going to get a hero's welcome even before the events of saturday. the former president certainly feeling the love and support from those republican delegates. this is a huge change from what we saw four years ago as there was no convention due to covid. for the former president this was a chance to show the american people and prime time what he's able to offer them. while yes the camera was wear on him during the 10:00 hour, the biggest headline was trump's decision to tap of the junior senator of ohio, jd vance, as his running mate. he had been on the shortlist for this job for months but it came down to the wire with vance only finding out that he got the job just 20 minutes before it was announced. he had been vetted, it was a lot of considerations. the tee leaves showing he was going to jet asked my going to get the job but it's official. is going to be a lot of scrutiny on him going forward but he talked to sean hannity and he

and the former president told people earlier today that he had more surprises up his sleeve. buckle up, it's only monday. here on the floor i me tell you what i saw when the president walked in. i saw somebody crying. i saw a lot of people who were emotional. i saw one man who was holing up his phone face time you left one so that they could watch in realtime the president walking in. i talked to another man who told me look this is a miracle that the president is here right now and it's so important for him to see the president here on monday instead of thursday because people wanted to know if he was okay. they wanted to see it for themselves and he told me if anything was different, if the president had been hit on saturday then the country would have been lost. also have some news for you on jd vance that you were hearing first. vance hitting the campaign trail immediately. i'm told he'll be in oklahoma

generals, execute political opponents. set it with a straight face. he should have been pulled off the air quite some time ago. i get disagreement over policy and scarborough i guess is -- is a democrat now or is saying what he... but to go that personal and make predictions like that is a whole bowl of wrong. they have a real problem because they continue to criticize the president this way on such personal terms, hyperbolic terms , terms that aren't based in any reality based on the president's first term. >> he is a world-class genius at marketing. the fact that the two things he had to think about in the moment was my breathing and where is the hero shot is really reflective of who he is. he has a brilliant marketer. that photo is everything he

>> the florida judge overseeing former president trumps classified documents case has ruled that special counsel jack smith was unlawfully appointed and has now dismissed the felony charges against mr trump. this international correspondent kevin corke is live with more on that story. >> judge cannon found the ag simply didn't have the authority to appoint a federal officer with the kind of power wielded by special counsel jack smith. he's out of there. you will recall in the documents case when president trump was indicted on charges that he wilfully retained sensitive national security documents at his estate down in florida.

after leaving office in 2021, they also accused him of obstructing government efforts to retrieve the material. however, it should be noted that the tug-of-war between outgoing president and the national archives is fairly common here. but in this case, the trump team was still negotiating the return of some materials when the archives and the doj decided they had waited long enough. prosecutors claim the documents included material related to u.s. military, intelligence and nuclear matters. the doj says it will appeal the ruling. it won't likely be decided before voters head to the polls in november. >> that's a big point. thank you. we are now learning more about the investigation unfolding in pennsylvania into the attempted assassination of former president trump. >> we are standing outside the infamous historic crime scene here in pennsylvania.

you might be able to see some of the headlights from law enforcement that are still guarding the scene. tonight a senior law enforcement source tells me that a suspicious person was flagged to local police at the rally for acting strangely before the gunmen opened fire which caused police to begin a foot chase for this person. one report says the person was acting nervously and pacing near the metal detectors. this is notable that the suspicious person was flagged at a separate location away from that rooftop that he climbed, raising more questions about whether the alleged shooter could have been stopped. i senior federal law enforcement source tells fox there were multiple radio transmissions describing a search for a suspicious person after citizens reported this to local police. a local law enforcement leader confronted the individual at the rooftop. here he had no known criminal

record in this state but he had a job working as a dietary aid south of pittsburgh. people said he was doing his job appropriately what he was described as a good student in high school. we've learned that the gun was an ar style gun that his father had purchased over a decade ago. >> thank you. let's bring in criminal defence attorney... you look at all these reports. law enforcement spotted the shooter some say 30 minutes before the shots were fired. nothing happened. this investigation is revealing some amazing things. what do you make of this information? >> not to make light out of it but sometimes we tell people you had one job to do. the secret service had one job to do. within that is to... local law enforcement generally has a responsibility to protect the peripheral areas from the

protected party president, vice president candidate. in this case they dropped the ball completely for one particular reason, the line of sight was not blocked by either an apparatus behind -- behind the president or something to stop any rooftop access. it was a direct line of sight that in asked mike that did not require the shooter to move around before expending the firearm in this case. it was a stationary thing, the depressing thing about it is it gives all of us a sense of insecurity and fear. this morning i had an opportunity to speak with a number of high-ranking individuals with the san diego sheriff's department. all of them were absolutely disheveled and in a poor state of mind. as we began talking about this it became very clear that they believe local law enforcement looks horrible win in fact secret service was in charge of hurting those kittens as they say. and the...

law enforcement was hanging on that rooftop and actually identify the shooter seconds before the shot rang out. the quote from this morning with my deputies that i spoke with, they said they put their hand on their badge. when we swear to uphold the safety of the community, we greet -- agreed to take that bullet, especially for the president of the united states. >> the cases growing, we are getting more and more information. i can't let you go before i talk about the documents case being dropped. jonathan turley said this about that this morning. >> if you were to have one case dismissed, if you had to have a wish list, this would be at. i've said from the beginning, florida was the greatest threat to donald trump. here smith was relying on established law. they will likely appeal this to the 11th circuit. some judges are going to disagree. we don't know whether this will be upheld but eventually it has to go to the supreme court.

