roadways so the evening commute won't be much better than the morning commute was, and localized flooding is still possible. here's a forecast animation starting at 5 p.m. going into the evening hours. we'll see more scattered showers again with some isolated downpours. so a wet and slippery evening commute going into tomorrow morning. more scattered showers and some heavier rain coming our way on wednesday morning. so i'll have a look at the complete accuweather. seven-day forecast and a look at when this will all end a little bit later. >> dan okay. spencer, thanks very much. now, this afternoon's rain was too much too fast for some roof gutters in san francisco. here's a look at one building. old building near the embarcadero that started spewing water, making quite a sight for passersby. as you can see, it's really coming down there. and a nearby a small geyser shot from this downtown sidewalk. heavy rainfall can make this happen when water rushes into sewer pipes too fast and traps air in daly city street, flooding briefly shut down roads near 88th street. >> the water got close to homes, but started going down once

drains were cleared, so now let's get to the north bay and abc seven news reporter cornell bernard and cornell. how are things there. >> hey, karina and dan. yeah, free sand and sand bags here for the taking at the santa rosa municipal yard. and check this out. there are upside down traffic cones to make it easier to fill them. pretty ingenious. we have seen rain falling most of the day here in the north bay . and you know what? more is on the way and up on the russian russian river. flood prevention measures are happening. to. heavy rain arrived monday morning, making driving pretty challenging on highway 101 in novato. clear up to the back roads of sonoma wine country. >> we are very happy to see the rain coming. it's been pretty dry. >> all eyes on the russian river right now. sonoma water officials say it's flowing at about 400 cubic feet per second,
4:03 pm
but later this week it could be running 25 times that. it's why this rubber dam near forestville is being deflated because it could be damaged in order to avoid that damage, we need to lower the dam. >> let it sit on the bottom of the river and let all the water pass right over the top of it. >> we found this landscape restoration crew working to prevent flooding and erosion near this vineyard on waller road. >> we put in all this rock here to prevent this bank from sloughing down, washing off. um, we put in all this fabric that's on the adjacent side of the of the stream in petaluma. >> rain didn't stop, folks from having lunch outside under covered parklets. yasmin onate was just trying to keep her dog cargo dry. i forgot his raincoat. >> i'm being a bad mom, right now, but he's still warm. >> marin county fire department posted on ex advising folks to avoid non-essential travel during the peak of the storm. the department says marin is expecting an estimated total of
4:04 pm
around five inches of rain between now and wednesday. and the department says with the first big storm of the season, it's a great opportunity to check those flashlights and generators ahead of possible winter power outages. and yeah, don't forget those sandbags, too. i'll be here for the next couple of minutes in case anybody needs them filled. we're live in santa rosa. cornell. bernard, abc seven news put you to work. >> yeah. that's right. thanks, cornell. yeah. all right. the wet weather here and stormy conditions back east are prompting delays at san francisco international airport. this is a live picture from sfo, where departures are delayed about 45 minutes. and arrivals about 35 minutes, according to flightaware. and as of moments ago, sfo reported some 372 flight experiencing delays due to weather. that's about 33% of all flights. there have been eight cancellations in southwest airlines will pay a record $140

