now, rainfall will intensify as we head towards tomorrow. we're going to get you into street level radars. san rafael marinwood highway 101. as you will notice, heading into novato south nato boulevard, we are seeing the steady lightrillionain. we are also seeing some showers right around the south bay and san jose west heading street park. more moderate rain there and as we widen the picture here, coastal flood advisory begins at 3 a.m. tomorrow, runs until 7 a.m. low lying areas could see flooding. here's why the rain is coming in a peak. high tide is expected to be almost close to six feet there in san francio. so just before 6 a.m. and so the combination of the two will lead to that flooding. so keep that in mind while those showers remain spotty and pretty much light to moderate in nature, the rainfall will pick up as we head towards the morning commute. 5 a.m. tomorrow, you will notice the coast is getting hit hard with some heavy rain. at times. there may be some thunder as well and that continues off and on through the afternoon and the evening hours. the winds are

also going to pick up while it is breezy right now, it gets gustier by midnight. we're looking at about 35 to 40 mile an hour winds, so keep that in mind in case you do have decorations that need to be secured. it's a light level one storm tonight through early thursday. brief heavy rain, gusty winds, thunder chance and minor flooding on the roadways. the potential is there for those small streams and creeks as they are rising rapidly as we head towards tomorrow. ama all right, thank you sandhya. >> we'll check back with you. despite the storm, few power outages in the bay area are shown right now. this is a look at p-g-and-e's map of current outages. you can see a lot of green there, so it's not too bad. it is snowing up in the sierra and chains are required right now on highway 50 between twin bridges and myers. this is from earlier in the day. you can see they were checking vehicles. their chain controls on 8-80 were dropped this afternoon. >> and in san francisco, cleanup is underway from the past two days of downpours. abc seven news reporter luz pena looks at how the city is gearing up to respond to even more rain.

>> today. san francisco woke up to the aftermath of the latest rainfall with at least 20 potholes surfacing, clogged storm drains and multiple floods throughout the city. >> we had about a dozen spots mid midday yesterday, a larger one near civic center on franklin and golden gate ahead of more days of rain. >> the city continues to distribute sandbags at least 400 have been given out on valencia street. flooded storm drains led to water coming inches from storefronts, linda yee said it was like a river from my window. >> i could see the flow of the water, the rain going that way and the leaves are on there and it was really moving. >> and on 18th and folsom streets, many of these businesses have layers of water barriers with sandbags outside of many of these stores, and then also metal and wooden panels blocking the storefronts. and none of this works. many of these businesses also have sandbags inside.

>> it's a low lying area, so the public utilities commission for san francisco puts out flood barriers. >> larry russo was ready with sandbags as we're always used to the water coming down from the twin peaks area. >> we always put out the sandbags, bags and, you know, we're lucky. >> uh- yesterday, others were not as lucky. raul escobar was on the phone with his insurance company while public works employees worked around his car. so what happened today? the tree fell on top of my truck. >> so talk to myself. >> well, i won't be able to move my car now. a trabajar ahorita and i can't go back to work. the city's department of emergency services says they're ready. >> we have held a coordination call earlier today because we received a very thorough briefing from the national weather service on what to expect in terms of duration of the next storm and intensity of the next storm in the meantime, residents and businesses in low areas are continuing to add more

people of solano county want to see in a new city, according to the online results, 80% of people supported the idea of new, good paying local jobs and safe, walkable neighborhoods, as well as protecting the suisun marsh and delta. whereas 60% of people express strong support for renewable energy and the plans to build one of the largest solar farms in california, residents liked energy efficient homes with no p-g-and-e's bills. when did you first reach out to travis air force base? >> um, after we've announced basically immediately after we announced the plans publicly, schrameck told the i-team in september he did not notify travis air force base of his plans beforehand, but this week, he says the survey results give him confidence this new city can draw on the connections to the military base by creating jobs that will support the base and keep people in california, he says. >> there's high demand for new jobs in advanced manufacturing, and so it's defense, aerospace, advanced manufacture. >> it's kind of, um, mix of all the new economy jobs that people

