today's storm ranks one on the exclusive abc seven news storm impact scale. we've got rain and gusty winds, plus some rough surf on the way. watch out for the waves in pacifica and not just here. there's a surf warning tomorrow for our entire coastline. we've seen people losing power all day today. >> this is a look at the current map of p-g-and-e's outages. not too bad right now. crews are stage across the bay area, though they are ready to respond for this storm. >> we've we've staged polls, shows transformers and other electrical equipment in our yards throughout the region and throughout our service area and anticipate of potential outages and associated damage and let's give you a quick check on commute conditions. >> these are live pictures around the bay area from i-80 and emeryville. the golden gate bridge uh- as you can see, it is moving along pretty well. a little slow on 80, but all in all, not too bad. now for those on transit. a bart is slowing

trains as a precaution because of the wet weather. and we want to give you a look now at what to expect from the weather for the rest of the night. >> that's right. so here's abc seven news meteorologist sandhya patel. sandhya yeah. and dan, and let's take a look at live doppler seven, because the focus of the wet weather is in the south bay and the east bay. we're going to get you in a little bit closer to street level radar. and the inland east bay around pittsburg. antioch highway four heading into deer valley road out towards oakley. it is wet and in the south bay. watch out for the rain from alum rock across san jose. story road , evergreen, coyote road. it is going to be a slow going ride tonight. we do have a coastal flood advisory. that is in effect right now until friday morning for the monterey bay for the bay area, it begins at 10 a.m. tomorrow until 1 p.m. thursday. the high tide will be peaking tomorrow, just before noon between seven and just over seven feet. which is why minor, low lying flooding is expected

there. the storm is moving in across northern and central california. we are seeing snow in the highest elevations here in the bay area. we're still seeing those scattered showers and that's what's going to continue through late tonight. 9 p.m. you're still seeing that wet weather. 11 p.m. we're looking at some wet spots across the region. winds have been gusty. not as strong as earlier, but 31 miles an hour. atlas peak right now 30 oakland hills. and as we look at our storm impact scale, it's a level one through tonight. showers, gusty winds, slippery roads and low visibility. a high surf warning goes up early tomorrow morning. remains up until friday morning. we are talking about large breakers 25 to 30 footers and that is going to mean dangerous swimming and surfing conditions. i will be back with a full look at the forecast, which also includes more storms in the seven-day. the rain started early in the north bay. >> this video was shot this morning on 101 in san rafael.

you see, there is some flooding in mill valley. it's not really the rain, it's because of the high tide. this is the manzanita park and ride it often floods here during high tide and wet weather. >> this year brought challenges for the santa clara valley water district, and as abc seven news reporter dustin dorsey explains, with more rain moving in now they're getting ready as we speak, with gray skies overhead, all is calm in the south bay. >> wednesday morning, but a few more rainy days remain before the new year hits and the work continues to keep the rivers flowing for valley water, we have crews going in, clearing some woody blockages in stream. >> we also have cleared on our pier noses and trash racks, about 24yd■!t of material. >> in other words, when there are trees, trash or other debris down valley, water crews are on site getting it out. it was a race against the clock along the guadalupe river near the children's discovery museum, with a level one storm pushing through the area. valley water watershed's operations and

maintenance unit manager ryan tregoning says they are keeping an eye on their usual areas of blockages and flood concerns. we are monitoring about 302 locations countywide and making sure our bridge piers are all clear and free of debris, um, to allow flows to run smoothly through the system, tregoning says most of their work happens before the rain falls. stream maintenance projects like the one at lower silver creek make it easier on crews to clean up when the actual rain comes, and that's where we're really doing the bulk of our flood protection work. >> so we do a lot of our sediment removal project and bank repairs and levee repairs at that time in the channel, and now we just kind of monitor what we have. and try to clear blockages as needed. >> we're almost a year removed from the torrential storms of january 2023, with an el nino forecasted to bring more flooding, rain and downed trees in 2024. valley water crews worked 24 hours a day during that time to keep the creeks and rivers cleared and they feel better prepared with this work

