take a look at that massive 777 behind me with united. that just same in from sao paulo. it's being loaded up because it's getting ready to go back out there again. united tells me it is all hands on deck. just about every employee is on the clock. this morning the record breaking holiday travel rush soaring to new heights as the faa's busiest day in the skies gets under way. nearly 49,000 planes expected in the air today, as passengers make a mad dash home for christmas. airports packed from chicago to seattle to charlotte. >> this is ridiculous. hard to get here. >> reporter: as far as cancellations and delays, largely smooth sailing with just a few disruptions. at la guardia airport wednesday, the tsa said it removed 17 bullets hidden inside a diaper in a carry on bag. while at reagan national outside washington, agents stopped a man with a load handgun. an unintended bag leading to brief delays at charlotte's

douglas international. >> i could miss my flight. everybody here could miss their flights. outrageous. >> reporter: most passengers will fly today through saturday. delta will transport nearly 9 million passengers over the holiday. american expecting more than 12 million. and united airlines saying this christmas season will be its busiest on record, transporting around 9 million passengers over the holiday with nearly 4,000 flights each day. >> planes are going to be full. the airports are going to be full. i'm not going to sugar coat that. what our focus is, making sure we get the planes out on time with their bags. >> reporter: and back out live here in houston, you see that massive 777 we've been talking about. it's getting loaded up to go to tokyo next. let's talk about flight delays and cancellations. yesterday was pretty smooth. not a whole lot of them. today i'm not seeing a lot of cancellations or delays, at least not in morning. ginger is watching that weather.

if it stays that way, stays smooth, built of a holiday miracle, michael. >> we are hoping for a holiday miracle, gio. that major storm hitting the west coast, that's threatening to disrupt holiday travel bringing snow, flooding and possible mud slides. matt gutman is in oxnard, california, with the latest. >> reporter: good morning, might matt. we are seeing a little bit of everything you just mentioned. this entire intersection had been flooded. you can see this downed trash can that got swept here from several hundred yards away. this entire area was submerged. multiple inches of rain hitting this part of southern california. two systems hitting the northern california area over the past 48 hours. there were flooded streets there. people setting up sandbags, downed trees. this is part of that el nino system that's hitting california

this year. multiple additional inches of rain expected here in the southern california area in the coming hours. some of the heaviest bands forecast to hit here coming up. we've seen high water rescues in this area in oxnard and areas just south of us have had an evacuation warning. some of the worst weather is still ahead in the coming hours here. michael? >> thank you very much, matt. ginger is tracking the holiday forecast as well. good morning, ginger. >> i got to write an extra note to santa. he needs to know to get the galoshes ready as he prepares to come to the united states instead of the ear muffs. we will be warm and wet. let's start in southern california. oxnard just got a month's worth of rain in 40 minutes this morning. that's why matt was standing in front of that mess. you see the elevated risk has gone down to santa monica. redondo. that's who's in place for it today. watch how it extends to the desert. phoenix and tucson tomorrow into early saturday. that's where that pile of rain is going to push up. you will see gusty winds with this, too, so any of those vulnerable trees.

mud slides. any of that land that's ready to move has a chance to. it will come together, robin, with this system from the north. you could have a booming christmas eve morning from dallas to kansas city, and then we could see record highs throughout the northern plains. >> did you say booming? >> booming. >> we'll see. thank you, ginger. we'll get back to you in just a bit. now to chaos at the southern border. authorities overwhelmed by the record number of people crossing, with texas now flying migrants to chicago days after governor abbott signed that controversial new law. aaron katersky has the latest for us. good morning, aaron. >> reporter: good morning, robin. this is an escalation of the policy of moving migrants out of his state and into democratic led cities after chicago impounded a bus, the governor chartered a plane. this morning texas governor greg abbott releasing video and announcing he's now flying migrants to chicago. 120 arriving on the first flight. one mother explaining there were

more than 100 people on board and they were left deserted when they arrived. abbott defending his actions saying the city, quote, started obstructing and targeting our bussing mission adding, until biden steps up to secure the border, we will continue to provide overwhelmed texas border towns with much needed relief. it comes after abbott signed a law this week that, if up held, without authorize local police to arrest migrants suspected of crossing the border illegally. a record 12,600 crossing in one day alone. >> there's more people in the pipeline, and i suspect christmas will be worsened today and new years will be worse than today. we are going in the absolute wrong direction. >> reporter: abc's mireya villarreal is in eagle pass, texas. >> one group leaves on a bus and another is coming over the river bank. yesterday 4,400 apprehensions. just in this area alone. many will wait 10 to 12 hours just to be processed, some will