really want to see here. and we think we can actually bring them more than 78% of online respondents want to see major infrastructure improvements made to highway 12. >> that's often referred as blood alley, as well as upgrades to the local water supply. schrameck says he has enough water rights to support the city from both the aquifer and the sacramento river, but the solano county water agency disagrees. a brand new city of up to 100,000 residents. >> that's a significant amount of water that doesn't currently exist. >> the water rights in california, and especially in solano county, they're already accounted for. >> california forever has hosted a number of recent town halls, where residents have voiced many of these concerns, including a simple yet common one. how will this all work? >> well, my. will my kids be able to walk to school? what does it mean? does it mean i can walk to the office? schrameck says those questions will be answered when the plans are finalized and released in mid january. >> in the meantime, he says, the survey shows a great deal of excitement among small business owners and young people who are

struggling to buy a home. among online respondents, more than 76% of people say affordable homes and family friendly parks and recreation areas are most important to them. but some city officials say there's concerns over zoning restrictions. >> i think that if zoning were not an issue for them, they would have gone the traditional route of creating a city, which is through lafco. but instead they've hired the most expensive , the most prestigious teams throughout the state. many of them close to big name politicians like governor newsom . >> but all of this has to make it on the ballot first. and schrameck says the percent of people still undecided. >> it's a it's a substantial number. >> now, if that ballot measure passes, schrameck says, this new city will be much farther away from travis air force base than current developments in suisun city and fairfield and depending on how this all plays out, there could even be a huge green belt that separates this new city from the surrounding cities. about 60% of people supported

despite prior sexual harassment allegations by several employees and a settlement with no admission of wrongdoing by the massage therapist remained employed by solange in calistoga until the client's allegations. >> right before we go, any further, let's warn you here. this report does involve sexual content and may not be appropriate for children. >> abc7 news i-team reporter melanie woodrow is live in the newsroom. melanie ama and dan, the calistoga police department, tells me there's an open investigation. >> the spa client says she believes the sexual assault could have been prevented, and she wants to know why the massage therapist wasn't fired sooner. alicia eastwood and her family were regulars at salon part of the auberge resorts collection in calistoga. >> it was always a place that was very safe. um, prior to this incident, according to her lawsuit, in september, while staying at salon, eastwood says massage therapist elliot ferrer, seen here in a deposition for a

prior sexual harassment in the workplace lawsuit, sexually assaulted her during a massage. it was unreal. i couldn't believe it. i couldn't believe what was happening. >> as detailed in her lawsuit as he was massaging my back, um, i felt like his hands were going too far down onto my bottom. >> um, when he was stretching me , the top part of my body was exposed, and. and he took my right arm and pulled it back and pulled my shoulder, um, which was face down onto the table, up off the table so that my right breast was exposed. >> and once she turned over, eastwood says, the massage became more uncomfortable to the point of, um, later going to the police. in her lawsuit, eastwood details how ferrer allegedly touched her, and at the very end of working on the right side of my body, he put his hand, um, on top of my, um, on top of my breast, including my nipple, and held it there for a few seconds and then. walked around and

completed the massage in the same way. >> on the other side of my body. >> according to her complaint. outside the room, she says ferrer repeatedly offered her his phone number so that he could work on her at her home. when she refused, he demanded my phone number. eastwood says she told him she was uncomfortable with that and went into the women's locker room. >> it was my body, but i didn't want to be in it, she says. >> she reported the incident to a spa manager, who allegedly said she wouldn't have to pay for the massage. she also says she spoke with the resort manager at the front desk. >> they never asked if i was okay. they never asked if i wanted to file a report, if i wanted to speak to the police. >> she left the resort a day early and filed a police report with calistoga pd. she also filed a civil lawsuit against salon, auberge resorts and elliot ferrer on november 20th by email. a police spokesperson tells the i-team the case is currently in open investigation. quote once our investigation is complete, the case will be forwarded to the napa county

