americans are getting an early jump start on their holiday travel as well. the weather isn't making it any easier. we're tracking a new storm in the west, flooding threat in the east. rob marciano is in wayne, new jersey, where they've already got hit hard. >> we begin with what you need to know about the holiday rush, as travel could reach record levels, especially in the air. our transportation correspondent gio benitez is at newark airport with much more. good morning, gio. >> reporter: robin, good morning. yeah, we've been saying this holiday travel period is expected to be the busiest ever. boy are we seeing that play out right here at newark liberty international airport. countless people checking their bags to get out. this morning the mad dash for the holidays is officially under way. the faa bracing for more than 47,000 planes to take to the skies today and nearly 49,000 tomorrow on what's expected to be the busiest travel day of the holiday season. >> we are preparing for a busy holiday travel season.

our safety teams will work around the clock so passengers are safe from takeoff to touchdown. >> reporter: that bad weather leading to a bumpy start with more than 10,000 flights delayed and hundreds cancelled this week. >> actually got delayed yesterday, missed my connection flight. >> reporter: the transportation secretary saying he's working closely with airlines to plan around further disruptions. >> we get down to the minute weather predictions from national weather service meteorologists. the big thing airlines need to control is how resilient the system is to that weather. >> reporter: the faa also opening up military air space along the east coast usually closed to commercial flights to keep traffic moving over the holidays. and the tsa said it's staffed up to meet the travel rush, expecting almost 2.5 million passengers a day ahead of christmas. so, yes, it is incredibly busy right now, obviously. i have been checking flight cancellations and delays and there's some good news. it's looking smooth across the

country. almost no cancellations or delays. that may change later on. but if you're traveling today, just get ready for those long lines. michael? >> i know travellers are hoping that doesn't change, gio. thank you very much for that. now to the urgent flooding situation in new jersey. the deadly storm earlier this week is causing a river to overflow, leading to rescues and evacuations. rob marciano is in wayne, new jersey, with the latest. good morning, rob. >> reporter: good morning, michael. hard to believe we're dealing with flooding in december in the northeast. certainly feels like a climate change fingerprint. the rivers right now cresting at record levels. hasn't been this high since august of 2011. that was hurricane, hurricane irene. now it's been nearly two days since the rain has stopped here and people are still having to be rescued from the rising water. overnight, with parts of the northeast still underwater, urgent rescues happening in the dark of night.

flashing lights illuminating first responders in north jersey, as they search for stranded homeowners. families pulled from homes. >> rescuing them in those locations is not an easy task. something that may at some point become impossible. >> reporter: a dialysis patient carried to safety in patterson, new jersey. from maine to new hampshire and vermont, residents reeling in the wake of that powerful and deadly storm. this road in maine washed away. >> water damage everywhere. it's been like this for two days. >> reporter: countless cars covered by feet of water. this couple in wayne, new jersey, using a shovel to paddle their boat to dry land after the first floor of their home was flooded. >> going to have to fix the houses. gonna be out of the house for months. >> reporter: he climbed to the roof where he could see his neighbor's house surrounded by floodwaters. fully engulfed in flames. first responder blocked from getting to it, spraying it down from a distance. you can imagine, you get flooding in highly populated urban areas. it's very difficult for first

responders to get to where they need to go. this isn't the only river cresting. many more are still in flood stages. dozens of them across the northeast. most will crest either today or the next day or two. but most of them also will take several days to recede. here we are five days before christmas, guy, and there's another swamped car over there. these guys aren't going anywhere. if shoppers are looking to come to this mall, they're going to have to choose a different parking lot. michael? >> thank you, rob. we'll be tracking that here. ginger is here tracking a new storm for the west coast. good morning, ginger. >> good morning to you, michael. unfortunately flooding in the east and now a big time flood watch that includes los angeles and santa barbara. this is video from rolling hills estate, california. maybe you remember last july when the land slide took them out there. they've been working really hard to try to get all that debris. this is a very vulnerable spot. there are many of these in the hills and mountain sides outside of los angeles that we're

concerned about going into the next 48 hours. we've got this storm that's going to plow in, come with flooding rains on the order of 3 to 6 inches on the high end. the wind alerts are for gusts upwards of 60 miles per hour. taking down power lines, those high trees and the eucalyptus we spoke about yesterday. we time it out for you here. tonight santa barbara, and down into los angeles by friday. so that's the rounds of rain you will be dealing with. cut off low is stagnant in a way. there's an elevated flood risk. that's the second highest level we go to. you do not see that in southern california that often. >> okay, ginger. thank you. we'll check back with you in just a bit. now bombshell ruling from the colorado supreme court disqualifying former president trump from running in the state's republican primary for his role on january 6th. the first time in history the 14th amendment has been used to ban a presidential candidate. rachel scott is joining us with more. rachel, trump, no doubt, is vowing to fight this. >> reporter: whit, good morning.

