station here on market street. firefighters say the call came in around 935 this evening and they tell us it was pretty severe. now, as a fire says one woman was trapped under the cruise autonomous car when they arrived, they did have to use, quote, the jaws of life to pull the woman out. now at this time, firefighters are only saying her condition is serious and that she is currently being treated at sf general hospital. we just heard from a fire captain with the sf fire department. he tells us it's extremely early, but they're looking into several factors. there's a number of different concerns when we have motor vehicles at intersections, high speed intersections as pedestrians lighting night time. >> there's a lot of different factors that can come together to cause injuries. >> now, as a fire says, crews is in contact with law enforcement. officials aren't yet sure where the woman was in the intersection when she was hit and run over here. and we two have been in touch with cruise representatives, both via email and those who are here on scene. so far, they are declining to

comment. in san francisco tonight, tim johns, abc seven news. >> all right, tim, thank you for the latest on that. now to the south bay, a disaster at a residential daycare in san jose. two children are dead after falling into a pool and drowning. a third child is recovering and is going to be okay. it happened just after nine this morning at the happy happy daycare on fleetwood drive in the almaden valley area. abc seven news south bay reporter lauren martinez is uncovering new information tonight into the history of the home. >> two children died after falling into a pool at their home daycare center in san jose. police say a third child was hospitalized. according to the department of social services, the home daycare center was licensed in january of 2021 to 2 women whose names are not being released at this time. the state has conducted a total of eight visits, including inspections. the purpose of one visit was to discuss the pool in 2020. one.

state analyst wrote. there is a pool that is fully fenced within the backyard. the fence is at least five feet high and is constructed so that the fence does not obscure the pool from view. the fence is made from a hard mesh material while the gate swings away from the pool, self closes and has a self latching device located no more than six inches from the top of the gate. the gap between the fence and the floor is less than one inch. in 2021, the licensees had to adjust the pool fence. but in january of this year, three citations were issued. licenses failed to provide a criminal record clearance for an adult working at the home. another citation was for not meeting ratio requirements. a state analyst observed five infants when the maximum is four for the other citation was failure to conduct a fire disaster drill within the past six months. on june 6th, a case management inspection found no deficient cases. the most recent visit by the state was three

weeks ago. on september 13th. it was an unannounced visit. the daycare center was cited. the licensees did not document safe sleep checks every 15 minutes. one nearby neighbor said the daycare runs monday through friday from 8:00 to 5 p.m. >> my thoughts and prayers are with the parents because that's what gets me. i've been shook up all day, to be quite honest. >> it just makes my heart and i feel bad for the families because we do. when i take her to school, we watch. we watch the families bring their kids and so we see their faces. it's heartbreaking. >> the san jose police department homicide unit and the santa clara county da's office are conducting a joint investigation into the circumstance dances around the drownings in san jose. lauren martinez, abc seven news. to the north bay now. >> there is still no sign of a missing swimmer off the coast of point reyes. but still plenty of

questions. the swimmer disappeared in the waters off wildcat beach on sunday after witnesses called to report a shark attack. the us coast guard spent all day searching for the swimmer, a mission that came up empty handed. the national park service is categorizing this incident as an unconfirmed shark attack, but also say there are a lot of dangerous rip currents along that coast. >> sometimes we get in our head and we're like, oh, the water looks nice. why not just jump in and cool off? things can change. you never know what's out there. >> national park service rangers will continue their search operation. the coast guard is calling off its search. we're told the victim was with a group who traveled to the scenic part of point reyes for a wedding celebration. to make sure that you are getting the new updates with this story, download the abc7 news bay area app. we are sending alerts just like this one with news and weather customized for you. just be sure to enable the apps notifications . fleet week is officially underway in san francisco. the blue angels haven't taken to the air yet, but as we saw from sky seven earlier today, the famous

planes are in town. and earlier this evening, a special hoops with the troops event was held at piers 3032, set beside some iconic san francisco sites. abc7 news reporter j.r stone was there and has the story. in the shadow of the uss john p murtha, the bay bridge and downtown san francisco basketballs were bouncing for fleet week's hoops with the troops basketball clinic. >> helicopter right there and it's just amazing actually playing with the ship is right there next to me. it's super cool because having having the ship in the background and playing with all the all the older people, it's super fun. >> older people are described by the boys and girls club. kids is basically the academy of art dunking basketball players and the navy sailors and marines who stay on this ship together for a fleet week that was just days ago in jeopardy over a possible government shutdown. >> one thing about the military, you know, we're always supposed

in a summer full of them, this one involving kaiser permanente. workers up and down the west coast and in the d.c. area. with now just hours left to reach a deal, the two sides are racing to avoid what could be the largest health care strike in us history. abc7 news reporter tim johns is closely following where things stand. he has this report on what it means for you for around 75,000 kaiser permanente health care workers nationwide, including here in the bay area, could soon be on a three day strike. >> an umbrella organization of about a dozen unions representing the workers say they plan to strike starting wednesday morning if they can't come to a new working agreement with kaiser. >> i want to make sure that my employment i can take i'm thinking about my patient all the time, not thinking about. i have to take a second job to be able to do, you know, to survive . >> sonia allen smith works as a kaiser radiology technician in oakland. she says issues like chronic understaffing, low pay and worker burnout are some of the top issues she and her

