news welcome everyone i'm sandra smith the new york great to be with you and adam schiff now a prominent democrat calling on biden to withdraw. john, good to be with you as we kick off a brand-new hour here. >> john: good to be with you too, sandra, schiff had told donors that everyday i think if he is our nominee we lose and we may very well lose the senate and our chance to take back the house. now according to a statement given exclusively to the "los angeles times," we are working to get this ourselves, he has now gone public with this, sandra. speech of the most influential democrats are far to call for biden to step away from the ballot. he told biden he is one of the most consequential for residents and our nation's history and has his lifetime as a senator, so vice president, now has president has been a country better. he goes on to say, john, "but our nation is at a crossroads. a second trump presidency will under mine are democracy and i

have serious concerns whether the president can defeat donald trump in november." >> john:qui heinrich is at the white house and they have been calling on biden to drop out somewhere around 20. i did not check in the last few minutes but now with schiff coming out and adding his name to the list making a very public a statement to the "los angeles times," could this be the crack in the dam that causes the whole thing to break wide open? >> time will only tell don i will say i doubt it. that is because schiff is not one of those top democrats who represents sort of the majority of the people around him. you have to look to people like chuck schumer and nancy pelosi, governor walz, the chair of the democratic governors association jim clyburn. those types of people who would be communicate and on behalf of a lot of members. i think schiff's statement makes public when he reportedly said over the weekend to a group of

donors. according to that "new york times" article and now he is coming out and saying basically has mind is not been changed since the events this week and with the assassination attempt on the former president because his remarks to donors have been before that. the president has been adamant he will stay in the race. going back a couple of weeks ago he said it would take a direct order from the lord almighty to get him to drop out then he said he would settle for a clear and convincing data not only could he not win but someone else could end earlier this week after this weekend's event that he said it would take him getting hit by a train. i doubt he will move the needle for biden. number democrats will keep that ally. that let her circulate and capitol hill on plans to move forward with early nomination roll call vote. looking that you can push back at least till august. the reason for that was because democrats wanted to keep the discussion open on whether or not biden is the right person

>> well i don't think adam schiff would do this without consulting with other people that he has been close to. i would suspect if he didn't get a green light from her, she at least knew this was coming and that's former speaker nancy pelosi. she and schiff are very close so this is a significant move, it's a big move. he is likely to be the next senator from california. it's a significant move. also, governor walz of minnesota, i thought that was a mealymouthed response. i don't trust ohio to live up to a law they passed and the governor signed on the statute books that says you have until september 1st to tell the state of ohio who the democratic presidential and vice presidential ticket is that should appear on our ballots. this is clearly an effort by the rules committee to force the hand of the dnc in order to shut down the efforts to encourage

president biden to step aside. i think it will be badly received and i think it was a mistake but you will notice he was not able to point anything specific besides we need to prepare. yeah, right when you take the 51 documents the 50 states and the district of columbia the official letters get them ready to go on the day after the democratic convention concludes naming kamala harris for vice president and joe biden for president, go ahead and get them ready if you like so they are ready to go of the day after the convention if that is what the result of the convention is. this is not a complicated deal, it's complicated where you have to comply with 51 state statutes but go prepare the letters if you like right now so that if you can send them out the moment that the convention ends all you have to do is plug in the names and hit print and send. >> john: public against the president this new poll americans on whether biden should stay in the race overall 28% want him to continue running.

70% say he should withdraw and look at this among democrats. 31% say he should continue running 65% nearly two-thirds of democrats say he should withdraw. i mean, that is getting close to lyndon johnson numbers. >> terrible. look at the fox poll on sunday morning. did not get a lot of attention because of the events of the saturday night. they ask do you think president biden's mental condition represents an "risk to the u.s. national security" 63% answered yes including 62% of independents and 38% of democrats think his status represents a threat to u.s. national security. the second question was do you think he is involved in decision-making? the only someone and not at all involved is 63%. and the final question was do you believe the white house has been honest and transparent with us about his mental condition,