donald trump is vowing to take this all the way to the supreme court. in an unprecedented and possibly far reaching move the colorado justices kicking a presidential candidate off of the state's ballot after finding donald trump not only engaged in an insurrection, but actively supported it as the capitol was under siege. overnight, donald trump back on the campaign trail. >> 2024 is our final battle. >> reporter: just hours after a historic ruling, colorado's state supreme court disqualifying the former president from running in the state's primary. in a 4-3 ruling the court finding trump engaged in an insurrection, pointing to his direct and expressed efforts over several months, ignoring his supporters to march to the capitol to what he falsely characterized as an alleged fraud. >> donald trump is the only person to blame for this. i understand his supporters may be upset that he could be off the ballot. but he needs to look in the mirror as to what he did on january 6th and the days leading up to it. >> reporter: the justices citing part of the 14th amendment that bars anyone who engages in

insurrection or rebellion from holding office. it is the first time in history the 14th amendment has been used to ban a presidential candidate, something the justices addressed directly. writing, we are mindful of the wait of the matter before us. we are like wise mindful of our solemn duty to apply to law without fear of favor. the trump campaign already promising a fight, telling abc news they will swiftly file an appeal to the u.s. supreme court. the former president facing 91 criminal charges, his legal defense the corner stone of his campaign. >> i consider it actually a great badge of honor. thank you very much. i appreciate it. >> reporter: while trump made no mention of the ruling in colorado at his campaign rally overnight, his republican rivals rallying against the court's ruling. >> we don't need to have judges making these decisions. we need voters to make these decisions. >> i do not believe donald trump should be prevented from being president of the united states by any court. i think he should be prevented

from being president of the united states by the voters in this country. >> reporter: trump has also been under fire this week for using language similar to what adolf hitler wrote, declaring undocumented immigrants poisoning the blood of america. despite mounting backlash, trump doubling down. >> they're ruining our country and it's true. they're destroying the blood of our country. that's what they're doing. they're destroying our country. >> reporter: dozens of lawsuits have been filed across the country to disqualify trump from being on the ballot. but this is the first time that it has succeeded. this morning the trump campaign is calling this ruling fraud and clearly they believe they will benefit off of this. they're already fund-raising off of this ruling. now all eyes on the supreme court. it will be up to the justices to decide whether or not they take up this case. we're clearly in unchartered territory, robin. >> we'll wait and see what they do there. all right, rachel. thank you. overseas to the war between israel and hamas and possible signs of a new deal for a pause in the fighting and the release of more hostages held in gaza. our foreign correspondent britt clennett is on the scene in israel.

lentil soup. a matter saying if it wasn't for that soup kitchen, they wow starve. michael? >> desperate situation there, britt. thank you. we're going to turn now to the federal government heading for a showdown with the federal government over its new state law. the situation leading to the highest number of migrants apprehended at the border in decades. mireya villarreal is on the scene in eagle pass, texas. good morning, mireya. >> reporter: good morning, michael. here in eagle pass, you can actually see hundreds of migrants sleeping on the floor near the river. i have spoken with many of them. they say as temperatures dip down into the 40s overnight, all they had were foil blankets and the clothes on their back. i also spoke with agents this morning. they tell me they are absolutely overwhelmed by the situation like this and they need help. this morning u.s. customs and border protection facing a record number of migrant encounters, including 11,000 apprehensions monday, the highest single day total in at

