showcasing something new as opening night is tonight, right? good morning. it's saturday, december 16th. i'm stephanie sierra and we are getting ready for some rain this weekend. lisa is here. good morning. yeah. >> good morning. this is our last dry day today. in fact, very mild temperatures will be near 70 in some locations starting out with live doppler seven and the cloud cover that continues to stream up out ahead of a system. the high clouds. so we'll see that throughout the day today. right now, visibility down to six miles in livermore, eight miles in hayward. it is 35. in santa rosa, 36 in sonoma, concord. checking in at 39. and we have got the low 40s on the peninsula with upper 30s in gilroy and 49 in san rafael. so that compares to yesterday, about seven degrees cooler over in oakland, five degrees colder in san carlos. so we will make up for the difference today as we get some sunshine. but we do have a spare the air alert for unhealthy air quality. that high pressure ridge is really kept a lid on the atmosphere and it will do that again today and

tomorrow. so be mindful not to barbecue or mow the lawn. having those fires indoors throughout the morning hours. sunny skies with a mix of some higher clouds and by the afternoon we're partly cloudy. temperatures will be very mild from the 60s. and then we'll talk about when the rain arrives. coming up, lisa, thank you. >> and you can check out the abc seven bay area app for the latest on weather conditions and to access the same live doppler seven that lisa and the weather team uses. search abc seven bay area and your devices app store to download it. well happening now, the martinez refinery is reporting flaring again after a reported operational incident. over 50 air quality complaints have been made related to strong odors emitted during the flaring . it also led the refinery to issue a level two alert. contra costa county health officials are investigating the incident and issued a notice of violation for public nuisance in the east bay. mothers are coming together to commemorate the lives lost by

violence in oakland organizers tell abc seven news reporter tara campbell that events like this help heal the community. >> one ornament at a time mothers honoring their children lost to gun violence and other violent crimes at the annual purple gala in oakland. >> the acronym purple stands for prayer, unity, restoration of peace, love and empowerment. >> lorraine taylor started 1000 mothers to prevent violence after her sons were shot and killed nearly 24 years ago, and having lost both my twin sons at the same time here in the city of oakland, we need all of that to get through the indescribable pain that mothers have to go through, especially during the holidays. and while offering emotional supports and other services. the nonprofit is also working to bring the community together. >> i thought if we brought everybody together, either with the police department, the district attorney's office to try and bridge the gap in trust

and communication because a lot of the pain we feel is due to unanswered questions. alameda county district attorney pamela price taking to the podium, pledging her support and commitment to the mothers. >> i know the family that have suffered and cried because of the loss of life in our community. >> as a city like oakland suffers so much loss and fortunately, organizers actions like this help families heal. >> that's former oakland police chief lauren armstrong, his position has now been vacant for nearly a year, and these mothers say the city needs to get it filled. >> we need somebody to really step up, take the helm and just really get this crime under control. i am afraid i've been in oakland all my life and it's just i've never seen it this bad. i'm scared. >> meanwhile, jill blackwell is still mourning. she lost her son, michael, just a couple of

years ago and says the support is comforting as he's gone and he's not coming back. >> but at the end of the day, i'm super excited to meet her. >> the evenings event offering some hope for healing to inspire me as well, you know, to just keep praying, keep praying and i know it's going to hurt, but it's going to get better. tara campbell, abc seven news. okay >> and is one step closer to naming a police chief, according to the chronicle, oakland's police commission voted to pass its three finalists onto mayor shengtao. we asked former chief leronne armstrong about the opening, and he told us he never wanted not to be chief. he was fired in february over allegations of misconduct, but later cleared of any wrongdoing. there's another warning this morning about a scam targeting parents in the oakland unified school district. two more families received calls this week that their child was kidnaped, being held for ransom. the district says the caller even knew the names of the students. however, in both

cases, they were in school and safe. in san francisco. so take a look. sky seven caught the end of this intense situation here in the city. a car was reported stolen and there was a two year old inside. it was taken at ashton and holloway in the ingleside neighborhood. police caught up to it about five blocks away. you can see them here. and we did spot a young child with the officers. we're told the suspect escaped and thankfully the toddler was fine. 80 people will be charged with unlawful public assembly and more in connection to the pro-palestinian protests that shut down the bay bridge in november. the incident blocked rush hour traffic protesters called on world leaders for a ceasefire during the apec summit. all those allegedly involved will be charged with five misdemeanor counts, including false imprisonment, refusing to comply, unlawful public assembly, refusing to disperse and obstruction of a public place. each person who was cited will appear in court through next week, starting on