district attorney's office if appropriate. in a letter, the auberge resorts area vice president sent eastwood. he writes, quote, we have been fully cooperating with the police and their investigation. he also writes that after eastwood's allegations, ferrer was taken off the schedule and is now no longer working at salon. also, that eastwood stay at salon had been fully refunded in a second letter he sent to eastwood, he wrote that ferrer denied all the allegations, but that they did not find his denials credible and found her allegations credible. also that they plan to implement some of her suggestions around crisis response training. eastwood later learned she wasn't the first to report ferrer to salon. in april, four former employees settled a lawsuit with salon with no admission of wrongdoing, accusing ferrer of sexual harassment in the workplace, including allegedly speaking to them in a sexual manner, stalking them, giving them gifts and unwelcomed hugs, and getting angry when his advances were rebuffed. leila miller was one of the four former salon employees who claims ferrer sexually harassed her. >> i think it gradually just got more uncomfortable for me when

he would go to hug me and i would pull away or be uncomfortable. he would. he would get visibly angry with me. >> and its answer to the complaint salon denied all allegations, as did ferrer in his deposition. despite the settlement, which included no admission of wrongdoing, salon did not fire ferrer. eastwood believes her sexual assault could have been prevented. i will live with this, you know, and. so and it didn't have to happen. >> they knew what type of person that he was, and we told them. all of us told them how he was and they didn't listen. they had the opportunity to fire him and they continued to let him work there. >> attorney john weiner represents the four former employees and is also now representing alicia eastwood. >> alicia's case to me, represents, um, a company not taking responsible plea. um for what it needed to do. he just goes on his merry way. according to the california massage

therapy council, ferrer's license expired in may of 2022. >> in october, ferrer started working at health spa napa valley, but was let go this month, helped by napa valley tells the i-team there was no incident or complaint involving ferrer while he worked there, but that after learning about eastwood's allegations, he is no longer employed by health spa napa valley. the i-team's attempts to reach ferrer went unanswered, and salon auberge resorts, the attorney and pr company representing them, have not yet responded to our emails or phone calls requesting a comment. eastwood says she's sharing her story out of concerns for others. >> i don't want this to happen to anybody else. >> since. her settled lawsuit, the other woman i interviewed, lee eileen muller, is no longer working as a massage therapist. she decided to become a nurse in the newsroom for the i-team. melanie woodrow abc seven news. all right, melanie, thank you very much. >> well, we got a little bit of a break from the rain today. >> it was nice to see. oh, i did see a rainbow. >> oh. you did? no kidding.

that's always nice. we had snow in the sierra some rain here. let's talk to a meteorologist, sandyha patel. with what we can expect going forward, we're going to see a lot more of the rain, that's for sure. >> especially near the coastline. >> dan and anna and more snow coming to the sierra. >> although it has been mixing in with rain. let me show you live doppler seven and we'll talk about what is happening so right now we just have some really spotty lightrillionain, but just northeast of rio vista, we have seen a few thunderstorms developing. they have issued a flood advisory for parts of solano county, and that is until about 915 tonight. as the heavy rain in that vicinity could lead to some flooding issues. so keep that in mind right around the north bay. woodacre lagunitas, fairfax, san anselmo. we're seeing some spotty lightrillioneturns and in the south bay lightrillionain falling right now in san jose, where it is 61 degrees. i mean, really mild. this is a mild storm. as of right now. we're looking at that warm air still 8-80 heading into center roads still dealing with those showers. so let's widen the picture here. over the last 12

