breaking hour ahead. we have just gotten the message that president biden is going to release a statement on the now former secret service director kimberly cheatle so we'll bring you that. we don't anticipate seeing him, of course. we haven't seen him since july 17th. we know that biden is headed back to the white house and we have some confirmation of that. as soon as he departs rehoboth beach, delaware, set to happen in 90 minutes, we'll continue to track his whereabouts. we haven't seen him in days. the breaking news, the pressure was unsurvivable. minutes ago the secret service director kimberly cheatle resigned. secret service director cheatle never went to the site where former president donald trump was nearly assassinated ten days ago. her testimony on capitol hill yesterday was anemic and she was not informed and apparently not too curious. that came off as unprofessional

and incompetent as one lawmaker put it. she was not curious enough to prepare for the house oversight hearing. cheatle was called incompetent and calls for her to be fired were made to her face in that hearing by democrats and republicans. cheatle said she would not quit. but she just did. i'm harris faulkner and you are in "the faulkner focus." i want to go right away to u.s. congressman andy biggs, member of the house oversight committee, who was one of those who questioned cheatle yesterday. congressman biggs, first of all your reaction to the resignation and fill us in what it was like to try to get answers from her. >> good to be with you. i will tell you the difficulty is that she should have resigned almost immediately. she took it ten days and it was because she wanted to actually

continue in this position. we couldn't figure out why. the right thing was for her to resign. she wouldn't do it. it was for the biden administration to fire her. yesterday she didn't want to answer any of our questions. i can't tell you, i asked a number of questions, things like was he a lone gunman, was he acting alone, was the gun up there already? did he have to carry a gun? those types of things american people want to know. >> harris: absolutely. >> she deferred to the f.b.i. >> harris: i have to cut in. we have the breaking news statement from president biden. i'm glad you are with me so i can get your first reaction. he has just released a statement and here is the quote. jill and i are grateful to director kim cheatle for her decades of public service. the independent review to get to the bottom of what happened on july 13th continues and i look forward to assessing its conclusion. we all know what happened that day can never happen again, end

quote. a couple of curiosities i have about that. why is jill included. not a condolence letter to someone after a loss, a personal loss. i would estimate she is included because the reason she even had that job as director of the united states secret service was because of her friendship with the first lady. your take. >> i agree with you why kim cheatle became the secret service director. i also think good grief, what do you have to do to be fired from this administration? the only people that have been fired are four staffers who smoked pot. you have somebody who almost gets the president -- former president of the united states killed and does get an individual killed and other people wounded and you don't get fired, what you get is a letter saying gee, we're sorry to see you go kind of thing. i'm incensed as much by the failure of the biden administration at the very top once again to signal to the

you are full of [bleep] today being completely dishonest. >> would you have tend erred your resignation if he had been killed. >> i have admitted i will take responsibility. >> when someone says the buck stops with me. i will stay in my job and give the answers to the american people and no what happened except you won't tell us. when you sit here and repeatedly tell people i have to wait, as frustrated everybody on this committee. guess what? it undermines your credibility. >> harris: you know, it is very rare that we see these days democrats and republicans agreeing and everybody to a person nearly -- we didn't hear from every single person on this topic. some were talking gun control. the democrats. for the most part they agreed it was time for this woman to go. >> you know, harris, we rarely get that kind of agreement on that committee.

we fight like cats and dogs because we are dealing with serious issues but everybody understands the gravity of what happened and her utter failure. her failure to actually even go to the site. her failure to actually give us answers that were legitimate that she could give without giving away the investigation. she didn't want to do any of that stuff. and she kept saying i need to be held accountable. the buck stops with me. the accountability finally hit. she finally resigned. >> harris: you had an uncurious position. she didn't know what dollar amount the buck was. is it really a buck? you couldn't put a value on the amount of responsibility dumped on her and she came ill prepared. i want to get this in. former president donald trump has just released a statement and here is part of that. it is a quote. she never gave me proper protection so i ended up having to take a bullet for democracy, end quote. he told fox news digital again a