monday. well, we want to take you to a live look from the gaza skyline this morning. you can see smoke rising as the battle intensifies as the war now on its 71st day, the israel defense forces has opened a probe after admitting they mistakenly killed three israeli hostages in gaza. it's just currently past 3:00 in the afternoon. there according to the israeli authorities, the hostages had either escaped from or were abandoned by hamas fighters. they reportedly thought the three men posed a threat, so they were the shot. it is something that, sadly, can an be expected of such a chaotic battlefield where the enemy constantly and systematically uses civilian clothing while they are fighting, and i think that is one of the root causes to why this mistake happened. >> now was not known. >> they were hostages until their bodies were taken back to israel. the israeli prime

minister, benjamin netanyahu, called their deaths an unbearable tragedy in the south bay. now the berryessa flea market will stay open for the next two years. after a deal was made with the city of san jose in an agreement with the bumb family landowners. the vendors can continue to operate there until a big housing development begins. it's a win for nearly 430 vendors who have been in limbo since the project was approved back in 2021. landowners will eventually develop the space into 950 homes, but for now, the market will stay open until at least january of 2026. now to a sure sign the holidays are upon us. opening night for the nutcracker in san jose is tonight, but production looks a little different this year. abc seven news reporter lauren martinez shows us how it taps into the city's diverse culture and history.

celebrates both the holiday classic and the bay area. >> i wanted to create a ballet that was inspired by our hometown and set in our hometown . >> set in 1905, the backdrop has the san jose electric light tower. on friday, the cast from new ballet held their final dress rehearsal inside the historic california theater. the audience included local students and families from autism bay area. >> those of us who live in san jose and love the city have so much to be proud of. >> dalia rawson is the artistic director. she was inspired to bring the spirit of innovation to the stage. the character clara has a mystical uncle who goes by the name of nikola tesla. >> he brings the gifts of electricity to the home and demonstrates some of his inventions, including setting off a tesla coil on stage. >> apricot blossoms instead of cherry blossoms, and a gilroy garlic harvester will also make appearances before the preview performance, we were backstage,

made up of mostly senior citizens say they're living in unacceptable conditions and want their landlords to listen. abc seven news south bay reporter zach fuentes spoke to them at a demonstration and has more on their demands. 5-5-5 5-5-5 months of frustration have brought these tenants to this building. >> the dozens that came to this sit in demonstration represent more than 100 tenants at korda terra village and bella castillo apartments in san jose. >> both of these complexes are high majority vietnamese monolingual speakers. according to seniors. everybody's a senior there, cindy tran is with the law foundation of silicon valley. >> she's been working with the tenants who recently formed associations in response to concerns, some of them having to do with safety and security. their garage. >> people come in and they break in. um, there was an instance where one of the tenants got their car stolen. >> another big concern for the mostly monolingual community is community action. the other staff on site who are able to communicate with them, tenants

say important notices are not being translated despite multiple requests. >> these are basic necessities that they've been trying to fight for. >> friday, the tenants came to the santa clara office of rome corporation, which they believed was an owner of the complexes. the plan was to sit in the office until they got a response from the ceo. instead police were called to escort them out. when we spoke to them, they said they're just a construction company. >> they're not the property managers. >> we reached out to the company , listed as the property manager for both complexes, and have not heard back the tenants say they also reached out to them and have not been successful in getting a sit down meeting. the fight has caught the attention of both santa clara county and city of san jose leaders. the council members made promises to facilitate communication on the tenants behalf so i can assure you that there are there their concerns will be addressed when we work with the county. >> when we work with rome, corporation promises, the tenants and advocates say, makes friday's demonstration a win. >> now is just trying to apply more pressure to have that face to face meeting so that the tenants voice can be heard and

the tenants will always tell me this. they're going to continue to fight until their last breath in the south bay. >> zach fuentes, abc seven news well, in san francisco, cook-off contests, it's brought out their best holiday recipes passed down from their abuelitos or grandmas. >> it was organized by the year 24 latino cultural district in celebration of tradition, flavor and community spirit. now judges taste tested all the dishes and picked out their grandmother inspired favorites. the district also encouraged visitors to support local vendors nearby, and the new public mission community market space called la placita. so this is certainly the time to make those costco runs to get all that holiday dish shopping in store. lisa do you have anything prepped and ready to go for next week? no but it's crazy out there for sure. >> yeah. uh, costco was crazy yesterday. yeah, all over lines. yeah. it's that time of year. so yeah, hopefully you're planning in the weather. will be cooperating today anyway because