wait up to two days. overnight they'll sleep on dirt with no shelter, just the clothes on their back and foil blankets. processing facilities are fill. agents are overworked and overwhelmed. >> we need to surge immigration judges to the border. this is america. people need to get their case heard in days not years. if they do not qualify for asylum, they need to be deported. >> reporter: there are real concerns about the living conditions and medical care being provided to migrants in texas and destinations north. now there are worries about the economic impact. rail crossings have been closed halting freight trains that carry everything from auto parts to food at a cost, according to one estimate of $200 million per day. whit. >> that ripple effect across the board. aaron, thank you. now to the high stakes prisoner swap with venezuela. ten americans are now back home this morning in exchange for venezuelan man held in the u.s. venezuela also handing over an american fugitive as part of the deal. our chief global affairs correspondent martha raddatz has the latest.

martha, good morning. >> reporter: good morning, whit. the negotiations were tense and tricky, releasing not only that notorious fugitive contractor who escaped in 2022, but bringing home every american held in venezuelan jails. overnight ten americans jailed in venezuela back on american soil. >> free at last, free at last thank god almighty, free at last. >> reporter: the safe return home comes months after secret negotiations. 38-year-old freed american business man savoy wright describing the moment he called his family. >> i face timed them and said, i'm on my way home back to the u.s. and i love you. we cried. >> reporter: one of six of the ten americans considered wrongfully detained including avon hernandez a los angeles public defender who was taken into custody last year near the border, accused of being a spy. >> all you think about when you're in prison is how you didn't appreciate being free.

>> reporter: hernandez thanking president biden for what he calls a difficult decision. >> he got us home and we're with our families and so we're incredibly grateful. >> reporter: also returned to the u.s., fugitive leonard francis also known as fat leonard, the master mine of a $35 million bribery scheme, the largest corruption scandal in u.s. military history. in 2015, he pleaded guilty to using prostitutes, luxury travel and cash to bribe u.s. naval officers to steer lucrative contracts to his company. here is francis on an investigative podcast produced by project brazen in 2021. >> everybody was in my pocket. i had them in my palm and was just rolling them around. i could just move the carriers like, you know, paper ships in the water. >> reporter: in exchange, the

u.s. granting clemency to alex saab, a top ally to venezuela's president. he was greeted on the tarmac by his wife and daughters. >> gracias. >> reporter: saying i thank the people of venezuela. i'm proud to serve the people of venezuela and to serve this government. saab was arrested in 2020 on mon money laundering charges. he was later welcomed at the presidential palace there. this all comes as the biden administration is trying to improve relations with venezuela in hopes the country moves towards free and fair elections. robin. >> that is the hope, martha. thank you. now the war between israel and hamas. the white house says negotiations are under way for another temporary cease fire. and the release of more hostages. as gaza's health ministry is run by hamas, reporting that the death toll surpassed 20,000. our foreign correspondent britt clennett is in israel for us.

being carried away and my girlfriend saying she loved me. >> reporter: house by house charred out, painful reminders of the horrors committed that day as pressure intensifies on the government to bring the rest of the hostages home. the white house says serious negotiations are under way, but hamas telling us the latest round of talks in egypt ended without results. michael? >> britt, thank you. please be safe. going to turn to a major recall. toyota recalling 1 million vehicles world wide over potential air bag issue. morgan norwood is here with what to know. good morning, morgan. >> reporter: good morning, michael. if you have a newer model, toyota is recalling 1 million cars and suv's in the u.s. due to a possible defect that could pass the passenger side air bag not to employ in a crash. that recall involves 15 different 2020 and 2021 toyota and lexus models. that includes the toyota camry, rav 4 as well as lexus rx350 and ef350. toyota says a short circuit in

those vehicles occupant classification systems could prevent the passenger's side air bags from deploying properly, driving up that risk of injury during a crash. here's what you need to know if your car is being recalled toyota will notify you sometime in february. the dealers will then examine your car to see if your sensors need to be replaced. if so, it's free to fix. >> thank you for that important information. now backlash from the sky rocketing cost of breakfast cereals. one of the top cereal makers admitting americans are fed up with the high prices and are not buying much. trevor ault joins us with more on that. >> reporter: good morning, whit. you've heard of kitchen table issues. these are breakfast table issues. it tells us a lot about the economy. we're talking about general mills. makers of cheerio's, lucky charms, wheatty they say sales are down because prices went too far up. they released their quarterly results.

