just like that. oakland is back to square one and its search for a new police chief. now at five. the mayor's decision to reject all finalists now causing a serious delay in the process for flood protection. >> the name of the game, the work being done in the south bay in an effort to avoid a repeat of the destruction and the mess left behind, almost a year ago. >> choppy, rough and dangerous. a high surf alert is in effect along the coast, but some adrenaline junkies just cannot stay away. look at those waves there. wow wow ooh ooh. well, good morning to you. it is thursday, december 28th. >> yes. we're going to start with a check of our forecast with drew. >> good morning. good morning. so we do have those waves to

talk about. some fog this morning a little bit of drizzle left over in the north bay. here's live doppler seven along the north bay coastline. we're finding some pockets of drizzle, but for the most part we're just dealing with over cast skies this morning. and some pockets of fog out there. temperatures were waking up. it's on the mild side. we're in the 50s to begin your day. thanks to that cloud cover overhead. the big story today is that high surf warning that's now in effect. look at those waves. bodega bay approaching 30 foot waves this morning. and we're likely not even seeing the worst of them quite yet. we could see breakers up to 40ft possible, so please do not go into the water today. those waves are very strong and they can be deadly when they're that high. take a look at the day planner today. it's all about those clouds. we'll have mostly cloudy conditions, but we're mild into the 60s. we have more rain coming our way tomorrow. talk about that in a few minutes. but first, let's check in with sue and see. we're on the road this morning. yeah, the wet roads are definitely causing some issues out there. >> also, the pockets of fog. you'll find that in the north bay golden gate bridge, though, is fog free and pretty much at the limit. very few cars coming

across the span. you'll have three lanes, both directions for your thursday morning drive to the san mateo bridge. we had a high wind advisory yesterday that's calming a little bit today, and you're in some company there, but everything's moving nicely. we do have a little bit of slow traffic over the altamont pass. otherwise an accident is reported westbound 37 headed towards the one lane each direction over the mare island bridge. i don't see a lot of slowing now, but we'll check back. guys >> thank you. sue. a high surf warning from the national weather service in effect this morning along much of the northern california coastline. this is what it looked like along half moon bay yesterday. officials are warning of serious danger with sneaker waves and possible rip currents. abc seven news reporter lena howland live in pacifica, where the rough waters are not keeping some surfers away. lena kumasi, good morning to you. >> we are just outside of the pacifica pier right now, where we have been hearing the waves roaring for even just the past

15 minutes. and overnight, the national weather service is warning folks that the ocean is not your friend today. here's a look at some new video just into our newsroom, showing what conditions looked like right around 3:00 this morning here at the pacifica pier. video shows the high tides to be almost as big as the pier. officials say a high surf warning is in effect until 3 a.m. tomorrow. for these extreme, dangerous waves expected to reach between 28 to 40ft in some places today. this has also shut down beach boulevard at santa rosa because of these dangerous conditions. despite the warning, pro surfers have traveled in from all over the world to chase these storms and northern california's legendary mavericks tanner white and a group of surfers came in from portugal to half moon bay for the big wave surfing competition, which is well underway. >> if the buoy readings are true and it's not affected by the local wind swell, then it'll be

the biggest waves i've been out in by far. >> i mean, they're they're deadly waves a few people have passed away here at maverick. >> members of the mavericks rescue team, who you just heard from will be standing by on a jet ski ready to pull anyone to safety as they believe today is expected to be the biggest day for mavericks in five years. now, during this high surf warning, people are encouraged to stay away from rocks, jetties, piers and never turn your back to the ocean. live in pacifica lena howland abc seven news thank you lena, another speed bump in oakland's ongoing search for a permanent police chief. >> the mayor has rejected all three of the finalists for the job. >> mayor shengtao made the decision yesterday, and she's now requesting a new list of nominees from the police commission. in a response to abc seven news, the police commission president marcia peterson says, quote, we respect the mayor's decision to ask for a new list of candidates. the oakland police commission will continue to perform our duty

under the city charter to review candidates and provide recommendations to the mayor. the commission will work collaboratively and diligently with the mayor to find exceptional candidates for oakland, end quote, and others we spoke to, though, are not so pleased with that move. >> it sets back the search. uh, tremendously. uh, it is a shame what she's done. it is. it shows a total lack of leadership. we need leadership in oakland at this time. >> the city has been without a permanent chief since february. mayor tao fired leronne armstrong, citing claims that he mishandled two officer misconduct cases. an independent arbitrator cleared him of those accusations. he was reportedly one of the three finalists rejected in a statement, armstrong says, quote, it is unfair that i am unable to continue to serve and protect the people of oakland. as a native of oakland, nothing gave me greater pleasure and pride

