southern california. so we're getting scraped by some of these outer bands. this morning. it's a level one storm with the biggest impact standing water on our roadways and really seeing the coast taking the brunt of the highestrillionainfall. today, as you move away from the coast, we do expect those totals to drop down significantly. but today we're in and out of the showers. in the downpours, take the umbrella with you. temperatures in the upper 50s to the lower 60s. after today, drier weather moves in. we'll show you that coming up in a few minutes, but let's check in with sue and see how we're doing with this wet wednesday commute. >> it is wet and standing water. andrew, it's interesting. maybe not surprising, but you can kind of follow the rain where all the accidents are. so 580 is really getting hit right now. you can see the macarthur maze 580 through here has been cleared out. we had an earlier accident, 580 at san ramon valley boulevard at lakeshore. there's just lots of standing water and solo spinouts. yes. >> thank you. sue and as sue has been telling us, it's already been a challenging morning for some people trying to get to the

bay bridge toll plaza. that's where we find abc seven news reporter lena howland. lena you have seen some pretty hard rain over the past hour. >> yeah, that's right, reggie and drivers heading into san francisco this week really cannot catch a break from all of that rain. we have been experiencing this rain coming down hard on us for about an hour and a half now. non stop. and it's definitely caused quite a slowdown at the bay bridge toll plaza with very slow moving traffic heading into the city. i want to go now to some new video taken earlier this morning showing all of that rain hitting the roads in the north bay. it also we also saw a rockslide near highway 116 in monterey, rio and some fast moving runoff and flooding right in front of the monte rio fire station on main street over in san francisco, the city's public works department reported at least 20 new potholes surfacing clogged storm drains and multiple floods throughout the city from monday night storm. while that cleanup is really

just beginning, they're gearing up for even more rain, handing out at least 400 sandbags on valencia street. flooded storm drains led to water coming just inches from storefronts. >> from my window, i could see the flow of the water. the rain going that way, and the leaves are on there and it was really moving. over on 18th a streets. >> many businesses put together layers of water barriers with sandbags outside of their stores and metal or wooden panels blocking the storefronts. if none of that works, many businesses say they also have sandbags ready to go inside. so if you do run into some of this rain on your morning commute today, or if you're headed to the airport for your holiday travels, just to remember to give yourself some extra time before heading out the door this morning, make sure those headlights are on and give yourself some extra following distance between you and the car in front of you. live at the bay bridge toll plaza. lena howland

abc seven news. >> thanks, lena. don't forget you can check out the abc seven bay area app for the latest on weather conditions and to access live doppler seven. the same radar that our meteorologists, including drew, use. search abc seven, bay area and your device's app store to download it. >> the city of san francisco and police chief bill scott are facing a class action lawsuit over the unpermitted dolores hill bomb that summer event sparked a clash between skateboarders and police. at least 113 people, including many teenagers, were arrested. people involved with the lawsuit believe police should not have been there in the first place. they say the city's park and rec department should have helped to make this a sanctioned event. >> in terms of the few kids that might have thrown things, the police had no reason to believe that any of the young people that they actually arrested had done those things, and so that's why the arrests were a civil rights violation. >> some parents of teens who've

not been charged want the arrest off of their record. the city attorney says he will review the complaint and respond in court. >> it's been six months since governor newsom announced increased efforts to shut down open air drug markets in san francisco's tenderloin, and this morning, we're getting an update. the city says nearly 700 people have been arrested for drug sales, nearly 800 arrested for public drug use. more than 420 wanted fugitives have been arrested in the tenderloin and south of market, and 148 kilos of narcotic, including more than 80 kilos of fentanyl, have been seized. so far, 752 people have died of an accidental drug overdose in the city this year. that is the most overdoses the city has ever seen. >> two oakland businesses are cleaning up after a smash and grab. burglars made a mess of their shops. the burglars used an suv to ram through the front of the lululemon store on

broadway and 25th yesterday morning, and you can see the front door completely smashed in. employees say the robbers got away with a lot of leggings. binner automotive was also targeted. that's right around the corner on 25th street. i went on my inside camera. >> it showed one guy coming in, one guy crawling out. uh they destroyed both of my doors. that's probably $4,000 right there. they didn't take one thing inside. they opened the filing cabinets and the desks. there's nothing in there. our tool boxes are all locked. >> mike benner says he's owned the shop for 58 years. and this is the third time in the last three months that someone has tried to break in. >> license plate readers are coming to emeryville after the lengthy discussion last night, the city council approved a plan to spend $50,000 on a 16 camera system during public comment. there was overwhelming support for it. the only debate was how many cameras should be installed. city officials plan to use the cameras to identify to track down people who commit

