today in the bob lee stabbing case. >> abc seven news i-team reporter melanie woodrow joining us live now in the newsroom with the latest melanie. >> larry and kristin, fireworks today in part because of a san francisco standard article that featured four pictures of neema mumini in his jail cell. the pictures taken by a freelance photographer in august who was working on a different story with the la times and recognized momeni. he then sold those pictures to the san francisco standard, the judge in the case says the sheriff's office is now looking into all of it. nima momiji's attorneys calling for a change of venue in the bob lee murder trial. >> obviously, the media publicity, okay, the reputation of the defendant, the reputation of the victim, whether or not a person can get a fair and impartial jury. >> adding fuel to their argument, a san francisco standard article publi included four photos of momeni in his jail cell, is so inappropriate and next level ugly is the best

term that i could use that we felt compelled that we had to kind of expedite our motion to change venue. in an emailed statement, the san francisco standards editor in chief writes, quote, a freelance photographer had permission to take photos inside the jail. and nima momeni gave the photographer permission to have his photo taken. we contacted momiji's legal team prior to publication and they did not raise objections or concerns about the publication of the images. the standard believes the images were entirely newsworthy. nima didn't agree to have his photograph taken. >> we didn't agree to have his photograph taken. this was a hit job and there's going to be ramifications. >> it looks like he's smiling in some of the photos and almost posing. >> that's just happenstance. what they did made this not a fair and impartial system. what they did was disgusting. what they did was illegal. what they did was civilly responsible and someone is going to be held responsible. >> in an email statement, the san francisco sheriff's office writes in part, quote, regrettably, the l.a. times photography tour violated our

established media rules while the l.a. times did not publish any unauthorized photos. its photographer proceeded to monetize the unauthorized photographs with other media outlets, resulting in a further violation of our media rules and a blatant disregard for the agreed upon conditions. moomin's attorneys also filed a motion for a rule to show cause related to mohamedi's vehicle, which was supposed to be released from a lot with no fees. they refused to do so. those motions will be heard in january with a tentative trial date set for march. nima momen's sister hussar was arrested on dui and hit and run charges in san francisco monday, the night of lee's murder. hussar texted lee just wanted to make sure you're doing okay, because i know nima came way down hard on you. her mother had no comment about her arrest. how is hussar doing? following monday's arrest. >> answer any questions and neither did nima's attorneys. >> we're not going to answer from an object standpoint, though. >> i mean, it was a big story on monday. >> optics standpoint. you look terrific. >> has amo many was not in court

today. she has been there in the past to support her brother. also interesting in this motion to change venue is alleged hostility from prior members of momen's defense team, including paula canny menominee's attorneys are alleging that canny his former defense attorney gave hussars cell phone to the lead investor later on the case without a warrant or court order by text. paula canny wrote to me none of that is true in the newsroom for the i-team, melanie woodrow, abc seven news. >> there is a lot going on there. thank you melody. >> a violent two car collision near oakland's merrick college this afternoon involved a stolen car whose driver ran away from the crash scene. that's according to oakland police. the crash happened at 145 on campus drive near merritt college. multiple people in the other car were hurt as a result of the collision. one was taken to highland hospital. police say the stolen car was recently taken in another city, a man who shut down caltrain service for hours by climbing and then

sitting atop an electrical pole is now in custody. this started at around 330 this morning at the fourth and king street station in san francisco. the disruption forced caltrain to stop service into the station, setting up a bus bridge to the 22nd street station. that man finally came down at about 9:00. >> members of congress are calling on regulators to hold the martinez refining company account, able for recent flaring activity. abc7 news reporter ryan curry shows us exactly what flaring is and why people are worried about its effects. >> this tall and bright flames is flaring from the martinez refining company continued wednesday night into thursday morning. residents are now worried for their health. >> it just seems constantly something's going on at the refineries every year or every few years. >> according to the american petroleum institute, flaring happens to alleviate pressure. they say natural gas builds up and it is safer to burn it than release it into the atmosphere. but burning it still releases

