>> we will have more on those stories coming up in just a few minutes. >> but first we got more rain coming overnight. spencer christian here with a first look at the forecast. hi, spencer. >> okay, larry. i like that water falling from the sky better than what you just described. here's here's a look at live doppler seven. it's been relatively quiet this afternoon in terms of rainfall, although we had a good dosing of rainfall this morning. let me move along and give you a look at what's coming our way though. you can see on the satellite radar composite image, more showers and areas of rain developing off shore and that will be sweeping on land onshore tonight. so this storm on the exclusive abc seven storm impact scale is a level one storm for tonight and tomorrow. we can expect periods of showers, showers mainly tonight. tomorrow morning during the morning commute especially, we expect some heavy and widespread downpours with gusty wind at times there is even a chance of thunder and certainly some minor localized flooding could occur. here's the forecast animation starting at 530, taking us into the late night hours. then after about midnight or so, a set of showers we can expect widespread, steadier, heavier rain continuing into the

morning commute in the early morning hours, it might be mainly near the coast and bay, but it's going to become much more widespread later in the day . i'll have the full forecast in just a few minutes. >> larry. all right, spencer, we'll see you then. the wet weather here and storms across the country contributed to more delays today at san francisco international airport. according to sfo, there have been 215 delays, so far today. that's about 20% of all flights at the airport. a total of five flights had to be canceled. meanwhile, at oakland international, only one flight was canceled. 12 delayed flights, san jose, only 13 delays and no cancellations. want to take a look now at the current power outages in the bay area? you can see quite a few in the east bay, as well as san francisco and along the peninsula. so here's what the chart means. green means fewer than 50 customers were affected. yellow is 50 to nearly 500, orange almost 500 to 5000, and red is more than a let's see, 5000. i don't see any red. so that's a good sign. >> now in san francisco, cleanup is underway from the past two

days of rain, the public works department has been dealing with multiple flooded areas across the city. >> abc7 news reporter luz pena takes a look at how the city is gearing up to respond to even more rain today. >> san francisco woke up to the aftermath of the latest rainfall, with at least 20 potholes surfacing, clogged storm drains and multiple floods throughout the city. >> we had about a dozen spots mid midday yesterday, a larger one near civic center on franklin and golden gate ahead of more days of rain. >> the city continues to distribute sandbags at least 400 have been given out on valencia street. flooded storm drains led to water coming inches from storefronts, linda yee said it was like a river from my window. >> i could see the flow of the water, the rain going that way and the leaves are on there and it was really m moving. >> and on 18th and folsom streets, many of these businesses have layers of water

barriers with sandbags. outside of many of these stores, and then also metal and wooden panels blocking the storefronts. and none of this works. many of these businesses also have sandbags inside. >> it's a low lying area, so the public utilities commission for san francisco puts out flood barriers. >> larry russo was ready with sandbags. we're always used to the water coming down from the twin peaks area. >> we always put out the sandbags and, you know, we're lucky. yesterday others were not as lucky. >> raul escobar was on the phone with his insurance company while public works employees worked around his car. so what happened today? the tree fell on top of my truck. >> so i thought to myself, well, i won't be able to move my car now. no puedo trabajar ahorita. >> and i can't go back to work. the city's department of emergency services says they're ready. >> we have held a coordination call. earlier today. we received a very thorough briefing from

state's primary ballot, claiming trump incited the january sixth attack on the capitol. it is the first time in history that clause of the 14th amendment has been used to disqualify a presidential candidate. the 4 to 3 ruling sets up a likely showdown in the supreme court to decide if trump can indeed remain in the race. >> back locally, the vallejo police officer who shot and killed san francisco native sean monterrosa will not face any criminal charges. a department of justice reportrillioneleased today finds there was insufficient evidence to prove beyond a reasonable doubt that officer jared tonn did not act in self defense. that officer fired a shot from the back seat of an unmarked police car that killed monterrosa in 2020. tonn was terminated in 2021, only to be reinstated in august of this year. >> santa clara county is honoring more than 200 people who died while homeless in the county this year. >> hector carrizo, brittany

durkin, joel acero, san jose mayor matt mahan was among the speakers who read the names of the 201 unhoused citizens recognized as part of today's event. >> it's an annual ceremony organized by home first, which provides shelter, mental health counseling, and more to the unhoused in the south bay. >> we know it doesn't have to be this way. we know the formula for ending unsheltered homelessness. we just have to find the political will to use it. >> the mayor says homeless deaths in santa clara county are down 18% compared to 2022. the second year in a row that the county has seen a decrease smash and grab, burglars made a real mess of things in oakland today, targeting two businesses in the northgate district. >> a pretty brazen stuff here. the burglars used an older suv to ram right through the front of this lululemon store on broadway in 25th street, and you can see it's sustained major damage. front door was crushed.