quote, many requests were made by on-site secret service for more people. always with a turn down or no response. he went on to say i have the biggest crowds in history and they should be treated accordingly. our nation's 45th president, donald trump, however, again said big improvements have been made over the last week so we've heard a little bit about that. but, i mean, it really wasn't he have than on her watch. she couldn't tell you any changes, really. i've made some changes but didn't give any detail. i wondered if she could give us an accounting of what was changing. >> i agree with you. what we saw at the rnc you saw a completely different team. a team of big, burly guys as tall as the president so they could provide that versus -- i'm not trying to denigrate the immediate detail that was there but physically they were very different. that's got to be part of the

protection detail, right? and she continued to emphasize she is a dei type of director and when you place dei over merit, you are going to sometimes have bad mistakes and she has a no-fail mission at the secret service to protect these individuals and she utterly failed. that's because, i think, philosophically she didn't get the full measure of the job. >> harris: i'm glad you and i have conversations on the air a lot because i can ask this question and i know that you know i'll probably ask something like this. when you say dei you get some people's ire up about that. she is a woman. the point you are making is her last job was ceo for pepsi and while it can be a delicious drink with a slice of lime i don't know if that was current enough experience to the secret service to be able to lead at this time. >> i guess that's the point.

did she merit that job? did she get it on merit or because, as you mentioned earlier, because she is a good buddy of the biden family and joe and jill are going to protect her and help her out? that really gets to the point. everybody wants the best person that you can possibly have in the job. that's why you do what you do. you are one of the best, harris, the reality is we want people in this particular very vital serious, very grave responsibility, we don't want to wonder oh, well, were you hired just because you knew somebody or a friend of the bidens or were you hired because you are absolutely best in training and physically and educate your troops. i literally talked to an hsi agent yesterday because there were hsi agents on the ground there. i said what kind of training do you guys get for protective

detail? he said we get a powerpoint training. that's it. that's not training. that's putting a band-aid over something and asking people who are trained to investigate narcotics or illegal immigrants. those types of things and we need your warm body here. we'll give you powerpoint training. that's what i mean by dei type stuff. they hired somebody who was not prepared to make the changes and lead this agency the way she should. >> harris: last quick one for you. we have john barrasso of wyoming standing by. congressman biggs, how does her departure figure to get answers ten days ago with former president trump? >> she still will be obligated to provide answers. we'll put her under oath and have to give those answers and well conduct a full investigation.

of his impression with kimberly cheatle as she ran away from him. no one anticipated that she would even be at the rnc convention. >> you are right. thank god president trump is still alive. >> harris: amen. we did lose someone that day. >> we did, tragedy, a hero protecting his family. it's past time that she resigns. should have happened a week ago. we still need all the answers as you were talking about with congressman biggs. we have to make sure that security failures like this never happen again. you are right, there has been no accountability in this administration from afghanistan, what has just happened now, all across the board. you saw the bipartisan outrage yesterday in the committee. what happened at the convention is four senior senators, when we found out she was at the republican convention in milwaukee, we wanted to go and talk with her because we had been on a conference call, 100

senators, earlier in the day and she was supposed to answer questions then but she didn't. she stonewalled. didn't give us information. we thought maybe we could ask simple questions that all the american people had, like how did the shooter get onto the roof? why wasn't the roof a protected area? why when this person was identified as a threat 11 minutes before they allowed president trump to go on the stage why in the world would they allow him to go on stage if they knew there was a threat right there? all of those answers we still need to have but it was a complete breakdown. i will tell you one other thing. talking with some secret service agents, they feel they have not had good leadership from the top with her. they think their leadership had failed them. there were secret service agents on the stage that day who were ravedy to take a bullet to protect president trump. this isn't about the men and women in the field. this is about leadership. one of the biden family

favorites. that's how the biden administration has done things. >> harris: agents told you they didn't feel they had good leadership. what is the chain of command like when the boss is not leading? what were their options at that point. a lack of leadership may not have completely led to what we saw ten days ago with an assassination attempt on a former president but it certainly wasn't helping. >> it undermines their own hard working individuals in the field, their own confidence in the leadership that they are under and you have to have confidence in your own leadership and they didn't have it. >> harris: where does the next leader come from now? i'm sure that senators and house members, all of you have to be looking at who is next? it is critical. we are 106 days away, 105 days away from election day in this country and we have already had an attempted hit on a former