than to work in my community and fight to improve it. no word from the mayor on where the process goes next. >> today we're expecting to learn more about the new county investigation into the troubled martinez refining company. county supervisors will be meeting with the oil refineries corporate leadership, contra costa health held an unannounced inspection at the refinery tuesday. authorities are concerned about the slew of recent flaring incidents and releases of hazardous ash at the refinery. >> the wet weather at the start of 2023 brought challenges for the santa clara valley water district. abc seven news reporter dustin dorsey explains how crews there are preparing for a similar event. this season. >> with gray skies overhead, all is calm in the south bay wednesday morning, but a few more rainy days remain before the new year hits and the work continues to keep the rivers flowing for valley water. >> we have crews going in, clearing some woody blockages in stream. we also have cleared on

our pier noses and trash racks, about 24yd■!t of material. >> in other words, when there are trees, trash or other debris down valley, water crews are on site getting it out. it was a race against the clock along the guadalupe river near the children's discovery museum, with a level one storm pushing through the area. valley water watershed's operations and maintenance unit manager ryan tregoning says they are keeping an eye on their usual areas of blockages and flood concerns. >> we are monitoring about 302 locations countywide and making sure our bridge piers are all clear and free of debris, um, to allow flows to run smoothly through the system, tregoning says most of their work happens before the rain falls. >> stream maintenance projects like the one at lower silver creek make it easier on crews to clean up when the actual rain comes, and that's where we're really doing the bulk of our flood protection work. >> so we do a lot of our sediment removal project and bank repairs and levee repairs at that time in the channel, and

now we just kind of monitor what we have. and try to clear blockages as needed. >> we're almost a year removed from the torrential storms of january 2023, with an el nino forecasted to bring more flooding, rain and downed trees in 2024, valley water crews worked 24 hours a day during that time to keep the creeks and rivers cleared, and they feel better prepared with this work done before the rain comes, the last january storm only, you know, gave us more experience and preparation for what's to come. >> so, you know, i think our crews are ready for it. i think we're ready to get back out there and, uh, weather, the weather, the weather in the south bay. >> dustin dorsey, abc seven news. >> 508 will take you to our visibility map on live doppler seven. it's a muggy morning out there. we have a lot of residual moisture from yesterday's rain, and that is leading to some pockets of fog. the worst visibility right now in livermore, down to a fourth of a mile in the north bay. we're fluctuating between 2 and 3 miles from novato to santa rosa. even some fog along half moon

bay coming in at two miles. visibility here's live doppler seven, along with satellite. the story we're tracking a storm system that's now up into canada , producing those large waves along our coastline. this morning. here's our next storm system, and it's getting its act together. and it will bring some rounds of heavy rain later tomorrow. and some gusty winds today. it's all about cloudy skies here locally, but if you are traveling, we are watching new york and chicago for some showers. even the potential for heavy rain around chicago at 42 degrees la looking great. denver atlanta. dallas. no problem. seattle. you will see some rain too in the mid 50s today. it's all about cloud cover. future weather showing you some pockets of drizzle very likely this morning, but with mostly cloudy skies and a south wind. we'll get those numbers into the mid 60s for daytime highs. today is a mainly dry day, but tomorrow though it is a wet afternoon and evening, it's a level two, a moderate storm here to finish out the week. we'll talk about those showers heavy at times and some gusty winds. gloria in about nine minutes. >> all right drew thank you so much. first their autonomous cars were taken off of city

the focus of a true crime mini series in 2019, called the act. developing news. general motors, the parent company of self-driving firm cruise, is suing the city of san francisco, though the company claims the city improperly overcharged them. $108 million in taxes over seven years. gm claims that cruise's payroll should not be included in its tax bill because cruise is run separately. the carmaker is seeking a refund of the money plus some 13 million in interest and penalties. >> as the new york times is suing san francisco based openai and microsoft for copyright infringement. the complaint says. both companies ai technology, illegally used new york times articles to train bots like chatgpt to provide people with information. the times says it has never given permission to anyone to use its content for generative ai purposes. the paper is seeking an unspecified amount of money, and the destruction of the ai