employees say the robbers got away with a lot of leggings. also hit today. benner auto motive right around the corner on 25th street. i went on my inside camera. >> it showed one guy coming in, one guy crawling out. uh. they destroyed both of my doors. that's probably $4,000 right there. they didn't take one thing inside. they opened the filing cabinets and the desks. there's nothing in there. our tool boxes are all locked. >> mike benner says he's owned that shop for 58 years. and this is the third time in just the last three months that someone has broken in. >> retail theft was in the spotlight today. also in sacramento, an assembly committee held its first hearing and focused primarily on reports and data from researchers. there have been numerous reports recently debating some of the statistics and their accuracy. shoplifting was one of the crimes that was addressed. >> we see that in the bay area, we have the highest reported rates, as well as the biggest recent jumps of the 15 largest

counties by population. san mateo and san francisco had the highest rates in 2022, and rates in these counties increased by 53% and 24, respectively, compared to 2019. today's hearing comes as governor gavin newsom announced the california highway patrol had significantly upped its efforts this year to crack down on retail theft. >> he says arrests were up by 109% compared to last year. >> some changes coming to google, the company is paying $700 million as part of an antitrust settlement, and as part of that deal, google will have to revamp and revamp its app store. abc seven news reporter suzanne fawn live in the newsroom with a look at the impact of this settlement. suzanne. well, larry, the settlement affects about 102 million android users in the u.s. if you downloaded an app on your droid by using google play, you could get a payment of at least $2. >> now, that's a really small amount, but legal and tech experts say this case has big implications for tech giant google.

>> and i have an android and i use android. >> android users list up. if you use google's play store any time in the past seven years, you could see some money coming your way. it's part of a multi-state lawsuit involving attorney general rob bonta and other attorneys general. bonta says google unlawfully monopolized the market for android app distribution and in-app payment processing. >> they made it very, extremely difficult for consumers to have options for consumers to have, um, options that would reduce price and they essentially effectively maintained a monopoly and gouged consumers and developers in the process, bonta says. >> droid users can expect to get up to $2 each via paypal or venmo. they won't have to submit claims. that doesn't seem like much, but tech experts say the settlement sends a clear message to tech giants. >> the tech companies for the longest time, they don't have any competition. when you are too big, you control the market and you start squeezing more

money from the users without anybody complaining about it. this is a good sign that that the government is doing their job by watching what the big tech is coming and making sure that it's fair for them and it's fair for us as a users. >> the settlement requires google to change its app store practices. google will have to let users choose whether to pay for in-app purchases through its billing system, or through paypal, or a third party platform. google must also simplify the process by which consumers are allowed to install apps. wilson white, google's vp of government affairs and public policy, addressed the settlement in a blog post, saying, quote, android and google play provide choices and opportunities for innovation that other platforms we compete against simply don't. we're pleased to reach an agreement that builds on that foundation, and we look forward to making these improvements that will help evolve. android and google play. a judge still needs to approve the settlement before it's finalized, and just last week, a federal jury in california ruled against google in favor of epic games, the

water supply. abc seven news reporter zach fuentes has more on why experts say the process that gives some people pause is actually safe to say california became the second state in the country after colorado, to approve regulations for recycling wastewater and bringing it through taps at homes, businesses and schools. >> a common analogy has been from toilet to tap, but officials say direct potable reuse, as it's called, is not that simplistic. >> we're getting a lot of headlines right now that imply that, you know, basically wastewater will be served to the public and nothing is further from the truth. kirsten true, with the santa clara valley water district says the decision made by the california water resources control board is historic. this will be some of the cleanest water that will be out there. clean water that will be critical to our water supply. >> though it's been a wet year

in california, struve says the next drought could be just around the corner for more than a decade, experts have been looking to wastewater as a solution. >> the item is adopted. the vote is unanimous. the newly approved rules give agencies like valley water more flexibility for reusing wastewater for drinking water. >> state regulators say reuse it is nothing new. >> reality is that anyone out there on the mississippi river, anyone out there on the colorado river, anywhere out there taking drinking water downstream from a wastewater treatment plant discharge, which i promise you, you're all doing, is already drinking toilet to tap locally. >> the silicon valley advanced water purification center already purifies recycled water, water that's later used on things like landscapes and cooling towers. with the regulations in place, agencies like valley water can add technology to recycle wastewater faster, making it drinkable. the rules state that the technology has to treat the water for all pathogens and viruses. >> the purification process uses smaller and smaller filters and other methods to remove bio logical and chemical contaminants that might be in