71% said no. think about it, two-thirds of the american people don't think he has what it takes to be president and a 7 out of 10 americans think the white house has been misleading him and cannot be trusted. those are terrible numbers and they are not going to get be better. >> sandra: just rumbled before this statement to the "los angeles times" we were already hearing from adam schiff in "the new york times" he said on biden's prospects "i think if he is our nominee i think we lose" and we may very, very well lose the senate and lose our chance to take back the house" so there have been growing under some concerns and very vocal concerns yet here is where biden stands on what it would take for him to step down. this is a bet interview answering that question. >> a medical condition, if doctors came and said you have this problem in that problem but i made a serious mistake in the whole debate. >> sandra: is he showing any

signs of budging here? >> well, no, that does not put on the other hand he earlier had said he would stay in unless the poll showed him losing. now the poll shows him losing and they have shown he's been losing. the last time he was ahead in the real clear politics average of recent polls was last oct october. he was four years ago i think leading by ten points at this point in the campaign and he is losing today and he is not going to get better. could be close because these two men are the country is deeply polarized and both have high negatives, but the guy who has higher negatives is joe biden and they are not going to get better. that debate confirmed to a large number of americans the worst fears they have which was he simply his way too old and neither his mental acuity nor physical stamina means he is likely to serve effectively for the next four years. speak what i want to ask you about what happened at the rnc monday night when the teamsters president sean o'brien i think became the first teamsters

unions that have members who like republicans, who make things and drive trucks and so forth. those are the unions where you find more republican sentiment than the service international or the government unions. so, what sean o'brien got was i get to be seen as a significant figure that both democrats and republicans need to be bidding for the support of and would donald trump got was a guy who is a very visible member of the union movement, a leader in the union movement saying nice things about him. sean o'brien needed to come to that convention to speak because think about it, the teamsters are part of the union movement increasingly republican very, very visible i suspect he could any trump rally and there'll be be a lot of teamster members there saying "i love donald trump" so sean o'brien needed to make certain inside his union he was covering all the bases and he did. speak to carl, we appreciate you jumping on breaking news at the top of the sour with us, thank you.

both and i will call for resignation as well. >> john: the dhs inspector general opening an investigation into the secret service's planning of the rally where former president trump was nearly killed. this is the senate and house awaiting separate unclassified briefings from the secret service, fbi, and justice department. and it comes amid a stunning new development that the gunman's parents called the police before the rally. exclusive new video capturing the chaos at the trump valley just seconds after the gunman opened fire. rally goers seen ducking for cover calling out for help. to be caught live in butler, pennsylvania, with the latest on the investigation. what do we know, cb, about the shooter's parents? >> hi, john, federal investigators continue to piece together a timeline of what happened before, during, and after the shooting. we now know that included a phone call from the shooter's parents to law enforcement on

the day of the rally to say they could not find their son. this as an alarming new photo obtained by local station wpxi shows a cell phone and a transmitter device. he had explosives in his car found near the rally and bomb making materials inside his home. the alarming photo raises questions about whether brooks had other plans as he opened fire from a building less than 200 yards away from the rally stage while position on a rooftop which the secret service says was within a perimeter. it was delegated to local law enforcement. as the finger-pointing continues a federal source told me there was a local law enforcement presence inside the building. the shooter was on top of echoing with the secret service director stated during an abc news interview. but now there are conflicting reports from local media who

cite sources that say local officers were only positioned inside a nearby building. we know from federal sources crooks was spotted acting suspicious before the rally and several photos including this one were captured and exchanged among officers during about a 30 minute window before the gun fire periods family now reacting to what is being called a major security failure. >> a major brief and i don't want to be the guy doing conspiratorial, i'm sure plenty of people will and i think all of those questions are fair game because it is so ridiculous. it is so flagrant. speak of "the new york times" now reporting the gunman shared several packages labored "hazardous materials" in the last several months. john? >> john: cb con for us, thank you very much. you know, when you take a look at the security failure if that on that day, i mean, it's amazing that nobody has come out to say anything about it yet. >> sandra: it's incredible,

