♪ ♪ vu co. we have lot of breaking news coming in this hour. we will keep you updated on the latest but for now republican national convention, we are here. it is officially underway here in milwaukee. this is where tracking presidential race has seen a dramatic shift in the past 72 hours. no one could have predicted it. first, former president trump, he is expected to announce vice presidential pick at any moment. we have been waiting we will bring you the clues and vowed to find out who will join the ticket. we have been asking that question so long today is a day. also breaking a judge tossed out former president trump's classified documents case ruling special counsel jack smith should never have been appointed. we have a live report coming up. the unprecedented backdrop for all of this. the assassination attempt on former president trump. new developments on the

investigation and what the shooter was doing hours before he climbed on top of the building and fire at. this is "outnumbered" and i'm kayleigh mcenany and my cohost harris faulkner, emily compagno and also some states folks person and security morgan ortagus and former biden campaigns are a good, kevin walling. but first, let's go to cb cotten and butler, pennsylvania, with the latest on the investigation. >> hi, kayleigh, good afternoon this is the rooftop where federal agents eight thomas matthew crooks tried to assassinate former president donald trump. the rally was taking place where you can see american flags blowing in the distance only 20e standing. this is now an active crime scene. we are kept away from the immediate area, but throughout the morning, we have seen state and federal agents coming and going. we have also learned the shooter reportedly purchased 50 rounds of ammunition in the hours

before the tragedy. federal law enforcement sources tell us it was law enforcement good responsibility for the rooftop. it was rally goers that's part of the gunmen crawling on top of the building. sources tell us one officer climbed to the top of the road, saw him armed with a rifle and retreated. soon after that, crooks began to fire according to the source and moments later from a secret service counter sniper shot and killed the gunman. our federal sources tell us they are trying to access the shooter as they learn what may have motivated him. bomb-making materials found inside of the shooter's home and car shipped to the fbi lab in quantico. we learned a social media profile, the shooter had on discord has been removed according to a statement that reads, "we have identified an account that appears to be linked to the suspect, and we remove the account according to off platform behavior."

rarely utilized and not used in months and we found no evidence it was used to plant this incident, promote violence, or discuss his political views. today, we saw the fbi agents around the shooter's home talking to neighbors, going door to door down the block. >> i knew, i knew it was my neighbor. speak with the secret service now pushing back against criticisms over its handling of security for this rally. the secret service director said she is committed to working with both state and federal agents to make sure something like this never happens again, kayleigh. >> kayleigh: cb, thank you. you know, emily come i want to back up for a moment and talk at something that was kind of overlooked, but it is something president trump said to bret baier. i confirmed with bret baier that president trump shared with him.

here is what president trump said, "there is a lot of talk about what could have been done to get the shooter him a lot of questions. but the guys around me did a fantastic job localized talk to senior official retired who was familiar with presidential protection and he told me the counter sniper neutralized in three seconds. seven heroic agents who jumped on top of him did what they should have done and wear armor in front of him. a lot of questions. we don't have all the answers, but there were some people who acted quite heroically that day. >> emily: later in the show we have a former supervisory agent, jeff james comer presidential detail for many decades and we will pick his brain about the operation spirit i want to point out as well that recall amongst the first things out of president trump's mouth after that attempted assassination was to express that gratitude for those brave men and women who have sworn to protect him at all costs, even if it means

sacrificing their lives. that level of gratitude in the face of what can only be, i'm sure, extreme shock and is really commendable because that shows where his mind-set is. to your point, i can't think of anyone who watched this unfold without such agitation in fear and shock and dismay. they are by the grace of god, president trump is standing befe us because what we see splitting hairs in time, he just lightly shifted his face, and that is why the bullet only grazed his ear. that is a miracle at a minimum, kayleigh. >> kayleigh: ideas a miracle and he had protecting him in that moment. morgan, you've been to a lot of rallies and you know how this works as well but there is no doubt there was a failure we will figure out where that failure happened, where it occurred. however, it is important for the viewers to understand, at a rally in middle perimeter, inner perimeter, outer perimeter