the ceo blamed, quote, stronger than anticipated value seeking behaviors which is heavy corporate speak for people wanting a deal and we weren't giving them one. let's go back a few years. the pandemic turned around what had been a steady slide in cereal sales. everybody though then was eating at home so sales went up 5% in 2020. that didn't last though. they fell 8.7% in 2021 and almost 4% in 2022. over that time with supply chain issues and inflation, general mills was raising their prices but they were raising them higher than the rate of inflation. too high for a lot of people. sales of cheaper store brands by 20%. so general mills now has to figure this out. they predict they might not return to typical sales volume until at least next summer. robin? >> trevor, thank you. we're going to turn to the holiday shipping rush and the u.p.s. driver who went above and beyond to make sure he made his delivery, rain or shine. andrew dimburt has details. >> reporter: ryan long knew he was probably carrying christmas gifts and wasn't going to let a flood stop him from delivering the goods.

but not all holiday hazards are set up by kevin. with so many families gathering for the holidays, now's the time to give your home a closer look. we're gonna tell you how to find the potential dangers. that is coming up. >> between cars at the bottom of the stairs, always a red flag. looking forward to that coming up. first top headlines we're following. the record breaking holiday travel rush is taking off this morning. the faa preparing for the busiest day in the skies, with nearly 49,000 planes expected in the air. this as a major storm slams the west, bringing heavy rain and flooding, making its way east. two crew members from our station wpbi who died tuesday night's helicopter crash in new jersey have been identified as 67-year-old monroe smith, the pilot and 45-year-old photographer christopher douherty. the chopper crashed while returning to philadelphia. the cause is under investigation. again, our thoughts are with their families and our colleagues. >> certainly is, whit.

this morning some financial relief for millions of taxpayers. the irs is waiving about $1 billion in late payment fees for people who failed to pay back taxes totalling less than $100,000 in 2020 and 2021. some 4.6 million taxpayers are eligible and will receive notification of their new balances from the irs in january. got a lot more ahead, including a warning from the fbi about gift card scams. how to spot if your card has been tampered with. and that is coming up, michael. >> thank you, robin. now to the georgia mom accused in a murder for hire plot targeting her estranged husband. lindsay shiver will appear in a bahamas court where a judge will decide whether she can return to the u.s. victor oquendo joins us with the latest. good morning, victor. >> reporter: lindsay shiver has not seen her three young

children since she was arrested. she's expected in court in a matter of hours where she will learn whether a judge will allow her to return to the u.s. before her trial. this morning the georgia mother accused of plotting to kill her estranged husband due back in a bahamas courtroom to ask a judge for permission to let her go home for christmas. 37-year-old lindsay shiver has been in the bahamas since july 16th, out on $100,000 bail, unable to see her three young sons since her arrest. lindsay, last seen two weeks ago in these daily mail photos, headed to a court appearance where she plead guilty to charges. that she allegedly tried to kill her husband robert shiver with her boyfriend and a hit man. >> although typically a petition of this type, in this type of case with these charges is not going to be granted in the u.s. there may be some interesting law in the bahamas that allows this to happen. >> reporter: according to a police report, investigators say lindsay admitted to sending messages and photos saying, kill him.

lindsay's lawyer telling abc news's news she is facing the legal process with complete transparency. the shivers are in the middle of a heated divorce. in july, body camera footage capturing an argument between the couple at their home less than a week before lindsay's arrest in the bahamas. >> woke up this morning. we have travel plans to leave. he's insisting that i don't go. >> she's saying that she's going to change her plans and now get on the airplane with me and the kids to go to the bahamas and when we land, she's going to go to her boyfriend's. >> elsewhere. >> and me and the kids will go to the house. >> reporter: if granted permission to leave the bahamas, lindsay will need to get her passport back from the u.s. embassy. prosecution asked to say she does not come within 100 feet of her husband. >> when we're talking one country to another, it's highly unlikely they will grant this unless there's an extraordinary circumstance.

