>> i'm meteorologist sandhya patel tracking the fog tonight that will impact your morning commute. i'll have the hour by hour forecast coming up. abc7 news at 9:00 starts right now. >> building a better bay area moving forward, finding solutions. this is abc7 news. i'm not going to let me into the reroom coffee shop controversy employees say there's more than what the video shows. >> good evening. i'm ama daetz. >> and i'm dan ashley. thanks for joining us. the coffee shop we're talking about is farley's east. it's on grand avenue in oakland. >> abc7 news anchor karina nova spoke with a current employee at farley's who says the short video needs to be put in context. >> i need you to leave. i want you to go into the restroom. i need you to leave. please. >> this is the viral video at the heart of the controversy at farley's coffee shop in oakland. on december 3rd, a customer recorded what appears to show employees preventing her from going inside a restroom to record anti-semitic graffiti on the walls. current employee hass brown shared his description of

what happened. >> we have employees in the video borrowing her from entering the restroom as she is insisting that she must enter that particular one. it was offered multiple times that she used a separate restroom that would not have any inflammatory graffiti in there so as to not upset her further. >> but brown says prior to the start of the video, the customer had already used that restroom and saw the graffiti, which he says she wanted removed. >> she had been yelling over open beverages, which is obviously a sanitation issue, but more importantly was making her an unruly customer. >> eventually she was let into the bathroom to record the words written on the mirror. zionism is fascism. you can also hear what the employees say to her free palestine. >> now. >> free palestine. it's always please leave. >> but brown says this viral video doesn't tell the whole story. he and several other former employees claim the graffiti had been up for months and the owners were aware but didn't take action.

>> it's been two months that it been recorded as being in the restroom with it having been mentioned to the owners that it had been a source of harassment for employees. >> this weekend farley's owners amy and chris hilliard, released a statement saying the employees involved in the incident are no longer employed by farley's. and what began as a civil dialog between our staff and a jewish customer is escalated into a situation that was shocking and unacceptable. though all employees are entitled to hold differing viewpoints, they are not entitled to express themselves on the job in ways that are disrespectful and hurtful to anyone. for brown, the incident is about safety for all people involved. customers and employees. >> yes, people should feel safe and that that safety, while always extended to our clientele, has yet to be extended in any tangible fashion to the personnel. and they're currently, as i know, as a current employee, no actual protections or policies or infrastructure put in place to

prevent any of those things happening to me as a current employee. >> farley's in oakland will be closed until january 1st and a message sent to employees the owners say this is a time for everyone to heal. the employees will be paid during the closure in the newsroom. karina nova, abc seven news. >> all right. we are expecting a foggy start to the day tomorrow. >> we are. and here's abc seven news meteorologist sandhya patel. sandhya >> yeah. dan and give yourself plenty of time to get to work or get those kids off to school tomorrow morning. you're going to need it. so let me show you a live picture from our sutro tower camera. as you take a look at this fog, you can pretty much see why you're going to need that extra time. it's not just near the coast. we are on live doppler seven also tracking the fog in some of our inland areas as well. right now, visibility has dropped to zero or less in santa rosa, three mile visibility in half moon bay. we go hour by hour. and tonight at 9:00, we have those temperatures in the 40s, 50s with the fog. it expands tomorrow morning and the

commute will include some pockets of heavy fog. so be careful out there as we head towards 10 a.m, fog begins to pull out of the inland communities. i'll show you the rest of that forecast in just a moment. but here's a little bit of good news for you in case you have been thinking. it's been so cold, temperatures are actually running higher than where they were 24 hours ago for just about everyone. 11 degrees warmer right now in novato compared to yesterday, six degrees warmer compared to yesterday at this time in san jose. i'll be back with a full look at the forecast which does include changes in just a few minutes. ama. >> all right. thank you, sandra. we'll check back. a federal jury in san francisco has reached a unanimous verdict in an antitrust lawsuit against google. deciding that android app store illegally gouged users and stifled innovation took jurors just three hours to reach a verdict. today, after four weeks of testimony. the lawsuit was filed in 2020 by epic games makers of the popular video game fortnite. the suit alleged