retail theft or car burglaries. police say the suspects often come from other cities. >> the state's new assembly committee focused on retail theft and possible solutions, held its first hearing in sacramento yesterday. lawmakers mainly focused on data from researchers there have been reports recently debating some of the stats and their accuracy shot lifting was one of the crimes addressed. >> we see that in the bay area, we have the highest reported rates, as well as the biggest recent jumps of the 15 largest counties by population in san mateo and san francisco had the highest rates in 2022, and rates in these counties increased by 53% and 24, respectively, compared to 2019. >> yesterday's hearing comes as governor newsom announced the california highway patrol had significant upped its efforts this year to crack down on retail theft. he says arrests were up 109% compared with last year. this morning, we want to take a moment to send thoughts to our colleagues at our sister

that we're watching very closely for bands of heavy rain. here's live doppler seven. over the last hour, you can see the heaviest rain is mainly confined to the coastline. you move away from the coast and the rain becomes a lot lighter in fact, some areas in the inland east bay are waking up to dry conditions this morning, so location is key as to how wet you are starting your day. the coast are watching in very closely this morning for the highest rainfall totals. we'll start to dry out later on this afternoon, but around the bay

with plans to reform its department of family and children's services, comes after the death of phenix castro. she died back in may at just 13 weeks old, after authorities say that she ingested meth and fentanyl after her death, the county admitted to our media partners at the bay area news group that they had contact with the girl's family numerous times , including some contact over safety concerns for her older siblings. the children were not removed from the home during a special meeting yesterday, the county board of supervisors questioned if current practices need to be changed. >> i think the emphasis has been on keeping the family together and while i think that's really important, i think it's also important to keep our children safe at the end of this four hour meeting, the board unanimously passed a motion to begin reforming dfcs and east oakland nonprofit is trying to

raise $50 million to reinvest in the community. >> the rise east initiative is planning to use that money to help. formerly incarcerated people settle back home. if they do raise the $50 million blue meridian partners, which is a national philanthropic group, is going to match it. antonio jones is one of the people benefiting from the programs he helps to make soap at roots community health center. at 34 years old, this is his first 9 to 5 job. >> not only do i have a job, but i also have other supported resources that i need to, um, you know, just to better myself in other areas until we have raised the full 50, we cannot unlock that $50 million match rise east has already raised $26 million. >> that money will expand and create new programs like the ones helping jones and anyone can contribute. >> recycled wastewater could be coming to your faucet. california is now the second state to approve regulated plans for recycling wastewater and bringing it through taps at homes, businesses, schools.

locally, the silicon valley advanced purification center already purifies recycled water. the water is later used for landscaping and cooling towers. with the new regulations in place, agencies like valley water can add technology to recycle wastewater faster, make it drinkable. the rules state the tech has to treat the wastewater for all pathogens and viruses. >> as we're getting a lot of headlines right now that imply that, you know, basically wastewater will be served to the public and nothing is further from the truth. this will be some of the cleanest water that will be out there. >> officials are projecting the regulations will be effective by april 1st. water agencies will have to let customers know before they start recycling the wastewater. >> a vietnam veteran and texas is on a mission to spread love at a local hospital. he's found a new calling later in life as a volunteer baby cuddler. 80 year old lynn harris helps two days a week at saint davis medical

showers we are tracking. so as you head westbound on the san mateo bridge, you're encountering some heavier downpour doors in the south bay. right now, it's lightrillionain falling from santa clara to san jose. willow glen, little heavier around alum rock in the east foothills. as we head into the city, parts of marin county, parts of the east bay. it's light to moderate showers this morning, but location just a short distance can really change what kind of weather you're seeing as you move inland towards concord. antioch discovery bay just some light mist, if not mostly cloudy conditions. it's the coastline that is really going to take the brunt of these showers throughout the day. winds are picking up a bit. we're gusting to about 30 in hayward, 22 in san mateo, 17 in half moon bay and temperatures are cooler than yesterday. we're mainly in the 50s as we go throughout our wednesday. here's future weather scattered showers and downpours continue this morning. we may get a brief break in the middle part of our day and a lot of areas, but then we'll see some more downpours likely to develop across parts of the east bay and the north bay later on this

bridge toll plaza. lena howland abc seven news. >> thank you. lena the widow of a murdered security guard, will have to wait until after the new year to get a better understanding of the charges against the suspects in the case. a retired police officer, kevin nishida, was working as a guard for a local tv news crew when he was shot two years ago in downtown oakland, and he died a few days later. virginia nishida was at the hall of justice in dublin for a hearing yesterday morning. she is concerned embattled district attorney pamela price may drop the special circumstance and some enhancements which could have kept the suspects locked up for life. getting rid of the special circumstances or getting rid of the enhancements will enable them to be out on the streets sooner. >> for um, at the end of, you know, their sentencing, you know, and that's where the safety issue comes in at. some suggests there may be changes to the charges because a third suspect, loren gilbert, may be the man who actually shot nishida de price says he still