least 20 years. drone footage showing hundreds lining up in eagle pass texas. sop migrants seen with emergency blankets as they brave the winter elements. this comes as civil rights groups mount a legal challenge to texas bill sb 4 signed into law by governor abbott, which gives state officials the right to arrest, prosecute and deport anyone illegally crossing the u.s./mexico border into texas. critics say it will lead to racial discrimination. >> it will impact our communities. it will impact our communities' safety. it will separate families. that is just a reality that we cannot abide by. >> reporter: meanwhile, in an effort to slow crossings and reallocate resources to processing migrants, cdp recently closed a number of border patrol entry points. congress is set to leave for holiday break in just a few days and they have made no

compromise on funding for border security leaving people on the ground, the agents and local leaders to deal with this crisis. they are relying heavily on nonprofit organizations for food, water, medical treatment. one trooper said they have been working around the clock and said these conditions are unacceptable. >> all right, mireya, thank you. we turn to the lawmakers sounding the alarm about drug shortages across the country. some of the limited supplies include life saving cancer medications. our senior investigative correspondent aaron katersky joining us with the latest. good morning. >> reporter: good morning. for cancer patients, this is an excruciating reality knowing their cancer is treatable, but the drugs to do it are too scarce. this morning crucial chemotherapy drugs are in short supply, forcing doctors to ration them leaving some patients behind. >> we know how to treat cancer, but shortages force impossible choices. we have drugs that are life saving and shortages that are life threatening. >> reporter: drugs that treat

lymphoma and leukemia are among those running short. experts blame economics and a business model for generic drugs meant to keep costs low. >> a vial of steroid injectable medicine typically costs less than this cup of coffee that i bought downstairs this morning. so this reduces the incentive for manufacturers to invest in quality or in newer manufacturing facilities. >> reporter: it's not just cancer drugs. there are shortages of drugs used to treat infections and a stimulant kimberly ward's daughter takes to control her adhd. >> adderall started this whole shortage. you want me to potentially not have consistent medication for my daughter? instead? really? why? >> reporter: the biden administration last month announced a new investment in domestic manufacturing to help shore up supplies of morphine, insulin, flu vaccine. experts say government manufacturing, stock piling and setting up a price floor could

also help ease these shortages. robin? >> all right, aaron. thank you very much for your reporting on that. now to the popular applesauce for kids linked to more than 200 reported cases of lead poisoning. rhiannon ally is here with an update. good morning, rhiannon. >> reporter: good morning to you, robin. parents really need to check their pantry because kids are getting sick. it could be due to these popular children's snacks. we are learning the fda thinks the lead contamination in these apple sauces may have been deliberate. the cdc says they are investigating 205 reports of lead poisoning cases in 33 states, possibly linked to the major applesauce recall. according to the u.s. food and drug administration, its investigation of lead contaminated cinnamon flavored applesauce pouchs found some samples had as much as 2,000 times the highest recommended amount of lead allowed. the finding comes from the fda's inspection of the astro foods facility in ecuador. that is where the recalled product, we're talking apple cinnamon fruit puree pouch,

family climbed aboard the ship bound eventually for canada. >> it's cold. it's cold cold. wind's blowing, cold like, offensively cold. >> reporter: on monday while briefly docked in boston, an east coast storm brought them heavy rain and gusts of wind nearing 70 miles an hour. >> i never fathomed we would be back in cold weather. >> reporter: in a statement, the cruise line said unseasonable weather would have made it impossible to safely reach the bahamas saying the only alternative would have been to take the more extreme step, canceling the cruise and thousands of people's vacations outright. they did offer the chance to cancel and put the full value paid for this cruise toward another at their convenience. but what are your rights as a passenger if your trip is suddenly heavily altered? the answer is complicated. >> cruise lines have what's known as a contract of carriage. it doesn't guarantee any ports. the cruise line is within its legal rights to change those ports. >> reporter: the bottom line is to follow the weather closely and get trip insurance and maybe consider packing a few extra layers.