president. one of the candidates. what about protection going forward? who will lead this? any ideas? >> there will be the continued committee hearings in senate to make sure that someone is there who can do the job capably. it is a presidential appointment. so the president who is clearly not up to doing the job today will be in charge of making that appointment. remember, up until last week even robert f. kennedy didn't have secret service protection. i thought it was a mistake and error of judgment. >> harris: look at what happened with his family and all the service they gave this nation and they wouldn't provide for rfk junior. it is almost like on purpose they just followed her lead and she was not good at her job. but she is gone now and -- >> president trump needs and deserves whatever kind of secret service protection that vice

president harris, now the nominee is getting. whatever president biden is getting. donald trump needs that 100% level of full protection. not just as a former president of the united states but also as the republican nominee for president. he needs that full protection. >> harris: let me ask you this. does something need to change? maybe you can't change the appointment process from president to the leader of the secret service, but when that person's job then feathers out to someone who is competing with the current president, should there be more of a checks and balance in congress on the hill for how those decisions are made to protect that candidate? because clearly what we have is not working. >> i believe that should be, harris. right now this is not a position confirmed by the united states senate whether we do a confirmation vote. maybe we ought to look at this to make sure that no matter who is in the white house, that the secret service director has

president biden tomorrow at 8:00 p.m. eastern and assuming we'll also see him since he is reportedly going to give his address from the oval office. we haven't seen him since july 17th. and really have not heard him talk about pulling out of the race for re-election since sunday when he did that. there is gaps, disappearing vanishing act he has been on for a while. we know that at some point he was recovering from covid. he is returning to the white house so that would let you know that potentially he wouldn't be contagious because he has staff around him. power panel. gianno caldwell and doug schoen. let's jump right in here. gianno, your reaction to the president of the united states finally getting ready to address the nation. >> there is only one major question i think most americans would have is how can you decide not to run for re-election but

not resign the office of president and don't tell us it is just because of your poll numbers. we know that's a lie. you chose to stay in even though you had bad poll number after bad poll number for months. with this consideration in mind he needs to lay out a case why he should be there for the next five months. >> harris: first of all your reaction to what gianno said. >> it is a fair question. the president has to speak to his competence, his agenda, and why he made the decision he did and how the decision not to run allows him to continue to serve. fair question, reasonable issue that should be addressed. >> harris: you know, i look at this kind of bifurcated. you have on the one hand he is leaving and, i mean, could you have had more people to ask him to step aside just in your own party, doug? i don't think it's possible. but at this point, do you have faith in kamala harris then stepping up should he not be in

the presidency, she becomes president at that point potentially if there is a 25th amendment or resigns his office, whatever would get him out of that seat. and we have two wars going on, a lot happening. your thoughts, doug. >> well, i have trouble with the process that was put in place to very quickly rubber stamp her nomination. no mini primary, no open convention. basically the deal was done in 48 hours. i have a problem with that. i have also a set of questions about how much, if any, responsibility president biden is going to give to vice president kamala harris now that he is standing down as a candidate. so i have many questions, many concerns, and i think the american people, most of all want to know what's happening, why it has happened and what it means for the governance of this

country. as you put it quite rightly, harris, the prosecution of two wars that we have important and ongoing roles in. >> harris: i don't see a match on her resume to be able to handle that level of foreign policy but she is the vice president and immediately goes into the roll. the caution i've been talking to republicans about. be careful what you ask for. she will be harder to beat if she suddenly president kamala harris. >> yes, but i have to tell you kamala harris is an unserious, uncapable and unqualified person to be president. how do we know this? we see what she's done at vice president. shh he went to ribbon cutting ceremonies. does not showed america she has the leadership it takes to be president of the united states.

thank you for all that you do and will continue to do for our great nation, kac, director, her initials, of course. charles, your reaction. >> well, i think the former director made the right decision here. it is time no focus on the agency so they can come out stronger on the back end. she had to take the hit for the security fail earls we saw on july 13th and resignation was the right move. i have to tell you and you will be the first to hear it. i'm talking to a lot of people in the agency, including senior officials, there is a lot of frustration right now over at the secret service. and that is because they felt like they were not allowed to get out in front of this and that they've been muzzled throughout this incident and this process by the department of homeland security. we are talking about homeland security public affairs, legal, and even some mingling from the secretary's office.