appeared inside the perimeter, secret service controls at area. outside of that parameter is local law enforcement which secret service has to rely on some respect. senior law enforcement officials say he will reveal that it was, indeed local law enforcement in charge of the building as cb cotton sources are telling her as well. a huge question, is what assets did secret service request? what was accepted, what was denied, and where did that breakdown happen? >> that is all right, kayleigh. i've been to a lot of rallies. i've been with you and it's fun to watch people take selfies with you and you're a big hit at the rally spirit immediately when i saw this i thought about the many times i've been with mike pompeo and diplomatic security, the times with the president and i want to reiterate what emily said. it is so important. i would look around at the secret service and diplomatic security i know women and men able to take a bullet if needed work on so grateful for them

because everybody in that picture protecting president trump was somebody whd a wife, mother, children, spouses, husbands, they all had family that watched them put themselves in harm's way in real time. when you start to talk about the physical security of the rally, there are a lot of important questions i have to be answered. you just laid them out so i will not reiterate all of them, kayleigh come i think you laid them out perfectly. this is why you see congress call for the secret service, head of dhs to come forward and testify. it is not just about former president trump. it is secret service for the sitting president, the first ladies. i would remind everybody and i've been saying this on "outnumbered" for three years and unfortunately i will have to reiterate this again, that iranian regime has against president trump and former cabinet members and our enemies all the vulnerabilities saturday so it has to be fixed. >> kayleigh: harris use it in

with former president trump and there was talk of currency canceled, is he still going to show up? he came and showed up on time, it is remarkable. >> harris: he didn't just show the nation we are all capable of amazing resilience by raising his h hand in that iconic fashi, that fist, blood streaming down his face. and getting out the word "fight." he did that, yes, but he also showed us we are capable of so much more. he kept going. he played golf. he went to the thing that he loves at bedminster, a beautiful place, another beautiful place where he lives. he reminded us there is more than this political fight we are in in this moment. they were is the reason why we are in it that we need to focus on command that is america has got to be better than what it is right now. i want to share something with you i've been thinking about the

assassination attempt as we call it on donald trump's life. i call the shooter and assassin because he did kill someone that day. an american citizen who went to a rally to see if maybe his beliefs would start to come out of a candidate's mouth here that would be the person he would vote for. the reason why everybody goes to a rally! is this the person i have been cheering for, is he worth my vote? blah, blah, blah! taken out in front of his family. i know glenn youngkin last hour was recognizing corey and his family. but also, you have two people who are hospitalized, they are conditions upgraded to stable now. he was an assassin. there was an assassination. it was just thankfully not the president but it was someone's dad, husband. we must not forget that. so yes, the fbi classifies as an assassination attempt, but i've been thinking about that. >> kayleigh: corey comperatore, a father of

two shielding his daughter an absolute firefighter and attended church every week. upstanding member of his family, lost his life to this gunman. kevin, right behind me, at some point we will have an enormous moment where president trump what's on the stage, everyone wanting to see him ride we don't know what his ear will look like optically, what you will look like but he will exude strength and it will be quite a moment. i will predict that moment happens tonight, but your predictions, kevin. >> kevin: i think it will be an incredible moment, kayleigh to your point, the president's life was saved. it was such a remarkable thing to see the president come up from that attack, fist raised into hand, hands raised, as harris talked about. the fact to harris' point too, this man lost his life. we want to engage we want people showing up, knocking on doors, going to rallies come engaging

♪ ♪ >> harris: major breaking news today on former president trump's legal battles, a victory. his classified documents case in florida has been dismissed. judge aileen cannon has thrown the case out after deciding special counsel jack smith's appointment violated the u.s. constitution. great reporting on this today from david spunt, who is live for us at the justice department with the latest info president, president trump's reaction, david. >> harris, president trump is thrilled. we are waiting for some sort of reaction from the justice department having fun yet we are told some likely special counsel jack smith's office and perhaps his next steps. he could appeal to the 11th circuit court of appeals in a potentially the supreme court. remember it was two years ago, august 2022, that is when the fbi raided mar-a-lago. this case has been hanging over former president donald trump before he even announced reelection.