the water that some of these filters are there. holes are so small that only a water molecule can pass through, so they it becomes really clean, almost like distilled water. officials are projecting the regulations to be effective, starting april 1st. >> the regulations require that water agencies let customers know before they start recycling the wastewater in the south bay. zach fuentes, abc seven news. we have so many questions about this. >> drink up. yum yum yum yum yum i don't know i'd like to see them use it for something else. so weird situation i'm driving in today and i'm coming in on the bay bridge on the right side of the camera here. it was beautiful sunny blue sky and on the other side it was dark and gloomy, almost like two different worlds. >> it's really funny. spencer. i noticed that earlier today to like patches of blue here and there, not everywhere. >> it's part of that bay area diversity. we have diversity in weather as well, and this is the kind of storm we have right now. you know, we had some steadier rain this morning. the afternoon was relatively quiet. there were dark clouds in some parts of the

sky and blue patches in other parts of the sky. that's exactly what is happening right now. here's a look at live doppler seven. you can see that we have light, widely scattered showers across the bay area right now. not much in the way of any significant precipitation at the moment, but more is on the way as you can see on the satellite radar, composite image, there's a lot of rain building offshore here that's sweeping in our direction, and we're going to have some wet weather overnight and tomorrow morning. right now, though relatively calm conditions, even the wind is generally pretty calm, except for gusts at sfo up to up to 21mph, and we'll probably have some stronger and more widespread gusts going later into the evening. in the late night hours, a 24 hour temperature change shows most locations a few degrees warmer at this hour than at this time yesterday. five degrees warmer in novato and six degrees warmer in napa. nine degrees warmer in concord. so on. we go to a live view showing what we were just describing earlier, what larry was describing. some dark clouds over the bay, over parts of san francisco and some brighter sky off in the distance, 60 degrees in san francisco, right now and

in oakland, mid 60s at hayward and san jose, san mateo, 62 and half moon bay, 59 degrees. another view of the diverse sky conditions looking toward the golden gate from emeryville. it is currently 60 degrees in napa, upper 50s at santa rosa and petaluma, low 60s at fairfield, concord and livermore. and these are our forecast headlines tonight. showers early breezy, becoming gusty at times tomorrow starting in the early morning hours. occasional downpours in fact, those downpours may at times be widespread. and as the weekend approaches, we'll see sunnier skies and some cold mornings coming our way as well. so just get ready to bundle up. and here we go. looking at this current storm on the exclusive abc seven storm impact scale, it's a level one for tonight and tomorrow again. scattered showers becoming a heavy downpours in the morning hours. probably a rather challenging morning commute. gusty wind at times. a chance of thunder. a slight chance of thunder and there could be minor flooding on

the roadways. here's our forecast animation starting at 530 with just those scattered showers we've been talking about in the early evening hours. but later tonight we'll see much more widespread and much more intense rainfall developing. much of it will linger near the coast and the bay before it moves inland later in the day, but everyone will get a taste of this this storm tomorrow for sure, and it will start to wind down late tomorrow night into early thursday morning. rainfall estimates on top of what we already have, another half inch or so in san jose. more than an inch, or to an inch and a half in parts of the north bay, which will be our wettest region. overnight lows will be mainly in the low to mid 50s. highs tomorrow, mainly in the low 60s. and here's the accuweather seven day forecast level one storm tomorrow giving way to drier conditions on thursday. the first day of winter and on friday partly cloudy skies getting a little bit cooler but gets much cooler over the weekend. saturday and sunday under sunny skies, daytime highs will reach only to the 50s mid to upper 50s. so beautiful skies

salvation army says the need in san francisco has reached a new high, with 30% more families asking to be a part of their angel tree program than last year. there are people where, when they submit their income numbers so we can verify that there's a need and we're seeing that expenses are going up and there's the wages aren't keeping with it. >> and so they're having a tough time. people are trying to figure, do i pay my rent? do i pay for food? do i get medicine? do i get toys for my kids? >> and that's a message several organizations and private donors heard loud and clear. many of these toys were bought just a week and a half ago by teens, part of an organization called dig deep sf. they raised nearly $100,000 in one week by asking friends and family to dig deep for donations before taking that money on an early morning shopping spree through target. >> the good news is that this this community has rallied together. >> 8-80 argueta, a single mom of two boys under the age of seven, says this is a program that's made a big difference in her life. >> weekends by the toys. so when