done before the rain comes, the last january storm only, you know, gave us more experience and preparation for what's to come. >> so you know, i think our crews are ready for it. i think we're ready to get back out there and, uh, weather. the weather, the weather in the south bay. >> dustin dawsey, abc seven news. >> new developments. oakland's mayor has rejected all three final candidates for the role of police chief. mayor shengtao is now requesting a new list of nominees from the police commission. it's a big setback for the city, which has been without a permanent chief since february. that's when tao fired leronne armstrong, citing an investigation that found he'd mishandle two misconduct cases an independent arbitrator cleared him of those accusations, and he reapplied for his job in october. now, it's unclear if armstrong was on the list of final candidates nominated. >> smoke from a fire at the san leandro marina could be seen for miles this morning. the former harbor master's office just went up in flames about 830 this morning. the building, which had been abandoned for quite some time, is expected to be a total

loss. the cause of the fire is still under investigation. abc seven news was back in los altos today to follow up on this strip mall that burned on christmas morning. today it's been fenced off and marked as too dangerous to enter the fire before dawn on christmas morning. went to three alarms as it spread. firefighters say they'll need to demolish the building before they can really begin to figure out what caused the fire. the eastbound portion of el camino real near san antonio road, will remain closed until that building is knocked down. >> the cost of wine and liquor will go up on january 1st. that's because of a new crv deposit. californians already pay 5 or $0.10 on nearly all bottled beverages in the new year. we'll add wine and liquors to the list. you can get the crv money back, but in the past, that's been challenging for most people. abc seven news reporter melanie woodrow explains how come january. first, for the first time, californians will be charged a deposit fee on wine and liquor bottles and

containers? >> they'll also be able to get that deposit back if they recycle properly. consumer watchdog president jamie court says it's time. >> it's a win win win all around for the winemakers, for the consumer uh- and for the environment. the question is how is this going to be rolled out and how is it going to be worked. and the devil's in the details and that's in the hand of the recycling regulators. >> cal recycle director rachel wagner, where we would typically recycle is where you would recycle your bottles uh- from your uh- festivities, which is where things get a little tricky. are there enough centers for the volume of bottles that people are going to have to redeem? >> we recognize that for some, especially either very urban areas or very rural areas, that it is difficult to cite recycling centers. >> it's for that reason that the legislation allows for retailers to get together and create dealer cooperatives, creating a system that will work for their individual communities. but that won't go into effect until early to mid 2025. right now, retailers still have the option of paying $100 a day to opt out

of in-store takeback until that ends in 2025. california can redeem their bottles at existing redemption centers, which may be few and far between, depending where you live. >> there is one recycling center at. the edge of town in south san francisco, where you can go and recycle. that's the only recycling center left in san francisco, wagner says. >> there are pilot projects around the bay area, including backdrops, though she recognizes . >> i know that it's been a little bumpy. >> redemption rates range from 5 to $0.25, depending on the material and size of the bottle or container. beverage manufacturers have until july of 2025 to make sure their label is correct, but will start paying january 1st, 2024, even if there isn't a crv label on the bottle and recycling centers will have to redeem it. as of january first, 2024. again, even if there is no crv label on the bottle yet, you can still put your bottles out curbside, but you won't receive any money for that. and cal recycle would rather you didn't. >> we get cleaner, less contaminated material that comes

tell reservations. abc seven news anchor karina nova has a rundown of some of these new laws, as the new year is bringing in a host of new laws that will make living and working in california more enjoyable. >> let's start with the minimum wage. it's going up to $16 an hour on january 1st for fast food workers. it's jumping to $20 an hour in april. another benefit. for workers all full and part time employees in california are getting a minimum of five sick days a year renting a home is a little bit more accessible starting in 2024, landlords. can only ask for one month's rent as a security deposit instead of the typical two months rent before. now, if