hours we've seen snow falling in the sierra as low as 7000ft. by the way, right now, state route four and 88 are requiring chains . thunderstorms have been firing up, not here in the bay area, but to our northeast right now. as you can see. but really, it has been a wet weather maker for much of california, and southern california is getting hit next as we head towards the next couple of days. rainfall since sunday. these totals are quite impressive over 4.4.9 four inches to be precise. in ben lomond, almost five inches of rain and we're still counting kentfield close to three over three in santa rosa, 1.84 in san francisco, exactly an inch in oakland. napa nearing two inches. you'll notice livermore concord over an inch of rain. san jose 9/10 9000/300 in redwood city. so looking good. we need more rain and it's coming, but it's not going to come in an intense matter in tomorrow. so the flooding is a concern. low 60s from san francisco to oakland hayward 61, san jose, 57, and half moon bay

heading down towards southern california. now, at noontime, some of this starts to move inland a little bit. look what happens in the evening, late afternoon evening commute could be dicey as well, as we see some more periods of heavy rain. and this continues through the early part of thursday. before this system winds down. there's thursday, 9 a.m. we still have wraparound moisture coming right back into the bay area. so rainfall estimates the numbers have gone down a bit, but the coastal areas i think are going to pick up 1 to 2in. for the rest of you, you're looking at lower totals, your morning temperatures 40s and 50 soquel's. don't leave home without your rain gear and give yourself that extra time. you are going to need it tomorrow afternoon. you're looking at 50s and 60s with still the wet weather around. and here's a look at the accuweather seven day forecast. it's a one for tomorrow downpours at times. thunderstorm possibility early thursday morning. showers winter arrives at 727 thursday evening. and let me tell you, we're going to notice it. not so much.

are still standing at this time, virginia nishida says there are now concerns that the current alameda county district attorney, pamela price, may drop the special. circumstance some enhancements. which could have kept the suspects locked up for life. >> but she says those charges still haven't officially been submitted through the court system. >> so that's what i'm worried about, that they're not being held accountable and they need to be, especially for murder. >> monday evening, da price issued a statement ahead of tuesday's hearing saying that two of the suspects should mitchell and herschel hale, will both be charged with first degree murder, plus arming enhancements they face 25 years to life. these are very serious charges, and they reflect my office's commitment to punishing those who come to alameda county to inflict harm on people in our community, da price said. but it did not address if the initial enhancements are being dropped. >> getting rid of the special circumstances, getting rid of the enhancements will enable

them to be out on the streets sooner. um at the end of, you know, their sentencing, you know, and that's where the safety issue comes in at some suggest that there may be changes to the charges because the third suspect, lauren gilbert, may be the man who actually shot nishida. >> da price says gilbert is still at large. in an email to abc seven news, the alameda county public defender's office, which represents mitchell, says it. supports dropping enhancements since they say mitchell did not pull the trigger and it blames the oakland police department for errors in the case. investigators including oakland police detective john tran, tried to cover up their incompetence by skewing the case to make it seem like our client was the shooter, writes alameda county public defender brendan woods. >> where i'm hanging in here and i'll be here at every court date in dublin, anser hassan abc seven news new developments the vallejo police officer who shot and killed sean monterrosa will not face criminal charges. >> a state department of justice

report released today finds there's insufficient evidence to prove beyond a reasonable doubt that officer jared tan did not act in self defense. tan fired a shot from the back seat of an unmarked police car, killing monterrosa. in 2020, the monterrosa family learned of the doj's decision today during a meeting with attorney general rob bonta. >> it is extremely disappointing that they've decided not to move forward with criminal charges. we believe that there is more than sufficient evidence, uh, not only in our civil case that runs along parallel lines, but enough evidence to bring criminal charges against jared tan and, uh, we're looking forward, uh, to do a review at the federal level. >> officer tan was terminated in 2021, only to be reinstated in august of this year. the san francisco police department and its commanders are being hit with a class action. >> federal lawsuit after arrests were made at a skateboarding event last summer, attorneys for the 113 people arrested or cited during july's dolores hill skate bomb claim officers corralled

