered that they weren't relevant in this case and haven't left the state in particular. the special prosecutor tried to defend this days and she got on the stand herself. carrie morrissey. take a listen. >> it never left the state of arizona. i understand that the court disagrees with me and i respect the court's decision.

there is absolutely no evidence that any of that ammunition is related to the incident involving ms. hutchens. >> jonathan hunt there in that fabulous report he just did, showed the judge with the blue gloves on going through the bullets and initially the prosecutor said there wasn't a match here. she goes through them. but some of them were the starline brass so essentially matching characteristics, and there went the case. your thoughts on just the judge's actions in this moment, the drama in the courtroom and this ultimate end? >> yeah, look, well, a couple of things. first of all, prosecutors, not the judge and arbiter of whether evident is relevant or not. that's an irresponsible comment by the prosecutor. thee should have turned over the evidence. just so your viewers know, any kind of evidence is potentially exculpatory. you have a legal obligation to turn that over. should have been turned over. the judge, extraordinary putting on gloves, looking at the evidence, making a

determination as to if that evident is relevant. it's clearly relevant because it determines who brought the live ammunition onto the set. right? that proves that alec baldwin did not bring the ammunition onto the set. the last point i want to make. this should never have been brought from this prosecutor against alec baldwin. they had connected hannah gutierrez reed. she was responsible for making sure there was not a live bullet in that prop gun. and that was her job and prosecutors put her on the stand and convicted her and the judge was vocal in sentencing her. why would you bring in a second person and that's unprecedented, too, to have two people charged for the same crime. molly: that's part of this. could there be major fallout for the armorer, for hannah gutierrez reed. as you mentioned, she was sentenced 18 months.

and her attorney says he could move to get her case dismissed. could that be a potential result of all of this? >> that's a question, i'm 50-50 on this one. i think there's a good chance that hannah gutierrez reed gets a new trial. she didn't have evidence, and hey, i didn't bring that live ammunition to the set. somebody else did. that said i don't think that the judge is going to dismiss her charges and why? what i said, she had one job that was to look inside the gun and make sure there's not a live piece of ammunition in that gun. so this new evidence doesn't really excullpate her from that legal issue. they probably gets a new trial, but i don't think that all of her charges get thrown out. molly: also, one of the things to look next at is the potential for civil cases here against baldwin in particular. your thoughts on that? does this affect that in any

way? >> it absolutely does. i've done civil rights cases, there's due process violations here against alec baldwin and the fact that the prosecutors, remember, they charged him before, and then they pulled the charges back, and then they charged him again. what was the new evidence? to charge him again? those are the focal points his lawyers are making, he's got a potential false arrest charge. you've got to prove legal causation in new mexico, that's a hard burden, you can't prove they were careless. you've got to prove what baldwin did caused this death and even if he pulled the trigger, that didn't cause the death, what caused the death, hannah gutierrez reed allowing the bullet to be in there. he's got a civil rights case especially based on the mistreatment of evidence that could have gotten him off the hook. molly: he could be facing civil lawsuits, as well, halyna hutchins lost her life, and as

>> people are being told to swim smart after a spate of recent shark bites and shark sightings across the country. one florida community just had its fourth shark attack in the span of a week after a teen boy was bitten on his left foot. this as part of rockaway beach in new york briefly closed this week after a drone spotted this shark not far from beach-goers. more with cb cotton, is it safe to go in the water? >> it's pretty safe. you have to stay vigilant. within seconds this week though swimmers at a new york city beach were told to get out of the water after a drone spotted this shark.

take a look, the first shark sighting on thursday came just after 1 p.m. local time and the waters off rockaway beach. if you look closely, you can see the shark's dark schad low loving in the motion as it was spotted by a drone from the new york city police department. a second shark sighting happened not too far away on the same day. this prompting stretches of rockaway beach to immediately close to swimmers. n.y.p.d. helicopters up above and officers below patrolled the area to make sure that everyone was out of the water. this was the first shark sighting of the summer for new yorkers, many of whom can remember a slew of bites in recent years. last summer, there were at least five reported shark bites in the waters off of long island. now, both city and state leaders have increased the number of drones in use for shark watch this summer, but there is an urgent message from state leaders who want to give beach-goers additional reminders on safety.