it's dry. it's mild. you may not want to do anything at all, but enjoy some of the outdoors because we have temperatures that will climb well above average. but look at what is spinning in the pacific area of low pressure. there's a couple of them that will be allowing for rain to finally return to the bay area for the next several days, but right now it's about a wind chill factor out by the delta of 29 degrees with a little bit of a breeze. it's cold out there from 35 san ramon, 36 in livermore, and we have the upper 40s san francisco . typical cool spot. palo alto, 3839, in gilroy and taking into the north bay, where our look at the anomaly from mill valley, 5152 in vallejo, we've got 50 in napa. and then you go down the road and we're in the mid 30s here. so there are some clouds around. there's a bit of wind out there, but we still have high pressure in control that is really capping the atmosphere, allowing for the hazy conditions. the spare, the air alert today and tomorrow. so and looking at some sun mixed in

with some high clouds for your saturday and then into sunday, we have some showers, not only in the evening, but i think tomorrow morning we'll see some showers. a level one system arriving and boy do we need the rain as we look at the percentage of normal. so far. santa rosa three and a third inches of rain, 40% of average. look at san francisco to over two inches of rain. only 42% of average. and as you go down the line, oakland not even an inch. san jose three quarters of an inch. and with san francisco an inch and a half, only 33% of average. so we are way behind. we will catch up in the next several days. here's a look at today. the high clouds by the later part of the afternoon. and then this is that light band of rain moving through early tomorrow morning. then you can see the bulk of the day is dry for your sunday. look what happens though sunday night. we've got south winds and that low pressure on the way. so gusty winds. our level one system allowing for not only the rain overnight but a rainy monday morning commute. stopping this at one in the morning.

you'll notice that heavier rain over in the east bay, and then we'll be on and off showers as the low moves to the north. this is monday night, but you can still see pockets of some heavy rain rainfall estimates between the sunday morning and monday night. you can see anywhere from about 8.66 in hayward to over an inch in novato and santa rosa, 1.64. but they'll be more. we've got another area of low pressure on the way for tuesday. wednesday highs today with that spare the air alert upper 60s for you in oakland. it's mild 69 in fremont, 73 in san jose. so overnight tonight the rain stays offshore. the clouds keeping it pretty mild upper 40s to low 50s. and the accuweather seven day forecast. we've got sunshine hazy warm conditions today. isolated showers tomorrow. level one system. heaviest rain in the morning on monday. level two. and then you can see tuesday wednesday. more on and off. rain with winter arriving on thursday . stephanie. >> all right lisa thank you. up. coming up. we're getting a closer look at how the unhoused can get to a shelter bed here in

for those trying to avoid living their. we're learning more about the process for unhoused people to get a shelter bed in san francisco. turns out it's not very easy. abc seven news reporter lyanne melendez breaks down how it all works. >> quite often, people think that the unhoused line up every night waiting to get access to a shelter bed. today in san francisco, it's far more complicated. >> every other place i've lived before here, you can just walk in and get a shelter bed if they had an opening. but here you can't do that. >> for many, the first point of contact is the homeless outreach team. hot they help people get

on a waiting list for a shelter bed. if not through them. a phone and the internet are other options, so let's check it out. first, i dial the number and add. i wait your call is very important to us. >> for spanish press one. >> so here i'm supposed to talk to somebody or leave a message with my name and contact information. >> often you can easily submit your waitlist request online. >> and now i'm being encouraged to go online. let's remind people that these are the unhoused. some don't. have a phone. they may have lost it or had it stolen. you're sleeping, you're not watching it. >> and so you lose your phone, your hot team, your homeless outreach team, worker calls and says there's a spot. and then you you don't have your phone to answer to. and what happens? and then you back, you're back at square one. so how do they contact you if something becomes

