leaders to provide concrete answers and decisive action. >> a rallying cry tonight in oakland after a beloved donut shop is robbed. yet again. this is not the just the third time since june, but also the second time just this week. and now the community is calling on city leaders to do more to help small business owners. good evening. thank you for joining us. i'm dan ashley and i'm ama daetz. >> organizers of today's rally called out city leadership for failed policies and pointed to recent robberies in oakland as part of the ongoing concerns over public safety. >> and as abc seven news reporter anser hassan tells us, they want the city to declare a state of emergency. surveillance video from early friday morning shows the popular colonial donuts in oakland getting robbed for a second time this week. >> unfortunately, we've heard this is the third time that colonial donuts has been robbed. two times this week alone. three times in the last six months. this is unacceptable. no more crime. >> no more crime.

>> a coalition of community groups rallied in front of colonial donuts. they blame failed leadership and failed policies for rising crime. >> we are not safe and it's because of policy, not covid, not economy, not late stage capitalism policy. >> because otherwise these things will be happening in berkeley with the same frequency as they're happening in oakland. >> among the changes they want bringing in more county and state resources, hiring a police chief and hiring enough police officers to be proportionate to the city's population, and calling for a state of emergency, saying nikki bass, we need a state of emergency. >> we got to stop the robbing of this of the community and the business community. >> oakland city leaders counter by saying crime is trending downwards. the addition of foot patrol officers, having chp help with traffic mitigation, and the introduction of the mobile command center in the fruitvale district. they argue, as evidence of progress. in a statement to abc seven news,

mayor shengtao writes, oakland has more police officers, safety ambassadors and violence prevention teams on our streets than any time in the past two years. we've also increased patrols and undercover operations and providing funding to business districts to enhance security. but at today's rally, they say these are band-aid solutions to ongoing issues. >> these are all superficial response to what's been ongoing. we need actual solutions that are sustainable in oakland, anser hassan, abc seven news. >> also in the east bay, there's a push underway for a new protection for renters, better access to lawyers to deal with possible evictions. but some landlord are saying they want the same protections as abc7 news reporter ryan curry breaks it all down. >> she calls it an early holiday gift, but for leslie lewis, it's another chapter in a long battle. for now, he gets to stay in this home. how long have you lived here? i've lived here since 1954. decades in oakland. but for the 10th time, he's

avoided eviction. he pays his rent on time, but his landlord wants a new tenant. leslie wants to stay. >> i've showed this property seven times. the last time. the last two times i i told them lie the situation here in oakland is kind of a little funny. we have a lot of crime going on. >> he lives in east oakland, his neighborhood, and the ones around it are dangerous. >> i'm not comfortable just allowing anybody to come into this house with out me checking their id. no knowing who they are and what their intentions are. >> council member carol fife wants to expand protections for tenants. she wants to install new legislation at the city, county or state level, giving tenants facing eviction a right to an attorney. she says having one can help people stay housed and save oakland money. the county unfortunately cut the program, but if we were able to have that, we would save millions of dollars on the front end from the money that we put on the back end. >> once people end up on the streets, housing providers say

this would put them in a bind. >> chris moore, with the east bay rental housing association, says their own tax dollars would be used against them if the tenants are provided free legal help by the city uh, then shouldn't the housing provider be provided help as well? >> because if they're not, then they're just pushing them into bankruptcy, he says. >> landlords should have the ability to evict tenants, especially if they don't pay rent. what happens is when they you know, they are not receiving rent, they can't afford to provide this housing in the community. >> and that's what the community needs. >> but eviction could lead some. to being homeless. where would you be if you didn't have this home? >> i'd be on the street, a place leslie does not want to end up. >> he thinks better protections will help him and others in oakland. ryan curry, abc seven news happy now the holiday travel rush is on and bay area airports are seeing long lines and full flights. >> this is a live look at oakland international airport with a travel day has been challenging 65 delayed flights so far and counting a majority

of those are southwest flights. the airport's largest carrier. all right, here's a live picture of sfo, san francisco international, where this will be one of the holiday travel periods. busiest days travel has been slow going there too. there have been more than 200 delays at sfo on this very busy travel day. that's according to flightaware. you're being urged to get to the airport early if you plan on flying in the next few days. >> and finally, let's check the conditions at san jose mineta international abc seven news reporter zach fuentes was there today and says things were running pretty smoothly today. >> it's the holiday season at san jose mineta international airport. >> oh, i'm so excited. the holidays are here. i'm going to see my grandkids and my son in law, my daughter, and we're probably going to spend a lot of time at santa cruz, at the boardwalk, family and friends coming together from all over to spend time together, kicking off their visits at the airport during a time that can be extremely hectic. >> usually, the friday before christmas is going to be one of the biggest, busiest travel days of the year, and many of those

travelers came ready for it. >> what were you preparing yourself for? >> a total mess. a total jam. um. people everywhere. >> if she had been here almost a year ago, that's what she would have seen. crowds of people impacted by the southwest airlines meltdown. rows of luggage taking up large spaces of the baggage claim area. but friday afternoon, even though the airport was far from empty, the crowds were still lighter than expected. pleasantly surprised. >> pleasantly surprised. >> even commutes to the airport were relatively calm for many very clear traffic and the roads were all in very good shape. >> no road rage, everyone's being behaving very well. it's good to see that for the holidays. >> still, airport officials say everyone should stay prepared and leave plenty of time. holidays are falling neatly on a monday, so that leads to some long weekends, so we expect to see fridays being busy and then probably monday or tuesday. some important tips before heading to the airport. wait to wrap or bag up holiday gifts you may be taking. tsa may have to unwrap them for inspection. arrive early to allow yourself plenty of time in case crowds pick up. also, be sure to reserve parking and use cell phone waiting areas if you're picking someone up to avoid congestion. finally, as

