>> hello, this is "outnumbered." i'm kayleigh mcenany with my cohost emily come upon you and harris faulkner. also joining us, host of the "kennedy saves the world," kennedy, and host of "making money" on fox business, charles payne. we begin this monday with the stark difference between what vice president kamala harris is touting on the campaign trail and her far left record. "the new york post" is callin harris a "the new york post" is callin harris a -- hiding her far left positions from voters, many are saying. now, people are saying she's tough on crime: she is a prosecutor. >> before was elected to the united states as a senator, i was an elected attorney general. [cheers and applause] before that, a district

attorney. and before that, i was a courtroom prosecutor. as a prosecutor -- as a prosecutor -- as a prosecutor. >> we know her resume, i guess. that tough prosecutor you just watched once backed a bail fund that helped free violent criminals. now, the new tough on crime kamala wants you to believe that after nearly four years and 8 million illegal immigrants, she's going to get tough on the border too. >> i was attorney general of a border state. i went after the transnational gangs, the drug cartels and human traffickers. i prosecuted them in case after case, and i won. [cheers and applause] i know what i'm talking about. he talks a big game about a lot of things. but he talks a big game about border security but he does not
9:03 am
walk the walk. >> trump is the one talking a big game while kamala is taking a big play from his playbook. his proposed policy is a copy and paste from his idea months ago. >> we are going to not charge taxes on tips. >> eliminate taxes on tips for service and hospitality workers. >> a little plagiarism. trump blasted kamala, saying every thing she does is fake. despite the apparent gaslighting on harris' far left record, she is leading in three critical battleground states. you will see if there. this is a new poll from "the new york times" college showing that harris is leading by four points in michigan, wisconsin, pennsylvania. those are the big states. how is that possible when the liberal media has her back? just look at the magazine's latest cover. they are calling it "her

moment." that's powerful. kamala is different than kamala plus media. starting the tax on tips, i saw this imme -- in real-time. i thought of president trump. when you do research, you pulled us up. this is on the irs web page. look at the date on this. february 6th, 2023. irs introduces new service industry tip reporting program, after kamala harris cast a tie-breaking vote to literally tax your tips. >> and on top of it, they want to get 80,000 irs agents to go after people who are tip workers or side hustle workers. look what happened in california. they tried to shut down the gig economy because they are not unionized. it's bizarre to me what's happening. i can only think half of the folks who are buying into this just don't know. they are apolitical, maybe not paying attention. the other half agree that this is a wink and a nod. say what you have to say, but we know you will govern
9:05 am
differently. that's the dangerous part. they are probably right. 99% sure they are right in their assumption that they will do whatever it is to win, but then she will revert to who she has been for the majority of her life. >> politico noted this morning what was so significant about tax on tips is it copied trump but it was her first policy proposal. where are the white papers? where are the plans? they don't exist. enthusiasm is what she is banking on. >> they are looking at what has traction. ma they know they can't substantively talk about the border. we have seen biden "should we flip the switch on some of trump's policies and bring the numbers down if we can? the answer to that being yes --" if they can. why hasn't she done some of this before? i didn't know she had a financial fiscal policy. did anybody know that? i didn't know she felt so strongly about tips. it's only been 22 days. it's not like the woman has had the time to reinvent herself, not without help.
9:06 am
so, what are the fingerprints on this from nancy pelosi? i have been thinking about this a lot. put it out there and tell them they can find out what's in it when we pass it. i think that's how they are going to roll. they're going to talk about a lot of issues, ways to fix stuff, and then -- you just know that it is -- kamala. you just know that it's her and you will find out once all the stuff, that she is the last person in the room and signs the legislation, once it makes it to her desk you will know what's in it. is that good enough for americans? i don't know. i guess we'll find out in 85 days. >because she teased reporters that she has some plan, to harris' point. i don't know what's in it. we will see when it comes out if it comes out. she says it will. "the washington post" editorial board, normally i would say quite liberal. they do make this interesting point. elections aren't just about winning: they are about accumulating political capital which harris cannot do unless
9:07 am
she articulates one. she needs to articulate her plan. >> she doesn't have one. [laughter] i guess -- the "time" magazine covers. >> it's been obvious for all of these decades that people have been sugg subjected to, does whatever it takes to get elected and then simply lets the vapid, radical left make the agenda. it's not her articulating anything. she is not a thought leader. she is not in any way a progressive in my opinion, because she is an empty vessel that capitulates to whatever that tiny progressive left says and does. we have gone through tick by tick of her flip-flopping. we have talked about the tips and taxes, fracking, president biden going from a racist old white man to all of a sudden unmatched legacy. the list goes on of how she has now walked backward or off and walks backward, and that's what she says and what she stands for. at the end of the day, the press is complacent.
9:08 am
i thought "the new york post" put it beautifully: it's not that the press won't ask: it's that they are preventing from being asked exactly what those articulated policies are, exactly what her credibility is, and therefore they presents that so everyone can vote her in and then she is just going to sit back and let the progressive left win and do everything. >> we played those clips on our show appeared she wants to start from scratch with ice, wants to redirect resources from police, wanted medicare for all which means health care for none. as i was looking through this cross tabs of "the new york times" poll, this stood out to me. if i had to pick one crosstab, it would be this one. ask about harris whether she is too liberal or not. 44% says she is, 44% s -- say she is not too far either way. i would show the policies. she is too far left. most markets, 70-80% of americans are against abolishing
9:09 am
ice and redirecting resources from police and so forth. >> i credit her team with this because it's been a very effective strategy for her. the trump team is running points ahead of biden/harris, and now that she is atop the ticket, the polls are reflecting the sugar high. what they are doing to augment that rush, the excitement of contrast. she can be contrasted with biden who is no longer on the ticket. now what they are doing is looking at her policy failures, some of the position she has taken in the past. all they are saying is it's opposite day. just say the opposite now, and then gaslight everyone who asks you questions or challenges you in the slightest about it. it has been an effective strategy so far. the problem is that's not going to hold. i will tell you why. people remember the sugar high, the contrast when biden was elected. it was all about feelings, about "trump is gone, this is amazing,
9:10 am
the world can heal." and then the economy fell apart. now, we have foreign policy disasters all over the globe. people need to pump the brakes. feelings are not enough. the more the former president and his pick for vp hold our log no holds barred press conferences and talk to everyone in mainstream media, it's going to be impossible for her and her slimy veep to slither out of these all-important grilling's. they have to sit for these things, and the press, it is their responsibility to say "here are massive contradictions. how do you sure these up?" you cannot be two things at once in the same way. it's a principle of noncontradictory. >> this article from new york. to that point, we want to cover for you, but give us something to cover. how generic can kamala harris be? or campaign website: seven donation buttons, zero policy pages. we got your back, but give us