you own an electric scooter or bicycle, good news you can now store it inside your apartment. if the battery meets certain safety guidelines. if it doesn't, your landlord may require you to purchase liability insurance or may prohibit you from charging it indoors and be careful where you park. come 2024. parking like this will be illegal. the new law prohibits drivers from parking within 20ft of a vehicle's approach to a cross walk. drivers will only get warnings in 2024, but they will start getting tickets the following year. wonder how much your coworkers make now? a new law protects you from retaliation. if you want to discuss your wages with your coworkers or even complain about low wages to your boss, employers are now banned from discriminating against a worker who uses cannabis while not at work and away from their workplace. employers also won't

be able to ask a job applicant if they've used cannabis, and now you can make a hotel or airbnb reservation with more ease of mind. a new law gives you 24 hours to cancel a reservation once you make it. if the place you're staying at is located in california, you just need to make the reservation in at least 72 hours before you're supposed to check in. but be careful with campground reservations at state parks or beaches. you'll be penalized one day's lodging if you cancel 2 to 6 days from the start of a reservation in no shows are cancellations within 24 hours of the start of the reservation will be charged for the entire stay in a new law might help you in the kitchen. manufacturers must now disclose if your nonstick cookware has hazardous chemicals. the law also prohibits misleading advertising on cookware, packaging. in march, the california consumer privacy act takes full effect. that means you'll be able to

prevent businesses from selling or sharing your sensitive data. wish there was a cheaper way to repair your broken phone or other electronics? the right to repair act requires electronics and appliance manufacturers to share information about their devices so that consumers and small repair shops can service them. the only bad thing is we have to wait until july for the law to take effect. karina nova abc seven news. >> you can find out what else is changing in the new year with this article. you'll find it on abc seven news.com on storm. >> watch. the potential for high waves has officials in santa cruz county urging people to stay away from beaches tomorrow, let's take a live look from our santa cruz tower cam right now. parts of the county were hit hard by high surf earlier this year. abc seven news south bay reporter zach fuentes spent the day in some of those areas to see how they're doing now. >> rain picked up throughout the day in parts of santa cruz county wednesday, but it did

nothing to keep crowds away from the most popular areas. >> we're so lucky where we live here. it's, you know, it's beautiful. >> but with the high surf warning issued by the national weather service for thursday morning to friday morning, officials want people to stay away. what? we're going to see are some extraordinarily large waves on top of on high tide of 6 or 7ft, and the tides have actually been running higher than predicted when you put waves of that size on top of tides that are that high, we have the potential for some coastal damage and certainly coastal flooding. >> the county says it's been focused on working to get the word out, to avoid the beach and look at the high surf only from safe distances. stay on cliffs, stay high off the beach, don't go for a dog walk. areas like this are the biggest concern for county officials. >> the lower lying areas. this is rio del mar beach in aptos. it's an area that was hit very hard by the high surf earlier in the year. the famous cement ship is just behind me, and many of you might remember that it once had that famous pier leading up to it. that pier was so badly damaged in the high surf that it

had to be taken out completely. the city of capitola, also still recovering from the high surf. in january, construction, was going on to rebuild the badly damaged wharf. businesses hit hardest like the sandbar in the village, only just now recovering. >> there's still more to do. we got the front done. it's coming along. it's refreshing to be back in business again. that's great. that's great. but but there are definitely worries. >> equipment to create sand barriers could be seen around the businesses, but the county says it's been difficult to keep up with the constant weather events hitting the area. we're kind of into this cycle, unfortunately, of trying to scramble every year to fix these roads and then getting hit with another wave of significant winter storms. the impact of the vicious cycle also felt by the hard hit business owners, who say they're working hard to keep their spirits up. >> i'm just going to try and stay positive. >> in santa cruz county, zach fuentes, abc seven news being an active couple of days. >> yeah, sounds like it with a little bit of a break, i think. >> right, sandhya? absolutely. >> ama and deanna. and that's

