in contra cost driver is shot ad killed just sitting in his car. good evening. thank you for joining us. i'm dan ashley and i'm ama daetz tonight. >> police in the town of oakley. tell us the suspects are still on the run. now, this all came just before 5:00 tonight on rutherford lane in a secluded section of town and right across the street from a local elementary school. police say the pizza delivery man was inside his car on a break from making deliveries when another vehicle approached alongside. that's when officers say a

passenger inside that car got out and shot the man. multiple times at close range before leaving the scene. >> the mother of the delivery driver called 911 investigators, saying she was inside the home as her son was parked out front. >> she originally did not see the incident occur. she heard the shot and she came out and saw her son had a gunshot wound. >> first responders say they arrived minutes later and tried to save the delivery driver, but he ultimately died from his injuries just minutes later. oakley's police chief is hoping people in this neighborhood will check their surveillance footage. this neighborhood is a relatively quiet neighborhood. >> it adjoins uh- vintage parkway school, so we take safety very seriously in this neighborhood. >> police did not say which pizza delivery company the victim was working for, but a nearby domino's had closed for the evening. we reached out for comment but have not heard back.

we're keeping a close eye on this, obviously. we'll let you know. just as soon as we get more information. >> we turn now to our storm watch as we take a live look at live doppler seven, showing us something we haven't seen in quite a while. dry skies. but some of us aren't all the way in the clear just yet. abc seven news meteorologist sandhya patel is on top of it all, and that long stretch of rain we had sandhya. yeah, it all started at sunday and it continued today. we had the wetrillionoadways pounding rain this morning. let me show you live doppler seven right now and you will notice how much quieter it is right now. >> but we do have a few showers in the east bay, right around pleasant hill. 242 clayton road into concord. very light stuff. it wasn't like that earlier today. if you woke up this morning to the pounding rain, you know exactly what i'm talking about because we did have downpours come through here between the morning hours and the early afternoon as we check out what's ahead. well, 2 a.m. you're going to see a few showers popping up as we head

towards 5 a.m. still some scattered showers in the forecast and then early in the morning. most of the activity is when it goes through here, but in the afternoon, notice what's showing up a couple more showers in the southern part of our viewing area on our storm impact scale overnight tonight. it's a level one. scattered showers, slick roadways and pockets of poor visibility something you'll need to watch out for. that area of low pressure while it is moving down parallel along the coast towards southern california, where they are getting quite a bit of rain right now, and it's only going to get worse. that system isn't completely done with us yet. now, if you are traveling flood watches and warnings up for much of southern california, where the mountains and the foothills expecting to pick up 5 to 10in of rain, that's excessive. it's going to be dicey heading down that way with thunderstorms, mudslides, certainly, and debris flows a possibility. high elevation snow, 61, in los angeles tomorrow. traveling out west vegas 67 degrees. you will notice seattle 49. pretty quiet weather, right around salt lake city, 52 degrees. i'll be back with a look at what it's going

to be like as we head towards the weekend and the start of winter tomorrow night. dan okay, sandy, thanks very much. >> the bay area is not the only part of california seeing rain. as sandhya mentioned, los angeles is expecting 2 to 5in of rain and then up to ten inches in the santa barbara region through friday, and a flood watch is in effect from there down to san diego, with risk of thunder and mudslide as travel delays, road closures, very likely other parts of the country are seeing extreme wet weather, with the northeast facing heavy flooding, especially in maine and in new jersey, happening now. >> x, formerly known as twitter, just came back online after an outage that lasted about an hour. users could log in, but all they saw was a message saying welcome to x. they were unable to view posts on the social media website and their timelines vanished. no word though, on what caused the outage. >> new developments tonight with several americans that were being held in venezuela, some of them classified as being wrongfully detained, ten of them landed in texas this evening

a letter to california's secretary of state urging her to explore legal options. yesterday, the colorado supreme court disqualified trump from being on their state's ballot under the constitution's so-called insum action clause. this case could end up at the us supreme court if the colorado supreme court decision is upheld, then i think california will move forward. >> there is another lawsuit pending, in addition to the letter that you talked about, and other states will move forward as well and say that the former president is not eligible. trump is appealing colorado's ruling. >> fellow republican candidates, including nikki haley and chris christie, have come to his defense, saying these issues should not be decided in court. >> a groundbreaking new law coming into effect in california at the start of the new year. it will require gender neutral toy sections at large retail stores across the state. abc seven news reporter j.r. stone has the story. >> most toy stores have the pink girls section and the blue boys section. now now, a new california law going into effect

at the start of the year will require large retail stores with 500 or more employees statewide to have a gender neutral section for toys. >> we're not affected by the law, but i say yay! it's not called woke. it's called american freedom. >> helen dean is the longtime owner of toy safari toy store in alameda. she is cheering on the move much of her store already has a mix of toys for boys and girls side by side in every aisle. even the lego friends collection, specifically marketed for girls and not fully compatible with other legos. she says. many years ago, barbie toys like this were geared towards all kids. now the packaging is straight pink. >> if you look at the packaging, you can see an evolution in going from kids playing with toys to hey, we're going to sell this to a little girl girl and this is what she's going to want because we know the way we are