>> reporter: if granted that permission to come to the u.s., she will be ordered to return to the bahamas in late february for a pretrial hearing with her trial set to start in march. guys? >> we will see what happens there, victor. thank you. now an abc news exclusive with the family of the little girl who was abducted on a camping trip in new york state earlier this year and found days later. her aunt sitting down for her first tv interview since her dramatic rescue. erielle reshef is here with more. good morning. >> reporter: good morning to you guys. so many of us followed this case so closely. for two tense days more than 400 law enforcement officers worked around the clock to unravel the mystery of this little girl's disappearance until she was finally reunited with her family. now her aunt is speaking out to warn others how quickly abductions can happen and the lasting impact for victims. you always say, like, this type of stuff doesn't happen to you. but obviously, it can happen to you. >> reporter: it was a case that gripped the country. a little girl abducted while camping in upstate new york last

in agony. then a bizarre break in the case. law enforcement says a ransom note was slipped into her parents mailbox while an officer was watching. fingerprints leading authorities to 46-year-old craig ross jr., who had been arrested for dui in 1999. authorities tracking him down in a trailer behind his mother's home 13 miles from the victim's house. police say the 9-year-old was found alive in a cabinet. when you learned that your niece had been located, what was your reaction. >> i dropped to my knees screaming. >> reporter: ross jr. now charged with nine counts of kidnapping and assault. he's pleaded not guilty. >> unfortunately, the world we live in, there are predators out there and so justice will be not only him being safely away to not do this to anyone else, but also her having great support

we are watching that eruption happen behind us here. i want you to see the picture from above that shows you the fissure that stretches for 2.5 miles. the gases and magma has been spewing from two vents this morning. as long as this eruption continues to unfold, the concern is high that toxic gases could spread across the region. because this is an under ground system that scientists are dealing with, there's a lot they don't know about what is happening. officials told me they are worried about the gases but also for the potential that this eruption could reintensify. of course, since monday's eruption, they also warned about the risk for lava to reach a nearby town which was evacuated last month. now that has not happened, thankfully, but they're not in the clear. certainly they're continuing to watch what happens here. the over arching question though is how long will this last? and nobody knows.

back now with scam u and a warning from the fbi about gift card scams. according to the ftc, gift card fraud cost americans $160 million in the first nine months of this year and there's been a sharp spike in scams this holiday season. aaron katersky is back with an exclusive look at how to tell if a card has been tampered with before you buy. good morning again. >> reporter: good morning to you, robin. that gift card you've been waiting to use the fbi says may turn out to be worthless. this morning exclusive images of a scam. the fbi showing gma how criminals tamper with gift cards, shoplifting them from stores and placing a bogus security sticker. scammers reseal the packaging, these images show the glue residue left behind, and put them back in stores where unsuspecting customers fill these cards with money that is sometimes instantly stolen.

>> so we're seeing this scam across the united states. it's really picked up in the last few weeks. we see generally a rise in scams of this type around the holidays. >> reporter: the latest method criminals are using to lift the money out of your pocket this holiday season. >> you have my $200. the crook has my gift. >> reporter: one woman fell to the scam. when the new mom went to spend money, it wasn't there. >> she was scratching off the security lining with all of her baby purchases. it comes up zero balance. also there was a note that said that this gift card had been assigned to another account. >> reporter: gift card scams have been around for years, but the fbi says never at the volume they're seeing now. how would a consumer even know that the gift card they're buying actually has no value because it's been siphoned away by some criminal? >> the consumer has to be really vigilant.