rachel, good morning. >> reporter: whit, good morning to you. the trump campaign is vowing to take this all the way to the u.s. supreme court. in an unprecedented move, the colorado justices kicking a presidential candidate off of the state's ballot after finding donald trump incited an insurrection. the justices citing part of the 14th amendment as grounds for this decision. it says anyone who has engaged in insurrection or rebellion from holding office. the 4-3 ruling pointed to trump's direct efforts over several months. he was trying to prevent what he falsely characterized as an alleged fraud. this is the first time in history the 14th amendment has been used to disqualify a candidate. it's something the justices addressed. they understand the weight and magnitude of this moment. dozens of lawsuits have been filed across the country to try to disqualify trump from being on the ballot but this is the first time it has been successful. this morning the trump campaign is responding by calling this decision flawed. they're already fund-raising off of it. all eyes are on the supreme

see food insecurity and hunger every day. >> reporter: once a month the team loads their truck with food, bringing them to a food desert in lake charles, where one in eight people experience food insecurity. >> we go into lake charles. we are identifying the most impactful needs to them and how do we respond? >> reporter: in 2020, two single category 4 hurricanes destroyed this area, taking out five grocery stores. >> hurricane laura destroyed the only place for fresh fruits and vegetables that the community could get. one butter! one cheese! >> reporter: the community came together to find a solution that worked for them, reaching out to second harvest to help create the mobile market, bringing affordable groceries closer to residents experiencing food insecurity. >> it's just grown. some days we have 150 transactions that we complete in a two hour period. >> reporter: the grocery second harvest buys are sold at steep discount prices.

you are the out reach supervisor. what made you want to take this as a full-time responsibility? >> well, will, i volunteered at several different places around the city in other places that i have lived. this was home for me. it just touched me because of the fact that the people make it the place to be. it's awesome. we have a fun atmosphere. it's meaningful work. it's rewarding to be here every day serving the people of louisiana and giving back. that's what it's all about. >> reporter: it is all about that. david, you are a volunteer. you know this community as well as anyone. what does second harvest mean to this community and what do you need to give back? >> well, when you volunteer here, you quickly realize how much of a need is out there. the people need access to fresh fruit, hot meals and so much more. i love the work we do here, working with the other

of killing his wife on an african safari. he is speaking for the first time since his dad was sentenced to life in prison. eva pilgrim is here with that story. >> good morning, robin. julian rudolph said he still can't wrap his mind around what happened. federal prosecutors say his dad murdered his mother for insurance money, money julian thinks should now go to him and his sister, but the government won't let them have it. >> it's been seven year since we lost her and i still wake up in the middle of the night and i think, this can't be real. >> reporter: this morning the son of larry rudolph the prominent dentist sentenced to life in prison for murdering his wife and committing mail fraud is speaking out for the first time exclusively to abc news. >> what you have to understand about the trial is that it was just horrifying ordeal, the visual, the sounds, the sights

in that courtroom for three weeks. it's tattooed in my mind. >> reporter: larry and his wife of 34 years bianca were on a hunting trip in zambia in october 2016. just as they were getting ready to return home, rudolph said his wife, known to be an excellent marksman accidentally shot herself while packing her shot gun. >> he cried, what am i going to tell my children. >> my father was telling us, i'm innocent, this was a terrible accident. >> reporter: but authorities saying within a few months of his wife's death, rudolph secretly cashed out nine separate life insurance policies in her name totalling about $5 million. did you know he bought cars and went on vacation? >> i knew he had a nice

lifestyle. i saw him roughly once a year so i didn't know how he was living his life. >> reporter: the fbi learning rudolph had a long term girlfriend. >> i think my mother brought out the best in him and lori brought out the worst. >> reporter: a bartender telling authorities that in early 2020 he overheard rudolph and her arguing in a restaurant. >> he pointed his finger and said, i killed my wife for you. >> reporter: this june a judge sentencing mileyer to 17 years in prison for being an accessory to a murder. after uncovering the truth the justice department seizing two multimillion dollar homes and nearly $5 million from rudolph. prosecutors telling a federal judge that money should go to the insurance companies as the victims of fraud, but julian and his sister say they are the real victims, arguing the money belongs to them and most of the insurance companies have said in writing they agree.

>> it's the matter of right and wrong. my mother put us as the beneficiaries on those insurance policies. she wanted us to receive those proceeds if something ever happened to her. the insurance companies themselves have indicated, we don't want these proceeds. still the government is hell bent on fighting us in court to give it back to the insurance companies instead of us. >> reporter: in response the doj insisting it's just following the law and working in good faith to make sure larry rudolph never gains from murdering his wife. in an affidavit filed after rudolph's arrest, julian telling a judge he knows his father is innocent, but now julian sees things differently. do you still believe your dad is innocent? >> i can't stand by that original statement. that was before we saw the evidence in the trial. >> reporter: so do you believe your dad killed your mom?