and trapped attendees without giving them notice, warning of any kind or an opportunity to disperse. s 83 of those detained were juveniles. >> i had guns pointed in my face simply for trying to walk home. i was kept on the street until two in the morning, only to be walked to a police station a block away by the department claims bottles and fireworks were thrown at officers, muni busses and city vehicles were vandalized. >> chief bill scott says the department deployed in advance and barricaded streets following major injuries, and even one death in years past >> smash and grab burglars made a mess of things at two oakland businesses today. the burglars used an suv to ram through the front of this lululemon store on broadway at 25th street around seven this morning. it had major damage. as you see, the front door was crushed. employees say the robbers got away with a lot of legs. was also hit. today, benner automotive around the corner on 25th street. i went on my inside camera.

the volcanic activity could last weeks, maybe even months. jessica ball, a volcanologist with the usgs california volcano observatory, talked with us at 3 p.m. for a program getting answers about why this eruption differs from a series of volcanic events here in 2010. what you had there was gassy magma, but the magma itself was to sticky to flow like this. >> so instead of flowing, it exploded out of the volcano and created all of that ash here. what you're seeing is actually, um, gas escaping the magma much more easily. and so because it's able to do that, you get lava flows instead of lava explosions . >> less pressure evidently. well, today, the lava flow diminished to one quarter its original size from just yesterday. well how do you feel about drinking tap water? >> that used to be waste water. a historic decision was made today that could bolster the state's water supply. abc seven news reporter zach fuentes has more on why experts say the

process that gives some people pause is actually safe. >> tuesday, california became the second state in the country after colorado, to approve regulations for recycling. wastewater and bringing it through taps at homes, businesses and schools. a common analogy has been from toilet to tap, but officials say direct potable reuse, as it's called, is not that simplistic. >> we're getting a lot of headlines right now that imply that, you know, basically wastewater will be served to the public and nothing is further from the truth. >> kirsten, true, with the santa clara valley water district says the decision made by the california water resources control board is historic. >> this will be some of the cleanest water that will be out there, clean water that will be critical to our water supply. >> though it's been a wet year in california, struve says the next drought could be just around the corner. for more than a decade, experts have been looking to wastewater as a solution. the item is adopted. >> the vote is unanimous. >> the newly approved rules give agencies like valley water more flexibility for reusing wastewater for drinking water. state regulators say reusing it is nothing new. >> reality is that anyone out

there on the mississippi river, anyone out there on the colorado river, anywhere out there taking drinking water downstream from a wastewater treatment plant discharge, which i promise you you're all doing, is already drinking toilet to tap locally. >> the silicon valley advanced water purification center already purifies recycled water. water that's later used on things like landscapes and cooling towers. with the regulations in place, agencies like valley water can add technology to recycle wastewater faster, making it drinkable. the rules state that the technology has to treat the water for all pathogens and viruses. >> the purification process uses smaller and smaller filters and other methods to remove biological and chemical contaminants that might be in the water that some of these filters are there. holes are so small that only a water molecule can pass through, so they it becomes really clean, almost like distilled water. >> officials are projecting the regulations to be effective starting april first. the regulations require that water agencies let customers know

going up from san luis obispo, heading down towards southern california. if you're traveling, winter storm warning from tioga pass, moving southward into the southern sierra until thursday morning. so these could be some travel issues. area of low pressure off the coastline is going to slide parallel to the coast. here's a quick animation. that's why we're going to get the rainfall. the coast will have the heaviest rain tomorrow. and then tomorrow really going through friday is when southern california is getting hit with that heavy rain. they're looking at anywhere from 4 to 8in, possibly more level one system for us. so tomorrow morning at 530, you're going to see those downpours, especially near the coast. and then by 1230 starting to shift inland. moderate to heavy rain at times. at 230 in the afternoon, chance of thunder. those showers are going to continue well into the evening and linger into thursday. so umbrellas extra time to get you where you need to go tomorrow afternoon. 50s. 60s. here's a look at that accuweather seven day forecast. it's a level one for tomorrow. a