toxic chemicals like the burning of any fossil fuel flaring releases, pollutants. >> this can be methane, carbon monoxide, nitrous oxide, chemicals that should not be inhaled, especially by people who live nearby. those closest to these facilities are usually, unfortunately, those most burdened by these environmental hazards. >> this is now the third time in just over a year flaring occurred at this refinery. they say flaring happened following an operational incident. they said we have been maintaining clean combustion during the flaring and ground level air monitoring has shown normal measurements. still, many are concerned about this refinery. residents already filed a lawsuit this week demanding pbf energy, which owns the refinery, be more transparent following its two other chemical releases. the lawyers representing the plaintiffs say that the refinery's emissions from those flaring events are a danger to the people's health. and now, after what happened yesterday, they're adding that recent

flaring event to the lawsuit. congress member john garamendi wants the state and county to closely monitor the refinery. there's a long history of this particular refinery of flaring of emissions of various kinds being sent into the air and contaminating the community nearby. >> that's got to stop, he says. >> as long as we continue to use fossil fuels, refineries have to be more mindful of people's health. >> we still are using the petroleum products that come from the refineries. so as long as that's going on, these refineries have to operate safely in martinez, ryan curry, abc7 news. >> two people are recovering after being pulled from the bay today when their boat capsized. san francisco firefighters say the pair were thrown into the water. about 200 yards off the shore of baker beach in san francisco. they're going to be okay. that boat is going to sit on baker beach until salvage crew can head out there and move

it. >> it is blue versus red tonight , governor newsom set to face off with florida governor ron desantis. this is a highly anticipated debate. it is also highly unusual. abc seven news reporter zach fuentes has our preview. >> there's a really hyper partizan culture in the united states of red versus blue that's manifested in florida versus california. and tonight, the governors of those states meet face to face. >> governor gavin newsom in florida, governor ron desantis face off in georgia. it all comes after months of negotiations over when and how it would happen. newsom is backing president joe biden's reelection in 2024, but he's talked about eventually running for president and recent trips to discuss foreign policy in israel and china are raising his profile. meanwhile, desantis is in the current presidential race , but he's facing an uphill battle against the top challenger, former president donald trump. all factors some political analysts say, give both governors something to gain from the debate. i think ron desantis is clearly going to try and separate himself from donald trump and try to elevate his

presidential campaign. >> and throughout this debate, gavin newsom is going to have to walk kind of a tighter line. i think he's going to have to be an advocate for president biden, who's part of the party, but also try and sell his own brand and his own presidential ambitions. at the same time. topics are said to include crime, the economy and the us-mexico border. >> desantis could hit newsom with numbers that show a declining population. here in california state estimates show that the state has lost more than 800,000 people since 2020, while data from florida shows its numbers have stayed positive. one of many points, desantis supporters have highlighted leading up to the debate blueprint that he has in florida seems to be working. >> the economy is good down there. >> on the flip side, the san francisco democratic party, said newsom, will highlight the strength of california's tech based economy and hit desantis on issues such as abortion and lgbtq rights. >> we're talking about providing the basics like health infrastructure, new jobs, energy. >> but there is one thing many agree on this will be a highly watched event. >> increasingly treated our

politics like entertainment. and think something like the governor of california versus the governor of florida is something that audiences find entertaining. it's the pro wrestling version of democracy. >> guess zach fuentes, abc7 news. >> san francisco police say retail thefts are dropping drastically thanks to undercover efforts. >> in fact, this week police made more than a dozen arrests. that was in a single operation. and now they're sending out basically a warning to shoplifters. abc7 news reporter tara campbell with the story. the message that we want to send is we want to discourage people from taking the chance. >> san francisco police chief william scott has a warning for shoplifters. >> we can't be everywhere, but we're in a lot of places and if you happen to go in one of those locations and try to steal and we're there, we're going to arrest you. >> he's talking about what the department calls its blitz operations made up of plainclothes and uniformed officers and aimed at discouraging retail thefts like this officer are inside a retail