>> reporter: the fbi says look to see if the packaging seems tampered with. if there's a sticker over the scratch off material. buy gift cards kept behind a counter and save the receipt something suzanne said kept her from losing money. >> it was a little while, but finally i got an e-mail from target gift card services. they said they would be happy to replace my gift card. yes, for me, i got the $200 back. >> reporter: target said in a statement, we are aware of the gift card tampering and take this issue seriously. now store teams regularly inspect cards for physical signs of tampering. individual consumers may lose $50, $100, $200, whatever the value of the compromised gift card they bought. the fbi says all that adds up. the combined losses from this scam are pretty high. victims can try getting their money back from retailers, but the fbi would also like them to file a complaint at ic3.gov. guys? >> great message, especially for

aaron katersky is back with that. >> reporter: good morning again, michael. what federal regulators are proposing amounts to one of the most aggressive attempts to protect children's privacy online in nearly 15 years. the ftc is suggesting new regulations meant to curb how social media companies use and monetize children's data. websites that collect personal information from kids under 13 are already required to notify parents and obtain consent. the new proposals would limit push notifications that encourage kids to stay online longer, require targeted advertising to be off by default, and expressly tell companies they cannot keep children's information forever. regulators say unnecessary collection retention and use of children's personal information could endanger their safety or expose them to hacks and allow companies to prey on their trust and vulnerability. kids can not help but be on their computers, right? for school and daily life. the ftc said kids must be able to play and learn online without

being endlessly tracked by companies looking to horde and monetize their personal information. members of the public have two months now to comment on these proposed changes before a note next year. whit? >> aaron, thank you. now to the mayor of boston issuing an emotional apology to two black men wrongly arrested after a racist murder investigation more than three decades ago. morgan norwood is here with details. >> good morning. this was a case that deepened the racial tension over in boston. let me set the scene. in 1989 charles stewart told police a black man murdered his pregnant wife. that led to the wrongful arrest of alan swanson and willie bennett. their families overcome with emotion as the mayor issued a stunning apology. >> we are here today to acknowledge the tremendous pain the city of boston inflicted on black residents throughout our neighborhoods 34 years ago. >> reporter: the mayor of boston issuing a stunning public apology to two black men wrongfully accused in the 1989

creates a level of encryption that we just can't get with physical cards. >> reporter: google says digital wallets provide added security and apple adds it's better than using a credit debit or prepaid card. but what if your phone gets stolen? nor to use the digital wallets on watches or phones, your device must have a password. now apple tells us that apple pay is available in 85% of retailers. one downside is that other 15% means you still have to carry a plastic credit card. it's not just the big three samsung, google and apple. there are services like zelle, pay pal and venmo. it is a whole different world paying for purchase. >> yes, it is. i tell my kids, i give them cash. they're like, what is this? put it on a card. now we'll turn to a new report that says switching to a plant based diet could cut your risk of diabetes by 25%. registered dietitian and nutritionist mya feller is here to break it down. this comes as we're heading to the holiday filled with a lot of sweets. tell us about this report. >> okay. so this report is a cohort study. participants were 40-69. what researchers were doing, they were looking at healthy plant based diets, unhealthy plant based diets and type 2 diabetes. they said healthy plant based diets were, beans, nuts, fruits, vegetables with unhealthy being sugar sweetened beverages, added sugars, the things we expected. what they did find, for the folks who ate the healthy plant based diet they did have a reduced risk of type 2 diabetes. the people going in at base line with the healthiest plant based diet, they tended to be older, more active and had greater education so that could have been a factor. >> when you take the plant based

approach, it's not a one size fits all. >> not at all. folks need to individualize based on their personal health where they are right now. their likes, dislikes, finances and access. what we know, those diets that have the fruits, vegetables, beans, nuts, seeds, these bioactive compounds we want folks to have access to. that's good for your metabolic health. look, it's a plug to eat more plants in their whole and minimally processed form. >> holidays. you want to stick to this plant based approach, but you want to indulge. how do you do it? >> in my practice we're talking about balance and sustainability. i want folks over the next few weeks to think about what are the plants you can add into your pattern of eating? you may not like salad. that's okay. but do you like a cooked vegetable? can you add fruit to your

theme. do pepperoni, olives. they're festive looking. stick that cheese on there. >> we have a lot to do here. what kind of tips do you have for prepping all this stuff? >> the nice thing about this for parents and you're busy, you can do this ahead of time. anything that will keep in a fridge you can put on a skewer, stick it in the fridge. when you are ready to display it, put it out. you don't need a circular board. you can do this in any shape you want. arrange the rosemary so it's in a circle. put cookies in the middle. put this in the middle. use. use one of these skewers and you can skewer these so that people can pick them up without everybody's hands going into the dips and everybody's hands going, very easy to do.