google basically created an unlawful monopoly with its play store. google defended its play store rules as a way to keep the company competitive against apple's app store. this ruling could lead to changes in the way android users pay for content at the red cross is helping after a fast moving fire in san francisco forced people out of their homes. >> it broke out near grove street and masonic avenue, not far from the university of san francisco campus, and it went to three alarms. abc7 news reporter lena howland has details. on flames shooting out of both the second and third floor of a san francisco home. >> this is what neighbors in the panhandle woke up to just before 330 monday morning. >> the entire flames are coming out of both stories at the time. >> the fire so powerful it caused a partial floor collapse of the home and a desperate escape for two people living inside. >> one person jumped out of the building, an unknown, whether it was the second or third floor. at this time, moderate injuries and another person from that

fire building as well, with minor injuries escorted out of the building, nathan snyder, a neighbor two doors down, says he had less than a minute to grab what he could and evacuate with his roommate out. >> we had previously lived in a wildfire zone for the south and peninsula, so we actually had all of our go bags ready to go. so i grabbed what i needed and left very quickly. >> fire officials say the home where the fire started is a total loss to neighboring homes are damaged and seven people are displaced in vestigators say it appears some construction work was happening at the home that caught fire. it's unclear if it sparked the fire, but could have fueled the fast spreading flames . >> the studs are exposed when that fire happens in something like that, a fire travels very rapidly, more so than when you have insulation and sheetrock on the walls. so that may have caused the amount of fire to be present upon our arrival. the red cross is assisting with

those seven people displaced from this fire in san francisco, lena howland, abc seven news. >> new questions today over how pleasant hill police handled a standoff involving a former police officer. this started thursday when a former pittsburgh police officer allegedly shot at his wife. officers and swat teams went to the home on cleopatra drive. the suspect was barricaded. police daetz left before making an arrest. they returned friday and the suspect fired up to 30 shots at an armored car. he eventually surrendered saturday morning. the police chief says he made the decision to pull officers from the scene, hoping it would deescalate the situation. he said they were still running surveillance. the man's wife is expected to make a full recovery . >> new developments in the deadly shooting of a security guard at an oakland 7-eleven store. the victim's identity has now been released. 59 year old james johnson was killed friday night at the 7-eleven on harrison street in the adams point neighborhood. police are still looking for the shooter. here's abc seven news reporter leslie brinkley with the story.

>> a streak of relentless, brazen violence continued in oakland on friday night when a security guard at this 7-eleven on harrison street confronted a shoplifter after who allegedly pulled a gun and shot and killed him before escaping. oakland police say they've made no arrests as their investigation continues. coworkers say they're now scared to be at work after 59 year old james johnson died inside the store. despite efforts of paramedics. those who work here at the 7-eleven told me that johnson lived just one block away at a homeless shelter and that he worked here at the 7-eleven as an unarmed security guard. >> it was really nice, dude. he begged the people there to get a job there, and they denied him a couple of times until they finally let him. >> people are feeling less safe. less secure. >> lynette mcelhaney served this district on oakland city council for eight years, and she thinks the escalation in violence correlates with the lack of a

police chief this year. >> leadership matters and what we say matters. and we really need people to move with urgency and empathy and compassion for the victims of violent crimes, even as we seek to understand root causes. unfortunately i think too often right now in oakland, we are more ideological than we are really committed to resolving issues as this homicide at the 7-eleven happened across the street from a whole foods and adjacent to many neighborhood churches just blocks away from lake merritt. >> it's the second shooting at a 7-eleven in oakland in the last week. a new chief of violence prevention will take the reins this month in oakland, but no date is set for the appointment of a new police chief in oakland. i'm leslie brinkly, abc7 news. >> just days ago, a man died from injuries from an assault that happened last month. san jose police say he was attacked