4:06 pm
and a person of interest, alex herrmann was last seen in santa cruz on december third. >> no one has heard from her since. abc seven news reporter ryan curry spoke with her family, who is just hoping she'll be found soon. >> police throughout northern california are searching for this woman. >> alice herman has been missing for over two weeks. her family says she didn't show up for work one day and didn't return any texts or calls. >> we had not heard back from her. we couldn't get ahold of her and, um, we actually were starting to get worried about it. piecing together that she hadn't been in contact for some other inquiries that we had. >> alice, who also goes by alex, is supposed to be in hawaii right now visiting her family. when they could notrillioneach her, they called police. >> we had pieced together on our own that the last communication we heard from her was approximately the 2nd of december, which is a while. it wasn't just like a day or two, and that was extreme, unusual from our perspective. >> police say they have enough
4:07 pm
information to investigate this as a homicide. they say herman was last at a paddling event in santa cruz before going missing. they're looking for her and theo lengyel, an ex-boyfriend and person of interest. his el cerrito home has boarded up windows and doors. the curtains are closed. police say they found herman's car abandoned on the street in front of lengyel's home. they say he has not been cooperating and he possibly fled north to oregon. theodore lengyel um, was in capitola around the time of her disappearance, came back to el cerrito and then from el cerrito, traveled to portland, oregon by car. >> if anyone has seen these cars, police want to hear from you. >> herman drove a red toyota and lengyel an old ford pickup. >> we're trying to determine where he may have gone in that time frame, with the hope of finding some clue about where alice is at. police say he might still be in the bay area, since they are investigating this as a homicide. >> they want to speak with lengyel soon. >> people have seen him come in
4:08 pm
contact with him. we really want to know what the context is for that as well. >> for the herman family is not losing hope of finding alex. >> we're worried. at the same time, we're trying to remain hopeful. um, for a good outcome in el cerrito. >> ryan curry abc seven news, san jose police have made an arrest in a fraud case that cost victims more than $1 million. >> office hours with the financial crimes unit seized guns, drugs and jewelry when taking 30 year old john mahoney into custody. he is the prime suspect in a crime ring responsible for passing bogus checks and money orders. mahoney was arrested after a warrant was served at his home. officers say they also found altered money orders and about 600 fraudulent checks at the home. >> new details today involving the protesters facing charges for shutting down the bay bridge last month, they were calling for a cease fire in gaza. abc seven news reporter luz pena is in the newsroom. luz, you spoke with the protesters attorney today. what are you hearing? >> that's right. dan, a total of
4:09 pm
80 people are facing five misdemeanor charges in connection to the protest that shut down the bay bridge for hours during apec in november. today, the first 17 protesters faced a judge and the occupation now. hundreds rallied outside of san francisco's hall of justice, urging the district attorney to change her mind as the first group of protesters went in front of a judge. we say, ta da! >> jenkins dropped the charges against our beloved 78 out of the 80 facing charges, the group's attorney says two of them are bystanders who were arrested by officers. >> but were not part of the protest. >> all of this could have been prevented if these elected officials called for a cease fire. so people do what they feel like they need to do out of desperation. >> emily rose johns is part of the legal team representing the 80. >> i think the da has been trying to send a message for a long time that she is a law and order district attorney, unlike her predecessors, i don't
4:10 pm
believe that charges like this really demonstrate that, and i don't believe that they're going to get her the support that she wants from a city. and county that largely, overwhelmingly, she supports a cease fire. >> the 80 are facing five misdemeanor counts for unlawful public assembly, refusing to disperse, refusing to comply with a peace officer, obstruction of street, sidewalk or other place open to the public and false imprisonment for blocking traffic for hours. a charge that this group viewed as extreme. >> we've had other shutdowns that have never resulted in charges as outrageous as false imprisonment, although just a misdemeanor. it is, of course. uh, it carries with it a specific sense different than the other charges. >> in a statement, san francisco's district attorney said, while we must protect avenues for free speech, the exercise of free speech cannot compromise public safety. but this group says the da's response doesn't represent san francisco.
4:11 pm
>> this is a city that that welcomes justice and welcomes calls for justice and i'm hopeful also because, you know, 66% of america is are heeding the exact same call of those bay bridge protesters. and that is for a cease fire. >> the district attorney's office confirmed that another two bystanders were also mistakenly taken by officers during the protest on the bridge. one of them was a mom who got out of her car to document the protest. both of those people have now confirmed to us that their charges have been dropped in the newsroom, luz pena, abc seven news lucy, the legal process could obviously take a while. >> could these protesters ultimately face any jail time? >> well, this process could take months. and according to one of the lead attorneys representing the group, jail time is unlikely . but based on the charges, there is a possibility that some of these protesters could face anywhere between six months to a year in jail. we're told many of them will plead not guilty.