why we're timing it all out for you so that you get that little breather in between each storm. let me show you some live pictures right now from our tower cameras. it's a wet golden gate bridge. richmond san rafael bridge, also showing you the rain from santa cruz camera sfo, by the way, wet runway. their arrival delays of over an hour and a half due to low ceilings. so if you are picking somebody up, keep that in mind. let's check out live doppler seven. and i'm going to get you into street level radar from santa cruz highway nine heading into morgan hill and gilroy. we are seeing the wetrillionoadways right now. this is street level radar san martin going across monterey road. watch out. the evening commute is going to be a bit dicey, especially if you're traveling across 580 from pleasanton in dublin area all the way to livermore, dublin boulevard. right now, rainfall is coming down across the peninsula to east palo alto. you will notice heading across the bridge there, the dumbarton bridge into the fremont hayward area. so let's look at the north

bay napa also reporting some wet weather. and as we go and widen this picture, you will see the area of low pressure is off the pacific northwest coast. but it has pushed that front through. although it is raining at the lower elevations in the sierra blue canyon is reporting snow, so the snow is starting to pick up up there. now, i do want to show you the wave heights. as you know, high surf warning goes up tomorrow. wave heights will be building as we head towards tomorrow. those wave heights over 1820 footers and then the wave heights will slowly come down. but not until after 7 a.m. on friday. so watch out. especially if you want to go check out the waves along the coastline. temperatures right now, mid 50s around san francisco, oakland, san jose 60 degrees. we've had a south wind. it's been mild 57 in san mateo, lee's for parts of the bay area this afternoon. right now it is cool. in the 50s. santa rosa 57 right now 54. fairfield 57, concord and livermore. richmond-san rafael bridge showing you the raindrops there. here's a look at the headlines

through tonight. we're looking at scattered showers, high surf warning for your thursday rough and dangerous waves continuing into early friday. and that's when our next round of rain arrives friday and saturday we're going to look at what you can expect in terms of our storm impact scale through tonight. it's a level one showers with gusty winds, slippery roads and low visibility. so we go hour by hour, 7:00 tonight, those scattered showers, they'll continue even at 10 p.m. they're not going to be widespread at this point. by midnight. still very scattered in nature tomorrow morning. still could be some isolated showers in the north bay. and then the north bay has the best chance of showers in the afternoon. so 40s and 50s tomorrow morning. just keep that in mind. tomorrow afternoon. highs will be in the 60s for many of you. 55 in lakeport and once again, keep those umbrellas close by as an isolated shower or two could pop up in the north bay going into tomorrow afternoon, accuweather seven day forecast. it's a mostly cloudy thursday, wet and windy level one system for your friday going into saturday.

million dollars. one of the game's top ten biggest jackpots ever. tonight's drawing is at eight 8:00. it's the second to last drawing of the year. the final one will take place on saturday, and we may never find out who won the biggest mega millions jackpot ever. today, the florida lottery announced the winner is a limited liability company called saltine holdings llc. corporate records show the company was formed 30 days after the august 8th, drawing the jackpot was a record $1.6 billion. the winner chose a lump sum payment, which is more than $794 million, not too shabby. >> well, the new york times is suing san francisco based openai and microsoft for copyright

live doppler seven tracking today's wet weather. this is a level one storm. according to the exclusive abc seven news, storm impact scale. the storm has brought us showers, gusty winds and dangerous waves along the coastline. >> consumer watchdog wants california's attorney. general to look into the practices of clearview ai, a facial recognition company accused of violating california privacy law. >> abc7 news reporter stephanie sierra has the story. >> there's a technology out there that you may not know about, but there's a good chance they know you. and that's clearview ai. a new report from consumer watchdog claims the facial recognition company scrapes images off the internet, often from social media sites, then sells them to public agencies and potentially foreign companies to make a profit. >> in fact, it's virtually impossible to avoid being in that database. >> consumer watchdogs litigation

director jerry flanagan calls it invasive and a violation of state law. >> california law makes it very clearly both illegal for clearview to collect your image without your say so, without your consent, as well as the sell that data or share it to others, he says. >> a recent aclu settlement barred clearview from selling its product to private businesses, but adds there are no statewide restrictions on the company to sell its tech to government and law enforcement agencies in california. >> the ceo has made the point that they are selling broadly throughout the united states to law enforcement. >> the company advertises on its website it's advancing public safety, adding its investigative platform allows law enforcement to rapidly generate leads to help identify suspects, witnesses and victims to close cases faster. but numerous reports highlight concerns about inaccuracies targeting communities of color, including a recent study published in november by georgetown university's law center saying the tool is, quote, particularly