with a look now at her legacy. >> reporter, a trailblazer remembered in washington, d.c. today, former supreme court justice sandra day o'connor memorialized at the national cathedral after she died earlier this month. her casket carried into the cathedral as loved ones and former colleagues gathered, said chief justice roberts. o'connor's son jay, and president biden, all delivering eulogies at her funeral. equal justice under law is a noble act of the noblest aspiration of humankind, and the aspiration of sandra day o'connor, the one that she pursued and her whole life. >> it's hard to be the only woman on the court which i experienced for about ten years or so. >> the arizona native was the first female supreme court justice appointed by president reagan in 1981 and serving for two decades. on the high court before retiring in 2006. she was known for her decisions favoring states in disputes with the federal government and twice

joined the majority to uphold roe versus wade, reaffirming a woman's right to an abortion monday. lying in repose at the supreme court where the public and fellow justices could remember her, she, like countless other women, i will always remember the day sandra was nominated to become the first female supreme court justice. >> sitting in my district attorney's office in new york, i felt the gravity of her nomination. >> o'connor once said that she hoped her tombstone would read here lies a good judge. yesterday, justice sotomayor said it also should remember her as a wife, sister, grandma, mother, all the other aspects of her life in washington. liz landers abc news a major step forward today in the effort to name sfo's international terminal after late california senator dianne feinstein. >> this morning, airport commissioners discussed the nomination and announced they'll vote on the proposal on january 16th. feinstein died in september at the age of 90. in

>> now, despite prior sexual harassment allegations by several employees and a settlement with no admission of wrongdoing, the massage therapist remained employed by solange in calistoga. in calistoga until the client's allegations. >> and we want to warn you this report does involve sexual content and may not be appropriate for children. >> abc7 news i-team reporter melanie woodrow joins us live in the newsroom with more on this one. melanie dion and larry, the calistoga police department tells me there is an open investigation on the spa. >> client says she believes the sexual assault could have been prevented, and she wants to know why the massage therapist wasn't alicia eastwood and her family were regulars at salon as part of the auberge resorts collection in calistoga. >> it was always a place that was very safe. um, prior to this incident, according to her lawsuit, in september, while staying at salon, eastwood says massage therapist elliot ferrer, seen here in a deposition for a prior sexual harassment in the workplace lawsuit, sexually assaulted her during a massage.

it was unreal. i couldn't believe it. i couldn't believe what was happening as detailed in her lawsuit as he was massaging my back. um, i felt like his hands were going too far down onto my bottom. um, when he was stretching me, the top part of my body was exposed. used, and he took my right arm and pulled it back and pulled my shoulder, um, which was face down onto the table, up off the table so that my right breast was exposed. >> and when she turned over, eastwood says, the massage became more uncomfortable to the point of, um, later going to the police. in her lawsuit, eastwood details how ferrer allegedly touched her, and at the very end of working on the right side of my body, he put his hand, um, on top of my, um, on top of my breast, including my nipple, and held it there for a few seconds and then walked around and completed the massage in the

same way. >> on the other side of my body. >> according to her complaint. outside the room, she says ferrer repeatedly offered her his phone number so that he could work on her at her home. when she refused, he demanded my phone number, eastwood says. she told him she was uncomfortable with that and went into the women's locker room. >> it was my body, but i didn't want to be in it, she says. >> she reported the incident to a spa manager, who allegedly said she wouldn't have to pay for the massage. she also says she spoke with the resort manager at the front desk. >> they never asked if i was okay. they never asked if i wanted to file a report, if i wanted to speak to the police. >> she left the resort a day early and filed a police report with calistoga pd. she also filed a civil lawsuit against salon, auberge resorts and elliot ferrer on november 20th by email. a police spokesperson tells the i-team the case is currently in open investigation. quote, once our investigation is complete, the case will be forwarded to the napa county district attorney's office if appropriate. in a letter, the