establishment. >> stores some of our from walgreens to some of our bigger retail outlets and they're actually aggressively aggressively arresting people when they commit crimes in their presence. >> and he claims the strategy is working. with more than 300 arrests since starting the operations almost two years ago. he also says sfpd data shows a 30% drop in retail thefts in the past three months. >> some of them repeat offenders, some of them the first time they've come on our radar. but the bottom line is many of these offenders are very , very prolific. they are responsible for a lot of the issue that we see in our city. >> the department highlighting its efforts this week, announcing the arrests of 17 people at a single retail store in the mission district. >> we have a great city with in communities all over the city with retail corridors. so it's not all about the operations that we do at places like union square. >> and he says the city is going to come down hard on repeat offenders. >> jenkins is not only seeking

prosecutions on the cases where appropriate, she's seeking detentions, which is, in my opinion, a really good thing because we don't want them to get out after they've been arrested and before they have their day in court and re-offend. >> tara campbell, abc seven news, oakland officials want to help you feel safe shopping there this holiday season. >> the think oakland first campaign launched today. city officials joined with police, business leaders and store owners to encourage holiday shoppers to support the town's businesses. the effort includes increased safety measures in shopping districts, basically all the officers but patrol will be focused on the business districts for the next 30 days. >> we want everyone, one, just to really support our business district so that we can stay vibrant and alive and be a part of your communities. >> police say additional officers will be out in shopping districts across oakland, including jack london square, the laurel district, piedmont,

on monday with mayor london breed police chief bill scott and district attorney brooke jenkins. part of the conversation will be around moving past san francisco's homeless crisis as abc7 news reporter luz pena explains. >> as the number of people on the streets is stable but the cost to take care of them continues to grow. >> san francisco has one of the nation's highest per capita concentrations of homelessness, high housing costs, drug abuse and covid are some of the factors contributing to this crisis. as every two years the us department of housing and urban development requires communities count the number of people experiencing homelessness in february of 2022, the city counted 7754 homeless

individuals. hi, i'm luz pena with abc7. nice to meet you. what's your name? johnny crawford. how long have you been out here? >> i've been out here since 2018. >> johnny crawford is one of over 4000 homeless who live on the streets of san francisco. tell me about being out here. what is it like? it's interesting. yeah >> if you're not cut out for it, you're not going to make it. if you cut out for it, you can survive. >> san francisco has over 1000 occupied vehicles every night. many are families with kids. over 100 of these rvs are parked along lake merced boulevard, all homeless. i'm sleeping here with my daughter, my two kids. nelly has been renting this rv for the last year before living here. they rented a room in the mission district, but her work hours were cut during the pandemic, and they had to move out. >> i said coronavirus is that working? is down. my check is

like 200, 300. so i came to pay the rent. what do you work? housekeeping a motel. >> san francisco has about 10,000 units of housing for individuals experiencing homelessness. but just 2300 units of housing for families. but as demand grows, waitlists for housing and emergency shelter get longer. >> our shelter system is about 91% full. >> can you get shelter on the same day that you need it? >> yes. often you can often. >> not always. not always. what about families is most of the time families can get an emergency placement the day they need one, and it can take a few weeks to get a single room weeks. >> and that's why we have the emergency. >> why so long? because as our our long term family shelters are pretty well occupied. and as of november 29th, 2023, there were close to 500 pending shelter waitlist applications.