they set the holiday mood, keeping them chugging along. is i even letting you pay with your face so it scans your face? >> yes. you're going to tip the robots, huh? >> i don't know if i'm going to tip this now. >> sounds pretty cool, right? but keep in mind hollywood doesn't see a very bright future for i. >> shall we play a game? >> the answer to that question should have been no, but the folks here at callie express see the ai not only as a tasteful dining option, but an economical one as well. >> they don't call in sick. they don't get drunk the night before work and come in with a hangover. they're a little bit more reliable and a affordable. >> they wouldn't say how much the hamburger robot costs, but flippy, the fry chef over here, costs about $4,000. compare that to a human who california says will earn $20 an hour starting next year. >> it's quite a bit cheaper than uh- funding a few full time staff. >> those savings, they say, also

allowing them to use some really fancy meat in their burgers. >> why? >> you know, but don't worry, there will still be people working at callie express, adding that human touch. >> there's still humans who will pack the food, somebody to assemble, package them and actually be the friendly face to the customer. >> the folks at callie express are hoping those customers once they get a taste of their burgers. >> that is a good burger. >> we'll be saying this. i'll be back in pasadena. rob hayes, abc seven news. >> well, it's a day of giving in the south bay. volunteers are spending the day making thousands of tamales with love for farm workers and half moon bay. some are learning how to make them for the first time. for others, it's a family tradition. organizers say the annual event always turns into a party with conversation and music. >> today, we're making 2400 tamales to give to 200 farm workers. on wednesday. and so, as you can see, all the people behind me are busy making
4:18 pm
tamales. we're going to be here till 6 p.m. tonight. um making thousands of tamales, a lot of tamales. >> this is happening at saint john vianney church in san jose, and the celebration will continue on wednesday when they donate all of the tamales made today to the farmworker caravan to give to agricultural workers on the coast. >> that is fabulous. and a holiday tradition for those in need is underway once again in the south bay. sacred heart community services has launched its annual holiday food box and gift distribution event in san jose. the food boxes include a whole turkey produce, dairy, bread and more. the distribution will continue tomorrow at 9 a.m. and then the toy giveaway starts wednesday. people have to pre-register. keep in mind, to receive a food box, but very much appreciated. i know there are so many wonderful things happening this time of year. >> so many you know, giving organizations. >> that's what makes it so special, right? >> yeah, i love stories like that. all right. well, spencer is giving us i don't know if it's something great, but a lot

of rain and wind and it is really coming down. >> spencer. all day. >> it is. it's beneficial. rain so you can say that i'm giving you the rainfall. certainly giving you a look at it. here's a live doppler seven. you can see that the heaviest concentration of rain right now is well far south of the golden gate and east of the golden gate, but you can see more areas of rain moving onshore even as i describe this picture. so lighter rain up north right now and uh- more widespread rain and showers in the south bay and the east bay. let's pull back. give you a view on the satellite radar. composite composite looping image of this. clearly defined low pressure system offshore that's bringing us this rainfall. notice the counterclockwise circulation around that center of low pressure sweeping in moist, warm air from our southwest into the bay area. that's why, along with the rainfall we're getting right now, we've got a little bit of a warm up from yesterday. and so here's a look at the storm on our exclusive abc seven storm impact scale. it's a level one storm for tonight through wednesday. this morning when we
4:20 pm
had the heavier downpours downpour hours it was a level two. so tonight through wednesday we expect periods of showers and some scattered downpours. gusty wind 15 to 35mph. slick roadways obviously. and there's a chance of some localized flooding. here's our forecast animation starting at 5 p.m. we will continue to this evening to see areas of scattered showers and isolated downpours through the late night hours, then overnight into tomorrow morning. so tomorrow morning's commute will be a slick and challenging one as well. and then on wednesday morning we'll get some heavier rain coming in. much like what we had this morning. so we've got a couple more days of some fairly wet weather coming our way, and these rainfall estimates are on top of what we've already had. many locations have already received an inch or more of rain from what started yesterday. now over the next couple of days, we expect an additional 1 to 2in of rainfall. generally across the bay area. some locations down to the santa cruz mountains will receive up to three inches of additional rain. and right now we've got gusty conditions near the coast. as you can see, gusts
4:21 pm
up to about 25mph at half moon bay and sfo. and as we look at the wind for cast animation, you can see that overnight. it's going to continue to be gusty and the wind gusts will become more widespread across a larger portion of the bay area during the overnight and early morning hours. but then by mid-morning tomorrow, we'll see the winds easing up a bit. and one of the beneficial results of this storm is cleansing of the air. we have a pretty good air quality, just about all parts of the bay area right now is indicated by those green dots. on we go with a live view at the golden gate, where it looks like a little bit of a pause in the rainfall. right now, it's currently about 60 to 63 degrees from san francisco to oakland, hayward, san jose, san mateo on 59 at half moon bay. and it looks like we still have some light rain falling on the embarcadero just outside our studio here at abc seven. it is 59 up at santa rosa, mid 50s at petaluma, napa, fairfield, concord, 62 at livermore and as we look at our forecast headlines through tonight, more scattered showers tuesday and