models that use its journalism. openai and microsoft have not responded to the lawsuit. consumer watchdog wants california attorney general to look into the practices of clearview ai, a facial recognition company accused of violating california privacy law . abc7 news reporter stephanie sierra has the details. >> there's a technology out there that you may not know about, but there's a good chance they know you. and that's clearview ai. a new report from consumer watchdog claims the facial recognition company scrapes images off the internet, often from social media sites, then sells them to public agencies and potentially foreign companies to make a profit. >> in fact, it's virtually impossible to avoid being in that database. >> consumer watchdogs litigation director jerry flanagan calls it invasive and a violation of state law. >> california law makes it very clearly both illegal for clearview to collect your image without your say so, without

your consent. as well as the sell that data or share it to others, he says. >> a recent aclu settlement barred clearview from selling its product to private businesses, but adds there are no statewide restrictions on the company to sell its tech to government and law enforcement agencies in california. >> the ceo has made the point that they are selling broadly throughout the united states to law enforcement. >> the company advertises on its website it's advancing public safety, adding its investigative platform allows law enforcement to rapidly generate leads to help identify suspects, witnesses and victims to close cases faster. but numerous reports highlight concerns about inaccuracies targeting communities of color, including a recent study published in november by georgetown university's law center saying the tool is, quote, particularly prone to errors, adding the real world consequences of such errors include the investigation and arrest of an unknown number of innocent people, and the deprivation of due process of many, many more.

>> in fact, a mit study found that the software incorrectly identified up to 35% of darker skinned women. >> in a statement sent to the i-team, clearview ai refutes that, saying, quote, clearview ai's algorithm has been assessed by the national institute of standards and technology, a us government office, and found to be highly accurate across all demographic mix. there's also questions about the right to privacy with political rallies. clearview ai told the i-team their technology has been used to identify capitol rioters during the january 6th insurrection. your love off my body but flanagan argues, when you're in a public space exercising your first amendment rights to protest or to associate with a political party, or you have the right to do so without unwarranted government surveillance. both san francisco and oakland have adopted city ordinances barring city agencies from using clearview ai technology and court documents show. the technology has also been used in both alameda and antioch for the

i-team. stephanie sierra, abc seven news. >> new apple watches are once again available for now. a us federal appeals court has paused an import ban on apple smartwatches. it comes after medical tech company masimo claims that apple infringed its patents. the international trade commission banned all imports and sales of apple smartwatches that have a pulse oximeter. that's a feature that reads blood oxygen levels, the court said. a temporarily blocked the ban to consider apple's redesign of the apple watch models. apple said in a statement that the apple watch series nine and ultra two models will be on sale at apple stores and also available online, starting again today. >> you know, wouldn't it be nice to end 2023 and start the new year as a multi-millionaire? yeah well, saturday night's powerball jackpot is now at $760 million. there was no jackpot winner in last night's $700

waves as high as 40ft are possible. this morning. you really want to stay out of the water? never turn your back to the coastline because those waves can really take you out with those sneaker waves. tomorrow evening, rain returns heavy at times along with some gusty winds, but for new year's eve and new year's day, we are drying out. take a look at highs today. it's just a cloudy day. pockets of drizzle from time to time. no steady, heavy rain in the forecast today. temperatures though mild in the low and mid 60s for daytime. highs overnight tonight. we'll keep that humidity. some pockets of drizzle and numbers on either side of about 50 degrees. let's show you the storm impact scale for tomorrow evening. it is a level two, a moderate storm. we've upped it from a level one because the showers are heavy at times and we have some gusty winds up to 40mph. here's future weather tomorrow morning. we'll find some pockets of light showers in the north bay, but it's into the afternoon. you can see this is 130. this cold front is going to move through here with heavy rain at times throughout the evening. and by friday night we're still dealing with this wet weather. rainfall totals. a lot of us going to

pick up half of an inch of rain will likely see areas picking up more than an inch of rain through friday night as these showers move through. it's also some gusty winds will find anywhere from about 20 to 40mph. friday afternoon. so here's the accuweather seven day forecast. the next seven days for you. clouds and drizzle today. wet and windy tomorrow evening with scattered showers on saturday. we're cloudy but dry on sunday for new year's eve and it's a dry start to the new year on monday. >> sue good morning and we've got patchy fog and slick roads to wake up to this morning. and very light traffic conditions. although we do have a few incidents. this is a in san jose highway 87 headed up towards the airport and you can see just a few brake lights towards the top of your screen. but basically everybody's moving at the limit. right now, bart is experiencing a delay due to police activity. this is from south city to daly city, 20 minutes. so that is a major delay. and we do have fog, patchy areas for you. highway four and highway 580 over the