available like a shelter bed? >> um, i give them my email. >> the department of homelessness and supportive housing says it's working on making the process more seamless because once the city contacts a person, they only have up to 72 hours to respond. we found john waiting outside an emergency shelter. he moved here from iowa two months ago after thanksgiving, he finally got on the waitlist for a more permanent shelter bed. what number are you? i'm. i checked yesterday. >> i'm at 195. that's where i, um, am at currently. >> and you started close to 500? >> i think it was 490. yeah >> john, like hundreds of others, is waiting to get into one of the city's three largest shelters, msc south, which can house 410 people next door, 334 and sanctuary three, 200 people at these three locations are allowed to stay indefinitely

without having to pack and leave early the next morning, we found yvonne and her dog zeus. at one of them. how long have you been at this shelter? >> for a couple of years. two years, a couple. i've been at all of them. >> during those two years, you couldn't find some kind of more permanent supportive? >> they offered. i did not want what they offered, what they offered her in terms of housing, was located primarily in the tenderloin, known as a hotbed of illicit drug use. >> yvonne told me she wasn't about to give in to temptation. >> lived it, been there, done it, got the t shirt to prove it. you know what i mean? i don't want to go backwards. i want to go forwards and i don't want to make bad choices. >> currently, san francisco has a total of 48 shelters offering more than 3200 beds. yet those who don't get in more than 4000 people have no option but to sleep on the streets. among their stock are the interfaith

winter shelters, four of them, but they only operate from november through march. they come in late afternoon and stay till 7 a.m. the next morning. >> during that time, they get a home cooked dinner at night they sleep in the facility. it's nice and cozy and warm and then in the morning we come in 5 a.m. and cook breakfast and serve them breakfast. and then they have to go back out onto the street at seven in the morning when john leaves any of the emergency shelters, he's now left and navigating life as an unhoused person. >> well, that was lyanne melendez reporting this year. >> the department of homelessness and supportive housing spent 22% of its $672 million budget just on shelters. their plan is to add 1000 shelter beds over the next. years. now, abc seven spent an hour with san francisco's mayor, police chief and district attorney to tackle the city's chronic issues. the commercial free conversation is now streaming online. you can find

rosa, 36 there in sonoma. but over in napa and novato and mill valley, upper 40s to low 50s. so really a wide range. and it is 2 to 7 degrees colder from the east bay to oakland this morning. so as you. head on out, we are looking at not only the spare the air alert today, but tomorrow. so that means that unhealthy air for sensitive groups. look how quickly the temperatures warm. we're well into the 60s, even 70s today, but we'll talk rain coming up. stephanie. all right lisa. >> thank you. speaking of that rain, sandbags are now available for residents and businesses in san francisco. they are being distributed at the marina green east parking lot from noon until seven today. sandbags are also at the public works operations yard at marin and kansas streets in the bayview, as well as spare. the air alert has been extended through tomorrow. you're taking a live look at conditions from our sutro tower camera and the winter spare. the air alerts are because of wood smoke. it means no fireplaces or wood burning through sunday.

well happening now, authorities are searching for a suspect after one man was killed and four others were injured in a shooting yesterday in los angeles county. l.a. county sheriff's deputies responded to a call about the shooting around 2:30 p.m. in a willowbrook shopping center just northwest of compton. all five victims were taken to the hospital with various injuries. one victim later died and four others are still in the hospital. as of right now, the motive behind the shooting is unclear. officials say the investigation is ongoing in the east bay now. people are demanding action from oakland leaders in response to the killing of a security guard at a 7-eleven store. sky seven flew over a protest. store yesterday. you can see here neighbors say they want justice for 50. 59 year-old james johnson. he was shot to death while trying to stop a shoplifter at the store on harrison street in the adams

point neighborhood, right near lake merritt last week. they say it's another violent crime that city officials must accept some responsibility for. >> leadership is action, not position. those in positions. who are empowered to lead right now are on a very, very short timeline to show that they have the knowledge, skills and abilities to do this job and keep us safe or we will remove them. >> a memorial to johnson outside the store continues to grow. so far, no arrests have been made. we have new developments this morning. former trump attorney rudy giuliani is being ordered to pay nearly $150 million for defaming two georgia election workers. follow the 2020 election. he accused the election workers of ballot tampering and election fraud. the workers then sued for defamation, saying giuliani destroyed their reputation. giuliani remained defiant after the verdict. he said he does not regret his comments and plans to appeal the decision of the jury. closer to home now, we're getting a better idea about how