prone to errors, adding the real world consequences of such errors include the investigation and arrest of an unknown number of innocent people, and the deprivation of due process of many, many more. in fact, a mit study found that the software incorrectly identified up to 35% of darker skinned women. in a statement sent to the i-team, clearview ai refutes that, saying, quote, clearview ai's algorithm has been assessed by the national institute of standards and technology, a us government office, and found to be highly accurate across all demographic. six there's also questions about the right to privacy with political rallies. clearview ai told the i-team their technology has been used to identify capitol rioters during the january 6th insurrection. keep your lives off my body. but flanagan argues, when you're in a public space exercising your first amendment rights to protest or to associate with a political party, or you have the right to

do so without unwarranted government surveillance, both san francisco and oakland have adopted city ordinances barring city agencies from using clearview ai technology, and court documents show the technology has also been used in both alameda and antioch for the i-team. stephanie sierra, abc seven news. the chp has released the results of its christmas weekend maximum enforcement, where it increases patrols to search for unsafe drivers. >> chp officers made more than 900 dui arrests. that's up 42% from last year. there were 20 fatalities, down 23. there will be another maximum enforcement period starting. 6 p.m. through 11:59 p.m. monday for the new year. >> hundreds of pizza delivery drivers face layoffs as two major pizza hut franchises eliminate their delivery service , blaming the increase in california's minimum wage. the layoffs will affect more than 1200 delivery drivers in sacramento and southern california, as well as southern oregon and the reno, tahoe area in nevada, as well. customers

can still use third party apps like doordash and uber eats for deliveries. california's minimum wage goes up to $16 per hour on january first for fast food workers. it will go up an additional $4 in april to $20 per hour after almost half a century, famed fremont establishment dino's could be closing its doors for good by the end of the week. >> the restaurant has served the community for 46 years, but business hasn't been the same since the pandemic. last year, the owners opened billy roy's burger company and say it's much more profitable. but recently, the city of fremont made an offer to help keep the local diner open. >> the city approached him and wanted him to somehow put the two together and keep this place going, and they were willing to work with him to help him to keep this open. i am praying that it means that we are given another chance to try to make something better for fremont. >> for now, dino says it will be closing its doors on new year's

eve. >> tom smothers, half of the iconic duo the smothers brothers, passed away yesterday at his santa rosa home after a battle with cancer. the groundbreaking smothers brothers comedy hour debuted on cbs in 1967 and was an immediate success. the show was known for its pop culture trends and socially conscious sketches that poked fun at the establishment and protested the vietnam war. it was also controversial at times. tom's younger brother, dick smothers, said that he is devastated by the loss and added, quote, every breath i've taken, my brother's been around. tom smothers was 86 years old. we'll be back.

he'll be riding in this year's rose parade. >> rose parade preparations are well underway in pasadena and at stanford children's health. a send off for joseph sanchez, the san leandro teenager selected as the hospital's honoree, to ride in its rose float.

they mentioned about white wine workers and the laborers, all the chinese immigrants listed as john. john, john, even no in the first name that mentioned that is a sad. that is a wrong. it's a shameful. >> but at buena vista winery in sonoma, which was founded in 1857 and is considered one of the oldest wineries in the golden state, wine tasting visitors immediately learn about the history of chinese laborers. their story carefully preserved on the walls. inside, we could see the chinese worker here carrying a materials across our creek. >> the chinese played a major role in working the vineyards. uh- work in the winery, digging of the cave and our founder, count august and he was a big proponent of those chinese laborers and workers. we've seen anywhere from 200 to 500 workers. it was considered the