by his daughter's boyfriend when officers got there, the victim was unconscious. he died from his injuries last thursday. >> it's never okay to have abuse in any relationship, whether it's verbal or physical. so we always urge our victims to come forward and report any such crimes to our detectives, to our officers immediately. the suspect was arrested the night of the attack for that assault. >> he's now been booked on homicide charges. in san francisco, the man arrested for the death of his 27 year old girlfriend in the presidio heights neighborhood is now charged with murder. 29 year old scott fisher pleaded not guilty during his arraignment this afternoon. he's accused of stabbing to death 27 year old kimberly wong. authorities are calling it a deadly case of domestic abuse as services are here. >> san francisco has a lot of services, crisis lines. you can get help 24 hours a day, even if you just want to talk. certainly legal services to get a restraining order. and we have shelters for those who need them. so nobody is alone in san

francisco. reach out for help. >> huang's body was found inside the couple's apartment on clay street, back on november 30th. fisher was arrested a week later in concord and earlier today on our 3 p.m. show, getting answers, anchor kristen sze spoke with the executive director of asian women's shelter about what leads to domestic violence. >> there are sort of root causes for how this type of entitled violence happens and then there are exacerbating factors. so a lot of times people think, oh, it's because of the alcohol or, oh, it's because of the meth or oh, it's because of poverty, it's because of immigration, it's because of racism, it's because of all of these things. that's why domestic violence and we don't talk about it that way. you don't choose to commit this type of violence because something else was done to you. you choose to do this type of violence because you learn violence, you learn control, you learn entitled, but you have the opportunity to do it. and you choose to do it. >> if you or someone you know is struggling with issues of domestic violence, mental

atms have been targeted. >> a wave of atm theft is hitting california and san francisco is seeing a spike this year, according to police. >> we've seen about 15 incidents where for the thefts of automatic teller machines or atms have been stolen. >> the latest took place last week in the richmond district when thieves rammed a truck into the front entrance of a cvs store around 2:45 a.m. today. tire marks are still visible at the atm in pieces. >> we are dealing with a certain amount of brazen ness where a number of suspects are coordinated to steal these items . >> in the mission district, we found at least three businesses with similar stories with the crowbar. >> they they broke the door and they took this machine faster from here. and in three minutes, actually in the camera, we have it in the camera, three minutes. and they wave to us. they look at the camera like this. >> yeah. and they waved.

>> yes. on the same block. >> the owners of h liquors off camera confirmed their atm was also stolen overnight. earlier this month, across the street at randall's market, thieves tried uh- but were not successful. >> about 4:00 in the morning, four guys tried to open the they broke into the gate. they had a black lexus parked in front of the store. and what happened is they got in the car and they ran. and i can see the police right across the street from them. and they just let them go. >> the atm security association is tracking these incidents and confirmed california has more incidents than any other state, with more than 100 atm thefts reported. this year. >> local crime gangs who are operating within your area, within your state, we do see crime gangs coming in from mexico and also the largest organized crime groups are actually coming here for atm crimes from romania. >> business owners know the possibility of being targeted

for at least the next two weeks. in march, a student was stabbed and killed during a fight at montgomery high school. we have seen in the last few weeks some incidents that resonate with the march 1st tragedy that happened at montgomery high school. >> and so with that, it feels like it's getting worse. and for us, we need to do something now. >> officers will also be checking in at middle school campuses. all right. >> let's turn our attention to the weather. it's been a little crisp, lovely, but that may be changing somewhat. >> i looked at the weather yesterday, 39 degrees, really? >> what is going on in santa? i know it's almost winter. okay. so we're going to feel that chill, that's for sure. dan and ama, it's been a couple of cold mornings, even this morning. it was pretty chilly. let me show you what you can expect as far as the forecast headlines go. obviously we're not as cold as i mentioned at the top of the show. we do have some fog and some clouds that are insulating us. this morning. we got down near to below freezing in some