>> would you agree with that? would you add anything? >> this decision was really a separation of powers issue. this is the executive branch appointing an individual to enforce the law without any legislative oversight whatsoever. either through the appropriations for the money being used or by an appropriate appointment of this individual. this is a separation of powers decision. we've seen this theme through the supreme court throughout this tendency at this point in time and that appeal, while it may be filed, is not going to be fruitful just as clarence thomas has already given out sort of a crumb of the way this -- the supreme court may go. i do not disagree with the statements by him, he is spot on. >> so the president out of legal jeopardy at least until after the election. >> i believe yes. >> up next our guest was a witness to the attempted assassination of donald trump.

in fact he tried to help some of those who were shot at the rally let's bring in dr james sweetland. thank you for coming on tonight. i want to know if you can tell us what did you see, what did you hear and what was your first instinct when you heard the shots? >> first of all, thank you for having me on. i've watched your work for many years. i was in the bleachers on the left side as he looked at the stage where donald trump was on and i was below a jumbotron. i was with the crowd, it was a bright sunny day. everybody was enjoying themselves. it was like a rock concert. when he came out he spoke, he spoke for a few minutes and then he brought on the diagram of the illegal immigration. he turned and pointed to that

and i was standing up underneath the jumbotron with a friend and said look he's pointing out us, take a picture. it was a joke. he then turned back to the audience and turned around. at that time, three shots rang out. it sounded like firecrackers to me initially. there was maybe three or 42nd pause and then it was followed by about four more pops. i like everybody in the bleachers turned to look to our right over the field from the line of trees to see where it was coming from. i then turned back to seat secret service piling on president trump. they quickly became a human pyramid of about six secret service agents. by that time i heard a voice of a woman from the stands just 30 feet away down to my right, down on the benches saying he's

been shot. help, he's been shot, he's down. >> this is the firefighter correct? >> that's correct. but it was indeed corey. >> i'm sorry for interrupting. did you think at the time that there was a chance to say -- save corey? how bad was he at the time? >> when i got to him, there were people that were hunkered down. there was a large pool of blood. there was brain matter there. i did a brief examination of him. he had a bullet wound just above right here and it looked to be fatal. when you were in the field and those, you do what you need to

do which i got bystanders to help me get him back up on the bench so i could administer cpr. he had no pulse. so i administered cpr for about two minutes. >> when you heard and you looked at corey, and you knew and heard the president might be head, did you think the worst? >> i thought the worst. what was interesting as i was doing compressions on corey, i heard a roar from the crowd behind me. i didn't turn around or i assumed there was something going on behind me and it was a joyous rower. i didn't know until i turned around. two police officers came up and took him off the bleachers.

i was performing cpr at the feet of his wife and daughter. i will never forget the look on their face when i looked up at them. it was grief, being appalled and still a look of hope. i remember blurting out to them, he's being taken where he can get help. i then turned around and president trump was already off the stage. i then turned to my friend who had come down and said how is trump. i said i saw some blood on his cheek. and i said was he able to stand up and walked -- stand up and walk off and they said yes. i assumed the cheers where the fact that he was able to get up. i wasn't aware until later that those cheers where it when he gave the fist bump in the air. that was what the crowd wanted to know that he was okay. >> an awful experience for you.

>> busy night laying out the party's economic platform at the republican national convention in milwaukee. we are live with the highlights from night one. good evening. >> good evening to you trace. so many highlights on day one of the rnc is starting off with donald trump's first public appearance since saturday's attempted assassination. he did not speak but his presence alone with his bandaged right ear and fist pumps sparked a thunderous applause. earlier during the roll call, states pledging their delegates to trump, it was his home state of florida with its 125 votes that officially put him over the

they saw president or former president up there on stage given under duress message to the american people. to stand up both physically and mentally and be able to deliver this message in a way to say fight, not against your political opponent but fight for the future of america, for unity and then they kind of compare that to the clips of joe biden that they've been seeing on social media that paints a much different picture. >> the daily mail says the following here. they say jd vance brings fresh perspective and younger voters to the gop. does it bring young people? is that a good pick in your estimation that jd vance is now part of the ticket? >> absolutely. all we've heard about is age and now we are the group that is bringing in the generation that

short term from what we witnessed. i think we really understood that when he told the washington examiner that he ripped up his speech and he was going to take aim at joe biden but after this happened he wants to present a message of unity. i don't know if that some think that donald trump would've put aside in the passed. i'm sure there's going to be some fire between the two of them. he's going to bring up joe biden a little bit but the fact that he's invigorating his fan base with a renewed sense of passion and it was previously coming from frustration with the current administration, but now we've got a rally for the future of our country and he's going to present a front of unity that is really what the american people want. i think you will see that and continue to play that. >> joe biden said on nbc that he did not pay -- take part in this hateful rhetoric. your thoughts on that. >> just the day before he was saying we need to put trump in a bull's-eye we know that's exactly not true.