so the agency should have a right to defend itself. and transparency was a big issue. we heard it from congress, we've heard it from the american public. if the agency wants to get out front and be participating in some of these press conferences and be more candid with congress they shouldn't be fearful of repercussions from their parent agency dhs. >> harris: i have to go back on that. mayorkas, the secretary that you are talking about of homeland security, there has already been an impeachment movement toward him by republicans. impeached in the house but not removed by the senate. he kept his job. are you saying that you called it mingling. are they muzzling people? are they stepping not only on free speech but getting involved in stopping finding facts in an investigation from dhs? >> well, let's look at the questions that have been asked of the secret service, harris.

why haven't you been participating in press conferences and more forthcoming with the information, right? all of these questions deserve answers. and it is not surprising to me based on my experience that the mother ship, dhs, is controlling the narrative here. and it is not fair to the agency. it is not fair to the men and women of the secret service, especially if you have the best interests of the agency. and this needs to be looked into. has anything worked well under mayorkas's leadership at the department of homeland security? it is rhetorical but we know the answer is no. our border is wide open, the threat levels off the chart in the country, you have this incident with the secret service where i think resourcing is going to be a very fair question. do they have the capabilities within the secret service to carry out their important 0-fail mission where they need to show up to work and get it 100% correct each and every day? this really needs to be looked

into. maybe the agency hasn't been in the best position to articulate what's going on here. >> harris: look, i would want to know what the relationship has been like cheatle leaving the secret service and secretary mayorkas. was it a command and control that maybe somebody didn't do their job only two saturdays ago? the situation where she knew what to do and told not to do it? i want to know more about mayorkas and the answer to your question is no, nothing has worked on his watch. it is substantially important and evidentiary not just a rhetorical question. so what has to happen now? does this go all the way to the white house? >> well look, congress is going to be looking at the secret service and potential changes to the agency. 22 years later since dhs was

formed in the after math of september 11th, and it has never been revisited regarding its structure. the agencies that were pulled into it. maybe it's time to look and see if the secret service actually belongs within the department of homeland security. look, it is a struggle for the agency to get budgeting. they are going up against coast guard who need helicopters appeared ships and going up against political issues like border and immigration. it is tough. there is a lot of agencies. seven operational components within dhs. maybe the secret service under this administration has not been getting the attention that they deserve. >> harris: dhs has ballooned to the point if someone doesn't happen to be fantastic at their job, ie mayorkas, they can do that and things start to crumble beneath his feet across seven agencies. real quickly, what would you like to see -- who and what type

of person needs to be leading the secret service immediately? >> look, i think the secret service wants to remain the foremost protective agency in the world and they need to insure that that is prioritized. based on the fact that they have to go out to work every day and get it right. so focus on protection. you can't complain that you are being requested to do more with less when you are constantly raising your hand to do more. it is going to require tough conversations. it has to be focused. you have to have somebody that is going to come in, defend the agency, and provide some structure and guidance and say look, protection is our number one mission. we'll be the best at it in the world. if other things need to go away that we're doing right now so be it. >> harris: in the interest of time a quick answer on this. do you think the person is in the chain of command right now? >> not sure. >> harris: okay.

occupy this job over the course of the coming months. at the same time, i would counsel people against the wisdom of replacing joe biden with kamala harris. just given the fact if you actually believe that donald trump and j.d. vance are going to win in november, i can't believe that the two-month lame duck period that would follow election day for kamala harris would be better for the country than the one that we would see from joe biden. in fact, i think she would seek to satisfy the demands of probably the furthest left members of her own party in ways that could potentially build her up for the future. that's a danger people aren't considering. there is a marked degree of ideological difference between the two of these people. kamala harris was the most radical member of the senate when she was there. she was 100 out of 100 the bernie sanders left when it ca im to voting. think about that for a second. that's what she would bring to the presidency.