cities, areas of dense fog overnight tonight, mainly sunny skies tomorrow and later this week, it's going to be warming up. so if you don't like the coolish kind of weather in the afternoons we've had, just hang in there. visibility right now, quarter mile in santa rosa. so dense fog at this hour, just over a mile in half moon bay petaluma reporting a two mile visibility. definitely give yourself that extra time for the morning commute. you will need it as you look at live doppler seven. we have the fog around. it's not just a coastal fog event, but we also have some of that valley fog. high pressure, though, is in command of our weather. taking that storm track well to the north of us. so for the time being, we're going to go with a dry pattern for much of the workweek. here's a live view from our mount tam cam, san francisco barely visible mid 50s right now in the city. oakland, you're at 46 degrees, 49 in hayward, san jose, san mateo and half moon bay, all in the 50s. a live view from pier 39 and you can certainly see some gray sky there, 52 right now in petaluma,

50 in santa rosa, napa, fairfield, you're in the 40s along with concord and livermore. so we're going to go hour by hour here at 10:00 tonight. the fog footprint is there. notice the fog expanding as we head towards your morning commute. it's going to be pretty gray to start the day. even some mist and drizzle and then the fog will pull back around noontime from many of our inland areas. but still hang around parts of the bay and the coast. it's going to take a few more hours before it completely clears and you end up with sunshine. so keep that in mind. your morning temperatures will range from the mid 30s to the low 50s, as everyone else in between, but certainly that fog is going to be a big factor in the morning commute in terms of a slow going ride tomorrow afternoon in the south bay, you're looking at 66 in san jose, mild by december standards. gilroy 66, 62 and sunnyvale on the peninsula, 62 degrees in palo alto. upper 50s here near the coast. the last to clear as far as the fog goes, 61 in south city, 60 in downtown san francisco, 59 in daly city

in the north bay, you're going to see many 60 showing up after that morning fog. 58, though, in sausalito, 64. novato 63, san rafael, 65 in santa rosa, napa, 63 degrees, heading inland. these temperatures will be in the 60 soquel's after that morning. fog 62 in oakland, 61 berkeley. newark had inland and it's going to be pretty nice looking day. we'll go with 63 in concord 64 degrees for you in livermore and walnut creek. now let's look at the rain outlook. the climate prediction center is saying that december 19th through the 25th below, so average in terms of precipitation for much of the northern tier states, much of the east coast out west expecting above average in terms of precip. that includes the south as well. and we're going to look at california here 50 to 70% chance of above average rainfall. so no need to panic just yet. we do have at least some hope for some wet weather coming our way. the accuweather

health risks to surrounding neighborhoods. abc7 news south bay reporter dustin dorsey shows you how local leaders and the community are fighting back against this decision. protecting the environment. part of building a better bay area santa clara county banned leaded aviation fuel known as avgas due to its known threat to the environment and the community surrounding reid-hillview and other regional airports. >> but now a national decision may reverse the ban. and neighbors say it puts our community at risk. >> this is a personal challenge for me or a very difficult topic. i would feel very disillusioned. and if we if we if they were able to sell, if they forced us to sell leaded fuel because it would be like a huge step backwards, two bills in the house and senate would require avgas sales to be mandatory at all public airports, even at santa clara county airports, which stopped selling the harmful fuel as of january 2022. >> supervisor cindy chavez aims to stop national lawmakers from

reversing the county's work. >> i'm asking the santa clara county administration to continue working at the federal level to stop attempts of the federal government to make leaded fuel mandatory, to help do that, the referral from supervisor chavez calls for county staff to continue lobbying for unleaded fuel availability nationwide to create an easier pipeline in transition away from avgas. >> it would also push forward planning efforts for a reimagined reid-hillview site once the airport closes in 2031. we in this community will not go back. >> we do not want our children poisoned by lead. our communities poisoned by lead aviation expert walter geiger says pilots recognize that unleaded fuel is a better option for the environment and for planes. >> but until unleaded fuel is widely available and compatible with all aircrafts, he believes avgas must be sold. >> makes absolutely no sense to leave a number of airplanes stranded and uh- without the availability of leaded fuel.

