on live tv and later, a tomato that was lost in space is finally found. >> from abc news in new york, this is america this morning. >> good friday morning, everyone. i'm andrew dymburt. good morning to you. >> i'm rhiannon ally. we want to begin with the breaking news overnight. a new criminal case against president biden's son, hunter. >> new charges unveiled last night could carry a lengthy prison sentence if he's convicted. this morning, prosecutors have announced new charges against hunter biden after a grand jury indicted the president's son in his home state of california. >> these are much more serious charges here. >> hunter is accused of failing to pay at least $1.4 million in federal taxes while allegedly taking false deductions. prosecutors claim hunter spent this money on drugs, escorts, luxury hotels, exotic cars, clothing and other items of a personal nature. in short, they say everything but his taxes. >> you read the indictment. it's really a speaking indictment. it

talks about hunter biden's business dealings with china and the ukraine. >> according to the indictment, hunter earned more than $7 million between 2016 and 2020. his expenses more than $638,000 in payments to various women, 379,000 on clothing and accessories nearly 189,000 on adult entertainment and 27,000 on a site. the new charges are in addition to gun charges in delaware, claiming hunter lied about his drug use when he bought a gun. both cases were brought by special counsel david weiss, whose team negotiated a deal requiring hunter to plead guilty to misdemeanor tax charges in exchange for no prison time. but the deal unraveled in court after republicans accused the justice department of agreeing to a sweetheart deal. >> they've made him a very good deal. and he he sucked it up like a hoover deluxe. and i don't i can't blame you if you have a no time plea deal. >> that's something that you have to consider because david weiss might not have even been

special counsel and may not have been able to bring charges here in my home town of los angeles had hunter biden's lawyers not blown up that plea deal in delaware because the us attorney here, at least reportedly was not going to pursue these charges. >> responding to the new indictment overnight, hunter's attorney accused weiss of bowing to republican pressure, saying if hunter's last name was anything other than biden, the charges in delaware and now california would not have been brought. the white house not commenting on the indictment. the new charges include three felony and six misdemeanor tax offenses if convicted. hunter could face up to 17 years in prison. >> police in las vegas have released video of officers taking down the man who went on a shooting rampage at unlv. they say this video shows former professor anthony polito chasing an officer around a car. the officer then returns fire and the threat. police say polito killed three members of the faculty and staff. he's also accused of mailing letters to 22 universities across the us. a source says at least one letter

was laced with talcum powder. authorities say polito was carrying nine magazines of bullets and had a list of targets he previously taught at east carolina university, where a former student says polito was unusual. >> he kept a running log of every single negative thing that a student said about him. you know, one of the things that always stood out to me that made me uncomfortable was he would try to figure out who wrote the negative feedback, the victims include assistant professor patricia navarro velez and professor shah jahan chang. >> police say polito had applied for a job at unlv but was rejected. they say he also embraced conspiracy theories and wrote about the zodiac killer. >> now to the security concerns nationwide as hanukkah begins, the war in the middle east has police on alert. and now a shooting outside a temple in new york is being investigated as a possible hate crime. here's abc's andrea fujii this morning with hanukkah underway, the jewish community is on high

alert. >> in albany, new york, a man fired shots outside this temple yesterday say the preschool inside placed on lockdown. >> we were told by responding officers that he made a comment. three palestine. >> the shooter is described as emotionally disturbed with a lengthy criminal history. it comes as the fbi warns of a higher threat level due to the war between israel and hamas. raging in the middle east. at the lighting of the national menorah last night, vice president kamala harris's husband, doug emhoff, who is jewish, addressed the concerns. i know you're in pain. >> i'm in pain. i know a lot of us are feeling unmoored and afraid. >> emhoff also condemned the presidents of harvard, mit and the university of pennsylvania, who, during a congressional hearing this week, appeared to put more value on free speech than condemning anti-semitism. >> seeing the presidents of some

of our most elite universities as literally unable to denounce calling for the genocide of jews as anti-semitic, that lack of moral clarity is simply unacceptable. >> the controversy could cost the university of pennsylvania big money. a top donor is now threatening to withdraw a $100 million gift. the board of trustees calling an emergency meeting, but saying there's no plan for any immediate leadership change. meanwhile, at harvard, jewish students paid for this plane to fly over campus with a banner behind it. reading harvard hates jews as the presidents of harvard and penn have released statements clarifying or walking back their remarks and calling genocide evil and vile. but a congressional committee has now launched an investigation into the policies and procedures at all three schools. andrew rhiannon andrea, thank you. >> now to the war zone and some controversial images. new video circulating online from gaza shows dozens of detained