20 minutes and the larkspur ferry service will be running the slow boat this morning. if you're traveling to san francisco, seven 2850 and 1005, that means 15 minutes longer to number five. >> oakland mayor xiang tao is rejecting all three final candidates for the role of police chief. she's now requesting a new list of nominees from the police commission in former chief lauren armstrong, who was fired by tao, was one of those finalists. >> number six two san ramon police officers are recovering after being hospitalized from an accidental fentanyl exposure. police were searching a vehicle in a safeway parking lot when the exposure happened. hazmat crews were then called out and right now we don't have an update on those officers conditions. >> number seven chp made more than 900 dui arrests during the christmas weekend. maximum enforcement. that's up 42% from last year. there were 20 fatalities, which was down 23. there will be another maximum

enforcement period starting at 6 p.m. friday and going to midnight monday for the new year. the cost of wine and liquor going up on january first because of a new crv deposit. californians already pay 5 or $0.10 on nearly all bottled beverages in the new year. wine and liquor will be added to that list. you can get the crv money back, but in the past, it's been challenging for most people. abc seven news reporter melanie woodrow explains. >> come january first, for the first time, californians will be charged a deposit fee on wine and liquor bottles and containers. they'll also be able to get that deposit back if they recycle properly. consumer watchdog president jamie court says it's time. >> it's a win win win all around for the winemakers, for the consumer and for the environment. the question is how is this going to be rolled out and how is it going to be worked? and the devil's in the details and that's in the hand of the recycling regulators. >> calrecycle director rachel wagner, where we would typically

recycle is where you would recycle your bottles from your festive cities, which is where things get a little tricky. are there enough centers for the volume of bottles that people are going to have to redeem? we recognize that for some, especially either very urban areas or very rural areas that it is difficult to cite recycling centers. it's for that reason that the legislation allows for retailers to get together and create dealer cooperatives, creating a system that will work for their individual communities, but that won't go into effect until early to mid 2025. right now, retailers still have the option of paying $100 a day to opt out of in-store takeback. until that ends in 2025, californians can redeem their bottles at existing redemption centers, which may be few and far between, depending where you live. >> there is one recycling center at the edge of town in south san francisco, where you can go and recycle. that's the only recycling center left in san francisco, wagner says. >> there are pilot projects around the bay area, including backdrops, though she recognizes

. >> i know that it's been a little bumpy. >> redemption rates range from 5 to $0.25, depending on the material and size of the bottle or container. beverage manufacturers have until july of 2025 to make sure their label is correct, but will start paying january 1st, 2024, even if there isn't a crv label on the bottle and recycling centers will have to redeem it. as of january first, 2024. again, even if there is no crv label on the bottle yet, you can still put your bottles out curbside, but you won't receive any money for that. and cal recycle would rather you didn't. >> we get cleaner, less contaminated material that comes through the redemption centers, so we would prefer you brought them to a redemption center and got your money back. melanie woodrow, abc seven news. >> tom smothers, half of the iconic duo the smothers brothers, passed away yesterday at his santa rosa home after a battle with cancer. the groundbreaking smothers brothers comedy hour debuted on cbs in 1967 and was an immediate

success. the show was known for its pop culture trends and socially conscious sketches that poked fun of the establishment and protested the vietnam war. tom's younger brother, dick smothers, said that he is devastated by the loss and added, quote, every breath i've taken, my brother's been around. tom smothers was 86 years old

be there to watch the ball drop on sunday night. as always, new york city is stepping up its security around times square, and the bay area is also increasing security efforts. it comes as the fbi, homeland security and other law enforcement agencies pinpoint san francisco as a source of concern on new year's eve, abc news has obtained a threat assessment, and it says the city's upcoming fireworks celebration is, quote, an attractive target for foreign terrorist organizations. homegrown violent extremists and domestic violent extremists. the report does not offer information about any specific threats. retired san francisco police deputy chief jim dudley looked at that report as being a significant holiday. >> uh- significant numbers of people gathering in uh- high profile infrastructure areas, but also you have the landscape of the you know, international conflicts.