largest labor camp north of san francisco. >> a painting by jake lee, now at the chinese historical society of america, captures the role of the workers at buena vista winery in sonoma. >> basically, this is a vivid picture represents the piece of the history in the napa. in the sonoma, one of the places you can still see direct evidence of the labor of chinese workers is right here in the caves at buena vista winery. >> you can actually see the original pickax marks from from the 1860s, when these caves were dug and the building was built, like those who worked on the transcon railroad, these chinese workers at many wineries and vineyards faced immense challenges. >> dangerous and difficult work conditions, and discrimination in a lot of chinese workers never became u.s. citizens because of the chinese exclusion act, which lasted 61 years. many say the story of the chinese worker needs to be recognized, used and remembered. there's an effort underway to honor the chinese laborers who helped develop california's wine

industry during the 1800s. ding and others are raising money to put up a traditional chinese pavilion, or ting, at the depot park museum in sonoma. >> to honor these forgotten, nameless chinese laborers who made a contribution in the year 150 years ago. that is extremely important. as love for grapes, wine make you happy. >> ji grows them and sells his grapes to bouchaine winery right next door. and like a good neighbor, he often checks in doctor jesus essentially our local celebrity. >> you know he comes by all the time. >> some say diverse background, add a lot to wine. it needs to happen that there is more diversity within the wine industry. eric gudmundsson is director of operations for bouchaine winery. if we want wine to really grow in the united states and abroad, we need to understand that it's not just a privileged white person's

live doppler seven. the sierra is seeing snow at the highest elevations. rain at the lower elevations, and right now on live doppler seven, you can see in the east bay. we are seeing some steady rain right around pleasanton, dublin, livermore, across 580 dublin boulevard, also in the south bay from santa cruz to scotts valley, heading into morgan hill and gilroy and a few showers showing up in the north bay right around san quentin area. so we go hour by hour. those showers will remain scattered in nature. the next few hours, and then really start to wind down. but an isolated shower or 2nd may still pop up tomorrow. so in the afternoon, even in the morning, highs will be in the 50s and 60s for your thursday. and in case you're wondering about rainfall opportunity, well, our next storm comes in friday and it's going to stick around through saturday with some snow in the mountains. if you're traveling. the third one is going to be due in the middle of next week. so here's a look at the accuweather seven day forecast. it is going

injury report today, and trent williams was listed as a participant in today's walkthrough, which means he's also trending towards playing this weekend. purdy will need all the protection he can get, though, after experiencing a left shoulder stinger and back to back weeks to get some clarity on the nerve issues that result in a stinger, i caught up with our favorite doc, ucsf's doctor nirav pandya, to learn more about what purdy is going through. i kind of, you know, relate it to when people hit their funny bone, you know, you hit your elbow, you get a tingling sensation, or some people may have carpal tunnel syndrome where they get tingling in their hands, but it really is an electrical shock. so you imagine you've got a nerve, you're stretching it out, you're compressing it, and that nerve is sending the signal of, i don't like what's going on. um, so clearly that's the feeling that you're worried about. i think it definitely does raise a level of concern, you know, especially when they're back to back. and we have to understand a stinger is some degree of injury to a nerve. and whenever

a nerve is that sensitive week to week you worry about is this going to be a recurring problem or is there something anatomically with how his neck is set up or how the shoulder is, um, that can predispose him to it? so something that we need to watch closely. um as we head into playoff season, hopefully purdy gets through this weekend stinger free. meanwhile, the 40 niners next opponent is making a change at quarterback jacoby brissett will be under center as sam howell, who had two touchdowns. eight intercept runs over the past five weeks. he'll be the backup. not a bad time for the week off though. i wouldn't want to be chased by nick bosa or chase young either. and broncos country is ready to ride without russell wilson. they are benching him for jarrett stidham. this move is purely for financial reasons as wilson has already 39 million guaranteed for 2024, but he would get an additional 37 million if he gets injured and can't pass a physical by march. wilson is actually nfl seventh rated passer, but this move signals they may not have him in their future plans. good news for the warriors gary payton. the second returned to practice today. the team didn't do a full