judge aileen cannon, who happens to be trump appointed judge announced this case is dismissed because jack smith was and lawfully appointed. he was a special prosecutor, harris at the netherlands, war crimes in kosovo when attorney general merrick garland called him up and asked him to be special counsel. garland did so because he said he would be a candidate for president of the united states and would keep the doj insulated from looking like it was weighing its power on the scale here at judge cannon has problems with smith's appointment because he was not set confirm. she took a recent hint from supreme court justice clarence thomas who question on paper. cannon rode in 93 page ruling today, "in the end, there is a tradition of appointing special attorney in middle of scandal throughout the country's histor, but very few if any of these figures actually resembled a position of special counsel smith. mr. smith is a private citizen exercising the full power of the

united states attorney and with very little oversight or supervision. from 2016, we had one special counsel patrick fitzgerald from 2016, harris and five, robert mueller fbi director who investigated trump and the investigations and not sent approved but judge cannon is not going back in time. nothing she can do about that and john dewar them from the russian probe, david weiss with hunter biden and hunter biden and jack smith who is investigating donald trump era john dewar them, robert hurd, david weiss all u.s. attorneys and they were senate confirmed. right now we are waiting for some sort of news from jack smith's office but no question a seismic data for the trump campaign. he told bret baier earlier he wants his other prosecutions to end as well, harris. >> harris: it is interesting because with jack smith and you and i touched on this last hour, this potentially delays anything he would be doing against

donald trump. >> i think so. we have the january 6th case where former president accused of trying to overturn the 2020 election in washington, d.c. that was supposed to happen march 4th, the day before super tuesday. that was on hold because of the supreme court. two weeks ago today actually, july 1st, supreme court ruled which made it a little bit trickier for jack smith to move forward with this case but it does not mean it will not happen in d.c., but before the election is increasingly more difficult. >> harris: absolutely, david, thank you very much. emma lake maria break this down if you would in terms of how much of a victory this really is. >> emily: a significant victory and momentarily. i wanted to share i read that order and not only was the appointment ruled unconstitutional but also the use of indefinite, permanent appropriations, which those of us who talk about tax dollars should appreciate. here is the reality, and the next two days an indicator which way this case goes because at

the end of the day you can appeal anything. at the prosecution can file what would be an emergency appeal, filed the 11th circuit and say, "listen, we want an injunction right now and let this case go forward, blocking the judges order today." it will be on merits if granted appear that appeals court has a history of overturning cannon's ruling so that might be likely t however i believe in the absolute substantive corrective notes, the validation of her order so i don't predict that would be successful. the trump team and david spent touched on this for a moment, the trump team could file a motion in the d.c. federal appeals court, listen let stop federal elections case and all of that could pause while it winds its way up through eventually potentially to the u.s. supreme court. lots of legal things to develop, but the next two days, look for appeals court, peels being filed and we will see from there where the course of the case takes. >> harris: morgan, you can look at this a situation where

the wind is at the presidents back a little bit so far. and i don't know, this has the potential to backfire politically on democrats if they want to push this much further. and they might. i mean, if the situation could be they come at them at a different way. law fear, they have done before. >> morgan: i think you are right. emma lately doubt it is probably more likely than not that attorney general's office they will try to appeal this. the interesting thing about this is it affects the january 6th case as well. and i think whether it is the florida case, even if they appeal it, and the d.c. case, these both likely will hit the supreme court before they ever see a jury. i think with only four months until the election, we are unlikely to see that. the bottom line where we are, harris. >> harris: kayleigh come i know you want to talk with the

justice department's plans at this point. it dovetails into what i was saying this could go beyond the election. >> kayleigh: that is right. harris, what a remarkable moment this is. with that we would be coming to the convention with a sentencing pair that was to happen july 11th. that was pushed back and you have the immunity case and classified documents gone. but what is worth looking at is 24 hours after judge merchan said july 11th, we are not doing for sentencing but in september if you need to do so. within 24 hours, a "washington post" story broke in here is the headline "justice department to pursue trump's in past elections even if he wins." a spokesperson for garland said, i would expect the justice department to be full speed ahead and they should be. here is the interesting part, current official speaking on mn entity expressed the same sentiment if trump wins, the clocks on the federal cases kics to january 20th.