>> and dudley says a report that looks similar to briefings in past years. but he says this year the new dimension is a middle east conflict. and the related protests yesterday, people gathered in front of the san francisco chronicle to commemorate the palestinian journalist killed in gaza. >> they are honoring the lives of more than 100 journalists lost in the war. activists say they are protesting the u.s. support of israel and that violence should not be funded with our tax dollars. they say their hope is to shed more light on what's happening in gaza and commemorate the work those journalists were trying to do here in southern california, at least 36 people were arrested after staging a protest near lax. most demonstrators yesterday appeared to be pro-palestinian supporters. they blocked traffic near the airport entrance for about 30 minutes. los angeles police report the protesters threw an officer to the ground, used construction debris, roadsides, tree branches and concrete blocks to stop

traffic, and even attacked passing vehicles. no flights were impacted. the u.s. and israeli officials are meeting to discuss the israel-hamas war. a senior adviser to israeli prime minister benjamin netanyahu explained how they are trying to curb civilian casualties. >> so we are trying to be as surgical as we can be in a very difficult combat environment. so once again, i stress we don't want to see a civilian casualties. and i can tell you my information is that civilian casualties are going down. and that's a good thing. every time a civilian is caught up in crossfire from israel's point of view, it's a tragedy. it shouldn't have happened. >> the u.s. says it talked about the need for israel to focus on high value hamas targets in israel's post war plans. in gaza, officials also talked about steps to improve the humanitarian situation there. >> now to the us-mexico border leaders from both countries met to strategize as a solution to the growing migrant issue.

here's abc news reporter rachel bade. mexico officials unveiling a new task force to address the migrant surge at the us mexico border, a move that comes after us officials pressed the nation to do more to stem the crisis. >> sources telling abc news that us secretary of state antony blinken and dhs secretary alejandro mayorkas pushed mexico to step up immigration enforcement within their country and help reopen ports of entry and encourage migrants to stay in mexico. mexico's foreign affairs minister, heeding that request, telling reporters after the meeting that as part of the new task force, mexico will regularly meet with countries in central and latin america. the next meeting will be in january. one senior u.s. administration official telling abc news that the us is pleased with what mexico proposed. the news coming as overwhelmed border officials brace for the arrival of this caravan, a group that's estimated to top 6000 migrants. the month of december is on track to have the highest number of apprehensions ever, according to cbp officials. some days,

heights. we will find that they will peak later on this morning between say, nine nine and 11 a.m. and some of these waves could approach 40ft high. that is why we have the high surf warning in effect along our coastline as we head towards the afternoon. the evening, the wave heights will gradually recede and by early tomorrow morning, after the warning has expired, those waves are generally less than about ten feet high. it's this morning where we have the biggest concern for those dangerous waves. future weather is just a cloudy, humid morning. some pockets of drizzle from time to time, but we will get into the 60s once again. it is a mild day despite limited sunshine and that humid feel. if you're traveling to tahoe the next three days, it's partly sunny today. tomorrow it's sunny with some snow flurries late in the day, and then saturday we do expect snow, but unfortunately no accumulation right around an inch. it's not a big snow maker by any means. that same system will bring us rain tomorrow. it's a level two, a moderate storm tomorrow afternoon evening. we'll go hour by hour in future weather. show you the details of this next storm in about nine minutes. this is abc

there's no steady rain in the forecast today, but you will notice it's mild this afternoon. despite the limited sunshine. we'll go into the mid 60s for daytime highs overnight tonight we'll hang on to the cloud cover pretty much landing on either side of 50 degrees with those pockets of drizzle still continuing, mainly in the santa cruz mountains and in the north bay. but tomorrow we are tracking a stronger storm. it's a level two, a moderate storm on the abc seven storm impact scale. showers, heavy at times, especially in the afternoon. in the evening, gusty winds, slick travel and rough surf all impacts with this storm system. future weather tomorrow morning we'll be tracking just some pockets of light showers in the north bay and in the santa cruz mountains. the storm really gets its act together later in the day. here's friday afternoon, 2 p.m. you can see heavy rain at times falling in the north bay approaching the coastline as we head through the afternoon. this cold front will bring about strong, gusty winds out of the south, along with heavy pockets of rain. and we're in and out of the rain friday evening and friday night. so tomorrow night, if you have plans, add some extra time to your travel and