it's stunning when you look at the number of hours that have passed since this happened. 6:15 p.m. sunday afternoon over the weekend. the number of camera briefings, on camera briefings, news conferences from dhs which, remember, secret service falls under the department of home land security. zero, john. i mean, you are looking at the attorney general secret service, zero. and you look at the rampant speculation that is on all of our social media, these groups will be the first to say those are incorrect or false or squash them but they will not provide enough information or facts for the american people to know exactly what happened. that's a problem. >> john: coming up a number of hours since it happened you said 6:15 p.m. on saturdays and 91 hours now and we have seen the secret service director do individual interviews, we saw her talking with what looked like a local reporter there, but we have not heard any briefings from the secret service except for that briefing about

milwaukee where they refused to talk about what happened on saturday and looking ahead to the republican national convention, i mean, there were a lot of lawmakers but democrat and republican who believed that this is approaching the level of scandalous that no one has come out to say anything about this and how it all went down. and in particular, how that building was left unguarded. we heard kim cheadle the secret service director say oh, it was a peaked roof, let's leave that graph it up for a second there. there is the building on the left, there is the buildings behind which trump was speaking with the counter sniper teams, the pitch of those roofs is greater then the pitch of the roof that crookes was on. they had counter sniper teams on the leading edge and the trailing edge of those buildings, and the pitch of the roof was and too great for counter sniper teams on so how is it possible? how is it within the realm of possibility that the pitched roof that crookes was on was too

great a pitch for an agent or a uniform or a local police officer to be up there making sure that no one who got on top of that building? i mean, a lot of people are calling complete b.s. on what she said, and we will find out if it was or if it was true. >> sandra: to your point of the lack of news conferences but the amount of times that the director has given interviews every time she speaks she brings up more questions than answers. for the american people. >> john: where is may work us on this? >> sandra: crazy. >> john: we heard the president talk about it in the oval office address, he also spoke about it on saturday evening, but where is the official briefing on what happened? i mean, this is scandalous to the degree of the kennedy assassination. and how did lee harvey oswald ever get a gun into the texas book depository building and fire out that window and kill president kennedy? i mean, that it's on than we are still talking about to this day.

iranian assassination attempt would cause to be up security around the republican international candidate so why was the shooter still able to get on a roof and nearly killed the former president? a former advisor to the department of homeland security and a former u.s. secret service supervisor special agent joins us now. as we pointed out, charles, it's been more than 91 hours now since the near assassination of former president trump. we have heard nothing, really, from the department of homeland security on an official capacity there been no briefings, no news conferences, we have heard kim cheadle, the director of the secret service give a couple of individual interviews but there's been nothing coordinated to inform the american public as to potentially what happened, where we are and where we are going with this investigation. does that seem to you? >> look, it gives me no pleasure in saying that both the director of the u.s. secret service and

the secretary of homeland security should immediately resign. they have been too many statements from the director and the secret service that are contradictory, lie in the face of common sense, and undercut proven protected methodologies of the agency. the focus must now be on the agency, not an individual trying to keep their jobs. the secret service must come out of this stronger and must have the resources they need to do their important mission. >> sandra: this was some of kim cheadle defending on defending the perimeter at the saturday rally where this all went down, listen. >> was that perimeter too small? speak of the perimeter encompass the area we needed to secure for the event that we happened on that day. what happened is a terrible incident and should never happen. we are obviously going to make sure that moving forward we take whatever lessons that come out of this and address them accordingly. >> sandra: you hear that, charles and you think there is no room for mistakes. there are no rooms for errors

especially errors this big that led to the attempted assassination of the former president. you mentioned you heard contradictory statements, explain. would have you heard? >> you can't blame state and local law enforcement and say they had operational control of the outer perimeter when the secret service is responsible for creating and effectively implementing the totality of the operational security plan. look, they have the statutory responsibility for protecting the former president. they have the responsibility of creating this plan and they have the responsibility of requesting resources to help secure that venue. so there needs to be a method in which the protection that is being requested of this building for example is actually being carried through. >> john: let me put up if i could, charles, an aerial view of the area.