they were ready to double down on this, cannon threw a huge wrench in their plans and we will see what happens but this justice department, they should dispense gnomic dismissed both cases and jack smith. they appear to be an double down mode at least a week ago. >> harris: and if that double down happens, kevin, and they don't dismiss the cases, what political backfire can happen for democrats? what is the caution you would have for them, your party? >> kevin: i want to be the former president at the ballot box not in the courtroom. when you look at the polling of the cases the former president was facing, this is the most serious in terms of concerns of the american people. to emily's point, it will be appealed up the chain either supreme court or 11th district. but certainly this process will play out, but it is a win for the former president, no doubt. wind is at his sails and into the convention. >> harris: all right, president trump expected to announce his vice president at any moment. it will happen today we are

presidents including president trump. jeff, thank you first and foremost for your service. the secret service has said the perimeter is under local law enforcement purview. can you help us understand that? >> well, that is a little bit misleading. look, when the secret service comes in and does a site, we owned the entire package. now, we typically utilize state and local law enforcement for outer perimeter for us, but that doesn't mean they are not working under the guise of the secret service umbrella. so what i think will be interesting to find out is when a site agent set up the security, did he go to his local law enforcement, who are going to be on the outer perimeter and give him specific type directions like the outcome of this trip has been a cause of concern for us. make sure somebody has eyes on it and may have said to someone, hey, look, you guys just be general observation. main goal in the crowd and look for anything unusual. but there are also many times

where if they didn't, they should give specific instructions to post to say, regardless what agency they are with, hey, this field-of-view is your responsibility. make sure you hold it down for us. >> emily: simultaneous with this footage of this video, chaff, we have seen video of secret service counter sniper spirit could you explain what they might be seeing, doing, looking at those seconds leadino the shooting? >> yeah, a lot of respect for the secret service snipers. that little picture everybody has been showing where president trump was at the shooter was, the snipers were is misleading. but is that 150 yards of a very small picture. are snipers train out to 1,000 yards. if you would get on google maps and draw a line that goes out 3,000 feet, you will see their field field-of-view cover is perms to car dealerships, businesses, cross the highway, n

i see that video, what i think was happening was that sniper although he's pointing right at the shooter was probably looking over him maybe hundreds of yards or other potential threats. with people are yelling, hey, he has a gun, he has a gun, he may have been looking over him straight over him where a sniper may be hidden. when the shooter shoots and gives away his position, you see him pull away and engage and immediately neutralizes the threat. i don't think that picture everybody shows up that little map is very fair to what the enormity of the space the snipers actually have to cover. >> emily: notwithstanding the incredible quick reaction of the agents we saw an heroism displayed by so many, jeff, we saw an agent try to holster her gun into her badge. we learned about the 35th initiative deployed by the directive. that initiative with diversity requirements compromised the caliber of the secret service agents? >> i will tell you, more than

diversity because i worked with awesome female agents who could out shoot me and run me into the ground. one of the problems that i saw when i was at the end of my career i was doing background investigations on new hires was the things we started to say okay to that warrant okay when i was hired. i don't mean big things like criminal records or hard drug use, but sometimes you can realize that people are not a good fit. i had one situation where he did a background investigation on one person and i wrote three separate memo saying you shouldn't hire this person. they erred theanyway and hung around a year and unfortunately left because they were not the kind of person we want as a secret service agent. so i think more so than whether an applicant is male or female, race, color, religion, there is a caliber and a bar that they should meet in all things. integrity as well as physically that needs to be met regardless

about my point in saying this, everybody is reading the tea leaves down to the tiniest detail. >> yeah, i believe that j.d. actually has just landed in milwaukee about 15 minutes ago. marco rubio is there already. so it looks like it is coming down to the two web them the president trump as he mentioned to bret baier could throw a hail mary and choose someone we are not talking about here the good news, everybody has their personal preferences. i interviewed j.d. for my radio show and no marco rubio 20 years but no matter what personal preferences, the president is going to pick who is most comfortable with. what you will have at the rnc that you won't see at the chicago dnc's unity around the ticket. personal preferences aside, president trump should choose who he's most comfortable with and i do think the republican party will unite around whoever that pick is pure at the convention this week, as you said earlier, kayleigh, trying e