our schools are doing compared to pre-pandemic times. a new progress report is out from the california department of education on abc seven news reporter suzanne phan tells us how the data lines up with schools around the bay area. >> looking at the big picture, the 2023 dashboard shows that students in california schools are graduating at higher levels than before the pandemic and are missing less class time. year over year. statewide the graduation rate for the class of 2023 is 86.2. it's a decrease of less than 1% from the class of 2022, but it's still higher than pre-pandemic levels. >> that number is a great achievement and a great success. >> cassandra curiel is a teacher and president of the local san francisco teachers union in san francisco. >> 88.3% of our students are graduating from high school with their eligibility again across an entire district like ours, with over 50, um students with a

second language background. this is a huge a huge achievement when it comes to the san francisco unified school district. >> data shows a decline in chronic absenteeism rate. for the 2022 to 2023 school year. it dropped to 26% from 29% from the year before. in response, sfusd superintendent matt wayne stated , quote, attendance is directly tied to student outcomes. if a child does not come to school, they're not learning. we're pleased that we made progress last year in reducing chronic absenteeism, and we know that more work is needed to continue supporting students in coming to school every day in santa clara county schools, a similar story of progress. >> it is encouraging to see some of the progress. yes, as we compare to pre-pandemic, uh, performance and my second takeaway is that the dashboard is going to provide us a lot of information and support, and there is much more work for us all to do in oakland.

>> absenteeism is a growing problem. it went up 15% to 60, which means more than half of the students are chronically absent or miss 18 or more days of school. an abc seven news reached out to oakland unified for comment, but have not heard back yet. >> now to some help for hundreds of teens in santa clara county who are transitioniutf foster care friday marked the official groundbreaking in san jose for a new resource center on parkmoor avenue. former foster youth joined in yesterday itation of what organizerssecond call the hub. it's dedicat to helptrsitional foster youth ages 18 to 25 ye old. the facility will offer 40 housing unitand other resources and services like classes and job opportunities. this is what this whole center was about. >> it's like bringing all the resources to one center, bringing all the partners to one center, getting young people the resources and services that they need, and to really just try to get them to understand they don't have to just survive

anymore. this is an opportunity for them to thrive. >> roughly 764 youth are currently experiencing homelessness in santa clara county. the hub is slated to open in 2025. well, in. francisco. look at this an effort to revitalize downtown. the winter walk in union square is back. the festive pedestrian extravaganza returned to try and bring more people back to downtown, and the winter walk is filled with holiday decorations, as you can see, and the skating rink you just saw a moment ago. food trucks. there's bar options and of course, live music we see every year, as well as san francisco. excuse me. as we all know, san francisco has been struggling to rejuvenate the shopping district since the pandemic. but this holiday season is seeing a significant uptick in visitors. >> thank you for coming out to union square. thank you for not giving up on san francisco. and thank you for shopping in downtown and in the neighborhoods and all over for

alert with hazy conditions to sunshine to start out, then high clouds increasing temperatures will be warmer today. not only 60s but 70s arriving to the south of us. gilroy, morgan hill , san jose, santa clara and then some morning showers and then steadier evening showers with gusty south winds. a level one system arriving really as soon as tomorrow morning. here's a look at today. so by 4:00 we've got sun some high clouds and we're dry. early sunday morning you can see the showers just kind of being stretched out from cloverdale all the way down to the san mateo coast. half moon bay. then we've got a pretty dry day. could see an isolated shower. but as we get into the evening hours, here comes that system stopping this overnight early monday morning, heavier pockets of rain could even see a thunderstorm. and you'll notice as we get into your monday afternoon, we're not done with this. the system moves to the north, but we've got heavier downpours years from the east bay right on through the peninsula and the south bay. this is monday afternoon and

then into monday night. still some rain shower activity just scattered. and as we look at the rainfall totals from sunday to monday night, over an inch in the north bay inch and a half santa rosa, you can see lesser amounts. welcome rain boy, we really need it right? this is the first system. then the second system drops south. this is tuesday, wednesday, even into thursday. looks like we dry out for the christmas weekend as we lead up to christmas. and then remember monday rainfall totals adding in the wednesday thursday. and we get up anywhere from about a third, three and a third for santa rosa and could see over an inch in san francisco. this is 0.54. so widely varying totals and we could see even more than this. it's still quite a ways out. this second system that's a cut off low, hard to determine how much rain, but you get the idea. we're going to be wet throughout most of next week. and as we look at the snowfall, we need that too. and this takes us out