the city prioritizes who gets into a shelter. >> so if someone has a long term chronic illness, they're going to have a higher prioritization than someone who is able bodied and healthy. >> in the last year, san francisco faced another setback in clearing homeless encampments. an injunction that was brought forth after the coalition on homelessness filed a lawsuit against the city. they alleged encampments sweeps violated the rights of the unhoused. this has blocked the city from enforcing certain laws like sleeping on public property . the debate has polarized the city. even leading mayor london breed to rally outside the ninth circuit court of appeals. the fact that the courts have crippled our ability to do our jobs to help get people into shelter is criminal. the coalition has requested the city offer shelter before removing individuals from the streets. >> we're trying to get them to stop illegally confiscating property and criminalizing them when they have no choice but to

be on the streets. >> recently, the court provided clarification allowing for the city to continue cleanup efforts . we went out with the members of the san francisco department of emergency management and the homeless outreach team to see the process. >> they gave us a warning, you know, instead of during the three hour effort, we saw at least ten people out of more than 50 tents get shelter or housing. >> but jose torres was candid. he said there's not enough space for everyone, even in need. how do you do this job when there is not enough shelter? as you say, it's difficult. >> it's difficult to talk to people and not have enough to offer. >> in san francisco, luz pena, abc seven news. >> tonight at 11, we'll be diving into the unprecedented vacancies in downtown san francisco. obviously another major problem as retailers and office workers change habits. so we'll ask mayor breed, police chief scott and da jenkins about the issues impacting the city during a special town hall event that we are streaming live

in half moon bay from our santa cruz camera choppy waters right now as we look towards the lighthouse. upper 50s santa rosa novato low 60s. fairfield, napa, concord 58 degrees in livermore and a live picture from our east bay hills camera. you see mt. diablo with a couple of clouds scattered about with some sun in between. isolated showers and gusty winds. tonight, winds ease tomorrow slight chance lingers. spotty showers on saturday. that's our best opportunity for seeing any wet weather. and milder weather is expected next week. so 5:00 this evening, not out of the question to see a pop up shower as we head into the late night hours and into tomorrow morning. it's going to be mostly clouds. but by 6:00 tomorrow night, you see a few showers in the north bay. this pretty much continues into the late night hours. and then saturday morning, we have our opportunity for seeing the wet weather in the north bay between 5 and 8 a.m. and then starting to slide around noontime, really spotty. so we're not putting a storm impact scale on it now, but that could change. rainfall estimates anywhere from nothing measurable to about a seven

get a combined $22 million in federal grants. this coming from the federal transit administration in the sf bay ferry will use that money to install battery energy storage systems to power a new fleet of all electric boats. >> and next year we'll award a contract to a shipyard to build our first three emission free ferries here in san francisco. >> and this is great. we will greatly advanced the san francisco bay ferries efforts to transition to zero emission ferry service by increasing charging capacity, be setting the stage for clean, green, american made american made vessels. >> golden gate ferry will use the money to rebuild the sausalito ferry landing. >> new candidates stepping in and hoping for a spot on the bench at san franciscans are tired. >> they're tired of the conditions on our streets. >> reject this right wing attack on san francisco's judiciary is it an attack on progressives?

melendez sits down with the candidates. >> leanne well, you know san francisco's da has always blamed judges for being too lenient. we know that. now you should also know that there are 14 judges up for reelection but on the ballot. san francisco voters will only see the names of two judges. that's because when a judge has no one running against him or her, they are automatically reinstated. covid and their names will not even appear on the ballot. there are only two judges who face opposition, and here's why. concern over homelessness, crime and public drug use are forcing voters to reconsider who gets to sit here and dictate the law. the data analytics company emc research found that 3 in 4 voters say superior court judges are among those responsible for current crime levels. in san francisco. so at least two superior court judges are now being challenged. the two judges, michael biggert and patrick thompson, have been criticized by a group called