think late 80s, maybe early 90s. and, you know, that was his thing. he was a very religious man. and we do not do business on sundays. he felt strongly, and his board was often pressuring him to open because they're giving away a lot of money. but when he passed away, and i believe his kids took over, that was clear part of the agreement that that that tradition remained. so we'll see. yeah >> and so many people are obsessed with chick fil a. i know people would be happy to be able to pick it up on. >> i don't get it. i don't my daughter a couple of years ago was like, dad, this is going to be your first chick fil a experience. so we sit down and i'm like, is that it? and she goes, but look at all the dipping sauces you get and i'm like, yeah, the sauce is good. >> i think that it's part of it. and the fries, the waffle fries, the whole experience. >> okay. >> all right. well, you're not an expert to talk about fast food anyway. larry, you have to you have to recuse yourself. >> well, you are dan, not really, but but i will say, spencer, very quickly, i, i did respect if that was what he believes. >> true. good for him. you know, he stuck to his guns right.
4:43 pm
>> he stuck to his beliefs. >> apparently a lot of gen z experiences, uh, people have many anxiety. that's according to a uk study, 86% of gen z respondents say they were affected by this, compared to only 15% of gen xers and boomers. it can be triggered by high cost daetz or not knowing what to order. many young people ask others to order for them because of their anxiety. spencer i have not encountered this before, but it's very interesting that so many younger people. yeah, i wonder what drives that. i know a lot of young people very conscious about everything that they eat. >> yeah, that's true. i maybe we're talking about some people in this survey who just don't eat out. a lot of they're new to the whole experience of, you know, going out to a restaurant so they don't know what to order or they're intimidated by the menu, but it sounds kind of new to me as well. >> yeah, maybe during larry, during the pandemic, people of a certain age came of age and they really didn't get a chance to go out to restaurants during that period of time. and now it is kind of a new world for them. >> i don't know, i'm liable to
4:44 pm
make people mad if i say what i really think. um >> oh come on. oh. >> go ahead. that never stopped you before. >> that's true. we're talking about people age 11 to 26. that is the gen z, right? if you if you look it up, look, i get the high cost of, of eating out because sometimes you look at the menu, you go, whoa. yeah. right but we're just too soft. i mean, if you're 20 years old and you can't go out to a restaurant and order for yourself, come on. i mean, let's, you know. all right, come on. >> i agree. and larry, all of them watching, just said, okay, boomer. >> well, they're they're not watching. they are on their phone. got playing candy crush on the abc. >> they're watching on the abc seven app. >> i like it. >> that's how they watch boomer. >> yeah. >> that's what my kids call me when i do something boomer esque. yeah. next time someone says, okay boomer, i'm going to say, can you spell boomer? >> uh, let's talk about cookies and christmas. >> they go hand in hand, right? yep. and a new monmouth university survey found that sugar cookies dominate when it comes to christmas gingerbread

and chocolate chip are neck and neck with snickerdoodles in fourth. butter uh- peanut butter and chocolate cookies all tied for fifth. and dan, i know your wife was making lots of cookies this weekend, so what's your favorite? >> yes, angela, my wife had a cookie baked this weekend with lots of ladies over, including spencer's wife who was at the house. >> uh, my favorite are sugar cookies that she makes with this frosted. they're absolutely fantastic. >> i go for the gingerbread. i like gingerbread. >> yeah, you like, because it's not too sweet. >> not because it's not too sweet. exactly. yeah >> larry, do you spicy? >> do you allow yourself to have one cookie over christmas? >> he didn't like the waffle fries. i don't think he, you know. >> you know what? like like the gen zers, i get so anxious when i have to choose. but i would say spencer's wife's christmas cookies. those are good. are deliver here. yeah, the best by far. >> yeah, i'll have to try it. >> all right. that'