to that salon owner's place, ahead of a fund-raiser for vice president kamala harris. we have the footage from last week, allegedly showing an agent covering missile and security camera with tape so they could do what they wanted. they then picked the lock and occupy the building for hours. all of this, they said, was to use the bathroom, but you wouldn't need to be in there for hours. what were they doing there? by the way, it looks a little homey here. that's not a very big business. god bless the owner of the salon who says the secret service called her to apologize, and that the secret service is out with a statement. she said she would have gladly help them out if they had just asked her and knocked on the door. here is the secret service. "we hold these relationships in the highest regard, and our personnel would not enter or instruct our partners to enter a business without the owner's permission." you saw the camera. that was a lady secret service agent. the face was blurred, but you could kind of see a few things
9:52 am
anyway. you always can. she is moving. the bubble is not moving with her. charles, where are we with the secret service right now? >> i was worried you would come to me. [laughter] >> how could i not? >> i don't know! that's bizarro world. they broken, state for a long time -- a couple of hours -- they used the bathroom. i don't know what's going on. this story is so bizarre. i don't know what to make of it. i really don't. it's over my head. obviously, another stain on this secret service, which should -- i think back to the hearing and -- >> the acting agent. >> i could imagine how he is trying to defend this. it's time to say "this agency has serious issues top to bottom." >> so watch when this person climbs up. you can't see it because of this unfortunately, but when the person climbs up, that's when you get a review of that person
9:53 am
coming into focus before the camera is on. >> it is stunning to me. you think the secret service would have learned lessons in the last few weeks, but instead they come out with this statement suggesting that they weren't behind it and it might've been there business partners. that's what you take away from the statement. the communication strategy for the secret service appears to be confusion because apparently they apologized to her according to her. either own it or don't. you are the power of the federal government coming into a private business. kennedy and i were laughing. we think there is an amendment against that. >> it's a violation of the third amendment. that's crazy. >> preach. >> you cannot house and quarter troops or federal officers. they fall under that umbrella. they know that this is such an incredibly bad look for the departments. i feel bad for the good secret service agents out there who are going to be tasked with keeping a very wild dnc safe in chicago next week. i wish them well. i wish they didn't have to fight
9:54 am
upstream against this kind of negativity, but this is an own goal. >> i want to know the partners of the secret service -- i guess they farmed this out as their partners. they are still responsible for them. they are obviously protecting people. they are armed. i can't imagine they can distance themselves too far. so kennedy, remember early on mike kimberly cheatle before she resigned in that house here in? >> unfortunately i do pick >> what she would admit as they were down 1,500. i have read that it could be even more in terms of personnel for the secret service, so you are right. the dnc convention, any big events, all these rallies. it's got to be tough. >> in the dnc is expected to have 50,000 protesters in chicago. that is in addition to the chicanery that's already there. i hope they -- relationship with better law enforcement than they did. >> here is the deal. and the statement apparently they say it's against our policy. it doesn't matter because you did it. number two, the fact that you

did it -- it's often a hallmark of the secret service: they often tape over cameras for security reasons along their route. >> to use a bath and? >> no. too true and unrelated they often covert cameras and security routes, for security purposes, but this as you talked about, the salon owner -- "if they had asked me i would've bought them breakfast." they didn't even lock the door after, and they -- reportedly, as we learn more about who was there. we also have reports that emergency medical services persons of the secret service agents were saying "come this way, guys." when we talked about the dnc, the colossal p.r. failure, we need to talk about the restroom, which is a human bodily function which needs to be addressed. as a taxpayer come on for making those plans. not on my watch. >> but you don't need it for hours. if you do, you were sick before you went to work. donald trump is back on x, by the way. he has been tweeting for about
