that feel very strongly. it's a very emotional about feelings one way or another, about things that impact students. tonight a months long controversy over a flag policy at an east bay school district is reaching a boiling point. >> good evening. i'm ama daetz. >> and i'm dan ashley. thanks for joining us. it comes as the sunol glen school district board meeting gets underway right now. >> but prior to the meeting, a rally was held to protest the flag policy, which banned all flags except the american flag and the california state flag from campus. >> abc7 news reporter leslie brinkly is there and joins us live to explain that this all started when a pride flag was removed. this happened. leslie back in september. probably fell a couple of years. >> yeah, that's right. castro valley pride brought some of the flags you see behind me out here as they plan to a rally outside the school board meeting tonight. there are three members who we understand on the agenda are supposed to elect a new president and discuss bringing in an outside law firm after

they voted in september to not allow pride, flags on campus. >> the way we describe it is we feel like there's a dark cloud over our school at this time and the teachers, all of us, we really just want to be about the business of teaching the students. >> molly barnes is the superintendent and principal of this one school school district of 270 students. >> we try to keep that political stuff at bay. all students are welcome here. the lgbtq plus community, whether we fly a flag or not, they are so welcome, she said. the community division hit a peak in june when a pride flag on a fence was stolen. >> so they raised one on the flagpole. by september, two of the three board members voted that only the us flag and california flag were to be displayed on the school campus. the two board members who voted for excluding other flags from being displayed did not respond to a request for comment. some in the community say speaking out at the often heated board meetings has cost them.

>> my mom has been called everything from a to a liberal snowflake to other things that wouldn't be appropriate to say on camera. >> residents say a petition to recall the two board members who voted to ban the pride flag could give votes as the final say. as castro valley pride offers their support. >> we're seeing conversations about book banning. we're seeing conversations about a forced outing policy for trans kids. you know, the ban of a pride flag and then what i feel is blatant retaliation against staff. they're afraid for their jobs and really, that's what we're here for today, is just to show them that we care. >> castro valley pride claims this is part of a national conservative movement to take over local school boards. in other parts, perhaps of the bay area. the meeting tonight is likely to be emotional. there's a big divide in the community

over this. the meeting gets underway at 515, reporting live in sunol, i'm leslie brinkly abc7 news. >> okay, leslie, thanks very much. in sunol. san jose leaders are now trying to address extreme rking conditions. this all stems from a scandal five years ago at the cotrucon site of the silvery towers that's wre a federal investigation revealed that workers were not being paid properly and were being forced to live in extreme conditions. now, members of the san jose city council are pushing an ordinance to keep it from happening again. abc7 news south bay reporter zach fuentes has the story. >> the silvery towers in downtown san jose near san pedro square. stand tall today, but the construction of them more than five years ago led to controversy. tsay, a subcontractor from hayward, was accused of recruiting undocumented mexican workers, forcing them to work more than 24 hours at a time. and not paying them proper wages. they also lived and worked in unsafe conditions as they were in a shipping container like warehouse where they were locked

in at night after a federal investigation, the hayward man was convicted and received a prison sentence. ruth silverton is part of the santa clara county wage theft coalition and the south bay coalition to end human trafficking. she was there five years ago to offer services to the workers in 2021. she says the wage theft coalition found that more than 12,000 santa clara county construction workers were victims of wage theft. wage theft is really when employers do not pay workers, they don't pay them the wages they're owed. >> they don't pay them overtime. they make them work off the clock. >> now, more than five years after the silvery towers controversy, four members of the san jose city council say they want to better combat wage theft . they propose what's called the responsible construction ordinance, withholding long residency permits for buildings if the construction that you use on your project is with a developer or a contractor that has a history of wage theft. other south bay cities like