stop crime sf, because they claim these two judges have had revolving door policies when it comes to releasing criminals. we'll start with thompson, who in august 2022 denied a motion to retain a man for allegedly selling drugs despite two prior convictions in 2013 and 2018. you release a drug dealer, jefferson arteaga police had arrested him with enough fentanyl to kill 85,000 people. according to police, that's what they're alleging, that that you had released this person, despite his record. >> one of the things that gets missing in all of this discussion is that there are checks on me if i get it wrong. he's appeared before at least four other judges since i made that determination. and he's not re-offended and he's still awaiting trial. he keeps coming back to court. that's not the revolving door situation that they're trying to depict. thompson is running against jean

myung jin rowland, a san francisco prosecutor who has worked for the district attorney's office for more than 22 years. >> i have reviewed food and looked at thousands of cases, and a lot of what i do is weighing the evidence and looking at the law. and then i make tough decisions earns every single day. >> albert chip zecher is running against the incumbent judge michael bagert, who has been on the bench for 12 years. bagert was appointed by then republican governor arnold schwarzenegger, benkhert now presides over kerr court, a new judicial approach to get people with mental health and substance use disorders into treatment. before that, benkhert was already a judge in drug court, where he, according to the stop crime sf report, released a convicted sex offender who had multiple arrests for robbery, assault and battery and yes, this individual failed to appear and was arrested not on new crimes, but because she didn't show up.

shack normal offerings. >> so we're going to do a menu of three items. one is a play on a i don't know if i can say this without angering shake shack, but it's a play on the filet-o-fish. so it is a sort of a tempura of fried smoked cod patty with american cheese on there. beautiful shake shack buns and tartar sauce. so it's kind of a jewish filet of fish, as it were. we're doing some crinkle cut fries with a salt that we make and taste like pickles with dill and vinegar powder. so it's like eating a fry pickle. and then we're finishing with a sundae made with chocolate babka, which is really, really good. so we're looking forward to this. >> so how did these collaborations come together? because you guys are kind of the opposite ends of the food spectrum. >> yeah, you know, we've been lucky to have some really good friends within the shake shack world, obviously from danny meyers and mark rosati and john angus, all these, you know, key, key players. we've been big fans and friends of theirs for many years, and we've been trying to find ways to do something interesting together. and mark and john were on the culinary side. i've done a great job

creating relationships around the world with chefs in different markets, so i've been banging on their door for a while. and this this, uh, this opportunity presented itself. we're really, really excited. >> christopher is it fun? you know, you do such haute cuisine, such high end cuisine. it strikes me that it must be kind of fun to do something like this. and i love the jewish deli idea. those are yours. is it is it kind of neat creatively to do something totally different? >> it's both neat creatively and also, i always say this there's the most enjoyable place for me to be working is behind the register at the deli. it is so fun in the ability to interface with people and you know, a little less pressure maybe than than, than a than a three star experience. and it's been really, really fun for myself and martina and our girls. it just feels very, very comfortable and enjoyable. >> that's awesome. and of course, this is, you know, because it's very special. it is actually a ticketed event at the larkspur shake shack. how can people get tickets? >> we're actually going to do there are some tickets, but you can also just come on in between 12, 12 and three on sunday in

the shake shack. so we're we're the new lovsky is a stone's throw away from the shake shack. so when you come, you'll be able to see the new lovsky space. but come on in 12 to 3 on sunday and you can have our menu as well as the all the shake shack favorites. that's awesome. >> and the other upside of this is proceeds are going to a scholarship fund that you folks created. tell us about that. >> yes, sir. so we have a scholarship named after a former restaurant at meadowood employee who unfortunately passed away at a very young age. and it's the hamer and thompson legacy scholarship was, which was created with martina and myself and cameron's mother and the culinary institute of america to provide access for underserved people of color to get into the culinary school. it covers their tuition, their room and board as well as job placement and ongoing mentorship with african-american chefs within the industry of note, the marcus samuelsson and nina compton's and all these great people. so we have our first student, devon henderson, who actually lives with us now after having gone through the rigors of the scholarship. and we're about to select our second student. so the proceeds are going to that. yeah, it's been really a really special experience. yeah well, that's great.