palestinian men stripped down to their underwear, kneeling with hands behind their backs. israel claims it captured more than 150 terror suspects, but palestinians say some of the men are journalists and civilians, including a 72 year old man. meanwhile more fierce battles erupted overnight. flares lit up the sky over gaza and loud bangs could be heard from across the border in israel. >> back here at home, a major headline about the crisis at the southern border as authorities face a new surge in migrant crossings. the white house now appears willing to make a deal with republicans. abc's liz landers is here now with more. liz good morning. >> rihanna and president biden says he's willing to make, quote, significant compromises when it comes to border policy. according to the new york times, biden administration officials told lawmakers that the white house is willing to discuss new limits on asylum to make it harder for migrants to seek refuge in the us. the offer comes as republicans hold up funding for the war in ukraine. they say they won't approve the funding that president biden wants until changes are made at

the border. we're seeing a new surge of migrants crossing the border, a record number reported on tuesday this video shows dozens of migrants climbing the border wall near san diego. back in washington, time is running out to strike a deal. congress is scheduled to go back on break at the end of next week. andrew >> liz, thank you. the now former alaska airlines pilot accused of trying to shut off a plane's engines mid-flight has been released from jail. a judge granted joseph emerson bail in part because of mental health issues. but he must get treatment and he must stay away from planes. emerson was facing attempted murder charges, but has pleaded guilty to lesser counts. he claims he suffered a panic attack and had previously ingested magic mushrooms. >> okay, let's take a look at your friday weather. >> good morning. snow in denver today and salt lake city could accumulate to a few inches. drive carefully out there. meantime, the energy from that

hot air balloon collapsed and landed in her backyard. it got tangled up with a streetlight while trying to land in a nearby field. the nine people riding inside the basket made it out safely. glad everyone's okay. >> we turn now to the battle over an emergency abortion in texas. a judge has issued a ruling, but that may not settle this case. this morning, the attorney general of texas is warning doctors not to comply with the judge's decision that allows one woman to move forward with an emergency abortion. >> i am going to grant the temporary restraining order. >> kate cox wiped away tears as the judge yesterday ruled she can be exempt from the state's abortion ban. earlier this week, she sued for an exemption after doctors said her 20 week fetus has a severe abnormality and virtually no chance of survival. they said continued the pregnancy could put her health at risk and prevent her from getting pregnant again. texas does ban abortions outright, but

there are exceptions, including to prevent major bodily harm or to save the life of the mother. >> i could see in this case, surely i would qualify for that exemption. so my doctor told me that i did not have that option in the state of texas. i was i was shocked. >> the state wanted doctors to provide more evidence that cox qualifies for an exemption. >> the plaintiffs have not shown that they will suffer an immediate and irreparable injury. >> the judge rejected the state's argument. >> the idea that ms. cox wants desperately to be a parent and this law might actually cause her to lose that ability is shocking and. miscarriage of justice. but this legal battle may not be over yet. >> in a letter to the hospital's caring for cox, attorney general

ken paxton argues the judge is not medically qualified to make this determination and says the judge's decision would not excuse the hospital little or the doctors from facing charges, including first degree felony prosecute actions. cox's lawyer did not respond when asked whether the hospital will deny her an abortion, telling abc news fear mongering has been ken paxton's main tactic in enforcing these abortion bans. rather than respect the judiciary, he is misrepresenting the court's order for security reasons. cox's lawyers are not saying when or where her procedure might take place. the hospitals. as of last night had not publicly responded to paxton or a third death in the us is being blamed on a salmonella outbreak linked to cantaloupe. >> the cdc has issued warnings about precut cantaloupe. the affected fruit was grown in mexico and sold under the rudy and mariquita brands at several retailers, including walmart and trader joe's. we have a full list on our website. all right.

>> police in texas are now searching for a killer after the murder of a high school cheerleader. the 16 year old lizbeth medina was found dead inside her home in the town of medina, south of houston. friends paid tribute at a football game last night. they were wearing purple in her honor . lisbeth's mom says she found her body after the teen failed to show up for a christmas parade. i was at work and i went to the parade to see my child. >> when i didn't see her, i knew something was wrong. nobody ever wants to see their child. the way i found her. >> just really horrific. lisbeth's mother says their home was broken into just a few weeks ago and police have not yet named any suspects. >> and we turn now to a new warning for homeowners this holiday season. gangs are targeting upscale homes and they're breaking in with the help of the wi-fi. this morning, police are taking new action after a string of home break ins nationwide blamed on gangs. >> it's just a little leaves you