has not been found. >> virginia nishida says the case will be back in court january 3rd. >> the vallejo police officer who shot and killed sean monterrosa will not face criminal charges, a state department of justice report finds. there's insufficient evidence to prove beyond a reasonable doubt that officer jarrett tonn did not act in self-defense. tonn fired a shot from the back seat of an unmarked police car, killing monterrosa. in 2020, the monterrosa family learned of the doj's decision during a meeting with attorney general rob bonta. >> it is extremely disappointing that they've decided not to move forward with criminal charges. we believe that there is more than sufficient evidence. uh, not only in our civil case that runs along parallel lines, but that enough evidence to bring criminal charges against jared tonn and, uh, we're looking forward, uh, to a review at the federal level. >> officer tom was terminated in 2021, but was then re instated in august of this year. >> this morning, donald trump is

vowing to appeal a ruling by colorado's supreme court blocking him from the state's primary ballot. it's because of his alleged role in the january six insurrection. abc news reporter justin finch explains the trump campaign is slamming the decision as completely flawed. >> this morning, the trump campaign fighting an historic decision the colorado supreme courtrillionuling, the u.s. constitution insurrection clause bars the former president from appearing on the state's ballot. >> they want to silence me because i will never let them silence you. and in the end, they're not after me. they're after you. >> the republican front runner at an iowa rally. not mentioning the ruling trump has already faced 14th amendment lawsuits in several other states. this is the first time he's lost and also the first time the 14th amendment has been used to disqualify a presidential candidate. that clause bars the candidate from holding office if they took an oath to support the

constitution, but then engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. the lower court in colorado, finding trump engaged in an insurrection, but stopped short of applying the clause's definition of a u.s. officer to the president of the united states. in a 4 to 3 decision, the colorado supreme court, reversing that decision, one of the three dissenting justices writing the majority opinion flies in the face of the due process doctrine. the trump campaign saying it's appealing the decision to the u.s. supreme court, but the high court's ruling may not have a nationwide impact. >> the thing to keep in mind is, even if the court sets a standard on what the definition is of an insurrection and whether the president is an officer, that wouldn't necessarily affect all of the states, because each state has different laws for how you get on the ballot. >> the republican national committee plans to help with trump's legal fees, calling the

exhaustion. this comes after a series of near crashes involving commercial flights on or near runways. in a report last month, short staffed air traffic control towers. that was one of the biggest issues the faa is facing a shortage of more than 3000 controllers. the head of the controllers union said. the agency's hiring efforts only produce six new controllers in the past year, doctors across the country are warning about a shortage of several important drugs, including life saving cancer medications. >> the fda is drug shortage list includes those that treat lymphoma, lymphoma and leukemia, experts testified at a senate hearing yesterday. they are blaming the shortages, at least in part, on the low cost of generic drugs because, they say insurance companies often only pay for these cheaper versions. >> a vial of sterile injectable medicine typically cost less than this cup of coffee that i bought downstairs this morning, so this reduces the incentive of

manufacturers to invest in quality or in newer manufacturing facilities as the american medical association is urging the government to consider manufacturing some drugs itself to alleviate some of these shortages. >> a new covid 19 variant is the fastest growing strain of the virus. the cdc says. gen one is causing about 20% of new infections across the country. the agency says the spread of the variant more than doubled between late november and mid december. experts say there is no evidence gen one causes any more severe disease, as existing tests vaccine and treatments are all expected to work. >> we're learning more this morning about the implications of that huge $700 billion settlement announced by google. we told you yesterday android users could get at least $2 each as a part of the agreement, google was sued by states including california, accusing the company of operating its app store as an illegal monopoly. $2 really doesn't seem like that

reportedly still be on the jersey of the san francisco giants, according to the examiner. a giant spokesperson says the team's partnership with cruise through 2025 has not changed. cruise has hit a tumultuous stretch after one of its cars dragged a woman in san francisco who had just been hit by another nearby car. it's led to the company's permits being pulled by the state, mass layoffs and a full recall of the vehicles. that cruise patch is the giants first corporate logo on a home jersey. in the team's 140 year history. >> we could soon see turquoise lights on some vehicles. >> mercedes-benz is the first car company to get approval to use these blue lights. they indicate when a car is in self-driving mode. this is called the drive pilot system. it'll be available on certain mercedes models in california and in nevada, starting early next year. >> it's our morning money report. santa clara based intel is planning to lay off 235 employees at the end of the year. those affected work at the company's research and