milpitas and sunnyvale have passed similar ordinances, but at tuesday's san jose city council meeting, other council members were hesitant to vote on it immediately, saying developers hadn't had enough time to give their feedback. the when to hear the issue was debated. most members, including mayor matt mehan, seemed supportive of an ordinance wage theft is something we will not tolerate in san jose and if we can strengthen local laws to support that without huge negative unintended consequences is i think we're going to all agree on that. an agreement, tubbs says, can't come soon enough. >> we need it in san jose so we don't have another silvery slash slavery towers in san jose. >> zach fuentes, abc seven news. >> an arrest warrant is out for an 18 year old accused of trespassing at steph curry's home in atherton. a judge issued the warrant today for shenghao of cupertino after he failed to show up for a court hearing last week. police cited gao in october after he allegedly entered curry's house where someone confronted him and told him to leave, which he did. curry and his wife were not home, but his three children

were. prosecutors tell us gao was asking for curry's autograph and the east bay. >> one local company says it's seeing an increase in business, possibly related to concerns about crime. >> that's because the company installs bullet resistant glass. >> abc seven news anchor dion lim is here with the story. this is interesting. >> it's totally fascinating. dan and while no glass is completely bulletproof, there are products on the market that make it harder for a bullet or let's say another weapon to penetrate it. >> it does come at a hefty cost, but with the crimes we are seeing coming out of oakland, it is worth it to some. >> there's a special machine. it's like a multi-million dollar machine that builds these pieces at east bay. >> glass warehouse in oakland. the varieties of glass seem endless. the polycarbonate, it can be pretty light, but it's one type in particular that's being requested now more than ever. >> the bulletproof glass is 3/8 inch all the way up to like 2.5in bullet resistant ballistic glass. >> this video is from manufacture for ametek, which provides glass to east bay glass and installers across the

country. in recent months, i've covered a number of stories involving stray bullets going into homes in september, a mother of two was killed as she slept when stray bullets were fired into her home in the laurel neighborhood. >> i was so scared. >> this video was from a man who requested anonymity after a bullet flew into his apartment sunday, moments after he moved in about a dozen rounds went through a vehicle and home along macarthur boulevard on monday. >> and it's just sad, the condition that the community has gone in. >> joshua pritchard says while many homeowners may be curious about installing ballistic glass, the high cost can be a deterrent. only about $100 to $120 per square foot. >> there's glass that it can go all the way up to $350 a square foot. that is not with the installation, no larger organizations can afford the cost. for instance, like the city of oakland's permitting office, they wanted ballistic glass installed all the way across all their permitting. the desk. >> it's also being used in the event of a break in or vandalism . >> oakland high school as well as a few other schools around

the area for pritchard at east bay glass, he calls the crime in oakland a double edged sword. it's good for business, but it's not the kind of business that you really are happy to take on, you know, i mean, it's just it's sad. >> armstech the company that provides ballistic glass for east bay glass is based in utah. they tell me they, too are seeing a demand from installers all across the country. >> but you mentioned it's not cheap. i mean, 250 up to $250 a square foot. are there any other options? yeah. and that work. >> correct. and that's not including installation. that's just the material. right. so what people say at armtec, there is something called security film which can be applied to smooth glass. it's about 75% cheaper. but keep in mind, it doesn't offer the same level of protection. it just makes glass more difficult to break. okay >> all right, dion, thank you. >> thanks all right. >> oakland has a new campaign for the holiday season, encouraging people to support small businesses. business owners join together today to announce the find it in

fruitvale effort. their message is to shop local and shop latino. many of the small businesses in the fruitvale district are latino owned and oakland leaders recently granted the area. $250,000 to improve security so people can shop safely. >> it's something that we take seriously. it fruitvale is a vibrant community with families, children and also we've also partnered with the department of violence prevention there right here in the transit village. so i think you'll see a lot of different steps that are that are taken to assure your safety. >> one of those steps is a safety ambassador program. they'll be patrolling along fruitvale avenue between international and foothill boulevards. >> there's now a supervisor seat up for grabs in alameda county. after 30 years, potential candidates have until tomorrow at 5 p.m. to submit paperwork and join the 2024 supervisor. race comes after supervisor keith carson suddenly announced he will not run for reelection. he made the surprise announcement last friday, just minutes after the filing

