the roadrunner. from new york. >> this is america this morning. >> good tuesday morning everyone. i'm andrea fujii in for rhiannon. >> and i'm lionel moise in for andrew. we begin this morning with a major event in washington dc today. >> homeland security is gearing up for the so called march for israel, which has received the highest level of security designation as israel's ground war against hamas rages in gaza. meanwhile, in chicago, more than 100 people have been arrested after this protest demanding a cease fire on the battlefield. >> abc news has been granted access to a children's hospital in gaza. israel says hamas built a command center beneath that hospital. president biden is demanding that hospitals be protected. abc's justin finch is here with the latest from gaza and from washington. justin, good morning. >> lionel good morning. federal and local law enforcement are on high alert here in washington,

noting surging tensions in the us since that hamas terrorist attack on israel last month over the night, final preparations on the national mall for today's march for israel in washington dc, with organizers expecting a crowd of tens of thousands, security is top of mind for dc's mayor. also requesting support from the national guard amid rising threats, though law enforcement officials are not tracking any specific actionable threat to the march, homeland security officials are classifying the rally as a level one security event. it's highest designation. >> you can hear the take firing down the street in the war zone. >> gaza is overwhelmed. hospitals facing increasing danger. the israeli defense forces taking abc's matt gutman inside a northern gaza children's hospital that the idf says hamas militants were using as a command post and even to hold hostages.

>> those ak47s look pretty old and rusty. i mean, was this a crack force that was here? no no. >> some of the gear was operationally geared, but you also some of the terrorists fled away. it shows us the war machine. hamas is conducting from hospitals. >> the idf also claiming hamas turned the nearby al-shifa hospital into a stronghold to white house officials, saying the us has intelligence supporting that. but doctors refute that, saying the hospital is no longer functioning and had to remove premature babies from incubators without electricity. president biden reiterating his concerns about conditions surrounding that critical hospital. >> and it's my hope and expectation that there will be a less intrusive action relative to the hospital. the hospital must be protected. >> the white house also saying the us is continuing to work on

getting fuel supplies to gaza's hospital and allowing evacuations for patients in danger. andrea >> justin, thank you. we turn now to some travel trouble on the horizon. days before the busy holiday getaway begins, the government shutdown is looming in washington, which could jeopardize travel plans. this morning, growing concern about a possible government shutdown later this week that could spell chaos for millions of americans planning to travel during the holiday season. experts already predicting record crowds. >> we're going to carry more customers than we ever have before. about a half a million more than last year. >> but without a deal in congress to avoid a shutdown this friday night, air traffic controllers and tsa workers could be forced to work without pay. the concern is many could call out sick in protest at taxing the already overburdened, burdened system. >> and that is not fair to tsa workers at all to be expected to come to work during the busiest time of the travel season without being paid. we are

really going to feel the brunt of this come next week if the government shutdown. >> house speaker mike johnson has submitted a plan to keep the government funded through january, but it does not include money for israel or ukraine and it does not include spending cuts that many republicans want. >> but we've got to help israel. we've got to have strong oversight and scrutiny over ukraine aid. we've got to fix the border. all these things that we need to do in the appropriations process. but we won't be able to survive to have those fights if the government shut down, at least nine republicans oppose johnson's bill, but democrats could throw johnson a lifeline. >> the speaker's proposal is far from perfect, but the most important thing is that it refrains from making steep cuts. >> the house is expected to vote on johnson's plan today. over in the senate, minority leader mitch mcconnell has joined senator schumer in supporting the bill in investigators in southern california now believe the fire, which has shut down interstate ten in los angeles

and definitely was arson. >> no word yet on possible suspects, pallets, trailers and cars were being stored beneath that highway. the company storing those materials was in a legal battle with the state and their lease had expired and the fire damaged more than 100 columns supporting the freeway. plans are being made for repairs , but it's unclear when it will reopen. more than 300,000 people use that section of the highway every day. >> protests have erupted in mexico after the country's first openly non-binary judge was found dead. human rights groups are demanding an investigation to determine whether jesus ossio bayona's death was a hate crime. the 38 year old's body and the body of bayona's partner were found in their home. bayona was sworn in last year and was one of mexico's most visible lgbtq+ advocates. >> now to the history made at the supreme court. it's not a ruling, but a new code of conduct for the justices. the first ever. here's abc's derek dennis. this morning in response

to mounting criticism and growing questions about their ethics, the nine supreme court justices have signed on to a new code of conduct outlining what they should and should not do ethically as lifetime appointees. >> they were watching as the gallup poll numbers for the trust in their institution ticked down. and i think that really bothered a number of them. justices clarence thomas and sonia sotomayor are among those who've been in the spotlight recently, thomas, for his financial ties to a texas billionaire and republican mega-donor and sotomayor for allegedly using court staff to plan a book tour. >> justice alito also came under fire, accused of not reporting a luxury vacation on a private jet . among the highlights of the new code, avoiding conduct that might compromise impartiality, i.e. not conveying the impression that they're in a special position of influence and not using their taxpayer funded staff for non-court work. >> the supreme court of the united states is at least saying to the american people, we hear you and understand that the nine

justices on the supreme court are members of a democratic form of government, not royalty, but many observers note this new code of conduct is toothless. >> it does not include a mechanism for enforcement. it doesn't say what will happen if justices violate this code of ethics. the head of the senate judiciary committee called the new code a step in the right direction. >> but critics point out there are lots of should do's in the code and not a lot of must do's. and drea, lionel, derek, thank you. >> seismic activity has slowed down slightly in iceland where an entire town is evacuated due to concern about a volcanic eruption in about 900 earthquakes have been detected on iceland's southwest peninsula since sunday, ripping apart roads. a different volcanic eruption back in 2010 disrupted air travel to europe. >> time now for your tuesday weather. back in alaska have some areas on track for their snowy november

a candlelight vigil last night honoring the four idaho college students found dead in their house. the event on the university of idaho campus marked one year since the victims were killed and the accused killer, brian kohberger, is in custody, but no trial date has been set. a not guilty plea has been entered on his behalf. a motive remains a mystery. >> now to an abc news exclusive. we are now hearing what two of former president trump's former lawyers told prosecutors after they reached plea deals in the georgia election interference case. here's abc's melissa aidan an abc news exclusively obtaining portions of confidential videotaped interviews between the fulton county district attorney's office and two attorneys. >> sidney powell and jenna ellis, who were charged with aiding donald trump's alleged efforts to overturn the 2020 election. >> all his instincts told him he had been defrauded. >> powell and ellis, who were indicted alongside trump and 16 others, cut plea deals on

reduced charges in exchange for their cooperation with prosecutors in georgia's investigation to the former president, abc news obtaining these excerpts of their confidential interviews where ellis tells prosecutors she was personally informed by trump adviser dan scavino that trump had no plans to leave the white house despite fight. biden winning the 2020 election. >> and he said to me and a kind of excited tone, well, we don't care and we're not going to leave. he said. the bus is not going to leave under any circumstance. forces. we are just going to stay in power. >> i think it's helpful to the state when you look at the evidence because you've got somebody saying that he doesn't care whether he won the election or not. he's staying. but i think that there's going to be some challenges to that by some of the defense attorneys in the case. >> scavino did not respond to requests for comment and an attorney for trump called the purported conversation meaningless since trump did ultimately leave powell also told prosecutors trump was determined to stay in power despite his aides repeatedly telling him he lost. >> what was president trump's