feeding their minds and the materials we choose to use. >> it is narrowing their ideas and the ability to really negotiate out the world for them. but this new law does not take away a boys or girls section. >> it only adds the gender neutral section putting similar products that had been marketed for girls or boys side by side in an aisle along with toys that could appeal to everyone. here's something that you might find in a gender neutral section a clue doll made in france could be for a girl or a boy, but those with the california family council say enough is enough. they believe sacramento needs to start focusing more on things that matter and less on toys. it's a little crazy that sacramento seems so intent on breaking down the distinctions and differences between men and women, between boys and girls. >> it's not enough that we are having gender neutral bathrooms. we're even trying to extend that

to the toy section. >> if the law is violated, a store could first be handed a $250 fine, then a $500 fine for a second offense. jr stone, abc seven news. >> the bay area's crab season will be closed well past the new year. any commercial crabbing south of sonoma and mendocino county won't be assessed again until january 11th. it's not a totally unexpected update. the season has been delayed in recent years to protect migrant whales from getting tangled in crabbing gear, fish and wildlife officials say commercial crabbing can begin january 5th in waters above the sonoma mendocino line. you may see other dungeness crab from the pacific northwest in the stores as well. we'll have to see. >> building a better bay area is our core focus here at abc seven news, and we wanted to share one of those breakthroughs with you tonight. >> we did the effort to spread some holiday joy to farm workers in half moon bay came to fruition earlier this week. we told you about volunteers making

it's we're a microcosm of the greater world hate found on a middle school campus. >> and it's just one case of what we're seeing really happening across the country. an investigation is underway after swastikas were found on some lockers at block intermediate school in los altos. this is the second incident in the district in as many weeks. students are now going to go through training sessions as part of a partnership with the anti-defamation league. >> it is important that every student, in order to learn, comes to school feeling safe, feeling respected, feeling seen. and when our environment is breached in some way which this is a breach of, that we want to make sure that kids understand their role. >> a recent report by the jewish community council of the bay area found more than 60% of bay area jews feel less safe in their day to day lives. >> driverless vehicles have made lots of headlines in san

francisco. crews ended up having its permits revoked by the dmv after a number of high profile incidents. but there are other autonomous taxis rolling on the streets today. waymo released a study showing its driverless taxis have a 90% lower crash rate than human drivers. >> when we compare those two with each other, we see that we're involved in far fewer crashes as we're involved in involved in far fewer injuries and police reports, san francisco was one of three cities included in the study. >> on the surface, this appears to be a big win for waymo, but a technology reporter is pumping the brakes on the results. >> you know, 7 million miles sounds like a lot, but it's really a small sample size. so when you start to think about how that translates over hundreds of millions of miles of driving uh- again, i think this is early innings, but but encouraging. >> the study is now being reviewed by scientific journals, a process that could take several months. see what it's like inside a driverless car? abc seven news reporter lyanne

seen rain over the last couple of days and i just want to take you back in time about 24 hours. the higher elevations have picked up anywhere from 2 to 17in of snow. but like i mentioned, this was a warm storm. so lower elevations have not seen the snow. as we look at live doppler seven right now, a lot of cloud cover hanging around. there is an isolated shower right over the inland east bay right now around. concord, pacheco, vine hill six 8-80 martinez, alhambra avenue. really light stuff. this is kind of the nature of what you're going to see going into tomorrow morning. we do have a coastal flood advisory 5 to 9 a.m. tomorrow. and that's because the high tide is coming up at 640 in the morning, between 6.9 and 7.2 feet. so just be aware of the fact that there will be some low lying flooding during that time period. here's your area of low pressure that has been skirting the california coast. brought us the drenching this morning, and that low is now moving in towards southern california. and northern baja. it is giving them

a good dose of rain, but they haven't seen anything. they're going to be picking up several inches of rain at the lower elevations, 5 to 10 over the hills. and that's going to lead to some issues. the next couple of days. rainfall here in the bay area last 24 hours. more than two inches in ben lomond over an inch in oakland, san francisco close to two inches there in kentfield in santa rosa, san jose. you didn't get missed 8000 103,300. concord 4000/800 in livermore. let's take a look at where the 72 hour totals were. ben lomond more than seven inches of rain, san francisco over three. santa rosa picking up close to five. so where do we stand tonight? we're doing good. 72% of average at sfo, so big gains, 89. santa rosa, san jose. you're at 74% and 84% of average in san francisco. 40s and 50s right now. a look at the highlights overnight through the morning. scattered showers tomorrow. winter begins at 727. and this weekend we are looking at cold mornings and sunshine in the afternoons as we look at the storm impact scale. level one