prosecuted after he appealed a ruling in a lower district court . trump's legal team filed a motion to dismiss the federal election interference case. asked for absolute immunity from prosecution for his actions while serving as president. the judge overseeing the case denied the motion, saying the former president doesn't. get a

lifelong get out of jail free card. the supreme court will now expedite its decision to avoid an appeals court delaying the trial past the 2024 presidential election. >> back during the watergate era , of course, the court ruled and ruled in a very much expedited manner that president nixon could not use executive privilege to keep congress from getting access to his oval office tapes. >> trump's legal team has until next wednesday to respond to smith's request. >> tonight, the abortion battle in texas is heating up. a pregnant woman whose fetus has a fatal condition is now leaving the state to get an abortion. it comes after the state supreme court ruled against the mother's request for an emergency medical exception. abc's tim pulliam has the latest. >> kate cox, a dallas mother who sued texas, leaving the state for what she calls an urgent abortion. the 31 year old, now 20 weeks pregnant, says doctors determine her fetus has a low survival rate and the longer she

continued, the pregnancy, the greater risk to her health. and fertility. >> i could see in this case, surely i would qualify for that exemption. >> initially, she was granted permission for an abortion by a lower court. >> i am going to grant the temporary restraining order, but that decision appealed by attorney general ken paxton, asking the high court to reverse the order. >> on monday, it was shuttered by the all republican state supreme court. the justices unanimously denying her abortion, ruling her pregnancy risk, didn't meet the state's qualified options, including to prevent major bodily harm. are saved. the life of the mother. this doctor slamming the decision. >> they clearly want to continue to be able to control people's lives instead of allowing physicians to make the medical decisions that make the best sense for them and their patients. attorneys representing cox say she has received offers to help with her abortion in

places like colorado and canada. >> i also hope that people can see themselves in kate and her family as so many people can relate to, you know, the tragic loss of a wanted pregnancy. >> and when you add on top of that, the cruel and inhumane treatment that her state has put her through, it's truly unimaginable. >> earl cox, attorneys are not sharing details about her final decision. now, a similar case is playing out in a kentucky state court. tim pulliam, abc news, los angeles. and we got a physician's perspective on the texas abortion case today at 3 p.m. on our program, getting answers. >> listen as abc seven news special correspondent dr. luke patel explained it to kristen sze in this situation, we have to remember that pregnancy is a very high stress situation on a body. >> physiologic affecting all totally healthy woman. for a totally healthy woman with a healthy pregnancy. look at the cdc statistics. there's about a 20 times increase risk of pregnancy complications and death from pregnancy

complications versus abortion. that's how high risk pregnancy can be. so in a situation like trisomy 18, we don't know all the details of what was seen in her labs from the physician exam , but it was determined by this physician, this is a high risk pregnancy. you're going to lose this fetus and you are going to put yourself at risk as well. but because of the physician's wording and saying it's upon their their their best faith that this patient should get an abortion, it wasn't good enough for the supreme court. >> dr. patel added with trisomy 18, the survival rate for a fetus is low and babies born with the abnormality rarely live past one year. as we've told you about the big renovation planned for san francisco's famed castro theater. >> and now we're learning about plans for the last show before the year long closure