colleagues want addressed. ellen smith tells me while these issues have been around for years, the pandemic has made them worse. now, she says, it's impacting patient care because kaiser simply doesn't have enough people. >> i treat every patient that comes in as as if they were my mom or as if they were my brother, my family members. >> if a strike were to happen. kaiser permanente says their hospitals and emergency departments would remain open, but that some non-urgent medical appointments may need to be rescheduled in a statement, they said, quote, a strike is not inevitable and is certainly not justified. our goal is to reach a fair and equitable agreement that strengthens kaiser permanente as a best place to work and ensures that the high quality care our members expect from us remains affordable and easy to access. the kaiser strike would be just the latest in a series of major strikes that has happened nationwide in recent months. all of them share similarities, says labor law professor william gould. >> much of it grows out of a labor shortage. some of it grows out of wages that have been

they have kevin mccarthy as speaker of the house. a group of far right gop representatives led by gates are upset over house speaker mccarthy navigated through the government's federal funding deal over the weekend. the short term spending deal keeps the government running until november 17th, but now the house will take up gates's motion within two days. all it would take is a simple majority to remove mccarthy as house speaker. >> well, he doesn't have my

support anymore and he doesn't have the support of a requisite number of republicans to continue as the republican speaker. now, he may continue as the house speaker and he may continue as the speaker of the democrats in some sort of uni party coalition. but he is not going to be a speaker in power as a consequence of republican votes. >> there has not been a consistent republican name mentioned as a possible replacement to speaker mccarthy in a post on tonight, mccarthy responded with these three words bring it on. well donald trump slammed prosecutors during the first day of his civil trial in new york. the former president appeared in court this morning. he called the trial a disgrace. mr. trump is accused of fraud over several of his assets, including his namesake trump tower building in manhattan. new york's attorney general, letitia james, argues trump and his two oldest sons wrongly inflated their assets to cheat the system . trump, who is the gop front runner in the 2024 presidential race, faces being banned from doing business in the state of

new york. the us postal service is out with a new stamp honoring the late supreme court justice ruth bader ginsburg. it portrays her in her signature look wearing a black judicial robe with her white beaded collar for the supreme court's chief justice spoke about her impact at the stamp's unveiling a new stamp will honor this outstanding american eminent jurist who gave so much to our country as scholar, teacher, lawyer, our judge and justice. ginsburg died in 2020 at the age of 87. her family says she would have been thrilled by the honor . now, with the writers strike over, we are seeing some late night talk shows coming back, including jimmy kimmel live making its return tonight. >> i miss them. we missed them. i'm a nurse. my patients, that's what gets them through the night when they can't sleep at night. late show all the different shows. we're happy. we're excited. we turn the tvs on for them. and jimmy kimmel is one of the number one fans that we all

love and talk about. >> fans are also excited to see the workers back doing what they love and getting paid appropriately. tonight, the show is hosting arnold schwarzenegger with musical guest jason isbell, ketch jimmy kimmel live here on abc seven, right after us at 11. all right. for now, though, we want to get a check on the weather with abc seven news meteorologist sandhya patel. sandhya. yeah, get ready for the heat this week. >> so we do have a heat alert for you. temperatures will be soaring. we're talking about increase fire danger as we track october heat and a moderate risk of heat illness. so definitely stay hydrated and keep cool. here's what's going to bring us the hot weather. it's an area of high pressure that is starting to build as the area of low pressure that brought us the showers on saturday has moved on with this ridge of high pressure. we'll see those downslope winds and that will bring hot weather to the bay area. inland areas will be in the 90s 70 to 80s along the coast. this is wednesday as we head into thursday. even hotter weather in our inland

communities into the mid 90s going into friday. and it is going to be a warm one. even near the coast. the other thing that we are concerned about is the offshore winds with that high pressure building, northeasterly winds will dry out the atmosphere. any moisture that we had over the weekend will start to dry out as well. so we are looking at heightened fire danger. there is no red flag warning, but something to remain aware of as we head into that time period. so with those winds picking up just briefly and not strong, the fire danger will be coming up into the moderate to high category for parts of the north bay. you will notice as we head towards wednesday at midnight, for the time being, we don't have to worry about fire danger because we've got this shallow fog layer over san francisco. how cool is that? it's about 1000ft, so it's not going very far. here's a look at the fleet week forecast for the blue angels, any of the fleet week festivities. if you're going, it's going to be warm and sunny on friday in the mid 80s as the blue angels take to the skies. definitely great visibility and good weather for

saturday. upper 70s morning will be in the 50s and then sunday is the cooler day with some fog around. we do have the fog right now on live doppler seven. some higher clouds passing through as well. a look at those temperatures in the 50s and the 60s ocean temperature is 58 degrees. so good sleeping weather tonight and you can see a really nice view from mount tam of the fog right now as we take a look at the air quality, it's going to remain good to moderate tomorrow. but more areas start to see moderate air quality as that heat builds, particularly thursday and friday. so first thing tomorrow morning, watch out for that fog. it may be dense and patches and the fog will start to pull a little bit away from the coastline and then some patches will linger your morning temperatures in the 40s and the 50s, you will need that light extra layer in the morning. the nights are longer. it's getting cooler tomorrow afternoon though not cooler, it's warmer, mild along the coast, upper 60s in places like half moon bay, 73 in san francisco, mid to upper 80s inland. so it's going to be a warm one away from the coastline