it's a small number, agreed, but it just creates a lot of problems. >> the board of supervisors will vote on the referral tuesday in santa clara county. dustin dorsey, abc7 news east bay representative barbara lee has a new supporter in her race for the 2024 senate race. >> mayor anthony understands what many of us do that the only thing more dangerous than the hateful rhetoric of the extreme right is all out war. that was lee thanking burbank mayor constantine anthony after he announced he will endorse her during today's news conference. it comes after anthony withdrew his initial endorsement for his hometown representative, adam schiff. anthony says his decision is due to shifts public support of israel's war tactics. hunter biden's attorney is asking a judge to dismiss federal judge gun charges against him. >> it's one of four motions filed on behalf of hunter biden in federal court today in

delaware. special counsel david weiss recently hit the president's son with federal tax related charges here in california. both cases are from the same investigation that first resulted in a failed plea agreement in july. the supreme court has granted special counsel jack smith's request to expedite former president donald trump's court case regarding immunity over actions he took while in office. that includes the january 6th attack on the capitol. abc news reporter jacqueline lee has the story. >> tonight, a historic and potentially very risky request by special counsel jack smith ahead of the 2024 presidential election, asking the supreme court to immediately review and rule on the claim that former president donald trump has complete immunity from prosecution of anything he did while in office, particularly his role in the january 6th attack on the capitol. hours after smith filed his request, the supreme court said it would consider it on an expedited basis. a lower court has

rejected trump's claim of absolute immunity, but trump has appealed a process that could delay the trial well past the 2024 presidential election. smith, asking the supreme court, using certiorari before judgment , essentially skipping the appeals court, a rare procedure only granted in cases involving imperative importance to the public. the last time this procedure was used was in us versus nixon when nixon refused to hand over tape recordings to a special prosecutor related to the watergate scandal. smith's filing, stating the united states recognizes that this is an extra ordinary request. this is an extraordinary case, and the case is central to american democracy. writing a cornerstone of our constitutional order that no person is above the law. a separate filing in the criminal case says smith's team could call expert witnesses to trial in march who can describe how the crowd at the capitol responded to trump's public comments on january 6th. trump once again said he would be a dictator if he returns to the white house, but only on his first day in office.

from 8 to 17 claim the environmental protection agency deliberately allows pollution from the sources it regulates. >> those sources include cars, heavy duty trucks and power plants. the plaintiffs allege that the epa has let the us become one of the world's biggest emitters of planet warming pollution. despite knowing this pollution would harm children. 25% of the world's freshwater fish are in danger of extinction. it's a statistic that local experts say californians have to care about moving forward. abc seven news reporter zach fuentes has a look at the impact. >> that's the wake up call that

we should all be be hearing at this moment. >> that wake up call is an update from the international union for conservation of nature. they found 25% of freshwater fish are at risk of extinction. an the iucn said the update is part of the first comprehensive assessment of the world's freshwater fish population. but local experts say the findings are unfortunately not surprising that it's probably an underestimate. professor andrew ripoll is a professor at uc davis in fish ecology and director at the center for watershed sciences. >> our estimate is that about 83% of california fish are are vulnerable to extinction in some sort of way. so if we were to put the california number on that iucn number, it would be much, much higher. >> a problem that puts not just california's environment at risk, but also the economy. >> salmon just from an economic perspective, contribute, you know, $1.4 billion to the california economy. >> scott ardis is the executive director of the golden state salmon association. he says while salmon in some parts of the state are doing well, the

opposite is seen in other areas. keeping them at high risk. >> people should care because this is a species that touches not just people, but the entire environment. we're talking communities, culture, jobs, businesses, both the iucn and professor ripoll linked some of the same reasons to the high risk of extinction. >> that includes the warming of waters from climate change changes to the natural flow of rivers, along with invasive species and overfishing. >> all of these things sort of combine to create this ball of environmental stress for fish that ultimately hurts them here locally. >> arter says there's hope in the many organizations passionate about this that have come together, but more is needed from state water policy makers. >> this is the time to fight and to fight for those salmon, those jobs and those people that rely on it. ripoll says using science as a tool will be critical going forward and that humans must be good stewards of land and local waterways working together. >> i mean, that's the name of the game in the south bay. >> zach fuentes, abc seven news. >> so what we got to do work