celebrating its local community. a date hasn't been announced yet. the $20 million project will transform the 100 year old building into a multipurpose venue. it will include seat changes, historic restoration, additional mechanical systems and increased accessibility. the last day of programing is scheduled for february 4th. >> well, right now in richmond, an emergency meeting is just getting underway to address air quality concerns. it started with several flaring events at the local chevron refinery just two weeks ago. then last week, a petroleum smell near chevron as well as a heavy stench coming from the city's wastewater treatment plant. the cause was elevated levels of hydrogen sulfide. richmond's mayor says residents have been reporting headaches and even breathing issues. tonight's meeting is being held at richmond's community service building. a lot of people living nearby want some answers. >> yeah, they certainly do. all right. time to get a check on our weather. sun finally came out today. >> it's nice. meteorologist sandhya patel is here. >> sandhya yeah, considering how heavy that fog was this morning. dan and omar. let's take a look

at some live pictures right now. just about everyone saw the sun except for a few spots like santa rosa stuck in the fog all day long. here are the live views with the fog rolling in from our emeryville camera. certainly seeing a beautiful view of a post-sunset sky from santa cruz and golden gate and exploratorium. looking good. high pressure in command of our weather. so we're going to keep that storm track to our north until sunday. we'll talk about that in just a moment. fog is around right now on live doppler seven, not just near the coast, but we have some heavy fog in santa rosa. still dense fog. quarter mile visibility, which is why the high temperature at the airport was only in the low 50s believe it or not. the rest of you in the upper 50s to the mid 60s today. temperatures right now in the 50s and the 60s coastal flood advisory once again has been issued for tomorrow from 8 a.m. to 1 p.m. these areas is shaded in green. will likely see low lying flooding because of the high tides and that high tide for san francisco coming in just before

11 a.m, 6.6, six feet. so be careful if you're going to go out for a walk and just kind of be out and about or if you're parking in one of those park and rides in the north bay, you know, they get the flooding. all right. headlines for the week ahead. overnight, chilly with some areas of fog later this week. we are looking at a warming trend with near record temperatures. and then sunday through early next week, we're going to see a return of that rain. so you're going to need to bring those umbrellas out. speaking of the rain, here's how we're doing in terms of the rainy season. still behind, but santa rosa is up 47% of average, just over three inches of rain. san jose, 30, san francisco, 45. and oakland, you're at 22% of normal sierra snowpack. statewide, 32% of average. you will notice that we can definitely still use some snow. the southern part of the sierra, only 16% of average, 6:00 tonight, you're going to notice those temperatures in the 50s fog computer models not really picking up on it. i think we're going to have a lot more fog than what is showing up here. so

tomorrow morning, watch out for that. temperatures in the 30s to 50s first thing around 8 a.m. as we head towards the afternoon hours, you will notice exactly who's going to warm up and who's not going to warm up much. so inland areas will still be in the 50s your morning temperature is mid 30s to mid 40s. it is going to get chillier tonight. tomorrow afternoon you're looking at a mix of sun and high clouds, high temperatures will range from the upper 50s in places like antioch to the mid 60s in san jose. and here's a look at what you can expect in terms of the rainfall percentages. it's going up. best chance is still going to be sunday and monday. and as you look at the rainfall projections, parts of northern and central california looking at 1 to 2in of rain, which includes us. accuweather seven day forecast chilly morning with some fog certainly filtered sunshine tomorrow. look at those warmer air the warmer weather coming your way friday saturday low 70s for the warmest spots and then cooler level one for sunday through tuesday. de ama and dan. >> very good thank you sandy. >> a third north bay farm has

been hit by a widespread nationwide avian flu outbreak. 4900 birds at liberty ducks commercial farm in sonoma county tested positive last week. liberty duck supplies michelin star restaurants, including chez panisse and the french laundry. the farm coo has organized a go fund me to help cover the added costs. owners are navigating supply issues and a mandatory quarantine for the animals because of the outbreak in the meantime, there are some new additions to the michelin guide's 2023 list of top california restaurants. >> it includes three san francisco established giants delta in the presidio features mediterranean cuisine. then there's kiln, which features contemporary creations and kind of hip warehouse space on fell street near venice and lastly, movida, that's a mexican restaurant, just steps away from oracle park. bon appetit. we'll be