after a car fell 20ft off southbound 680 into an embankment. it happened near the castlewood exit, and authorities tell abc seven eight people were inside the vehicle and two adults died at the scene. six others, including two children, were injured. just terrible. >> we do not know if weather was a factor at all. we'll learn more about that as time goes on

here. but for the moment, let's turn now and focus on the weather. >> let's check in now with spencer christian tracking the rain and the storms. >> spencer, we have a lot more rain coming our way. so please, if you're out driving, exercise caution. here's a look at live doppler seven. you can see that we've got widespread showers and isolated downpours right now across much of the bay area. the storm that we have on the exclusive abc seven storm impact scale is a level one. tonight through wednesday. we expect continued periods of showers with isolated downpours, gusty conditions, winds ranging, wind speeds ranging from 15 to 35mph, slick roadways and the chance of locally flooding. here's our forecast animation taking us into the late night and overnight hours with a continued flow of periods of showers and isolated downpours, and then late tomorrow night into early wednesday, we expect the rainfall to intensify much as it did last night and this morning. so we've got a lot a lot of wet weather coming our way overnight. low temperatures, mainly in the low to mid 50s. highs tomorrow, generally in the

low to mid 60s. and here's the accuweather seven day forecast. you can see two more days of level one storm activity coming our way. we start to dry out and warm up a little bit on thursday , which interestingly enough is the first day of winter. dan and corina. >> okay, spencer, thank you. >> well, it looks like draymond green won't be getting back on the court for christmas. >> no. that's after his suspension for the latest altercation against an opposing team. brought down the hammer abc seven sports director larry biel is in the newsroom with more on this. larry >> yeah, dan we kind of had a sense when the suspension was first handed down that this might take a while to resolve itself. and one of the unknowns regarding the draymond suspension was, all right, let's just start with how long is he going to be out. we have our first idea of a possible timeline here. nba insider shams charania from the athletic reports that draymond has been counseling. he's begun counseling. it's expected that he'll be sidelined for at least three weeks. three weeks anger management counseling. if you look it up, it can range from 8 to 52 hours. and the guess here is that given the frequency of
4:51 pm
the issues that we've seen with draymond through the years, you figure this is going to take a while. a couple of positives though is that draymond is allowed to work out with the team at chase center. you know a lot of times leagues impose suspensions that exclude you from being around the team. but in the nba that's changed a little bit. so draymond can be around his teammates feel like he's involved and his absence opens the door for guys like trace jackson davis the rookie out of indiana who played really well last night. >> well that's nice. stay involved with the team practice and stay in shape. so when he does come back, he can get right back in action. that's a great point larry. we've seen draymond obviously. and you mentioned it here. lose his cool a number of times on the court. is there anything we know about off the court that may be a cause for this. >> so there's one thing that that stands out for me i mean draymond is one of those guys. we know he runs hot. he's the emotional leader of the team right. but he did give some insight. and we're going back a bit to right after he punched jordan poole in training camp last year. and draymond said quote hurt people hurt people. so we presume whatever was

causing his pain at that time and perhaps is still causing some pain is going to be discussed in the counseling and hopefully resolved and he can get the help that he needs. but it's a fine line between playing with that fire, the passion, the intensity, and then being able to just, okay, well, here's the line i can't, i can't cross it. i've got to be able to control it. so i mean, you know, um, it would be nice to just see him not screaming at the officials and all that. uh beyond the other extracurriculars. yeah >> we had an expert on getting answers today on our show at 3 p.m, and he was saying that, yes, sports is competitive, that aggressiveness is, uh, you know, sometimes encouraged, but there is that line, as you mentioned, that is crossed. and that's when somebody does need help. okay. so larry, real quick is the expectation that draymond will be back in three weeks. >> i don't know that there's any expectation at this point. three weeks would mean 12 games missed. i think it's just indefinite at this point. and the warriors just hope he gets the help that he needs. they're they're not counting down on the