auberge resorts area vice president sent eastwood. he writes, quote, we have been fully cooperating with the police and their investigation. he also writes that after eastwood's allegations, ferrer was taken off the schedule and is now no longer working at salon. also, that eastwood stay at salon had been fully refunded in a second letter he sent to eastwood, he wrote that ferrer denied all the allegations, but that they did not find his denials credible and found her allegations credible. also that they plan to implement some of her suggestions around crisis response training. eastwood later learned she wasn't the first to report ferrer to salon. in april, four former employees settled a lawsuit with salon with no admission of wrongdoing, accusing ferrer of sexual harassment in the workplace, including allegedly speaking to them in a sexual manner, stalking them, giving them gifts and unwelcomed hugs, and getting angry when his advances were rebuffed. leila miller was one of the four former salon employees who claims ferrer sexually harassed her. >> i think it gradually just got more uncomfortable for me when he would go to hug me and i would pull away or be

uncomfortable, he would. he would get visibly angry with me. >> and its answer to the complaint salon denied all allegations, as did ferrer in his deposition. despite the settlement, which included no admission of wrongdoing, salon did not fire ferrer. eastwood believes her sexual assault could have been prevented. i will live with this, you know, and so and it didn't have to happen. >> they knew what type of person that he was, and we told them. all of us told them how he was and they didn't listen. they had the opportunity to fire him and they continued to let him work there. >> attorney john weiner represents the four former employees and is also now representing alicia eastwood. >> alicia's case to me, represents, um, a company not taking responsible. um for what it needed to do. he just goes on his merry way. according to the california massage therapy council, ferrer's license expired in may of 2022.

>> in october, ferrer started working at health spa napa valley, but was let go this month, helped by napa valley tells the i-team there was no incident or complaint involving ferrer while he worked there, but that after learning about eastwood's allegations, he is no longer employed by health spa napa valley. the i-team's attempts to reach ferrer went unanswered. auberge resorts, the attorney and pr company representing them, have not yet responded to our emails or phone calls requesting a comment. eastwood says she's sharing her story out of concerns for others. >> i don't want this to happen to anybody else. >> and since her settled lawsuit, the other woman i interviewed, laila muller, says she is no longer a massage therapist. she decided instead to become a nurse in the newsroom for the i-team. melanie woodrow abc seven news story. >> i'm sure we'll continue to follow. >> yeah. thank you. melanie if you have a story for melanie and the i-team, you can call 188840 i-team or just go to abc7 news.com slash i-team.

have been evacuated, escaping the flowing lava. you can see it right there. abc news reporter marcus moore with all the details. >> after weeks of warning, the volcano in southwest iceland exploding, turning the sky bright orange, the glow from lava visible for miles even from the center of the capital, reykjavik, and not far from a power plant, watch as fiery fountains of lava flow high in the sky. magma or semi molten rock spewing along the ridge of a hill and across the volcanic hotspot. they tend to be gas rich and that causes them to shoot way up in the atmosphere and give the spectacular fire fountains. these photos show the earth's crust cracking open, exposing the glowing red ash rocks and dangerous volcanic

matter below. just last month, numerous cracks opening up in roads, steam pouring out of the ground as seismic activity intensified in the southwestern part of the country. the eruption occurring on iceland's reykjanes peninsula, less than two miles from the town of grindavik, which is about a half hour drive from the country's main airport, and just ten minutes from the famous blue lagoon, one of iceland's biggest tourist attractions. local authorities are on high alert, evacuating nearly 4000 residents of the small fishing town amid fears of a significant outbreak. while no flights have been canceled yet, holiday travelers fear widespread disruptions because of previous volcanic eruptions like this one back in 2010, which crippled air travel for days. >> wow. really dramatic pictures. yeah, and i was just going to say, if i'm in that town, i don't know how long i. yeah, exactly. pour out. yeah. we are out. >> yeah. and in comparison, i mean our weather situation downright calm. >> yeah. >> absolutely. level one stuff. yeah

>> this level one stuff i like that it is a level one. for now. let's take a look at live doppler seven. you can see that the weather is pretty quiet at the moment. but we expect things to activate later tonight. so let's take a look at the wider image here. the satellite radar composite image. you can see the storm that's brewing offshore right now that will be sweeping in later tonight and overnight bringing us another round of steady and more intense rainfall. nonetheless, this storm ranks level one on the exclusive abc seven storm impact scale tonight. mainly showers early tomorrow morning, sometime after midnight through the morning commute. we expect some downpours with gusty wind at times and the chance of some thunder tomorrow as well. here's the forecast animation starting at 530. just a few minutes from now uh- then it will see later tonight, the showers becoming more widespread than that. that ban of steadier rain starts to sweep in just after midnight, and that's going to produce some pretty heavy downpours, especially near the coastline and the bay. and then around midday or so, we expect it to work its way to other parts of