eastbound 24 and northbound 680 through the split in san jose, 101. i mean, it looks busy, but manageable in both directions at southbound lane on your right hand side. not really out of the ordinary for this time of day. >> and don't forget, if you're traveling for the holidays, you can take abc seven with you any time. just download the abc seven bay area app to keep up with the news and weather. even when you are away from home. >> a jury has reached a not guilty verdict in the trial of a man charged with attacking a former san francisco fire commissioner. that verdict comes after three days of deliberation in the trial of 25 year old garrett doherty. the attack was captured on video. prosecutors claim doherty beat don carmignani with a metal pipe, leaving carmignani with a fractured skull, a broken jaw and other injuries. doherty's attorneys said he acted in self defense after he and others were doused by carmignani with bear spray. >> the man, who camped outside a san francisco grade school for a year and posted a free fentanyl sign, has been convicted on a

public nuisance charge, prosecutors say. he also unlawfully displayed a meth for stolen items, sign. both signs were visible from the school's classrooms. his belongings also blocked the sidewalk. they say. moore's attorney has sought a deal with no probation. he remains in custody until sentencing and faces up to six months in jail. >> coming up after a year end report from the south bay paints a sobering picture of the situation at san jose's animal shelter. why officials say the mortality rate hit a five year high and the new policy that some say is contributing to the problem. abc

enter, a sign on the door says it will close at the end of the day. on christmas eve. that's according to sfgate. that particular location is at three embarcadero center. it's not clear why the location is

closing. it means there will be three stores still located in the city. the company is based in the bay area and has been in business for more than 100 years. a heartbreaking dilemma at a south bay animal shelter, the san jose animal care and services did not find a new home this year for hundreds of animals, and sadly, they're dying. >> here's abc seven news south bay reporter dustin dorsey with the story. >> reporter with the turn of the new year days away, san jose animal care and services staff, partners and volunteers hope it brings a new beginning as well. 2023 is recognized across the board as a harrowing year for the shelter, with jarring overcapacity numbers and tragic animal deaths. statistics. current and former volunteers are concerned about the safety of the animals. >> it's just terribly, terribly frustrating. it's sickening. >> it's so disturbing. it makes me so sad that animals are suffering, being euthanized, dying in their kennels when it's unneeded. >> their concern is warranted as a year end report released by

the shelter shows 426 animals died while in shelter care during the last fiscal year, a five year high compounding this problem was overpopulation in the shelter. some 11,000 animals all year and nearly 950 animals at one time. during the peak, which is more than double operating capacity. city of san jose director of public works matt lesh says the overcrowding forced the shelter to only accept mostly sick and injured animals, and that contributed to the high mortality rate. >> really had some really dire cases of animals that were really this is their last resort and we're trying to find that bridge. some of them were trying to give a chance, so we're not euthanizing. so our euthanasia numbers were down. overall, those animals in those critical challenging states, we had a really positive outcome for many of them. >> kurt and former volunteers, we spoke with tell a different story, highlighting issues with mismanagement regarding the care of the animals and a new rescue policy of focusing more on adoptions than rescues. town cats board of directors member nineveh parker says only a

fraction of the animals in the shelter that need to be rescued are available for partners, like her group to take in to help reduce capacity and save lives. >> i'm not sure why they decided to move away with rescues, but that model worked really well and now we're seeing the outcome of what happens when they don't rely on the rescue model the shelter is undergoing an audit requested by the city, and the results should be released in the new year in san jose. >> dustin dawsey, abc seven news. >> all those poor animals coming up, we are down to the last few days before christmas from the crowds at the malls to the lines of the mission, we're going to show you the last minute rush underway. >> and don't forget the 40 niners christmas day game is right here on abc seven. but all the action actually starts at 11 in the morning with the warriors in denver. that's followed by the celtics at the lakers. that's at two. and then i don't change the channel to catch the niners host the ravens at five. all of that coming up on christmas day. but

that would be last minute shopping. the holiday hustle was on this morning, big time inside hillsdale shopping center in san mateo. crowds were somewhat light, as you can see, but that still meant plenty of foot traffic. at least 60% of shoppers wait until the last week to buy their gifts. that's according to one study, actually just feel lucky that i got in and it's not too insane. >> although i can feel it brewing. >> so the gifts are all for you guys or for somebody else. well we have other people in our family too. >> that's not here. yeah, and so secret santa stuff. yeah secret santa saturday, tomorrow is expected to be the second busiest day of the holiday period. >> that's according to retail analysts. >> tamales at christmas are a tradition for many families, and many of them lined up outside la palma in san francisco mission district, waiting to stock up on all the ingredients necessary for them. the longtime business

worries. no rain, nothing to talk about. as far as right now goes. the fog that we had that was dense this morning for parts of the bay area has burned off, but we'll see some patchy fog returning. we're already starting to see the formation in uh- as we look here. coastal flood advisory issued once again for tomorrow morning. 6 to 10 a.m. high tide will be peaking right around 8 a.m. and that's going to result in some minor low-lying flooding between 6.9 and 7.4ft. so keep that in mind. here are the headlines tomorrow a chilly morning, sunny day. christmas. lovely for the holiday and we are looking at wet weather, returning next wednesday. so if you are keeping tabs on when we'll see the rain, it's coming. your holiday forecast, christmas eve and christmas day temperatures will be very similar. upper 50s to low 60s. chill in the morning. partly cloudy on christmas eve. christmas day is dry so really good looking weather out there. friday. tonight 615 you're looking at temperatures in the 50s. patchy fog later on tonight, cooling down into the