or all of this transpired. and you see that you have the stage there, counter sniper teams on the building behind the president, you have the shooter's location about 150 yards away. we are the director of the secret service say well, the shooter's location was on a pitched roof and it would've been dangerous to put any kind of uniformed secret service or local police officer up on that building because of the pitched roof. but if you take a look at where the counter sniper teams were located, the pitch of those groups is greater than the one that kirks was on. what do you make of her statement? >> this decreases trust in the agency and that is a bad thing. so that statement is ridiculous, right? it flies in the face of common sense. and, by the way, there needs to be redundancies in place that if it was requested for state and local law enforcement to protect that building and they failed to do so, that coverage is then implemented to make sure the

threat is being mitigated. look, we saw the worst of what happened here and what caused it of the operational plan and we saw the best of the secret service. the immediate interior perimeter response of protecting the president and making sure he did not suffer further injury. so as far as any questions about the dedication to the mission of the men and women of the secret service, the american people can rest assured the men and women of this agency want to fulfill their missions every single day with 100% accuracy. but if the leadership in question for example is not setting the model for the wave mission needs to be carried out, then that leader is no longer worthy of remaining in the position. >> sandra: wow. we hear you and the fbi and dhs now say they are concerned about the potential for fellow

why do you fathom the details and facts have been so light and not forthcoming for the american people to understand how this big of a security lapse hap happened? >> it has been 91 hours. that seems like leagues and leagues of time. but really when you are considering the answer directly to your question is they probably want to get it right the way they probably feel like they didn't get it right the first time. there is no way we should be in this situation. there is no way a person 150 yards could've gotten that close to the president and even fired a shot. it's crazy. so we are going to be sitting down and getting some initial reactions from the leadership there. i don't expect anything which is why we will be conducting a full investigation and congress. >> sandra: to follow up on that you don't expect you will be getting anything so you think this will just be -- >> no, i expect lip service and

political b.s. i expect people covering their backsides because they know they' screwed up. i don't expect to hear anything on out of these bureaucrats that will be considered confidential. your last guest made a very, very good point to separate the leadership failures from the top with the excellent work that was done by the folks on the ground. the sniper who actually took out this evil man and those who put their lives on the line to guard the president and get him swiftly away from that risky situation. i have been in combat, i've made life and death decisions before and leadership absolutely must be held accountable. >> sandra: you say 91 hours there have been no on camera briefings by doj, no news conferences. the attorney general, nothing. news conferences or camera briefings -- >> we are just as confused as you are. your tell mike that's wrong

answer. especially as we get information of credible threats to the current and former president, former president most notably from iran. and so the fact that we can have these tragedies and we expect local law enforcement to brief people the night of, at least what you know, it's very concerning. but i would expect in d.c. people tend to be more concerned with protecting their own neck. i am trying my best to give the benefit of the doubt and saying they are trying to go through this methodically and get it right the second time because it is so screwed up the first. >> sandra: we hope so but you know what happens. when you don't provide details or what you know to the american public in a timely manner it leads to speculation. there is rampant speculation. there are people questioning whether or not something is being hidden from us. this is michigan congressman mike rogers slamming the secret service responds early on

"fox & friends," listen. >> is really no excuse, it says they are hiding a little bit of something. not only they shot the president come he got off so many rounds before the counter sniper team were able to get him taken out so that tells you there was confusion on the ground. you can kind of see that in some of the videos. >> sandra: they can put an end to speculation with coming out and getting a news conference. end of these groups, it would be a benefit to the american pe people. >> even if you don't know anything, say you are still looking into it. show your face. 90% of leadership is showing up. they are continuing to fail each moment that passes to show leadership to the american people. >> you go back to charles' thoughts on the last segment and there were a lot of things that did go very right. there was admiral reaction, admirable reaction from secret service immediately on that stage. it was what happened with the perimeter that is in such big question right now.