together? absolutely >> see problems to solve. all right. let's talk a little bit more about the weather forecast. that is changing somewhat. >> yes. let's warm it up, sandy. all righty. since you asked so nicely, ama and dan. we'll warm it up later on this week. all right. but tomorrow, temperatures may actually take a step back because of the fog and the slow clearing. let's take a look at a live picture right now from our mt. tam cam where you do see the fog. right now, it is not just near the coast and around parts of the bay, but also in some of our valleys on live doppler seven. you can see visibility is down to a quarter mile dense fog in santa rosa, some heavy fog in half moon bay. it's a mile visibility right now as we check out our afternoon temperatures. they're going to come up into the upper 50s to the mid 60s. pretty nice looking day but that fog is going to be clearing the coast last in the afternoon hours around lunchtime. so that's what could hold the temperatures back in some areas as we go hour by hour future cast showing you that the rain stays away other than mist and drizzle, we don't have anything until maybe late sunday going into monday is our better

today. volunteers, including some from gap, began bagging up food that will be distributed on wednesday. glide will be giving each person two bags this year. one bag includes a traditional holiday meal of turkey and trimmings, the other contains culturally appropriate items for the asian community. glide officials say the need is especially great this year. >> so on paper, it says about 25% of our population population in san francisco is in food insecure or at risk of food insecurity. but we know it's more than that. if there was a great message that we have is that we like to spark hope and let people know that there is a solution. there are places that you can go to get the help that you need. and so in glide is one of them on wednesday, glide's volunteers will load the bags onto the trucks and deliver them to about 25 different organization. >> happens all across the city. they do amazing work every year and after all, tis the season to make a difference. >> it is. and a group of women from the warriors, rakuten and girls inc of alameda county teamed up to give the gift of

reading. we are here with women at rakuten and women at the warriors in partnership with girls inc of alameda county to do a gift wrapping event where we're wrapping over 700 books. >> rosie. the goal is to wrap all of these books for the holiday season to be able to reward underserved youth with books that mirror their cultures, their interests and serve as learning opportunities for them to expand their knowledge. >> we are so overwhelmed by the support we have received from the community to be able to gift our youth books to enjoy over the winter break. of alameda county puts on a book wrapping event every year and this year, volunteers from women at rakuten and women at warriors volunteered their time to come out and wrap these books and support making sure that these get out before the holiday season because of the support of our community. this event has expanded from last year. we have been able to not only gift books

to the girls we serve, but the boys as well. and not only that, but our spanish speaking youth as well. the ages are from kindergarten all the way through, through high school for girls and boys. and when you think about the power a book can have on one's life, it not only supports the development of basic language skills and the expansion of vocabulary, but it has the power to give our youth the tools to be able to achieve their dreams. >> i believe books are important. they are the foundation of the community and kids. you know, reading at many levels. i know once you start reading early on, it will help you later on in life. so i think having books that are engaging with the children in the books that look like you, that's even more important. so the books today are reflective of local community. it's really interesting that a lot of these young women and men don't actually own physical copies of books. >> so not only will this give them something that they have ownership over, but also give

them something that represents their interest. >> many of our youth identify as youth of color and the intentionality behind the books that we're gifting to our youth have representation in it. >> girls of alameda county does a great job of giving back to their community all year long, but this year it was a great opportunity to be able to gather women at rakuten and women at the warriors who have shared values and want to be able to give back during this season, and especially to a deserving community. so everyone was just really excited and to support a great cause and be able to donate time and also donate resources where they can. >> the gift of books is something that really can continue on because those can be shared with your other siblings, your other family members, and it really gives the family an experience in time to bond together. >> they mean so much to us to be able to give back to our youth during this holiday season and know that they will be enjoying their christmas break with a book. and not only any type of book, but a book that was intentionally picked out for them. >> that's sweet and makes a big
